More Victories For The Rule Of Law

Continued denial of CtC is, to put it bluntly, insane. Worse, it is harmful to liberty.

THE MOST RECENT VICTORY POSTED ON THESE PAGES BEFORE TODAY is a $39,126.29 refund issued on October 3, 2014. This refund was in response to an amended return correcting an original for 2010 in which more than $73,000 of routine earnings were mistakenly declared to be "income", and a tax of more than $34,000 was mistakenly "self-assessed", in exactly the fashion into which far too many Americans have been misled over the last 75 years.

The amended return-- which was accompanied by a straightforward cover letter explaining just what was being done-- corrected those numbers to $0s, and asked for a refund of the $34,850 paid-in as tax. Five months later, after some fussing and the diversion of some of the reclaimed money to what the IRS says was an outstanding balance of $772.84 for 2012, the CtC-educated American making this claim got his money back, with $3,428.61 in interest.

This stark $39K+ acknowledgement by the IRS of the correctness of CtC issued nearly eleven years to the day since the first such complete refund was issued in response to a CtC-educated filing, between which have been hundreds of thousands of others totaling billions of dollars steadily issued over that entire period after careful scrutiny by the tax agencies, and not just by the IRS but by dozens of state tax agencies as well (see about a thousand examples here). Some of these have even issued only after strenuous efforts to resist them by the tax agency involved.

During the entirety of this more-than-a-decade of massive and sustained acknowledgement, the government issuing most of these refunds has been engaged in a corrupt propaganda and disinformation campaign aimed at discouraging Americans from learning what has allowed all these folks to do all these astonishing things. The character of this campaign-- which even just a slightly-more-than-cursory examination reveals to be a series of hoaxes, frauds, evasions and the occasional outright attack on the integrity of the legal structure-- is itself a revelation and an emphasis of the truth it is designed to suppress.

AND YET, DESPITE ALL THE FOREGOING, there is ZERO media attention to CtC. Your average CPA knows nothing of it, or only what was read on some IRS or DOJ press release calculated to dis-inform. Your average attorney, tax specialist or otherwise, knows nothing of CtC, or the wide-ranging legal research and resources presented here.

I'm going to open this new year with some more victories, because it's a good note on which to launch 2015, and an especially good note on which to launch the start of another season of lies and truth. W-2s and 1099s are being prepared for littering the landscape by the end of the month, and everyone should be getting themselves in the groove for meeting that dark blizzard with a million points of light.

But before I present the heroes being honored here today, let me stay with that "million points of light" motif for a moment and urge you all to do what you can to see that every journalist, CPA and attorney-- as well as your friends, neighbors, and kin-- sees everything I wrote above about CtC before the month is out. Our battalion needs to become an army, and that's how it's done, and it really needs to be done without further delay (as I discuss in some detail in the article elsewhere on this page titled, 'Media Evasion Of CtC Must End, Now').

Meet Some Real American Heroes

These are folks who have gone into battle on behalf of YOUR rule of law-- without any big support structure, without any parades and pomp, and sometimes with no meaningful gain to themselves other than the satisfaction of knowing they've done the right thing in a good cause. Celebrate them, and tell your children: "This is what true patriots do!"

This camera-shot (and thus cropped) $31,488.67 check is a complete refund of all amounts withheld from Paul and Dorene during 2013 as federal income taxes, including nominal "federal income tax withheld", "Social security tax" and "Medicare tax", plus a bit of interest.

HATS OFF TO THESE HEROES, MY FRIENDS! It is with grown-ups like these, who learn the law and stand up for it, that the rot stops and the restoration of the republic commences.

Worse, CtC deniers are dangerously irresponsible. They are enablers of today's unbridled State through their effective endorsement of rank historical falsehoods about the purpose, meaning and effect of the Sixteenth Amendment and the taxing clauses of the US Constitution.

Ignorance of the true nature of the "income" tax has gagged, gutted and seduced-into-disgrace America's ministerial community. This must change.

The Great Deception, Part II

IN LAST WEEK'S CLOSE-OF-YEAR COMMENTARY, THE GREAT DECEPTION, I discuss, describe and illustrate the reliance of the enemies of liberty and the rule of law upon misunderstandings and fear in their campaign to disarm the American people against their predations. Today I want to touch a bit on some of the internal cognitive dynamics that either allow the campaign to succeed, or stop it in its tracks.

Regarding the cognitive dynamics that support the Statists' predations, I will address two: Awe and the appeal to the hind-brain; and the vulgarization of expectations.

As to the first, I'm sure everyone remembers the illusory "Oz, the Great and Powerful" created by the charlatan wizard in the classic film The Wizard of Oz: A huge, flaming head accompanied by a thunderous voice, high and remote in the splendor of a mighty hall, all calculated to overawe the observer and replace the rational, skeptical mind with the vulnerable irrational and reactive sub-mind.

The enemies of the law definitely rely upon the puffed-feather ploy to shut down the fore-brain and drive the target back to more primitive perspectives. That's what all the pomp and circumstance is for-- the grossly-oversized motorcades; the absurdly over-the-top security; the black robes and high seats; and all the other trappings of those who hope to be un-resisted in their exercise of power.

This practice of theatrical drama imbues the State with a divine aura in the eyes of many, making debate and justification of desired lawless practices unnecessary for those folks. Overawed Americans residing in their hind-brains take the righteousness of whatever is done by the Great and Powerful Oz as a given-- the only operating principle in their eyes is that the word of the State is self-validating. These are the folks to whom Nixon spoke when he said, "If the president does it, then it's legal."

But many other Americans are not so thoroughly conditioned or weak of mind. For them, there's another ploy used by the enemies of principle. This one might be described as the vulgarization of expectations.

What I mean by the vulgarization of expectations is the calculated disparagement and dismissal of commitment to principle, as though such commitment is childish and unrealistic. This is the fallacy animating the idiotic declaration, "The Constitution is not a suicide pact!" and others of the same sort which litter American history whenever State operators want to do something they are prohibited from doing.

A good example of this cheap Statist-serving sophistry is the use of the "Constitution is not a suicide pact!" line to defend conscription (by the Supreme Court in Kennedy v. Mendoza-Matrinez, 372 U.S. 144 (1963)) despite conscription being nowhere authorized by the Constitution, and being directly in conflict with what is found therein. As always in such cases, no ink is shed regarding the obvious fact that were America to actually be demonstrably in grave and imminent danger requiring a military response for her security, no draft would ever be needed, while if a draft IS needed to get Americans to turn out, the allegation of threat is plainly not well-supported. This is because the object here is not to plug an actual leak in the Constitutional shield-wall, but only to excuse a lawless act by the State.

Broadly put, this vulgarization of expectation implies that only a naive fool would really believe that adherence to principle is even a viable course of action in the real world, much less a desirable one. Under the sway of this cynicism, Constitutional prohibitions-- indeed, all laws-- become merely suggestions, or, at best, aspirations.

"No search or seizure without a warrant supported by sworn evidence of probable cause? Well, sure, whenever possible..." (see more on this here).

"No "taking" except for actual public use (as opposed to re-designated private use by which the local government captures more taxes)? A fine idea, but it would tie our hands and prevent us from properly serving the people..."

"Prohibition on torture? Well, of course no one wants to torture, but what if there's a ticking bomb to be found?"

"All powers not delegated are reserved? A lovely principle, and we honor it religiously. It's just that in not taking the rest of the Constitution quite so rigidly as a naive utopian might think we ought to, we find, interestingly, that there is precious little that has not been delegated to us, after all."

The vulgarization of expectations cognitive regime is the regime of the "living law". Principle, after all, is rigid and unyielding. When we are persuaded to view adherence to principle as unrealistic we are inevitably persuaded to view the law as "flexible", by which is meant, "the law has whatever meaning serves the interests of those wielding it." Since the interests of those wielding the law tend to be the interests of those who pay to put them in office, or those of the largest mob, the end result of the vulgarization of expectation is to pervert "the law" into merely the tool of the wealthy or the demagogue.

Clearly, we must resist the vulgarization effort and be champions of unyielding principle. The law only serves its true and critically-important purpose when it is predictable and properly-grounded. Happily, even when it has taken root in others, vulgarization and its evil effects can be defeated by individuals, one by one.

Media Evasion Of CtC Must End, Now

Time, unfortunately, is on the side of the well-funded disinformation specialists

OVER THE YEARS, I HAVE DEMONSTRATED FAR BEYOND RATIONAL DOUBT OR HONEST DISPUTE that for the last 75 years the income tax has been systematically mis-administered so as to capture far more revenue and from far more earners than it should and would were its actual statutory limits more broadly understood. I have further shown that this is not because of some quirk in the law being exploited by the IRS but solely because of the ignorance of the Americans to whom it ends up being misapplied.

People's ignorance is certainly being exploited by the IRS, of course. But as written, and as interpreted by the courts and the tax agency itself, the law is perfectly clear and entirely on the side of most Americans. Even while corrupt elements in the government have engaged in strenuous efforts to create a facade of opposition to what CtC reveals and thus shore up the ignorance regime  (such as is exposed here, here, here, here and here), and even while some folks are unfortunately targeted for annoying and sometimes protracted resistance to their claims before they are honored, nearly every person who simply learns how to stop the tax from being misapplied in his or her own case and acts accordingly has been enjoying proper acknowledgement and capitulation to the truth by federal and state tax agencies since 2003.

At the same time, I've also plainly shown that the collapse of the rule of law and metastasizing of the rogue State now threatening the well-being of every American (and possibly the entire world) coincides with, and results directly and exclusively from, the onset of the mis-application of the income tax in the early 1940s.

In short, I've shown the nature of the problem about which every non-state-coopted pundit steadily warns, and the nature of the solution to that problem. What's more, I introduce, highlight, and celebrate the tens of thousands of other American men and women who have also learned these facts and are leading the way down the only path to that solution.

NEARLY EVERY WEEK FOR NINE YEARS, I have shared my posts about all these things with all of you. For the last three years, I have copied those folks in the (purportedly) non-state-coopted media whose email addresses I believe I have.

At the same time, week after week the well-financed and much more influential enemies of the state-restraining, liberty-enhancing truth have steadily injected more and more noise into the ether in an attempt to drown out my signal. This means that the window of opportunity in which the liberating truth has a realistic chance to do its good work-- which it can only do by becoming widely known-- is finite and narrowing.

And yet every week the acknowledgements and desperately-needed signal-amplification offered by the purportedly-non-coopted media amount to... nada. Zero, zilch, radio silence.

This won't do. It also makes no sense-- unless my emails to these folks simply aren't getting through.

There are several reasons why my emails may not be making it. Some are as mundane as the possibility that they are being spam-filtered away from these folks' inboxes. It is known to me that, for instance, anyone on a pacbell, swbell or optonline server won't receive my emails-- these servers systematically (and apparently automatically, for reasons known only to their programmers) reject my emails as spam. There may be others that do the same without doing bounce-backs to me to let me know.

Then there are darker possibilities. As was posted here a few months ago in a letter from an educated American who works for the City of Los Angeles, while no other websites that might be described as "outside the box" are known to be so treated, access to losthorizons.com is blocked on the city's internet-capable computers. Wikipedia won't allow links to documents posted on losthorizons.com. Recent additions to the ongoing treasure-trove of revelations from the heroic Edward Snowden have awakened us all to the possibility of other knobblings of the same sort on a grander scale. It's also possible that some of these folks may simply have closed their own minds.

IN RESPONSE TO THIS PROBLEM, I am going to ask for everyone's help. Following is a short list of publicly-available alt-media-pundit email addresses which I have accumulated.

Because my emails do not seem to be making it through to these folks, I'd be grateful if you were to see if yours do. Compose your own thoughtful, courteous but plain-spoken entreaties and admonishments to these folks making clear to them that patriotic, activist and educated Americans are wondering why they are not contributing their voices on the side of the angels in this critically-important contest between State-serving myths and corruption and the liberating truth. Forward my emails to them, as well.

EXPECT RESISTANCE FROM THESE FOLKS! All of them are likely to think they already know all about the income tax, and will have opinions based on either some theories of their own or from the "tax honesty" community. Or they will be standard victims of "ignorance tax" mythologies.

These folks are also likely to imagine that they're just being told about another version of Irwin Schiff. Some will even reflexively resort to the troll sites and other noise generators maintained by the IRS and DOJ on the internet and fall prey to the fallacious notion that since I have been attacked by the government what I say must somehow be wrong, despite all the unambiguous evidence to the contrary. (This is as crazy as concluding that because John Kirkiaou and Chelsea Manning are in prison, and the government is salivating over the prospect of getting its prosecutorial hands on Edward Snowden and Julian Assange and Kangarooing them in as well, all the state crimes these folks revealed must not really have happened. But believe it or not, people can be that thoroughly conditioned to worship the State.)

 None of these folks will know a tenth of what you know about the tax. None of them will know a hundredth of what you know about CtC, its history, and the ferocious campaign to keep people like them from knowing the truth about it.

For one reason or another, I am unable to deal with this problem myself; your help will be greatly appreciated and may do much good. The email addresses are all offered with disabling formatting to protect against abuse from spiders, so to use them, please replace the "at" with @. By the by, if you have any other addresses of the same sort, please share them with me for addition to this list. (For instance, I have long sought an address for Paul Craig Roberts, whose work I esteem, and who seems to me a very likely ally in this fight, but who I am unable to contact, even through his website "contact form".)

Are You Having Trouble Spreading The Word?

SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance:

Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same?

Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort...

 Not really knowing what a Big Government fan is, but wanting to be liked by the
 teacher, all the kids raised their hands except for Little TJ.

A Graphical Contest

A picture is worth a thousand words...

I'VE GOT A CHALLENGE FOR ALL THE GRAPHIC ARTISTS OUT THERE! Due to the success of the "ignorance tax" scam, a simple dynamic is in place in America: Wealth is extracted from the millions taken in by the scam and moved into the US Treasury. From there it is doled out under one federal program or another to clients and cronies of the state-- the military-industrial complex; industries capitalizing on the massive welfare state apparatus; big agribusiness; the banksters; big education/indoctrination; prison industries; etc.

These beneficiaries of the tax scam then send back a dribble of the pelf to support and retain in office the political hacks who support and maintain the programs under which all that money goes into motion (which is still a very big dribble, since the pelf is doled out in torrential volumes, and a tiny fraction of that torrent is still a lot of money).

WHAT I'M ASKING YOU ARTISTS AND POWER-POINTERS AND VIDEOGRAPHERS FOR is your best effort at a graphical representation of this pathology, and then of the effect of cutting off the funding at the source-- that is, the effect of widespread understanding of the truth about the tax-- the later part of which would be best represented in stages for maximum illustrative value.

This could be a series of four or five .jpg images (one illustrating the dynamic as it now is, and then several showing the effect of cutting off say, 10% of the funding coming out of the peoples' pockets, then 30%, then 60%, then ending at the 20% or so that actually will be left when everyone once again accurately understands the tax). Or, it could be a video animation; or a Power-Point.

Give it your best shot, folks! Don't be shy.

Just Say No to GPS Tracking of American Cars and Trucks

Watch out — as the new year approaches the powers-that-be always unleash a new hoard of laws, rules and regulations. Already, we’re seeing another Orwellian idea re-emerge from its musty cave: The notion that drivers should pay an additional tax (they’ll call it a fee) based on how many miles you drive.

Causing a stir as far back as in 2001 when Oregon noticed that more fuel-efficient cars would impact gas tax revenue, politicians began to scramble to figure out how to use your driving as an excuse to take whatever money you have left in your wallet.

At least 18 states are now considering bills to do just this, and Oregon has initiated a pilot program. CBS News reports, “The Oregon pilot programs seeks to demonstrate whether a per-mile tax is a practical possibility. The state is finding 5,000 volunteers to pay 1.5-cents-per-mile tax instead of the 30 cents-per-gallon gas tax. Devices will report their mileage to the state. Other states are trying smaller pilot projects, including Nevada, Washington, Minnesota and California. The U.S. Senate passed a bill calling for a $90 million pilot project involving 10,000 cars. But the House leadership killed the bill after complaints from rural lawmakers that such a tax would unfairly penalize their constituents, who tend to drive farther than city drivers.”

It’s not just fairness that is at issue, it’s also about privacy. I contend this is a double-whammy by the government, which always wants to control two things: your money and your life.

SO TWEETED CYBERSECURITY EXPERT JEFFREY CARR, summing up the collapse of the US false flag project intended to pin responsibility for the Sony hack on North Korea. The point of the project was to build support for a government takeover of the internet, on the argument that this incident demonstrated that the internet is a legitimate foreign policy concern and is used as a weapon against 'merrikans by those axis of evil demons over in Eastasia.

Obviously, it's a lot harder to make a case for a takeover of cyberspace when hackers are merely disgruntled former Sony workers. So the US just lied about it.

The sad thing is, this is just business as usual for the United States (by which, as always on these pages, is meant the federal entity created by the US Constitution, not America or the people of the United States of America). And that's the takeaway here: the feds lie, constantly. If there is any way in which any given assertion-- or even just any implication drawn from federal behavior-- could support some ambition of the state or a part thereof, the default grown-up perception must be that the assertion or implication is false.


THIS WEEK A NEWLY-ELECTED MICHIGAN SUPREME COURT JUDGE TOOK OFFICE, complete with a special clerk tasked with reading aloud anything the new judge needs to know in order to do his job. The new judge is blind.

Richard Bernstein might well have a fine mind (although seemingly being of a socialist bent, so the jury is still out on that question). But he will never be able to see the expression on the face of anyone appearing before the court. He won't see facial tics, sweating, smirking or open-eyed honesty. He cannot browse the complete body of legal texts, and therefore will be under internal pressure to make do in his decisions without necessarily having seen everything actually relevant to a case or a decision. His accommodation of his limitations will influence other judges on the court toward shortcuts in their own research and taking of pains.

Bernstein's elevation to this position is a triumph for him personally, and for the transformation of American political culture as a result of the noisy and relentless "equality over all" advocates. But it is also a condemnation of the latter. Bernstein no more belongs on a court than I belong on the Detroit Pistons.

This is not in any way a criticism of the man personally (except in that he should not have let his pride or his pugnacity persuade him to overlook what I am here pointing out). But it is very much a criticism of the mindless notion of "equality-over-all-other-concerns" used as a vehicle by some demagogues for making their way into the spotlight. Bernstein is a perfect case-in-point for the fact that this notion means a lowering of standards, at everyone's expense. When the time comes that a pro basketball contest means ten 5'10" 59-year-old guys like me huffing and puffing up and down the court, blame Richard Bernstein and his mindless supporters.


SAY, HAVE YOU EVER GIVEN ANY THOUGHT to what will happen when 30 million other Americans-- or even just 3 million-- learn what you know about the "income" tax and begin following your example of acting to protect your own interests and uphold the law?

The political class thinks about it-- a lot.

You should, too, and add vigorous outreach to your activism.

How Can the People Save America from its Present Decline?

By scrupulously obeying the tax laws, and obliging others with whom they exchange money and labor to do the same.

Obeying the Letter and Intent of the US internal revenue laws will:

  • Dramatically reduce the federal revenue from income taxes, thereby obliging the federal government to shift its revenue reliance to lawful non-protectionist import tariffs. This will result in a market equilibrium that will boost domestic manufacturing jobs and slow the import of low quality goods from southeast Asia.

  • Oblige the federal government to shift its revenue reliance to apportioned direct taxes, based on the states' respective populations, and restore a much-needed political accountability to federal spending decisions.  (If you have been told by your CPA, accountant, or others that the federal income tax is a direct tax, excused from the apportionment requirement by the Sixteenth Amendment, then you have been lied to.  All relevant legal authorities, case law, IRS commissioners, and the internal revenue statutes at large clearly show that the federal income tax has always been an indirect tax.  More specifically, it is an excise tax on certain privileged activity with a federal connection.  For a detailed explanation with relevant legal citations, see http://losthorizons.com/Documents/The16th.htm)

  • Immediately result in an economic benefit for private citizens, who will be able to keep all earnings received in the private sector, while beneficiaries of federal privileges will continue to pay income taxes.

  • Improve the economic condition of each of the several state governments, as its private citizens, exercising their constitutional protections concerning their wealth, will be more able to sustain state-level programs that they wish to maintain.  Simultaneously, this will improve the general freedom and liberty of private citizens, as the federal government will no longer be able to improperly take wealth from the citizens and offer it back to the state governments with liberty-crushing strings attached.

  • Result in more robust, productive domestic and local economies, as capital remaining in the private sector will result in an improved standard of living, more efficient investment of capital, and burgeoning economic growth.

  • Right-size the federal government, limiting it to the size that the founders intended so that it will protect inalienable rights, instead of trampling these rights.

Illuminating anniversaries of this week:

January 14- In 1539, Spain annexes Cuba.  In 1639, the first written Constitution establishes a government in Connecticut.  In 1784, the Confederated United States of America ratify a peace treaty with Great Britain.  In 1954,  the Hudson Motor Car Company merges with Nash-Kelvinator to form the American Motors Corporation (AMC).  In 1967, the 'Human Be-In' happens in Golden Gate Park, San Francisco-- a prelude to the 'Summer of Love'.

Some Observations Regarding Educated And Accurate Filing

BASED ON MY OWN READING OF THE RELEVANT LAWS AND RULES, my own experience, and my own observations, I have come to the following conclusions. They may or may not have relevance to any particular person's situation, and of course everyone should make their own studies and come to their own conclusions. They are presented in no particular order, and I suggest everyone read through them all.

1. If "information returns" by a payer make what are believed to be erroneous allegations of the payment of "wages", "non-employee-compensation" or other revenue purportedly in connection with the conduct of an "income-taxable" activity, a filing intended to be true, complete and correct would seek to rebut the erroneous allegations and provide what the filer believes to be the correct amounts. This might be done by, for instance:

A. Attaching sworn statements specifically rebutting the errors on those forms with correct entries to one's 1040. Examples are Forms 4852 (to rebut and replace errant W-2s or 1099-Rs), or photocopies of errant original 1099-MISCs (or any other type of 1099 other than the 1099-R) with correct information replacing incorrect entries, and a sworn statement added declaring the instrument to be a rebuttal of an erroneous 1099-(xx) known to have been submitted by the listed payer.


B. Using the rebuttal instruments as replacements for the erroneous "information returns" and the correct information from the rebutting instruments to complete one's 1040. For instance, if one has received erroneous W-2s and has created a rebutting 4852, where a 1040 asks for "wages received" and says to attach a W-2, one would declare the "wage" entry from line 7(a) of the 4852, and attach that form instead of the erroneous W-2.

Instruments rebutting erroneous 1099s (other than 1099-Rs) are attached to the return by themselves-- that is, not with some kind of schedule-- unless one really IS operating some kind of tax-relevant business or other activity, and one is acknowledging having had SOME "trade or business" "income", but just a different amount than what was reported on the erroneous 1099.

 • If one engaged in no tax-relevant activities during the year there are likely no schedules that are appropriate for one's filing (unless, I suppose, one has something being carried over from a previous year in which something taxable WAS done...).

• If erroneous forms were included with a filing in which those erroneous forms are rebutted it would cause a contradiction in entries and make the return invalid and "frivolous", since everything included with a return is presumed to be attested to as correct by the filer.

• Failing to combine all amounts withheld as or for any kind of federal tax as a single figure on the line designated for "Federal income tax withheld", and/or failing to include and claim back any withheld amount while claiming back other amounts, is to create an apparent contradiction.

For instance, to report $0 "wages" and claim back amounts listed as withheld on a W-2 or 4852 as nominal "federal income tax" but to not also claim back amounts withheld as "Social Security tax" and "Medicare tax" would be to declare oneself to have not received "wages" as defined in 26 USC 3401(a) but to HAVE received 'wages" as defined in 3121(a). Since both designations of "wages" refer to the same receipts and activities which produce them (with the latter being merely a surtax on a portion of the former) the declarations are contradictory of each other.

The same contradiction would arise if one listed anything as "Excess social security and tier 1 RRTA tax withheld", while denying having received 3121(a) "wages". One can only have "excess SS tax withheld" if one has had "SS tax" properly withheld up to the amount at which anything further becomes "excess".

2. A return is NOT an appropriate document for making legal arguments of any kind. To include a cover letter explaining what is seen in the return (such as that erroneous "information returns" have been rebutted with instruments completed and attached for that purpose) does no harm, but this is neither the time nor the place to be making assertions about whether one is or isn't an "employee", arguments about the nature of the tax, and so forth. A return is just a statement of the amounts one knows and believes to be true, complete and correct in regard to each item inquired-about on the 1040, properly-understood as to its statutory meaning. It's neither a soap-box nor a legal brief; further, some kinds of arguments can actually invite a "frivolous" assertion.

3. Amounts improperly or erroneously collected, withheld, paid-in, what-have-you can only be claimed for refund looking back three years. On the other hand, rebuttals/corrections of erroneous assertions for their own sake, or as a response to collections efforts based on erroneous information returns, have no look-back limit. Learn more about both issues here.

4. Returns varying from (or attempting to supplement) the principles and points listed here, and/or reflecting notions not presented in CtC or on this site (exclusive of forum pages)-- such as adding "UCC" references to jurats, or otherwise marking-up or adding-to a return-- invite problems. I believe such variations are sometimes seen as reflecting an uncertainty (and therefore an insincerity) about one's filing, which can create a pretext for treating a return as "frivolous" and invalid. They also make one appear to be a soft target for harassment, ill-equipped to stand one's ground and deal competently with pushback, which is therefore more likely to be attempted.

5. Most all of the above has long been posted amongst much other useful material on the FAQ pages. Make a point of staying up to date with those pages, and everything linked from the Site Map!!

What Do The People Do About The Rogue State??

The most important question facing Americans today

THE ANSWER IS SIMPLE: The People impose restraint on the rogue state by choosing-- one by one-- to cease voluntarily turning control over their resources to the state, and choosing instead to retain control over those resources. This is done by refusing-- one by one-- to engage in "income tax" excisable activities (and refusing to blindly or fearfully allow their activities to be treated or taken as excisable activities upon which the tax arises, when they really are not).

The refusal of individual Americans to voluntarily engage in excisable activities forces the state to resort to highly-politically-accountable, highly-politically-vulnerable alternatives revenue sources. These include options like direct, apportioned taxes (which will not be tolerated by the people or approved by Congress at $multi-trillion annual volumes), and/or increased revenue tariffs (which can raise amounts adequate for legitimate state needs, but are very self-regulating, since consumers naturally choose domestic product alternatives when higher tariffs raise the prices of imports beyond a certain point).

This solution is precisely the one intended and provided for by the Founders-- who didn't impose the taxation rules in the US Constitution just so they could admire their handwriting. They put those rules in place in direct anticipation of state behavior of the sort with which we are now plagued.

 As even so odious a character as Hamilton pointed out in Federalist #21:

“Imposts, excises, and, in general, all duties upon articles of consumption, may be compared to a fluid, which will, in time, find its level with the means of paying them. The amount to be contributed by each citizen will in a degree be at his own option, and can be regulated by an attention to his resources. ...If duties are too high, they lessen the consumption; the collection is eluded; and the product to the treasury is not so great as when they are confined within proper and moderate bounds. This forms a complete barrier against any material oppression of the citizens by taxes of this class, and is itself a natural limitation of the power of imposing them.”

What we've got today is simply the direct (and perfectly predictable) consequences of NOT adhering to the Founders' plan. As Frederick Douglass trenchantly observed,

“Find out just what any people will quietly submit to and you have the exact measure of the injustice and wrong which will be imposed on them."

We've got plenty of injustice and wrong these days. But our fix to the problem was bought for us with blood a few hundred years ago.

All we have to do is stop playing along with the rogue state's false (and rather embarrassingly crude) paradigm  concerning who owns what, and what powers to tax have really been granted. As soon as enough of us quit endorsing that nonsense, it's all good

If You're Not Standing Up, Then You're Standing Down

...and "standing down" means "going down"...


MY FRIENDS, IT IS MY SINCERE BELIEF that this community of activists has been encouraged, inspired, enlightened and expanded over the years by the steady posting here of your ongoing victories on behalf of the rule of law. Certainly, it has been my pride and my joy to help you share with the world your honorable testament to the liberating truth about the tax, widespread knowledge of which is so critical to the well-being of ourselves, our children, and our beloved America.


However, unless YOU send those victories I can't post them. Unless YOU stand up, your courage and commitment can't inspire anyone.


YOU WILL RECALL THAT FOR THE LAST YEAR OR SO I've been telling you that we are in a transformational moment. Look around at what is going on today and recognize the truth of what I say.


More than half the American population views government as a threat. As mainstream a publication as Forbes magazine is posting articles about massive DHS ammunition and armored vehicle purchases. Denunciations of the NSA violations are features in every major MSM organ.


Even before Edward Snowden's documentation of particular crimes being committed against the American people the LA Times, NY Times, Washington Times and other mainstream organs were editorializing about Leviathan having grown too big, and gotten dangerously out-of-hand (see stories at each of the preceding links). In the Spring Rand Paul's filibuster denouncing the lawlessness of Mordor-on-the-Potomac prompted a major buzz across the country, and in July Justin Amash shocked Washington by very nearly defunding a huge portion of the illegal surveillance state's crimes.


Concurrently, this CtC community has been winning legal victories and refunds which are ever-more significant and telling. Consider, for instance, the victories which have qualified for the EWWBL collection. Every one of these is an especially illuminating acknowledgement of the truth about the tax, and now include a very significant two-time victory in a federal district court.


Things are happening!


HOW IT ALL SHAKES OUT is still up for grabs, though. This is not the time for either complacency or paralysis, because both of those don't amount to "doing nothing"-- instead they amount to "standing down". About The Author


Pete Hendrickson is possibly the most effective lawyer in history, even while never having set foot in a law school, nor ever being a card-carrying member of "the bar". He is the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes); further, since 2003 students of his legal analyses and arguments in ‘Cracking the Code- The Fascinating Truth About Taxation In America’ (CtC), and its sequel, 'Was Grandpa Really a Moron?' have been routinely retaining and recovering billions of dollars which otherwise-- wrongly, but as a matter of course-- would have gone to federal or state government treasuries. This despite concerted efforts by government to suppress his work, and in some cases vigorously oppose the claims by his students.


Hendrickson is also a widely-read essayist on matters of politics, public policy and law; many of these works are collected in his second book, ‘Upholding the Law And Other Observations’.  He is a member of Mensa; an award-winning artist; and has paid his dues as a youth soccer coach.  He is a long-time political activist as well, and has served as co-chair and platform convention delegate of Michigan’s largest county Libertarian Party organization; as a consultant to the National Right to Work Foundation and Citizens for a Sound Economy; as a member of the Heartland Institute; and as a member of the International Society for Individual Liberty.  He is a frequent radio-show guest on stations across the country.


Hendrickson's business career has included nearly a decade-and-a-half at the leading edge of the renewable-energy industry, both as Director of Purchasing and Materials Management and member of the R&D board at Starpak Energy Systems, the mid-west's then-largest solar heating and energy-recovery-and re-utilization company; and as founder and president of AFJ Inc., a high-efficiency lighting design, manufacture and installation firm.


Beginning in the mid-1990s and continuing for the twelve years before his present full-time focus on the restoration of the rule of law in America, Hendrickson directed purchasing activities for the $84 million-a-year multi-family-housing division of the Farmington Hills, Michigan branch of Edward Rose and Sons, with responsibility for 18,000+ apartments, direct supervision of 35 technicians and agents, and incidental authority over several hundred divisional workers.  He also ran the division's 10 cable television earth-station and distribution systems in four states, and designed and administered the company's website.


On rather the other end of the spectrum, amidst these more mundane pursuits Hendrickson co-founded and was the primary creative force behind a small board- and card-game company that enjoyed a modest success for several years.


 Hendrickson makes his home in southeast Michigan, with his wife and two children.  He is currently working on his next book.
