An Emphasizing Irony, Six Months Into This Make Or Break Year Marx observed that history repeats itself-- first as tragedy, then as farce. Karl, call your publisher! Here we have tragedy and farce all at the same time! THIS PAST THURSDAY WE SAID GOODBYE to Doreen's mom. A gratifyingly (and unsurprisingly) well-attended memorial service celebrated the life and mourned the passing of the feisty little Italian woman who bore my beautiful bride (and taught her much, including how to cook like an artist-- well done, Lorraine!). Lorraine's health had been poor for more than a year, and she was compelled to use a walker to get around. Perhaps due to the awkwardness of having to do so while recovering from a broken arm suffered in a previous fall, Lorraine fell again on May 17 and hit her head-- just eight days before Doreen was released from her second imprisonment for refusing to make false declarations of belief demanded of her by the government. A blood vessel burst in Lorraine's brain. Though she remained conscious for a few hours, and apparently wasn't even aware of the internal injury at the time, massive damage was taking place. Lorraine soon lapsed into a coma from which she never awoke. Kept alive for a week until Doreen was able to leave the prison and make it to her side one last time, Lorraine's life support was ended on Saturday, May 26, in keeping with her previously-made directive. Surrounded by her family, Lorraine then passed on within a matter of minutes, peacefully and painlessly. Lorraine Thompson was a good woman, and she will be missed very much. Her premature death is a tragedy. BUT LORRAINE THOMPSON'S DEATH is not the only tragedy in this tale. The greater tragedy lies in Doreen being kept from her mother during her last four months of life. Doreen had been caring for her mom during all of the six months prior to being thrown for a second time into a prison 550 miles away for refusing to make false declarations of belief at the government's command. She feared more than anything that something like this would happen while they were being kept from each other, and that it should have come to pass with barely a week of Doreen's unjust imprisonment remaining is a heart-wrenching underscore of the crime by which Doreen has been victimized. So, tragedy, indeed. BUT I MENTIONED "FARCE", AS WELL... Here it is: “[O]ne important manifestation of the principle of free speech is that one who chooses to speak may also decide ‘what not to say’ ” and “tailor” the content of his message as he sees fit. Id., at 573 (quoting Pacific Gas & Elec. Co. v. Public Util. Comm’n of Cal. , 475 U. S. 1, 16 (1986) (plurality opinion)). This rule “applies not only to expressions of value, opinion, or endorsement, but equally to statements of fact the speaker would rather avoid.” Hurley, supra, at 573. And it “makes no difference” whether the government is regulating the “creati[on], distributi[on], or consum[ption]” of the speech. Brown v. Entertainment Merchants Assn. , 564 U. S. 786, 792, n. 1 (2011). ... States cannot put individuals to the choice of “be[ing] compelled to affirm someone else’s belief” or “be[ing] forced to speak when [they] would prefer to remain silent.” [PruneYard Shopping Center v. Robins, 447 U. S. 74, (1980)], at 99. Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Comm’n, 584 U. S. ____ (2018) (Concurring opinion of Thomas, J.) (Emphasis added.) This Supreme Court opinion was issued one week ago, on June 4. That was just ten days after Doreen was released from a second imprisonment for "decid[ing] 'what not to say'", for refusing to be "compelled to affirm someone else's belief" (or alleged belief), and for asserting her right to not "be forced to speak when she would prefer to remain silent." And of course, this latest expression by the Supreme Court on the subject is only the most recent of an endless chain of 100% consistent rulings over the entire history of the USA. In fact, the same month Doreen was indicted in May of 2013 the court said this in a different ruling, again citing to many of its previous rulings saying the same thing: “It is, however, a basic First Amendment principle that “freedom of speech prohibits the government from telling people what they must say.” Rumsfeld v. Forum for Academic and Institutional Rights, Inc., 547 U. S. 47, 61 (2006) (citing West Virginia Bd. of Ed. v. Barnettei, 319 U. S. 624, 642 (1943), and Wooley v. Maynard, 430 U. S. 705, 717 (1977)). “At the heart of the First Amendment lies the principle that each person should decide for himself or herself the ideas and beliefs deserving of expression, consideration, and adherence.” Turner Broadcasting System, Inc. v. FCC, 512 U. S. 622, 641 (1994); see Knox v. Service Employees, 567 U. S. ___, ___–___ (2012) (slip op.,at 8–9) (“The government may not . . . compel the endorsement of ideas that it approves.”). ... “[W]e cannot improve upon what Justice Jackson wrote for the Court 70 years ago: “If there is any fixed star in our constitutional constellation, it is that no official, high or petty, can prescribe what shall be orthodox in politics, nationalism, religion, or other matters of opinion or force citizens to confess by word or act their faith therein.” Barnette, 319 U. S., at 642.” Agency for Int’l Development v. Alliance for Open Society Int’l, Inc., 133 S. Ct. 2321 (2013) (Emphasis added.) Four days after the October 20, 2016 denial of the petition to the same Supreme Court for review of Doreen's conviction for taking these pronouncements seriously, a federal judge in Texas offered her own summary of the most well-settled law in American jurisprudence: It is well settled that the First Amendment protects not only the right to speak but also the right not to speak. For this reason, government compulsion of speech has repeatedly been found to violate the Constitution. See Riley v. Nat’l Fed’n of the Blind of N.C., Inc., 487 U.S. 781, 797 (1988) (overturning law requiring fundraisers to disclose retained revenues to potential donors); Wooley v. Maynard, 430 U.S. 705, 714 (1977); W.Va. State Bd. of Educ. v. Barnette, 319 U.S. 624 (1943); see also Rumsfeld v. Forum for Academic & Institutional Rights, Inc., 547 U.S. 47, 61 (2006); Tex. State Troopers Ass’n v. Morales, 10 F. Supp.2d 628, 634 (N.D. Tex. 1998). ... Once First Amendment rights have been chilled, there is no effective remedy, and it is well established in the Fifth Circuit that infringement of First Amendment rights, standing alone, constitutes irreparable harm. See Texans for Free Enter. v. Tex. Ethics Comm’n, 732 F.3d 535, 539 (5th Cir. 2013) (“We have repeatedly held . . . that the loss of First Amendment freedoms, for even minimal periods of time, unquestionably constitutes irreparable injury.”) (and accompanying citations); accord Opulent Life Church v. City of Holly Springs, Miss., 697 F.3d 279, 295 (5th Cir. 2012). ASSOC'D BUILDERS AND CONTRACTORS OF SE TEXAS, et al. v. ANNE RUNG, Administrator, Office of Federal Procurement Policy, Office of Management and Budget, et al., EDT NO. 1:16-CV-425 (2016) Wow! What high-falutin' poetry and power! It sure appears that the courts stand tall on behalf of our right to control our own expressions, which is the very cornerstone of liberty! Sure does... Well... It DOES appear that way-- except where the "ignorance tax" gravy train is threatened. (Read this to learn how slapping Doreen around was rooted in the corrupt state's 15-year effort to suppress CtC.) Where a threat to power and perks of the political class is concerned, all that rhetoric becomes nothing more than patriot theater. It's all a farce when a cleansing wind starts to blow through the House of Cards. SO THERE WE HAVE IT: Tragedy and farce all in one single historical incident-- and it IS an historical incident-repetition for which invocation of Marx's maxim is suited. What's going on here is just the latest of an endless series of despotisms practiced or attempted by corrupt, power-mad men and women intent on imposing their will, and the law be damned. Those trying to suppress CtC are typical enemies of liberty and the rule of law, akin to every thug who has ever acquired an undeserved or unrighteous means to self-aggrandizement and luxury which he or she then does not wish to relinquish. They want to keep people from knowing the truth, and as good warrior and good friend, Willie Shields, recently put it, "It's not because we can't handle the truth; it's because the truth will enable us to handle them." Nothing changes where people like that are concerned, and this takes me to my intended message by way of this observation: ONLY THE FOUNDERS' DELBERATE AND CAREFUL STRUCTURE OF FEDERAL TAXATION AUTHORITY, BY WHICH INDIVIDUAL AMERICANS-- NOT PEOPLE IN OFFICE-- CONTROL HOW MUCH PRACTICAL POWER THOSE OFFICE-HOLDERS WIELD, WILL PRESERVE OUR LIBERTIES. Everything else is just squeezing a balloon or debating a witch. That structure and purpose of the Founders is explained here. Send it around. By this time tomorrow that webpage address should be appearing in thousands of your tweets, GAB posts, Facebook posts, newsgroup posts and emails, accompanied by an admonition to every viewer to click on the link and read the page. LET ME EXPLAIN SOMETHING to all of you who NEVER do what I just asked you to do. When I write an article for posting on these pages and put it on the losthorizons Facebook page and tweet it and GAB it and email it to the thousands of you in the larger state forums, and see it get only 10 or 12 retweets (max) and maybe a few score Facebook "likes" (max), I have to wonder why I and mine continue to absorb all this tragedy. I think about the fact that, like Doreen losing her mom in such tragic circumstances two weeks ago, I lost my dad halfway through my own kangaroo-court prison sentence. I hadn't seen his face for a year at that point, and it was another year before I could visit his grave or give my mother a comforting hug. I think about the fact that our kids spent two of their teenage years without a father at home, and two years as young adults without their mother. The more mundane aspects of all that my family has suffered would take pages and pages to lay out. All in all, I find myself remembering why I declared this past January that this has to be the year everyone steps up and does everything possible to awaken America to CtC's revelations. If not, I stop throwing more good years of the few I have left after those already apparently wasted. I'm not happy about staking out this position. I want liberty in my lifetime. But in light of the foregoing, perhaps you can understand that when I am not getting the amplification I need from every one of the thousands of people on behalf of whose liberty and rights I and mine have suffered, I wonder why I am bothering to write the articles and documents and analyses. PLEASE SPARE ME this internal conflict. Share what I ask you to share, as forcefully, persuasively and purposefully as I ask you to do it. Please. Don't worry about what those with whom you share the page will think of it. If they don't find it compelling, they are fools and not worth your worry. If they are not fools, you having shared it with them will have been well done, and will be appreciated, either right away or in time. How To Read State Tax Law It's simpler than many folks think, but also very important. I HAD OCCASION LAST WEEK to look up the tax statutes of Missouri. I'd heard from a warrior facing what appears to be a deliberate misconstruction of state law by an administrative tribunal trying to avoid issuing this good fellow's claimed refund. The filing involved was an early-education affair, which was unfortunately complicated by the inclusion with the 1040 and a 4852 of the W-2 which the other docs disputed. The state is pretending it has a lawful authority to "determine" the amount of "income" the filer received, seizing on the included W-2's "wage" allegations as its basis. In effect the state is saying that it is empowered to pick and choose what of the total information included in the filing it will recognize. Unsurprisingly, it is picking the allegations that provide it a rationale for keeping the filer's money. BUT IN FACT, the state's entire premise is wrong, if not corrupt. The only authority the state has is to determine how the tax rate applies to the amount of "income" reported by the filer. What is to be reported as "income" is independently established by state law, with no "determination" latitude for any administrative authority. Here are the state laws establishing what constitutes "income" for purposes of the state income tax authority: 143.111. Missouri taxable income. — The Missouri taxable income of a resident shall be such resident's Missouri adjusted gross income less: (1) Either the Missouri standard deduction or the Missouri itemized deduction; (2) The Missouri deduction for personal exemptions; (3) The Missouri deduction for dependency exemptions; (4) The deduction for federal income taxes provided in section 143.171; and (5) The deduction for a self-employed individual's health insurance costs provided in section 143.113. 143.121. Missouri adjusted gross income. — 1. The Missouri adjusted gross income of a resident individual shall be the taxpayer’s federal adjusted gross income subject to the modifications in this section. [This is followed by a series of specific additions, including federal tax refunds resulting in a Missouri tax benefit; certain kinds of interest; the amounts of two kinds of deductions a filer might have claimed on his federal form; and certain property tax amounts. A selection of available deductions that can be taken from the federal AGI is also provided in this section. See it all here.] So, as shown, under Missouri law a filer's "income" is determined by that filer when completing his federal 1040 and arriving at his federal AGI, subsequently subject to a few modifications, none of which include the addition of any pay-related amounts of any kind, whether qualified as "wages" or not. The section of state law establishing what the MDOR or any administrative tribunal is authorized to "determine" harmonizes with these specifications exactly: 143.611. 1. As soon as practical after the return is filed, the director of revenue shall examine it to determine the correct amount of tax. If the director of revenue finds that the amount of tax shown on the return is less than the correct amount, he shall notify the taxpayer of the amount of the deficiency proposed to be assessed. If the director of revenue finds that the tax paid is more than the correct amount, he shall credit the overpayment against any taxes due under sections 143.011 to 143.996 from the taxpayer and refund the difference. No deficiency shall be proposed and no refund shall be made pursuant to this or any section of sections 143.011 to 143.996 unless the amount exceeds one dollar. As plainly stated here, the director of revenue is empowered examine the return to determine the correct amount of tax, not the "correct" amount of "income" to which the tax should be applied. The preceding sections of law dictate what constitutes the correct amount of "income" to be used in calculating the correct amount of tax-- whatever appears as the filer's federal AGI. The same "determinations" statute commands the director to refund any overpayments. MOST STATE STRUCTURES are exactly like Missouri's. All that is needed to be on solid ground in dealing with evasive behavior is a little research that is invariably MUCH easier than the federal structure. Indeed, the bulk of most state structures is directly borrowed from the feds, with definitions, especially, simply declaring the meaning of terms as used in the state law to be the meaning given to the term by this or that specified federal statute. So being CtC-educated regarding the federal structure makes parsing out the state laws a piece of cake. SCOTT HANNON has cracked the wall in The Heart of Dixie. Scott has forced Alabama to acknowledge the truth about the income tax uniquely revealed in CtC and return every penny withheld from him during 2017 and given over to the state for income taxes it now has agreed Scott never owed. This first-time surrender by the state came not before some efforts to evade the truth-- In sharing this first victory in recovering everything, Scott reports having made his first efforts via amended returns for 2015 and 2016, which still have yet to be honored. But this original 2017 claim was answered respectfully by the state government just five weeks after being submitted. Consequently, the "Victory States" map has one of the very few remaining "not yet in compliance" states go green!
(By the way, anyone with unshared victories with any of the remaining five "in denial" states, get them to me, please! There should be no grey in the USA-- only green!!) Are You Having Trouble Spreading The Word? SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance: Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same? Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort... *****

***** About The Author Pete Hendrickson is possibly the most effective lawyer in history, even while never having set foot in a law school, nor ever being a card-carrying member of "the bar". He is the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes); further, since 2003 students of his legal analyses and arguments in ‘Cracking the Code- The Fascinating Truth About Taxation In America’’ (CtC), and its sequel, 'Was Grandpa Really a Moron?' have been routinely retaining and recovering billions of dollars which otherwise-- wrongly, but as a matter of course-- would have gone to federal or state government treasuries. This despite concerted efforts by government to suppress his work, and in some cases vigorously oppose the claims by his students. Hendrickson is also a widely-read essayist on matters of politics, public policy and law; many of these works are collected in his second book, ‘Upholding the Law And Other Observations’. He is a member of Mensa; an award-winning artist; and has paid his dues as a youth soccer coach. He is a long-time political activist as well, and has served as co-chair and platform convention delegate of Michigan’s largest county Libertarian Party organization; as a consultant to the National Right to Work Foundation and Citizens for a Sound Economy; as a member of the Heartland Institute; and as a member of the International Society for Individual Liberty. He is a frequent radio-show guest on stations across the country. Hendrickson's business career has included nearly a decade-and-a-half at the leading edge of the renewable-energy industry, both as Director of Purchasing and Materials Management and member of the R&D board at Starpak Energy Systems, the mid-west's then-largest solar heating and energy-recovery-and re-utilization company; and as founder and president of AFJ Inc., a high-efficiency lighting design, manufacture and installation firm. Beginning in the mid-1990s and continuing for the twelve years before his present full-time focus on the restoration of the rule of law in America, Hendrickson directed purchasing activities for the $84 million-a-year multi-family-housing division of the Farmington Hills, Michigan branch of Edward Rose and Sons, with responsibility for 18,000+ apartments, direct supervision of 35 technicians and agents, and incidental authority over several hundred divisional workers. He also ran the division's 10 cable television earth-station and distribution systems in four states, and designed and administered the company's website. On rather the other end of the spectrum, amidst these more mundane pursuits Hendrickson co-founded and was the primary creative force behind a small board- and card-game company that enjoyed a modest success for several years. Hendrickson makes his home in southeast Michigan, with his wife and two children.
