the representations of those who profit from those beliefs (like tax
bureaucrats and "tax professionals")?

Havana Harbor, Cuba, providing a pretext for the United States
to declare war on Spain. In 1933, an assassin bungles an
attempt to shoot FDR during a speech in Miami, Florida, but does
shoot and fatally wound the mayor of Chicago, who was in the car
from which the president was speaking. In 1946, ENIAC, the
first general-purpose electronic computer, is unveiled. In
1971, the first celebration of Washington's Birthday takes place
on the third Monday of February, rather than the actual
anniversary of February 22. Although Lincoln idolaters have
sought to mischaracterize the new schedule as somehow making the
occasion a combined celebration of Washington and Lincoln, the
holiday is still officially dedicated exclusively to
Washington's Birthday. In 1989, the Soviet Union announces that
all its troops have left Afghanistan. In 2003, protests against
the impending U.S. invasion and occupation of Iraq take place in
800 cities worldwide. BBC News estimates the participation of
between 6 and 10 million people in what proves to be the largest
peace demonstration in history. The Bush administration pays no
attention... In 2005, YouTube is launched.

A useful illustration of a core and critically-important
legal and political fact
WHILE CONDUCTING RESEARCH LAST WEEK CONCERNING
Michigan's laws against "frivolous return penalty" threats for addition to
this collection, I came across this little
item in the state's Compiled Laws:
Any person who shall commit the crime of treason
against this state shall be punished by imprisonment in a state
prison for life. No person shall be convicted of treason unless
upon the testimony of 2 witnesses to the same overt act, or on
confession in open court.
Nothing fundamentally remarkable about the
appearance of this law on Michigan's books, of course-- after
all, treason against the state is identified as a crime in
Michigan's Constitution:
Article 1, § 22 Treason; definition, evidence.
Sec. 22. Treason against the state shall consist
only in levying war against it or in adhering to its enemies,
giving them aid and comfort. No person shall be convicted of
treason unless upon the testimony of two witnesses to the same
overt act or on confession in open court.
Still, I wonder how many folks have reflected
on the clarity that state Constitutional provisions against
treason furnish to the legal reality that the union states are
free-standing, sovereign nations with independent interests and
obligations entirely distinct from those of the United States.
After all, such provisions in state Constitutions show that
treason against the United States-- the political and
governmental entity headquartered in Washington, DC-- isn't
necessarily treason against Michigan (or any other state), and
vice versa.
SO, SERIOUS FEDERALISM is a legal reality for
everyone in the USA. Nonetheless, I've always had the sense that
the institutional structure whose voice I am compelled to hear
everywhere I go and all the time has been steadily striving to
undermine public understanding of this fact.
I've had the sense, especially over the last 50
years, that the big, ubiquitous institutional voice here in
America has been trying hard to condition everyone to accept the
false notion that the USA is a monolithic, fused polity-- a
single nation with uniform and singular interests determined and
declared by the "United States government". In other words, that
institutional voice has been trying to bleed the states of
power, authority and independence, and gather all power in Mordo...
I mean, Washington.
Now, I'm going out on a limb here, but doesn't an
effort to bleed power, authority and independence from a state--
which is
accomplished as a practical fact simply by convincing enough of
the population that all power and authority resides
elsewhere, even without any formal, "on paper" alteration in the
distribution of these things-- amount to at least a form of
making war on the state? Doesn't it amount to some form of
adhering to its enemies?
I'm making no accusations, mind you. And frankly,
the manner in which such bad behavior is practiced would be very
hard to qualify or quantify, especially given the muddiness
already generated in the waters such inquiries would have to
ply.
But I think an appreciation of these concerns might
suggest to those who take the rule of law seriously, and who
respect the Founders' vision of how to safely and effectively
subordinate government to the overriding interest of liberty,
that advocacy or habits of deference to-- or aggrandizement of--
Washington and the United States legislature, executive and
courts by state officials should be looked upon with a very
jaundiced eye. Such things might not rise to the level of
treason, but they certainly should raise questions about whether
the loyalties of those officials really lie where they should.
Another real American shares the liberating truth,
and some serious inspiration

Here is the filing that produced this victory in enforcing
the rule of law-- that is, in enforcing the actual
Constitutional provisions controlling the ability of the federal
government to assert and collect unapportioned taxes (and that
of state governments acting under federal permission to lay
claim to a portion of the same things the feds tax as "income").
Jeremy's complete refund of everything withheld
from him and turned over to Georgia during 2013, plus interest,
which was issued on December 11, 2015, can be seen below:

It will have been noted that Jeremy included an IRS
transcript for each year involved in
his Georgia filings. Both showed the IRS's own calculations and
conclusions that Jeremy had received no "income" for those years
and had no tax liability, after having examined his federal
filings for those years.

Jeremy is still waiting for the return of what was
withheld and given to the feds for three of these years, but the
United States has already made its admissions/acknowledgements,

the "tranquility" of servitude. Jeremy joins
the ever-greater host of grown-up Americans who have stood,

Company is founded. In 1918, Lithuania declares its
independence. In 1923, Howard Carter unseals the burial chamber
of Tutankhamun. In 1937, nylon is patented. In 1959, Fidel

in Lebanon. In 2011, protests fomented against the regime of
Moammar Ghaddafi by western interests disturbed by extensive
oil-production deals being made between Ghaddafi and Chinese

The IRS and SSA Share A Nice
Institutional Acknowledgement Of CtC
It's always gratifying when these agencies just
come right out and admit the truth...
OVER THE 12+ YEARS SINCE
CtC REVEALED the liberating truth about the income tax,
government agencies have steadily issued acknowledgements of
that truth to the real American men and women who have applied
those revelations and upheld the true rule of law. These
acknowledgements most commonly take the form of
complete refunds of every penny taken from someone under the
auspices of the tax.
But sometimes other forms of acknowledgement are
presented. Today we're going to look at one of these more
unusual varieties, an example of which was recently sent to one
of those real Americans who are standing up to enforce the
Constitution.
THE GOOD FELLOW WHO RECEIVED the unusual
acknowledgement at which we're about to look is an accomplished
upholder of the law. He has three proudly-posted victories to
his credit so far since learning the truth about the tax a few
years ago, successfully overcoming false assertions that his
earnings were subject to the income tax, and recovering
everything withheld from him in connection with that tax during
each of those three years.
But for today, this gentleman's name is going to go
unmentioned, because despite the IRS having faced the truth
concerning his earnings for each of those other years (after
subjecting each claim to the agency's routine rigorous scrutiny),
for some reason the IRS employee that began to process this
man's 2012 filing has been dragging his or her feet. A lawsuit
is in progress, and what we're going to look at is relevant to
that. Our friend doesn't want to show his hand too soon.
So, there is no name to show until this contest is
over. But the chink in the tax agency's stonewall that was
revealed a few weeks ago will be of great interest to all
nonetheless.
WITHOUT ANY PROMPTING, and to our hero's
considerable surprise, out of the blue and into the mailbox came
a notice from the Social Security Administration announcing the
IRS acknowledgment that our hero's earnings as a contractor in
2012 don't qualify as IRC-defined "self-employment income" (the
kind of contractor pay that is subject to the tax). Our hero's
educated rebuttal of the contrary "1099-MISC" assertions of his
payer, on which the tax agency had been mindlessly relying, has
prevailed.
This kind of inter-agency acknowledgement happens
constantly. But for the filer to get notice of it is rare.
The SSA's accounting of taxable earnings
used to calculate any benefits for which our friend might someday
want to apply has been reduced accordingly, of course. But even
if the gentleman hasn't already accumulated the maximum credit
(as many folks of a certain age have done long since, over years
of suffering the misapplication of the tax prior to learning the
truth) I don't think he minds...
Here's the notice:
Isn't it nice when these bureaucrats finally give
up on lying and stonewalling and just do the right thing?
Frankly, I'm as happy for the one that found the right path to
walk here as I am for our hero.

You, like most folks, have been fooled into inadvertently
agreeing that your economic activities are exercises of
privilege, thereby allowing the tax to be applied to your
earnings. Why is this so hard for you to admit?
I GUESS THESE ACTUALLY LEAD TO A THIRD SIMPLE QUESTION: If you
really feel that all these things of which you complain are so
bad, why are you not helping more Americans understand the
nature of the tax and the ill effects of it being misunderstood
and misapplied?

PRO TIP: By the
physics of the law, an indirect tax is necessarily a
privilege tax. Here's why:
The distinction between a
direct tax and an indirect tax is incidence. A
direct tax arises by the direct imposition of the
taxer, without any election of the taxed (other than
that of authorizing the taxing power in the first
place).
An
indirect tax arises by the taxed
choosing to to do
something by which the taxer's claim is then
created. The choice that is a valid object of an
indirect tax can't be anything done as an exercise
of an untaxable right. Nor can it be any activity of
necessity. A tax on anything done by necessity would
arise not by actual election of the taxed but simply
because the tax had been imposed by the taxer. Such
a tax, whatever it may be called, would be in actual
substance a direct tax, even if one that arose only
intermittently. Think of a tax on eating, for
example, or working, or engaging in trade with
others (all of which are things done by right as
well as by necessity, but you get the point).
What is left as the
valid object of an indirect tax is the exercise of
privilege-- something done not by right, and
therefore done by the permission of the taxer (who,
due to being possessed of an ownership right in the
thing being permitted, is entitled to claim of
portion of the proceeds when the thing is profitably
used).
"[Although the Legislature
may declare as privileges and tax as such for State
revenue purposes those pursuits and occupations that
are not matters of common right], the Legislature
has no power to declare as a privilege and tax for
revenue purposes occupations that are of common
right."
If you're not talking this one up everywhere and
helping generate a buzz, you don't really want liberty and the
rule of law...
PRO TIP: The
argument that a concept explicitly given a statutory
definition for purposes of this or that chapter or
"title" has the same meaning as the common word the
legislature has borrowed for its label-- which
meaning plainly didn't suit the legislature's
purposes, hence its replacement-- is a preposterous
reading of the law.
“It is axiomatic that the
statutory definition of the term excludes unstated
meanings of that term.”
Meese v. Keene, 481
U.S. 465 (1987);
“[W]e are not at liberty to
put our gloss on the definition that Congress
provided by looking to the generally accepted
meaning of the defined term.”

But you know what? The charge against Doreen is an
effort by the state to make it so.
Doreen was charged, remember, with
criminally-refusing to cede control of her expressions to the
state. Now, I'll grant you that technically her thoughts would
remain her own, but if the state can dictate what everyone says,
then pretty soon that atmosphere of controlled expressions will
result in first influencing, and then ultimately controlling
what everyone thinks.
If the State gets away with establishing the
precedent that every written expression-- even just those on
testimonial instruments-- can be required to echo the state's
preferred view of things, the fate of free thinking and liberty
is obvious (and it's not good).

the first filibuster begins in the United States Senate. It
will last until March 11. In 1885, 'The Adventures of
Huckleberry Finn' is published. In 1930, Pluto is discovered.
In 1930, a cow named Elm Farm Ollie makes the first bovine
flight in a fixed-wing aircraft. In 1943, the members of the
White Rose anti-Nazi movement are arrested in Germany. In 1979,
snow falls in the Southern Algerian portion of the Sahara
Desert. In 1991, the IRA explodes bombs in Paddington Station
and Victoria Station in London. In 2014, the US-instigated coup
by neo-Nazi factions in Ukraine against the existing elected
government, which was balking at following a US-charted
foreign-policy course calling for distancing itself from Russia,
began to boil into its final days. Mysterious sniper fire
indiscriminately killed both police officers defending the
government and rioters whipped up by the plotters of the coup
amidst steady, increasingly violent clashes between the two

Are You Having Trouble Spreading The
Word??
SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE
EXPECTED when you're trying to explain to someone that
everything they've been encouraged their whole lives to
believe about something as entrenched and significant as the
income tax is basically nonsense. So here's a way to help
cut through the resistance:
Ask your listener how he or she would react if
you were to show an announcement from the Commissioner of
Internal Revenue admitting that the tax doesn't apply to the
earnings of most Americans and is misapplied most of the
time because people don't understand how it works? Or how
about if you showed a ruling from the Supreme Court saying
the same?
Now you just have to explain that
you're going to show exactly those things-- but because
the state really doesn't want people to know this, these
things haven't been said quite as forthrightly as we would
all wish. It's going to take a bit more work to take these
admissions in than is sufficient for just reading a press
release. But it'll be worth the effort...
IF YOU'RE NOT SPREADING THIS LINK with every bit of
energy you can, to school libraries, homeschool
families and community groups, your neighbors, your
family members, your pastors and
co-congregationalists, journalists, lawyers, CPAs,
members of congress, tax-agency workers, Wikipedia,
Anonymous, WikiLeaks, the Tax Foundation, everyone
in the "tax honesty" movement, the 9/11 truth
movement, other activist movements and everyone
else,
you have only yourself to blame for your
troubles with the tax, and a whole lot else of which
you might complain. It's on you.

explaining what will be seen at the link-- cryptic
is bad; excited is good-- and then send this WMI
(weapon of mass instruction) far and wide.

The Bottoson Effect

Two weeks ago, the Supreme Court struck down the
Florida death penalty statute. As usual, the story that matters
about this decision is the one that hasn’t been told.
You have probably never heard of Linroy Bottoson. He
was executed by the State of Florida December 9, 2002. Bottoson’s
execution was just another in a long series of forgotten killings
since the Supreme Court reinstated the death penalty in 1976.
Sixty-one men and two women preceded him to the gallows that year,
and seven more would follow before the year ended. Nothing about his
case has ever attracted the attention of the larger world. On the
day he died, the lead story in the New York Times concerned the
insistence by a top advisor to Saddam Hussein that Iraq had no
weapons of mass destruction. The paper of record made no mention of
Bottoson’s death.
But Linroy Bottoson nonetheless stands for something
exceedingly important about the death penalty in the United States.
For years, he insisted that his sentence was constitutionally
flawed. For years, the courts turned him away—first the lower
courts, and ultimately the Supreme Court. Eventually, however, the
courts came to the conclusion that Bottoson had been right all
along. By that time, however, he was dead. Bottoson thus exemplifies
the fatal interaction between a man who is constitutionally before
his time and a system that cannot undo its mistakes.
Now ask yourself this: Have you really done
all that you can to
urge everyone
you
know to also stand up and act in the only way that will really
bring about change in your lifetime?
Even as ardent a statist as Abraham
Lincoln, in announcing his willingness to burn the Southern states to the ground in order to
keep them paying the tariff for the benefit of Northern interests in
his first inaugural address on March 4, 1861, paid at least lip
service to the Founders design of leaving control over the fuel
available to feed the fires Washington wants to light in the hands
of the individual citizenry when he said, "Doing this I deem to
be only a simple duty on my part; and I shall perform it, unless my
rightful masters, the American people, shall withhold the requisite
means..."
February 20- In 1792,
the United States Post Office is established. In 1872, New
York's Metropolitan Museum of Art opens its doors. In 1933,
Congress proposes the Twenty-first Amendment, which will undo
prohibition. In 1962, John Glenn becomes the first American to
orbit the Earth. In 1976, SEATO-- the Southeast Asia Treaty
Organization-- disbands.

Hendrickson is also a widely-read essayist on matters of
politics, public policy and law; many of these works are
collected in his second book, ‘Upholding
the Law And Other Observations’. He is a member of
Mensa; an
award-winning artist; and has paid his dues as a youth
soccer coach. He is a long-time political activist as
well, and has served as co-chair and platform convention
delegate of Michigan’s largest county Libertarian Party
organization; as a consultant to the National Right to Work
Foundation and Citizens for a Sound Economy; as a member of the
Heartland Institute; and as a member of the International
Society for Individual Liberty. He is a frequent
radio-show guest on stations across the country.
Hendrickson's business career has included nearly a
decade-and-a-half at the leading edge of the renewable-energy
industry, both as Director of Purchasing and Materials
Management and member of the R&D board at Starpak Energy
Systems, the mid-west's then-largest solar heating and
energy-recovery-and re-utilization company; and as founder and
president of AFJ Inc., a high-efficiency lighting design,
manufacture and installation firm.
Beginning in the mid-1990s and continuing for the twelve years
before his present full-time focus on the restoration of the
rule of law in America, Hendrickson directed purchasing
activities for the $84 million-a-year multi-family-housing
division of the Farmington Hills, Michigan branch of Edward Rose
and Sons, with responsibility for 18,000+ apartments, direct
supervision of 35 technicians and agents, and incidental
authority over several hundred divisional workers. He also
ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On
rather the other end of the spectrum, amidst these more mundane
pursuits Hendrickson co-founded and was the primary creative
force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan, with his wife
and two children. He is currently working on his next
book.
