So, The First 2016 Victories Are In!

AS IN EACH of the last 13 years at around this time, I'm very pleased to post the first of the new year's government admissions of the correctness of CtC. On each of these occasions I recall with ever-greater amusement the smug expressions of skeptics over the years to the effect that, "These 'victories' you tout are just mistakes that slipped through the cracks. This won't go on long..."

Right.

I trust I don't need to comment at any length on how continued denial-- or even just distancing oneself from the truth-- is a shameful intellectual dishonesty. Perhaps I DO need to observe one point on this subject though: It is only the "alt-media's" intellectually-dishonest refusal to acknowledge and help spread the liberating truth about the tax uniquely revealed in CtC that has kept that truth from sweeping across America.

Were the spread of this information to be made a cause of the "alt-media", this country would be transformed in a matter of months from an increasingly bankrupt and looted wreck of a police state back into the shining city on a hill left for us by the Founders. What stoppers up the mouths of these folks is an abiding mystery to me, and an abiding tragedy for America.

ANYWAY, ENOUGH ABOUT lies and denials (unless you want to help end them, in which case go here). Let's get back to truth and affirmations!

We lead off the new season of truth defeating lies with complete refunds of everything withheld during 2016 and given over as "income taxes" to California in one case and to Oklahoma in another along with a complete refund of 2015 withholdings also secured a week earlier by one of the happy victors, and another of $23K+ from the feds for 2015 which was issued last week. Join me in celebrating the heroes who have acted to restore the rule of law and the Founders' vision of liberty and prosperity.

LET'S START OFF with Zac Zamirripa's California victory for 2016:

Zac had also, nine days earlier, secured the return of everything taken from him during 2015:

This victory in knowledgeably invoking the tax laws as actually written (in contrast to the misapplication of the laws by exploitation of ignorance, which is encouraged by all revenue-hungry tax agencies) resulted from this claim.

JUST 5 DAYS AFTER Zac's 2016 California victory, Tony George followed along with a complete refund from Oklahoma of everything withheld from HIM in 2016. Tony's refund actually took him by surprise in its rapidity-- the claim had only been made 11 days earlier! Here is Tony's refund:

Zac, Tony, John and Ha have stepped up and acted to restrain the dangerous and corrupt state and uphold the rule of law, something desperately needed from everyone. Their victories join those of the tens of thousands of other awakened and activated Americans represented here, and are more critical steps toward the restoration of the Founders republic and the true rule of law.

Don't you wish your victories were proudly posted, too?

It's easy. Stand up on behalf of the law, and then share the evidence.

The Physics Of The Law

It's science, but not rocket science.

THE NATURAL WORLD IS SUBJECT TO CERTAIN INESCAPABLE LAWS-- such as Newton's Third, that every action has an equal and opposite reaction. The world of valid law is similarly constrained.

Valid law tolerates no tyranny by which the interests of a favored party enjoy special benefit over those of another. Thus, every means by which a liability or subordination of one to another could be established must be counterbalanced by an equally potent means by which such a liability or subordination can be rebutted. There can be no involuntary, inescapable liability; no one can say, "You owe me a duty (either simply because I say so or based on some presumption or allegation of agreement or trespass), and you cannot effectively dispute the obligation."

By virtue of this principle, there can be no valid statutory structure by which a liability for a debt can be alleged or presumed, with a means for rebuttal specified, but in which that means for rebuttal actually serves to confirm or even just support the alleged liability. There is no, "Heads I win, tails you lose!" in valid law.

This reciprocity principle is (or should be) self-evident. And yet, millions of otherwise perfectly sensible Americans overlook it and allow themselves to be sucked into the disastrous practice of "non-filing" in regard to the income tax, based on the mistaken and indefensible belief that filing a tax return is inherently supportive of the tax liability the filing is meant to rebut, no matter what is said on the return.

THE FACT IS, the statutory structure under which the tax operates specifies a return as the means by which alleged or presumptive liabilities are rebutted, and therefore a return (whether the taxing authority's own published version, or its functional equivalent) is the ONLY thing recognized by the taxing authority as a rebuttal instrument. Thus, the irrational belief about the inherent adverse effect of filing a return embraces precisely the physics-violating fallacy described above, in which an allegation can exist with no actual countervailing means of rebuttal.

RETURNS (AND THE STRUCTURE WITHIN WHICH THEY OPERATE) DO NOT violate the physics of the law. Returns DO NOT carry with them inherent adverse effects. The relevant law states with perfect clarity that:

"[A]ny party, in his or her own behalf, or as guardian or trustee, as aforesaid, shall be permitted to declare, under oath or affirmation, the form and manner of which shall be prescribed by the Commissioner of Internal Revenue, that he or she was not possessed of an income of [more than the exemption amount of "income"], liable to be assessed according to the provisions of this act, or that he or she has been assessed elsewhere and the same year for an income duty, under authority of the United States, and shall thereupon be exempt from an income duty; or, if the list or return of any party shall have been increased by the assistant assessor, in manner as aforesaid, he or she may be permitted to declare, as aforesaid, the amount of his or her annual income, or the amount held in trust, as aforesaid, liable to be assessed, as aforesaid, and the same so declared shall be received as the sum upon which duties are to be assessed and collected."

The accuracy of a return can be questioned or challenged; the sincerity of a return can be questioned or challenged; but whether the return supports or rebuts an allegation of liability hinges solely and comprehensively on what is declared on the the return regarding the filer's income, with nothing in that respect inhering in the mere fact that a return was filed.

FURTHER, THE LAW ALSO SPECIFIES THAT IT IS ONLY BY MEANS OF A RETURN that payments against a tax liability not actually owed can be effectively reclaimed:

26 U.S. Code § 6402 - Authority to make credits or refunds

(a) General rule

In the case of any overpayment, the Secretary, within the applicable period of limitations, may credit the amount of such overpayment, including any interest allowed thereon, against any liability in respect of an internal revenue tax on the part of the person who made the overpayment and shall, subject to subsections (c), (d), (e), and (f), refund any balance to such person.

26 U.S. Code § 7422 - Civil actions for refund

(a) No suit prior to filing claim for refund

 No suit or proceeding shall be maintained in any court for the recovery of any internal revenue tax alleged to have been erroneously or illegally assessed or collected, or of any penalty claimed to have been collected without authority, or of any sum alleged to have been excessive or in any manner wrongfully collected, until a claim for refund or credit has been duly filed with the Secretary, according to the provisions of law in that regard, and the regulations of the Secretary established in pursuance thereof.

26 C.F.R. § 301.6402-3  Special rules applicable to income tax

(5) A properly executed individual, fiduciary, or corporation original income tax return or an amended return (on 1040X or 1120X if applicable) shall constitute a claim for refund or credit within the meaning of section 6402 and section 6511 for the amount of the overpayment disclosed by such return (or amended return).

Plainly, this structure of law would be inherently and self-evidently invalid if the specified means for recovering overpayments of tax had the effect of invalidating that recovery. If the filing of a tax return on which was declared the receipt of less income than would produce a liability equal or greater than the amount withheld or paid-in in order to claim a refund of the overpayment served to somehow inherently prove or support the allegation that a greater amount of income was received, it would be impossible to make a claim.

The filing of a return cannot even carry with it or cause to arise merely a "burden of proof" upon the filer. A return is the responsive instrument. It is not a means for prosecuting a claim against another based on alleged agreement or trespass-- it is a means of agreeing to the claim or allegation of another, or putting the other to the burden of making its proofs.

THERE CAN BE NO IMBALANCE OF THESE KINDS IN THE LAW. It is a "physics" impossibility. On that basis alone, those plagued by these irrational fears about filing returns should recognize the error of their thinking, even without studying the actual related provisions of law.

If such an imbalance were to be perceived in the law or in any action of the taxing authority or any court, it is not because the law is actually structured to allow it. It is, and can only be, either a mis-perception, or because the taxing authority or court is either in error or corrupt.

To none of these possibilities is non-filing an answer. Non-filing simply takes the issue off the table entirely.

Non-filing is not a rebuttal of liability-related allegations, or even a repudiation of error or corrupt practices by agency or court. It is, very much to the contrary, an agreement with the allegations, and an abandonment of one's own claims.

Indeed, if corruption is the reason for any agency or judicial proposal or effectuation of an invalid imbalance in the law, it is practiced in the hope of prompting non-filing by anyone whose return would rebut allegations of taxable income. Non-filing IS a "Heads you win, tails I lose" proposition, because the non-filer is not calling a side, or even showing up to watch the coin get tossed, just as a corrupt agency or court wishes.

SO, I URGE EVERYONE who knows anyone who is stumbling down the "non-filing" path to lend a friendly hand and give that person guidance. These folks usually have their hearts in the right place, and are simply victims of not only the "ignorance tax" scam, but also the misled "Show me the law!" crowd that had so much unfortunate influence in the "tax honesty" community a number of years ago.

60 million or more "non-filers" out there need our help. Let's light up the night, people.

Obamacare Declaration No Longer Being Demanded By IRS

BEGINNING IN 2016, the IRS had been demanding that all filers make a statement concerning health insurance coverage-- either that they have it; don't have it; or are not subject to the requirement, such as for not having received enough "income" to trigger the mandate. Reason magazine now reports that the IRS has quietly stopped enforcing the requirement, in response to a Trump administration executive order commanding all executive branch organs to abandon efforts to enforce the statist health-care takeover scheme. President Trump Properly Slaps Down Gratuitous Demonization Of Russia, But...

MORE KUDOS TO TRUMP-- this time for his acknowledgement of the United States' lack of innocence in his now-famous pre-Super Bowl exchange with the odious Bill O'Reilly after the latter's attempt to demonize Vladimir Putin:

“O’Reilly: Do you respect Putin?

“Trump: I do respect him, but –

“O’Reilly: Do you? Why?

“Trump: Well, I respect a lot of people, but that doesn’t mean I’m going to get along with him. He’s a leader of his country. I say it’s better to get along with Russia than not. And if Russia helps us in the fight against ISIS, which is a major fight – that’s a good thing. Will I get along with him? I have no idea.

“O’Reilly: But he’s a killer, though. Putin’s a killer.

“Trump: There are a lot of killers. We’ve got a lot of killers. What do you think – our country’s so innocent?”

O'Reilly was trying to get Trump to agree that Putin is somehow a villain who should therefore be automatically viewed as our mortal enemy, with whom no cordial or even simply un-hostile relations can exist. Trump properly rejected this middle-school-level nonsense, and moreover, did so while maturely and honestly acknowledging the red hands of the United States.

TRUMP UNDERSTANDS that Russia (Putin) behaves in what it perceives as its interests in exactly the same fashion as does the United States, and is no more villainous for doing so than is the U.S. Of course, the other side of this coin is that the United States is no less villainous than Russia when doing the same sort of things for which Russia can be criticized.* I hope Trump gets that part, too.

I surely hope the Bill O'Reillys of the world think that through and also end up getting it. I hope they come to understand that just as when Russia does it, or when al Sisi does it, or when Idi Amin did it, the fact that the U.S. has what it imagines to be a reason-- even a Reason of State, or an alleged National Interest-- doesn't make its actions virtuous, or not evil.

The actions of a state are those of self-interest, always. And not the "self-interest" of "the state"-- there is no such thing. Those actions are on behalf of the self-interest of the individual humans who have control of the state apparatus.

We may imagine that such people are of saintly disposition and have some kind of collective interest in mind and at heart, and that this alleged collective interest is unselfish and morally just in relation to the interests of all other in the world who will be affected by the actions on its behalf. But of course, we would be delusional to imagine such things.

THE REALITY IS OTHERWISE, and every thinking person knows it, however much the neocon nutcases and the military-industrial-congressional complex whose purses their manias feed would like everyone to naively overlook it. The reality is as Marine Corps Major General Smedley Butler put it in a magazine article in 1935:

I spent 33 years and four months in active military service and during that period I spent most of my time as a high class muscle man for Big Business, for Wall Street and the bankers. In short, I was a racketeer, a gangster for capitalism. I helped make Mexico and especially Tampico safe for American oil interests in 1914. I helped make Haiti and Cuba a decent place for the National City Bank boys to collect revenues in. I helped in the raping of half a dozen Central American republics for the benefit of Wall Street. I helped purify Nicaragua for the International Banking House of Brown Brothers in 1902-1912. I brought light to the Dominican Republic for the American sugar interests in 1916. I helped make Honduras right for the American fruit companies in 1903. In China in 1927 I helped see to it that Standard Oil went on its way unmolested. Looking back on it, I might have given Al Capone a few hints. The best he could do was to operate his racket in three districts. I operated on three continents.

Butler's very short but very wonderful and incisive disquisition, 'War Is A Racket' is a must-read.

Another wise voice reveals the truth about the supposed virtue conveyed to state actions by alleged "national interest" in another very memorable way:

The War Prayer

It was a time of great and exalting excitement. The country was up in arms, the war was on, in every breast burned the holy fire of patriotism; the drums were beating, the bands playing, the toy pistols popping, the bunched firecrackers hissing and spluttering; on every hand and far down the receding and fading spread of roofs and balconies a fluttering wilderness of flags flashed in the sun; daily the young volunteers marched down the wide avenue gay and fine in their new uniforms, the proud fathers and mothers and sisters and sweethearts cheering them with voices choked with happy emotion as they swung by; nightly the packed mass meetings listened, panting, to patriot oratory with stirred the deepest deeps of their hearts, and which they interrupted at briefest intervals with cyclones of applause, the tears running down their cheeks the while; in the churches the pastors preached devotion to flag and country, and invoked the God of Battles beseeching His aid in our good cause in outpourings of fervid eloquence which moved every listener.

It was indeed a glad and gracious time, and the half dozen rash spirits that ventured to disapprove of the war and cast a doubt upon its righteousness straightway got such a stern and angry warning that for their personal safety’s sake they quickly shrank out of sight and offended no more in that way.

Sunday morning came — next day the battalions would leave for the front; the church was filled; the volunteers were there, their young faces alight with martial dreams — visions of the stern advance, the gathering momentum, the rushing charge, the flashing sabers, the flight of the foe, the tumult, the enveloping smoke, the fierce pursuit, the surrender!

Then home from the war, bronzed heroes, welcomed, adored, submerged in golden seas of glory! With the volunteers sat their dear ones, proud, happy, and envied by the neighbors and friends who had no sons and brothers to send forth to the field of honor, there to win for the flag, or, failing, die the noblest of noble deaths. The service proceeded; a war chapter from the Old Testament was read; the first prayer was said; it was followed by an organ burst that shook the building, and with one impulse the house rose, with glowing eyes and beating hearts, and poured out that tremendous invocation:

God the all-terrible! Thou who ordainest,

Thunder thy clarion and lightning thy sword!

Then came the “long” prayer. None could remember the like of it for passionate pleading and moving and beautiful language. The burden of its supplication was, that an ever-merciful and benignant Father of us all would watch over our noble young soldiers, and aid, comfort, and encourage them in their patriotic work; bless them, shield them in the day of battle and the hour of peril, bear them in His mighty hand, make them strong and confident, invincible in the bloody onset; help them crush the foe, grant to them and to their flag and country imperishable honor and glory —

An aged stranger entered and moved with slow and noiseless step up the main aisle, his eyes fixed upon the minister, his long body clothed in a robe that reached to his feet, his head bare, his white hair descending in a frothy cataract to his shoulders, his seamy face unnaturally pale, pale even to ghastliness. With all eyes following him and wondering, he made his silent way; without pausing, he ascended to the preacher’s side and stood there waiting. With shut lids the preacher, unconscious of his presence, continued his moving prayer, and at last finished it with the words, uttered in fervent appeal, “Bless our arms, grant us the victory, O Lord and God, Father and Protector of our land and flag!”

The stranger touched his arm, motioned him to step aside — which the startled minister did — and took his place. During some moments he surveyed the spellbound audience with solemn eyes, in which burned an uncanny light; then in a deep voice he said:

“I come from the Throne — bearing a message from Almighty God!” The words smote the house with a shock; if the stranger perceived it he gave no attention. “He has heard the prayer of His servant your shepherd, and will grant it if such be your desire after I, His messenger, shall have explained to you its import — that is to say, its full import. For it is like unto many of the prayers of men, in that it asks for more than he who utters it is aware of — except he pause and think. “God’s servant and yours has prayed his prayer. Has he paused and taken thought? Is it one prayer? No, it is two — one uttered, and the other not. Both have reached the ear of Him who heareth all supplications, the spoken and the unspoken. Ponder this — keep it in mind. If you would beseech a blessing upon yourself, beware! lest without intent you invoke a curse upon your neighbor at the same time. If you pray for the blessing of rain on your crop which needs it, by that act you are possibly praying for a curse on some neighbor’s crop which may not need rain and can be injured by it.

“You have heard your servant’s prayer — the uttered part of it. I am commissioned by God to put into words the other part of it — that part which the pastor — and also you in your hearts — fervently prayed silently. And ignorantly and unthinkingly? God grant that it was so! You heard the words ‘Grant us the victory, O Lord our God!’ That is sufficient. The whole of the uttered prayer is compact into those pregnant words. Elaborations were not necessary. When you have prayed for victory you have prayed for many unmentioned results which follow victory — must follow it, cannot help but follow it. Upon the listening spirit of God fell also the unspoken part of the prayer. He commandeth me to put it into words. Listen!

It was believed afterward that the man was a lunatic, because there was no sense in what he said.

 SO, KUDOS TO TRUMP for his forthrightness, but we must all do all we can to make sure he realizes the larger points involved in this matter. His reported consideration of the neocon nutcase John Bolton as a replacement for Michael Flynn as National Security Advisor doesn't auger well in this regard.

*The reference by the O'Reilly crowd to the polonium poisoning of Alexander Litvinenko as their reason for calling Putin a killer provides a great opportunity to make the point that the United States is no less villainous than Russia when doing the same sort of things for which Russia is criticized. This Litvinenko murder is only possibly a state crime-- Litvinenko's father believes Russian "oligarch" crime boss Boris Beresovsky is responsible.

But even if it was Putin, compare Litvinenko's murder to the admitted murder by the United States of 16-year-old American Abdulrahmah al Awlaki by drone strike in Yemen without charges or trial. This came two weeks after the murder of al Awlaki's also uncharged and untried or convicted American father in the same place and manner (both by the Obama administration), and was followed by the murder of Abdulrahman's 8-year-old sister two weeks ago by the Trump administration (this one called "collateral damage" during a military strike against other targets by US military assets in Yemen-- a country with which we are not at war). Mr. O'Reilly and his kind should stop throwing stones so readily.

Raspberries to Trump For His Asset-Forfeiture Support

AS ALWAYS, IT SEEMS, President Trump presents us with a mixed bag. Just two days after the virtuous "We're not so innocent" comment discussed above, Trump indicated enthusiastic support for the pernicious due-process-violating (and therefore unconstitutional) practice of "civil asset forfeiture". This is where law enforcement agencies keep property seized during specious arrests for which no charges are ever filed-- cars, cash, houses, boats, jewelry, etc..

Noises are made in connection with the seizures/retentions which propose that the seized property is somehow the product of illegal acts, but this is merely a cynical and corrupt effort at justifying the official crimes. The alleged connection to criminal acts is never proven, or even attempted to be proven. There are no legal proceedings attempting to justify the seizures. Typically, the agencies spend the proceeds on themselves.

It IS a flatly illegal practice:

"No person shall... be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

Fifth Article of Amendment, United States Constitution

It is also so widespread now that the aggregate amount stolen by police agencies under the rubric of "Civil Asset Forfeiture" has now exceeded the aggregate total of all property stolen by private sector burglars:

I would argue that support for, and tolerance of, this practice is impeachable.

Not right, Mr. Trump...

Raspberries Over The Saber-Rattling At Iran

AS EXEMPLIFIED BY the assault in Yemen in which the eight-year-old sister of a young American murdered by the Obama administration was murdered two weeks ago, the Trump administration is showing a disturbing inclination to embrace the nutcase view of Iran as some sort of uniquely evil actor in the Middle East. This is nonsense, and dangerous and immoral nonsense.

First of all, the saber-rattling over Iran's test of medium-rang ballistic missiles is based on a false premise. Iran is not barred from such tests, and has the same rights to provide for its own defense as are argued by every American standing up for his or her Second Amendment rights against those who argue that it's too dangerous for their neighbors to possess the means to defend themselves.

No good has ever come from arguments for the use of force which are based on lies. Much harm has come from such arguments.

Secondly, the entire neocon nutcase mania over Iran is an expression of false and dangerous denial, in service to unstated and immoral purposes. I strongly urge everyone to read the excellent presentation of the modern history of the Middle East found here. This account was written in 1991, and so misses recent events, but most of those should be available to most readers own memories. Even without consideration of some of the events of the last 26 years, the deep background of this presentation is hugely important.

What REALLY Should Be Done About Muslim Terrorism

We've already been told-- long since...

Dear President Trump:

If you wish to do the very best that can be done to ensure the safety of Americans from the possibility of terrorism by refugees from Muslim states, here is what you do: END U.S. VIOLENCE IN THE MIDDLE EAST.

Announce to the world that while United States foreign policy has been in thrall to neo-con nutcases for the last few decades, and to their "intellectual" ancestors for the several decades before that, a new day has now dawned in America. Tell the world that henceforth, the United States will embrace and re-dedicate itself to the principles and wisdom laid out for us by George Washington:

"...nothing is more essential, than that permanent, inveterate antipathies against particular Nations, and passionate attachments for others, should be excluded; and that, in place of them, just and amicable feelings towards all should be cultivated. The Nation, which indulges towards another an habitual hatred, or an habitual fondness, is in some degree a slave. It is a slave to its animosity or to its affection, either of which is sufficient to lead it astray from its duty and its interest. Antipathy in one nation against another disposes each more readily to offer insult and injury, to lay hold of slight causes of umbrage, and to be haughty and intractable, when accidental or trifling occasions of dispute occur. Hence frequent collisions, obstinate, envenomed, and bloody contests. The Nation, prompted by ill-will and resentment, sometimes impels to war the Government, contrary to the best calculations of policy. The Government sometimes participates in the national propensity, and adopts through passion what reason would reject; at other times, it makes the animosity of the nation subservient to projects of hostility instigated by pride, ambition, and other sinister and pernicious motives. The peace often, sometimes perhaps the liberty, of Nations has been the victim.

"So likewise, a passionate attachment of one Nation for another produces a variety of evils. Sympathy for the favorite Nation, facilitating the illusion of an imaginary common interest, in cases where no real common interest exists, and infusing into one the enmities of the other, betrays the former into a participation in the quarrels and wars of the latter, without adequate inducement or justification. Thomas Jefferson:

"About to enter, fellow-citizens, on the exercise of duties which comprehend everything dear and valuable to you, it is proper you should understand what I deem the essential principles of our Government, and consequently those which ought to shape its Administration. I will compress them within the narrowest compass they will bear, stating the general principle, but not all its limitations. Equal and exact justice to all men, of whatever state or persuasion, religious or political; peace, commerce, and honest friendship with all nations, entangling alliances with none;"

James Madison:

"Of all the enemies to public liberty war is, perhaps, the most to be dreaded, because it comprises and develops the germ of every other. War is the parent of armies; from these proceed debts and taxes; and armies, and debts, and taxes are the known instruments for bringing the many under the domination of the few. The same malignant aspect in republicanism may be traced in the inequality of fortunes, and the opportunities of fraud, growing out of a state of war, and in the degeneracy of manners and of morals engendered by both. John Quincy Adams:

"America does not go abroad in search of monsters to destroy. She is the well-wisher to freedom and independence of all. She is the champion and vindicator only of her own."

and Dwight Eisenhower:

"In the councils of government, we must guard against the acquisition of unwarranted influence, whether sought or unsought, by the military-industrial complex. The potential for the disastrous rise of misplaced power exists and will persist. We must never let the weight of this combination endanger our liberties or democratic processes."

Tell the world, "We wish you all well, but it's time for you all to "suit-up" and step up, because our century of madness is over. Don't mess with us, and we won't mess with you; see you in the marketplace."

BREXIT. DONALD TRUMP elected to the White House. The Cubbies taking the World Series. A Clinton or two on the road to prison.

Does anyone still doubt that we are in a transformational moment? Don't doubt it. We are.

The status-quo house of cards is reeling and rocking like it has not done even once for a moment in the 75 years of systematic, institutionalized misapplication of the income tax. Now is the time to stand up and make things happen, people.

So, Did You Fear A President Clinton? Do You Fear A President Trump?

You ought to dread either one...

IF THERE HAS BEEN ONE POSITIVE CONSEQUENCE of this latest election cycle, it is that a whole lot of Americans have been awakened to the fact that power in the hands of public officials is dangerous! Whether one's choice of the lesser evil might be, Clinton or Trump, the other evil on offer has starkly painted into his mind the perils of modern state power falling into undeserving hands.

Generally, in past elections, opposition to the "other guy"-- the pick preferred by other folks but not you-- has hinged on policy issues. Though sometimes heatedly defended or assailed, and though often concerning important matters, the issues have generally been taken at one or another level of "academic" consideration.

This year "position" and "opposition" have been on a self-preservation level. Whether you're for Clinton or Trump, you view the choice as one on which your very survival might depend.

Being unable to tell today how it's going to turn out in December (when the actual election takes place), everyone has experienced a very cold feeling in the pit of the stomach from the thought that it might go the wrong way. That feeling of imminent dire peril is the gift of the remarkable 2016 presidential race.

This year, for the first time, a lot of Americans are really, truly learning that to facilitate the near-Satanic power of the unrestrained state is to hang a Sword of Damocles over their own heads, and those of their children.

As P.J. O'Rourke wittily and accurately said, "Giving money and power to politicians is like giving whiskey and car keys to teenage boys." I'll add what is clearly implied but what I suspect many folks hadn't really realized until this year-- you and your kids are strapped into the back seat of that car.

SOSO, LOTS OF FOLKS ARE REALLY GETTING THE MESSAGE FOR THE FIRST TIME that power in political hands is bad, stupid, dangerous. What we in the CtC community must do is help these folks-- our friends, family and acquaintances-- recognize the necessary solution to this now-understood grave threat: STOP GIVING THEM THE GAS!!!

We in the CtC community must seize the moment. We must make a big push right now to show those about whom we care that it is their right and their duty to learn and declare the truth on every tax-related instrument they sign.

At the same time, we must show those we love that learning and declaring the truth on every tax-related instrument-- and thereby cutting off the excessive fuel-supply to the state-- is their only real hope for safety. Otherwise there will always be a Leviathan plenty big enough to destroy them at best waiting in the wings for one dicey election to go the wrong way and bring the nightmare to life.

A NUMBER OF YEARS AGO a statist thug made the observation that a crisis should never be allowed to go to waste. In his case he meant that a crisis should be used to grow the state and fasten it ever-more firmly on the American people.

But that sword cuts both ways. This time, how about the good guys capitalize on the crisis and use it to shrink the state?

Let's not forget, the "Cracking the Code" community has always also been the "Restore the Republic" community. So, CtC2RtR (#CtC2RtR)! That has a nice ring to it, doesn't it?

The Biggest Snow-Job In World History: The Myth That 1913 America Adopted A Marxist Progressive Tax On "All That Comes In"

Illuminating anniversaries of this week:

March 1- In 1781, the Continental Congress adopts the Articles of Confederation.  This day in 1803 is designated as that of Ohio's admission to the union as the 17th of the several states, but the actual congressional action on the admission didn't take place until August 7, 1953.  In 1815, Napoleon Bonaparte returns to France after escaping his imprisonment on Elba.  In 1867, Nebraska is admitted to the union as the 37th of the several states (36th, really-- see the Ohio entry above).  In 1872, Yellowstone becomes the first United States park.  In 1912, Albert Berry makes the first parachute jump from an aircraft in flight.  In 1932, the son of aviator Charles Lindbergh is kidnapped.  In 1941, the first FM radio station in America begins broadcasting (WSM-FM in Nashville, Tennessee).  In 1954, Puerto Rican nationalists open fire on United States representatives from the visitor's gallery during a session of Congress, wounding five.  In 1966, the Soviet Venera 3 space craft becomes the first to land (by crashing) on the surface of another planet.  In 1971, the Weather Underground sets off a bomb in a men's room in the U.S. Capitol building.  In 1974, seven suspects are charged with conspiracy to obstruct justice in connection with the Watergate break-in.  In 2014, eight assailants armed with knives massacred 29 people and left another 140 wounded in an attack in the Chinese city of Kumming.  Predictable calls for strengthened "knife control" laws echoed throughout statist lairs across America.

 

PRO TIP: If I were the IRS and I wanted to discourage people from rebutting allegations that they had done things I can tax, and keep them from successfully reclaiming withheld or paid-in money, I would salt the "tax honesty" community with passionate-seeming "legal researchers" who would warn anyone whose ear they captured that filing a 1040 is a bad idea for one reason or another.

The plane that gets the most flak is the one that's right above the target.

FOR ALL THE YEARS SINCE 2003 when CtC was first published, the government has engaged in a concerted effort to frighten people away from its truths. This effort involves official government websites and press releases touting an occasional court ruling that appears to be at odds with some CtC-revelation (but without details sufficient to expose the real substance of the ruling)-- and sometimes even more mendacious behavior.

Two Simple Questions For Every Silent "Alt-Media" Journalist

The silence of these folks is the liberation bottleneck. Maybe this'll help, if enough people ask...

HERE'S A SIMPLE QUESTION: The income tax is, and always has been, an excise tax on privilege. This is established beyond any controversy whatever by repeated Supreme Court rulings, the words of the related laws, and, since 2003, by hundreds of thousands of acknowledgements by federal and state tax agencies.

You, like most folks, have been fooled into inadvertently agreeing that your economic activities are exercises of privilege, thereby allowing the tax to be applied to your earnings. Why is this so hard for you to admit?

HERE'S ANOTHER SIMPLE QUESTION: You and everyone else being fooled into agreeing that your economic activities are privileged and thereby allowing them to be taxed is what enables the flow of wealth that finances all the bad things done by the state of which you complain in every column. Why is this so hard for you to admit?

I GUESS THESE ACTUALLY LEAD TO A THIRD SIMPLE QUESTION: If you really feel that all these things of which you complain are so bad, why are you not helping more Americans understand the true nature of the tax and the ill effects of it being misunderstood and misapplied?

PRO TIP: By the physics of the law, an indirect tax is necessarily a privilege tax. Here's why:

The distinction between a direct tax and an indirect tax is incidence. A direct tax arises by the direct imposition of the taxer, without any election of the taxed (other than that of authorizing the taxing power in the first place).

An indirect tax arises by the taxed choosing t to to to to do something by which the taxer's claim is then created. The choice that is a valid object of an indirect tax can't be anything done as an exercise of an untaxable right. Nor can it be any activity of necessity. A tax on anything done by necessity would arise not by actual election of the taxed but simply because the tax had been imposed by the taxer. Such a tax, whatever it may be called, would be in actual substance a direct tax, even if one that arose only intermittently. Think of a tax on eating, for example, or working, or engaging in trade with others (all of which are things done by right as well as by necessity, but you get the point).

What is left as the valid object of an indirect tax is the exercise of privilege-- something done not by right, and therefore done by the permission of the taxer (who, due to being possessed of an ownership right in the thing being permitted, is entitled to claim of portion of the proceeds when the thing is profitably used).

"[Although the Legislature may declare as privileges and tax as such for State revenue purposes those pursuits and occupations that are not matters of common right], the Legislature has no power to declare as a privilege and tax for revenue purposes occupations that are of common right."

Sims v. Ahrens, 167 Ark. 557, 271 SW 720 594, 595 (Ark. 1925)

 

The 'Watching the Watchmen Amendment'

If you're not talking this one up everywhere and helping generate a buzz, you don't really want liberty and the rule of law...

 

PRO TIP: The argument that a concept explicitly given a statutory definition for purposes of this or that chapter or "title" has the same meaning as the common word the legislature has borrowed for its label-- which meaning plainly didn't suit the legislature's purposes, hence its replacement-- is a preposterous reading of the law.

“It is axiomatic that the statutory definition of the term excludes unstated meanings of that term.” 

Meese v. Keene, 481 U.S. 465 (1987);

“[W]e are not at liberty to put our gloss on the definition that Congress provided by looking to the generally accepted meaning of the defined term.”

Tenn. Prot. & Advocacy Inc. v. Wells, 371 F.3d 342 (6th Cir. 2004).

 

 

In light of the actual evidence, , , those who doubt or deny the accuracy and correctness of CtC just because government officials make weaselly representations against it are like the 16th-century Europeans who were mystified by Copernicus getting all those astronomical predictions right even though the church had said he was wrong.

Are You Having Trouble Spreading The Word?

SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance:

Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same?

Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort...

Why Do So Many Americans Fear Muslims? Decades of Denial About America's Role in the World

There’s been lots of attention-grabbing opposition to Trump’s “Muslim ban” executive order, from demonstrations to court orders. But polls make it clear public opinion is much more mixed. Standard phone polls show small majorities opposed, while web and automated polls find small majorities continue to support it.

What surprises me about the poll results isn’t that lots of Americans like the ban — but that so many Americans don’t. Regular people have lives to lead and can’t investigate complicated issues in detail. Instead they usually take their cues from leaders they trust. And given what politicians across the U.S. political spectrum say about terrorism, Trump’s executive order makes perfect sense. There are literally no national-level American politicians telling a story that would help ordinary people understand why Trump’s goals are both horrendously counterproductive and morally vile.

Think of it this way:

On February 13, 1991 during the first Gulf War, the U.S. dropped two laser-guided bombs on the Amiriyah public air raid shelter in Baghdad. More than 400 Iraqi civilians were incinerated or boiled alive. For years afterward visitors to a memorial there would meet a woman with eight children who had died during the bombing; she was living in the ruined shelter because she could not bear to be anywhere else.

Now, imagine that immediately after the bombing Saddam Hussein had delivered a speech on Iraqi TV in which he plaintively asked “Why do they hate us?” — without ever mentioning the fact that Iraq was occupying Kuwait. And even Saddam’s political opponents would only mumble that “this is a complicated issue.” And most Iraqis had no idea that their country had invaded Kuwait, and that there were extensive United Nation resolutions and speeches by George H.W. Bush explaining the U.S.-led coalition’s rationale for attacking Iraq in response. And that the few Iraqis who suggested there might be some kind of relationship between Hussein’s invasion of Kuwait and the Amiriyah bombing were shouted down by politicians saying these Iraq-hating radicals obviously believed that America’s slaughter of 400 people was justified.

If that had happened, we’d immediately recognize that Iraqi political culture was completely insane, and that it would cause them to behave in dangerously nutty ways. But that’s exactly what U.S. political culture is like.

About The Author

 

Pete Hendrickson is possibly the most effective lawyer in history, even while never having set foot in a law school, nor ever being a card-carrying member of "the bar". He is the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes); further, since 2003 students of his legal analyses and arguments in ‘Cracking the Code- The Fascinating Truth About Taxation In America’’ (CtC), and its sequel, 'Was Grandpa Really a Moron?' have been routinely retaining and recovering billions of dollars which otherwise-- wrongly, but as a matter of course-- would have gone to federal or state government treasuries. This despite concerted efforts by government to suppress his work, and in some cases vigorously oppose the claims by his students.

 

Hendrickson is also a widely-read essayist on matters of politics, public policy and law; many of these works are collected in his second book, ‘Upholding the Law And Other Observations’.  He is a member of Mensa; an award-winning artist; and has paid his dues as a youth soccer coach.  He is a long-time political activist as well, and has served as co-chair and platform convention delegate of Michigan’s largest county Libertarian Party organization; as a consultant to the National Right to Work Foundation and Citizens for a Sound Economy; as a member of the Heartland Institute; and as a member of the International Society for Individual Liberty.  He is a frequent radio-show guest on stations across the country.

 

Hendrickson's business career has included nearly a decade-and-a-half at the leading edge of the renewable-energy industry, both as Director of Purchasing and Materials Management and member of the R&D board at Starpak Energy Systems, the mid-west's then-largest solar heating and energy-recovery-and re-utilization company; and as founder and president of AFJ Inc., a high-efficiency lighting design, manufacture and installation firm.

 

Beginning in the mid-1990s and continuing for the twelve years before his present full-time focus on the restoration of the rule of law in America, Hendrickson directed purchasing activities for the $84 million-a-year multi-family-housing division of the Farmington Hills, Michigan branch of Edward Rose and Sons, with responsibility for 18,000+ apartments, direct supervision of 35 technicians and agents, and incidental authority over several hundred divisional workers.  He also ran the division's 10 cable television earth-station and distribution systems in four states, and designed and administered the company's website.

 

On rather the other end of the spectrum, amidst these more mundane pursuits Hendrickson co-founded and was the primary creative force behind a small board- and card-game company that enjoyed a modest success for several years.

 

Hendrickson makes his home in southeast Michigan, with his wife and two children.  He is currently working on his next book.
