March 22- In 1765, the British Parliament
passes the "Stamp Act" imposing a tax on all legal papers in the
American Colonies. In 1871, William Woods Holden, the
Republican governor of North Carolina, is impeached and removed
from office by the Democratic legislature for his vigorous
efforts to suppress the activities of the Ku Klux Klan. In
1946, Jordan gains its independence from Britain. In 1954, the
first "shopping mall" opens in Southfield, Michigan. In 1960,
the first patent for a laser is issued. In 1981, U.S.
first-class postage rises from 15 cents to 18 cents per ounce.

THIS YEAR'S SEASON OF LIES has been unfolding in the usual
fashion. As in every year since the 1940s, millions of
groundless allegations that American men and women who simply exercised their
God-given, unalienable and un-burdenable right to work were
somehow engaging in taxable activities by doing so have been
issued on W-2s and 1099s by hundreds of thousands of payers who have never studied (and
probably have never even seen) the rules specifying what is
actually to be reported on these forms.
It used to be that the lies (and the repeating and solidifying
of the lies by equally-ignorant workers) were all there ever
was. Happily, since CtC
was first published in 2003 there has come a time each
year when the flurry of lies begins to be counter-balanced by
individual assertions and government acknowledgements of
the
liberating truth about the "income" tax.
These assertions take the form of
CtC-educated
filings, and the acknowledgments take the form of
complete refunds of everything withheld the
previous year which have been claimed by CtC-educated filers who have rebutted those bogus allegations. Now, this year's Season
of Truth has begun-- and earlier than usual.
Gary and Connie
TWO WEEKS AGO, Gary and Connie secured this
complete refund of everything withheld
from their earnings during 2014
and given over to California in connection with the "income"
tax. Gary and Connie knowledgeably rebutted the payer's ignorant
allegations that their earnings came from "income-taxable"
activities, and declared themselves to have done nothing
"income" taxable overall such as to cause a liability to arise
by means of their California return.

here; and raise a toast to Gary and Connie! They wasted no
time countering lies with truth and this victory of theirs on
behalf of the rule of law is the first concerning 2014 to be
posted on these pages!
RO & L
COINCIDENTALLY, on the same day, RO & L received a
refund for 2013. Like Gary and Connie, RO & L rebutted
ignorantly-made allegations by payers that their earnings were
"income"-taxable, and declared by way of their return that they
had not received any gains of that specialized variety
sufficient to have any liability for that tax.
Annoyingly, the government is playing a little game with
RO &L here-- it has agreed that they earned no "wages" (and had
nothing else qualifying as "income" in sufficient amount to
cause a liability to legitimately arise), as evidenced by this
complete refund of everything withheld from them as nominal
"federal income tax". But the amounts withheld from them as
"Social security" and "Medicare" "income" taxes haven't yet been
returned, despite the fact that each of these surtaxes only
arise on, and can be measured by, the receipt of the "wages" it
has been admitted that RO & L have not received...
These agencies can be shameless, and RO & L will
have to rattle some cages to get the rest of their property
returned, it appears.

THIS YOUNG MAN WAS TOO EXCITED at his first victory on behalf of
the rule of law to make a copy of the check before putting it in
his bank account, but rounded up this check-stub of his complete
refund from Nebraska of everything withheld in connection with
the "income" tax during 2013 to share with everyone.
Not a lot of money, of course, but every penny belongs to
this fine young American, and now he has it all back, by way of
this filing.

Ignorance of the true nature of the "income" tax
has gagged, gutted and seduced-into-disgrace America's
ministerial community. This must change.
Illuminating anniversaries of this week:
March 23- In 1775,
Patrick Henry says, "Give me liberty, or give me death!" In
1806, Lewis and Clark turn their backs on the Pacific and head
home. In 1857, Elisha Otis's first elevator is installed in New
York City. In 1919, Benito Mussolini founds the Fascist
movement in Italy. In 1933, the German Reichstag passes the
'Enabling Act', giving Adolph Hitler dictatorial powers. In
1956, Pakistan becomes the world's first Islamic republic. In
2006, the Federal Reserve stops publishing 'M-3'-- the complete
report of money supply-- thus acting to conceal key policy
indices. This information is still reported by private
sources-- see the 'Regarding Money' feature of this newsletter
for access.
Like the question of what belongs on a return,
it's all context, context, context.
I'M SURE EVERYONE UNDERSTANDS that everything
anyone hands the guy at H&R Block is automatically and
unavoidably taken as being declared to be taxable
activity-related. "Taxable-activity-related" is the context
in which tax-preparers do their thing, and any document
brought to them as part of a request to do tax calculations
will be taken as relevant to that context.
It can't be otherwise, outside of very narrow
special cases in which even a federally-connected version of
any given activity isn't subject to the tax. After all,
other than as regards economic activity which is under no
circumstances subject to the tax, the guy at H&R Block is in
no position to say that any particular thing which might be given
to him ISN'T tax-related. He is not that privy to his client's
affairs.
The H&R Block guy might pull out from a
document dump a client's records of receiving a gift, and
not include it in "income" because no kind of gift receipt
is taxable. But if he's given documents about a guy's
plumbing business, he'll assume that it is being declared to
be an "income taxable" plumbing business, 'cause otherwise
why would it be given to him in the context of
tax-return-preparation?
So, only a crazy person would just bring every
document in his or her possession related to overall
economic activities and rely on the H&R Block guy to
distinguish between the tax-related stuff and the
non-tax-related stuff. They don't have the knowledge, and
that's not their job.
A TAX AUDIT IS EXACTLY THE SAME. A tax audit is
a forensic examination and analysis of tax-related
information. It's not a general examination of all economic
activity.
There's no authority for a tax agency to just
dig through and examine every document related to anybody's
overall economic activity. A law enforcement agent might get
authorization for such a search, pursuant to a warrant based
on a sworn allegation establishing probable cause that
evidence of a crime will be discovered by the search. But a
tax audit can only demand the production of books and
records related to "income" activities.
Consequently, the limitation of the audit
authority creates a context in which it is exercised. Any
response to that exercise will be colored by that context,
such that any documents produced in response to an audit
summons will be
reasonably and unavoidably
taken as being declared by the respondent to be "income"-related
(meaning that the activities to which those documents relate
will be taken to be income-taxable activities).
Like with the H&R Block guy, if one brings
documents related to one's plumbing business to an audit, it
will be assumed that one is declaring one's plumbing
business to be the taxable kind of plumbing business. Like
with the H&R Block guy, it falls to the audit respondent to
distinguish between what (if any) of his or her economic
activity is actually relevant to an "income tax" audit and
what is not, and only present the one.
In short, an
audit only has authority to examine taxable activities and
events, and the records related thereto. Anything brought in
will be presumed to be so related, by implicit declaration
of the one who brought them (or who gave them to the one who
brought them, if that is a third-party service-provider,
like an accountant).
NOTE: A nice judicial expression of the
"context" doctrine discussed above, and of the limits of the
audit and examination authority can be found
here.
NOTE II: I hope everyone will recognize
how the reality of tax audits as just explained clarifies
what some have long imagined to be Fourth Amendment
violations inexplicably allowed by the courts. As explained,
a tax audit is NOT a Fourth-Amendment-violating general
poke-through of one's papers. It is only an examination of
records related to the exercise of privileged activities.
What is mistaken to be an
inexplicably-permitted general warrant is just the vaporware
product of those who don't understand the limits of the tax
and therefore ignorantly assume that the "books and records"
demand encompasses ALL books and records, not just those
related to engaging in federally-privileged activities (the
opportunity for which carries with it an implicit or
explicit agreement to allow such examinations of relevant
records).
Importantly, by flipping that coin around, the
"books and records" examination authority serves to
demonstrate the actual limits of the tax. If the examination
authority DID extend to ALL books and records, and without
probable cause or authorization as a side effect of choosing
to exercise a privilege, it could not co-exist with the
Fourth Amendment.
Since the examination authority DOES co-exist
with the amendment, the authority must be limited and arise
by agreement. These things can only be true if the tax
itself is limited and of the nature of an excise upon the
voluntarily-undertaken exercise of privilege.
NOTE III: I hope you all realize that being
able to use liberating information like this without
obnoxious and stressful push-back from ignorance or craft
rests on lots of Americans knowing it (which means lots of
Americans knowing the truth about the tax). There's a reason
why I say over and over and over: SPREADING THE WORD IS JOB
ONE!!
Get books and share them; forward
this page to everyone, over and over, all the time.
NOTE IV: I wonder if any educated filer has
ever hired H&R Block (or its like) to do his or her taxes?
It would only be done to create a teachable moment (or out
of curiosity), since otherwise it would just make the
preparation of the return expensive and time-consuming
compared to the typical 15-minute self-preparation. But it
would be interesting to learn whether the reaction of such a
person to the return information provided by an educated
filer was bland indifference, fascination or hostility...

A Touch 'O The Irish In Honor Of St.

THE FOLLOWING LETTER was found by a friend in
his attic a few years ago. I'm not sure it really expresses
much of today's traditional St. Patrick's Day mood, but I'm
not sure that today's tradition has it right, anyway. After
all, what St. Patrick is famous for is driving all the
snakes out of Ireland...
In any event, it's a fascinating glimpse into a
not too distant past, and it surely is Irish as all get
out...
March 24- In 1765,
Britain passes the "Quartering Act", requiring the American
colonists to house British troops. In 1882, the tuberculosis
bacterium is discovered. In 1900, New York City breaks ground
on its first subway project. In 1972, Britain imposes direct
rule over Northern Ireland. In 1989, the 'Exxon Valdez' spills
240,000 barrels of oil after running aground in Prince William
Sound, Alaska. In 1999, NATO attacks Yugoslavia.
Time, unfortunately, is on the side of the

Are You Having Trouble Spreading The
Word?
SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE
EXPECTED when you're trying to explain to someone that
everything they've been encouraged their whole lives to
believe about something as entrenched and significant as the
income tax is basically nonsense. So here's a way to help
cut through the resistance:
Ask your listener how he or she would react if
you were to show an announcement from the Commissioner of
Internal Revenue admitting that the tax doesn't apply to the
earnings of most Americans and is misapplied most of the
time because people don't understand how it works? Or how
about if you showed a ruling from the Supreme Court saying
the same?
Now you just have to explain that
you're going to show exactly those things-- but because
the state really doesn't want people to know this, these
things haven't been said quite as forthrightly as we would
all wish. It's going to take a bit more work to take these
admissions in than is sufficient for just reading a press
release. But it'll be worth the effort...

The recent 70th anniversary of the liberation of
Auschwitz was a reminder of the great crime of fascism, whose Nazi
iconography is embedded in our consciousness. Fascism is preserved
as history, as flickering footage of goose-stepping blackshirts,
their criminality terrible and clear. Yet in the same liberal
societies, whose war-making elites urge us never to forget, the
accelerating danger of a modern kind of fascism is suppressed; for
it is their fascism.
“To initiate a war of aggression…,” said the Nuremberg
Tribunal judges in 1946, “is not only an international crime, it is
the supreme international crime, differing only from other war
crimes in that it contains within itself the accumulated evil of the
whole.”
Had the Nazis not invaded Europe, Auschwitz and the
Holocaust would not have happened. Had the United States and its
satellites not initiated their war of aggression in Iraq in 2003,
almost a million people would be alive today; and Islamic State, or
ISIS, would not have us in thrall to its savagery. They are the
progeny of modern fascism, weaned by the bombs, bloodbaths and lies
that are the surreal theatre known as news.
Like the fascism of the 1930s and 1940s, big lies are
delivered with the precision of a metronome: thanks to an
omnipresent, repetitive media and its virulent censorship by
omission. Take the catastrophe in Libya.
In 2011, Nato launched 9,700 “strike sorties” against
Libya, of which more than a third were aimed at civilian targets.
Uranium warheads were used; the cities of Misurata and Sirte were
carpet-bombed. The Red Cross identified mass graves, and Unicef
reported that “most [of the children killed] were under the age of
ten”.
The public sodomising of the Libyan president Muammar
Gaddafi with a “rebel” bayonet was greeted by the then US Secretary
of State, Hillary Clinton, with the words: “We came, we saw, he
died.” His murder, like the destruction of his country, was
justified with a familiar big lie; he was planning “genocide”
against his own people. “We knew… that if we waited one more day,”
said President Obama, “Benghazi, a city the size of Charlotte, could
suffer a massacre that would have reverberated across the region and
stained the conscience of the world.”
This was the fabrication of Islamist militias facing
defeat by Libyan government forces. They told Reuters there would be
“a real bloodbath, a massacre like we saw in Rwanda”. Reported on
March 14, 2011, the lie provided the first spark for Nato’s inferno,
described by David Cameron as a “humanitarian intervention”.
Secretly supplied and trained by Britain’s SAS, many of
the “rebels” would become ISIS, whose latest video offering shows
the beheading of 21 Coptic Christian workers seized in Sirte, the
city destroyed on their behalf by Nato bombers.
Aren't you REALLY, REALLY glad YOU'VE
had the fortitude and clarity of vision to do
the only thing that will actually make a
difference by taking control of how much of YOUR WEALTH facilitates
government
misbehavior?
Now ask yourself this: Have I really done
all that I can to
urge everyone I
know to also stand up and act in the only way that will really bring
about change in my lifetime?
Even as ardent a statist as Abraham
Lincoln, in announcing his willingness to burn the Southern states to the ground in order to
keep them paying the tariff for the benefit of Northern interests in
his first inaugural address on March 4, 1861, paid at least lip
service to the Founders design of leaving control over the fuel
available to feed the fires Washington wants to light in the hands
of the individual citizenry when he said, "Doing this I deem to
be only a simple duty on my part; and I shall perform it, unless my
rightful masters, the American people, shall withhold the requisite
means..."

HAVE YOU EVER THOUGHT ABOUT THE FACT THAT the oath of office
required of everyone on taking up entrusted powers and
responsibilities in America is to the primacy of the
Constitution itself, rather than to some superior who interprets
the Constitution? Federal judges, for instance, each
take oaths swearing their personal allegiance directly to the People's
Law, and not to their institutional superior, the Supreme Court.
If the Framers had meant for the Supreme Court to be the arbiter
of Constitutional meaning and intent, or for it to do everyone
else's thinking for them, and take from them the moral
responsibility for their conclusions and behavior, the oath
sworn by federal officeholders would have (or at least, might
have) been written as "...to uphold and defend what the Supreme
Court tells me is meant by the Constitution." But they didn't.
Very much on the contrary, and in my mind very
deliberately, the Framers left full moral responsibility on the
shoulders of each office holder. Each officeholder must make his
or her own decisions as to what the Constitution provides and
requires, and is implicitly forbidden to foist
responsibility off on someone else. Thus, even if the Supreme
Court, and every other office-holder, for that matter, takes
position 'A' on an issue, any office-holder who concludes that
position 'B' is actually the right one must hew to that
alternate view, and act accordingly.
Sure, this has a tinge of anarchy to it, but that
was the Framers' perspective: power diffused as widely as
possible, which is only meaningful if everyone wielding power is
expected to have their own mind. What is the virtue of a diffusion of power if everyone in office is bound to sing from
the same hymnal?
By that same token, it is obvious that it is NOT
the job or responsibility of one branch of government to
facilitate another on an institutional level, either. Thus, it
is NOT proper for the Supreme Court, for instance, to stretch
for creative rationales and workarounds by which Obamacare can
be deemed Constitutional or un-hoist on the petard of its own
limiting language about state-based exchanges in the face of
state refusal to create those exchanges.
Quite the contrary, the Constitutional plan of
separately-minded but interlinked branches of the federal state
was meant to make each an anchor against the expansive
enthusiasms of any other(s). The Founders and Framers set a much
higher standard that that Americans should struggle along under
a "rule of law" bent and corrupted to accommodate legislative
and executive political ambitions.

CONTINUING IN THE SAME VEIN, it's recently been in the news that the Obama administration
is presuming an authority to ban
ammunition, an act
plainly forbidden by the Second Amendment. I wonder what the
ammo manufacturers and re-sellers will do if faced with a
serious push based on this presumption.
I wonder if they will consider that they are of The People, the fourth
branch of government, and are fully empowered and required to
come to their own conclusions about the meaning and purpose of
Constitutional provisions. I wonder if they will remember Jefferson's
observation going to this point, that, "A free people claim
their rights as derived from the laws of nature, and not as the
gift of their chief magistrate."

SINCE LAST JULY I HAVE BEEN CONTINUALLY
CATALOGING the seemingly endless illegalities resorted-to by
prosecutor and court in their struggle to engineer a guilty verdict
of my wife Doreen for the non-crime of resisting a blatantly
unlawful court order as part of the ignorance-tax-addict State's
desperate effort to suppress
CtC. As is true of virtually every State effort to resist or
attack
CtC,
those perpetrated against Doreen in this proceeding actually have
the effect of emphasizing the truth of what the State wishes nobody
knew, 'cause lying and cheating are only needed when attacking the
truth.
This week I had occasion to excerpt and highlight a
portion of the trial transcript recording both the lead prosecutor--
a DOJ Tax Division specialist-- and the judge herself explicitly
misrepresenting to the jury the words of 26 USC § 6020(b).
Those words of 26 USC § 6020(b) are, verbatim:
"If any person fails to make any return required by
any internal revenue law or regulation made thereunder at the time
prescribed therefor, or makes, willfully or otherwise, a false or
fraudulent return, the Secretary shall make such return from his own
knowledge and from such information as he can obtain through
testimony or otherwise.
Any return so made and subscribed by the Secretary
shall be prima facie good and sufficient for all legal purposes."
Holding that verbatim text of the statute in their own
hands, the DOJ prosecutor and the judge in turn, instead declared it
to say... well, what you can see for yourself
here.
Having reminded myself of this calculated evasion, I am
inclined to remind all of you of the significance of what the
government meant to obscure and evade with these "mis-statements". I

admission by the Sixth Circuit Court of Appeals).

HERE'S AN INTERESTING
TURN-- supporters seeking to buy space in the Detroit News to alert
the area community to what is scheduled to be done in its backyard
on April 9 with
this ad copy were told the paper would not print the following
portions, even in paid space for the content of which it
specifically, by printed policy, disclaims all responsibility:

retaliation against Doreen’s husband for his book, which clearly
defines the difference between taxable income and earnings that are
not taxable under the IRS Code. Though numerous attempts have been
made to discredit and suppress the book, especially through
deliberate misrepresentation of its contents by government
officials, nothing actually revealed in the book has ever been
disputed.
How low must our overlords, posing as government, go?
Even organized crime has a code of honor that they will do no harm
to the wives and children of their adversaries.
Apparently the "watch-dog" press really has become
nothing but a well-tamed lap-dog of the state. So much so that it
will even engage in censorship to protect the master from being made
to look bad,
however thoroughly documented the offense...

EARLIER THIS WEEK A READER SENT ME A LINK to this
(rather old) video
challenging the official narrative of the provocative events at the
Boston Marathon two years ago:
I don't know the truth about the Boston Marathon
events (and please, don't remind me that the surviving Tsarnaev
declared himself to have been involved once in trial and having to
plan a course leading to the best possible outcome in light
of a death penalty on the table; making such a declaration can be a
strategic decision, and further, whether it's true or not is
irrelevant to the question of who else might have been involved). But
the video reminds me of how much mature and well-grounded skepticism toward official narratives
exists in America.
The problem is that this mature skepticism
all-too-often is only able to find expression in the form of growing
anxiety. I want to reach out to those suffering from the stress of
this sound realization, while hindered by ignorance of where to find
purchase, with this:
SAY, HAVE YOU EVER GIVEN ANY THOUGHT to
what will happen when 30 million other Americans-- or even just 3
million-- learn what you
know about the "income" tax and begin following your example of
acting to protect your own interests and uphold the law?

Illuminating anniversaries of this week:
March 27- In 1836,
shortly after the successful siege of the Alamo, Mexico's
General Santa Anna orders the massacre of about 400 Texan POWs
captured during other clashes between the Republic of Texas
revolutionaries and the Mexican Army assembled at Goliad. In
1881, rioting over the promotion of temperance by the Salvation
Army grew so severe in Basingstoke, England, that troops has to
be called out in an effort to restore peace. In 1941, a coup by
officers of the Air Force topples the pro-Axis government of
Yugoslavia. In 1964, an earthquake registering at 9.2 on the
Richter scale struck Alaska-- the most powerful ever recorded in
North America before or since. Much of Anchorage was
destroyed. However, being left unhindered by FEMA, the city is
quickly rebuilt.

March 28- In 193, Roman Emperor Publius Helvius
Pertinax is assassinated by his Praetorian Guards, who then
auction the throne to the highest bidder (Senator Didius
Julianus). In 1834, the United States Senate censures President
Andrew Jackson for de-funding the Second Bank of the United
States (a central bank equipped to emit notes and extend credit,
somewhat anticipating the current Federal Reserve, and
responsible, during its 20-year existence, for a massive
real-estate price bubble and collapse). After the demise of the
bank, the United States experienced virtually zero inflation
until the Fed was instituted (with the exception of the period
during the War Between The States, when the Lincoln
administration issued its fiat "greenbacks"). In 1939, fascist
Francisco Franco takes Madrid in the Spanish Civil War. In
1979, the worst nuclear power plant accident in American history
occurs at the Three Mile Island reactor in Pennsylvania. No one
is hurt and no damage occurs.

Hendrickson is also a widely-read essayist on matters of
politics, public policy and law; many of these works are
collected in his second book, ‘Upholding
the Law And Other Observations’. He is a member of
Mensa; an
award-winning artist; and has paid his dues as a youth
soccer coach. He is a long-time political activist as
well, and has served as co-chair and platform convention
delegate of Michigan’s largest county Libertarian Party
organization; as a consultant to the National Right to Work
Foundation and Citizens for a Sound Economy; as a member of the
Heartland Institute; and as a member of the International
Society for Individual Liberty. He is a frequent
radio-show guest on stations across the country.
Hendrickson's business career has included nearly a
decade-and-a-half at the leading edge of the renewable-energy
industry, both as Director of Purchasing and Materials
Management and member of the R&D board at Starpak Energy
Systems, the mid-west's then-largest solar heating and
energy-recovery-and re-utilization company; and as founder and
president of AFJ Inc., a high-efficiency lighting design,
manufacture and installation firm.
Beginning in the mid-1990s and continuing for the twelve years
before his present full-time focus on the restoration of the
rule of law in America, Hendrickson directed purchasing
activities for the $84 million-a-year multi-family-housing
division of the Farmington Hills, Michigan branch of Edward Rose
and Sons, with responsibility for 18,000+ apartments, direct
supervision of 35 technicians and agents, and incidental
authority over several hundred divisional workers. He also
ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On
rather the other end of the spectrum, amidst these more mundane
pursuits Hendrickson co-founded and was the primary creative
force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan, with his wife
and two children. He is currently working on his next
book.
