Even while knowing that their beliefs about the tax are derived entirely from the representations of those who profit from those beliefs (like tax bureaucrats and "tax professionals")?

Why "Originalism" Is Correct, And Matters

"Originalism and "textualism" are required legal doctrines for a true rule of law.

IT'S THIS SIMPLE: Without using for their Rosetta Stone the intent of the legislators-- as directly expressed in their words, read with the meanings they had at the time they were chosen-- courts are necessarily and inescapably making up the law as they go along. Pretensions of modern jurisprudence to the contrary notwithstanding, this is not an authority granted to the courts, and not within the authority of Congress to delegate.

Further, when the courts are not confining their application of the law to the words and intent of the lawmakers, the meaning and effect of the law-- what it prescribes and/or proscribes-- becomes a moving target. Knowing how to act within the requirements of the law is made into a guessing-game for all concerned, and the application of the law is made inherently arbitrary and capricious.

People cannot properly exercise their liberties, function as responsible and empowered citizens and effectively pursue happiness when they must guess at what the law commands (or when their law-- and they ARE the source of the law-- is subject to "evolution" by judges at the behest of executive-branch bureaucrats). How can any of these things be done when at any time the next court in which an issue arises can be persuaded by a government attorney to "evolve" a view of the law so as to give the state whatever outcome it prefers?

EVERY APPLICATION OF EVERY LAW must be exactly the same, every time. If new outcomes are desired, the law must be changed, but until and unless it is, its effect each time must be 100% what it was each and every time in the past.

This requirement is true for valid application of laws passed by Congress, and doubly true for valid application of the fundamental law by which Congress is created and granted its limited scope of authority for law-making. When Constitutional prescriptions and proscriptions are "fluid"-- or "living"-- then whatever they may be called, in truth they are merely the commands of whoever is purporting to "interpret" their meaning.

The People do not rule when Constitutions "live". When Constitutions "live", the scryers rule, and liberty and the true rule of law die.

THE SIMPLE FACT IS, "originalism" and "textualism" are fundamental requirements of Constitutionally-sound jurisprudence. The key purpose of our Constitutions is to restrain those in power, and they cannot and will not do so if those in power (whether elected or appointed) are "interpreting" the manner and degree to which they are restrained.

In fact, it is only when those wielding power find themselves hindered by the true meaning and intent of the Constitution, and the limits thus imposed, that the notion of "living" Constitutions arise.

Donald Trump's selection of "originalist" Neil Gorsuch as replacement for Antonin Scalia is a good call. The Supreme Court (and all the others) should have nothing but "originalists"-- all others embrace a judicial philosophy of despotism, pure and simple, and have no business being in a position of trust and honor in America. Indeed, every American should raise the hue and cry whenever anyone except an "originalist" is nominated for the judiciary, or for any other office.

George Will Offers Some Excellent Thoughts On This Subject

THE ONCE REGULARLY EXCELLENT and lately a bit less reliable George Will has had another peak performance moment with the following column on the flaws of Scalia's perspective-- and the much worse perspective of the usual run of Supreme Court justices over the last many decades-- as compared to the proper originalist view. Well worth reading:

Where Justice Scalia Went Wrong

With an asperity born of exasperation, Justice Antonin Scalia once wrote, “If you want aspirations, you can read the Declaration of Independence,” but “there is no such philosophizing in our Constitution,” which is “a practical and pragmatic charter of government.” Scalia was wrong, and much depends on Neil Gorsuch not resembling Scalia in this regard. Gorsuch can endorse Scalia’s originalism, construing the Constitution’s text and structure as it was understood by its Framers and ratifiers, without embracing Scalia’s misunderstanding of this:

There is no philosophizing in the Constitution -- until the Founders’ philosophy is infused into it by construing the document as a charter of government for a nation that is, in Lincoln’s formulation, dedicated to a proposition that Scalia implicitly disparaged as impractical and unpragmatic. The proposition is that all persons are created equal in their possession of natural rights, to “secure” which -- the Declaration’s word -- the government is instituted. In Lincoln’s formulation, the Constitution is the “frame of silver” for the “apple of gold” that is the Declaration. Silver is valuable and frames are important, but gold is more precious and frames derive their importance from what they frame.

The drama of American democracy derives from the tension between the natural rights of the individual and the constructed right of the community to make such laws as the majority desires. Natural rights are affirmed by the Declaration; majority rule, circumscribed and modulated, is constructed by the Constitution and a properly engaged judiciary is duty-bound to declare majority acts invalid when they abridge natural rights.

What REALLY Should Be Done About Muslim Terrorism

We've already been told-- long since...

Dear President Trump:

If you wish to do the very best that can be done to ensure the safety of Americans from the possibility of terrorism by refugees from Muslim states, here is what you do: END U.S. VIOLENCE IN THE MIDDLE EAST.

Announce to the world that while United States foreign policy has been in thrall to neo-con nutcases for the last few decades, and to their "intellectual" ancestors for the several decades before that, a new day has now dawned in America. Tell the world that henceforth, the United States will embrace and re-dedicate itself to the principles and wisdom laid out for us by George Washington:

"...nothing is more essential, than that permanent, inveterate antipathies against particular Nations, and passionate attachments for others, should be excluded; and that, in place of them, just and amicable feelings towards all should be cultivated. The Nation, which indulges towards another an habitual hatred, or an habitual fondness, is in some degree a slave. It is a slave to its animosity or to its affection, either of which is sufficient to lead it astray from its duty and its interest. Antipathy in one nation against another disposes each more readily to offer insult and injury, to lay hold of slight causes of umbrage, and to be haughty and intractable, when accidental or trifling occasions of dispute occur. Hence frequent collisions, obstinate, envenomed, and bloody contests. The Nation, prompted by ill-will and resentment, sometimes impels to war the Government, contrary to the best calculations of policy. The Government sometimes participates in the national propensity, and adopts through passion what reason would reject; at other times, it makes the animosity of the nation subservient to projects of hostility instigated by pride, ambition, and other sinister and pernicious motives. The peace often, sometimes perhaps the liberty, of Nations has been the victim.

"So likewise, a passionate attachment of one Nation for another produces a variety of evils. Thomas Jefferson:

"About to enter, fellow-citizens, on the exercise of duties which comprehend everything dear and valuable to you, it is proper you should understand what I deem the essential principles of our Government, and consequently those which ought to shape its Administration. I will compress them within the narrowest compass they will bear, stating the general principle, but not all its limitations. Equal and exact justice to all men, of whatever state or persuasion, religious or political; peace, commerce, and honest friendship with all nations, entangling alliances with none;"

James Madison:

"Of all the enemies to public liberty war is, perhaps, the most to be dreaded, because it comprises and develops the germ of every other. War is the parent of armies; from these proceed debts and taxes; and armies, and debts, and taxes are the known instruments for bringing the many under the domination of the few. John Quincy Adams:

Tell the world, "We wish you all well, but it's time for you all to "suit-up" and step up, because our century of madness is over. Don't mess with us, and we won't mess with you; see you in the marketplace."

Word To The CtC Community

BREXIT. DONALD TRUMP elected to the White House. The Cubbies taking the World Series. A Clinton or two on the road to prison.

Does anyone still doubt that we are in a transformational moment? Don't doubt it. We are.

The status-quo house of cards is reeling and rocking like it has not done even once for a moment in the 75 years of systematic, institutionalized misapplication of the income tax. Now is the time to stand up and make things happen, people.

I URGE YOU ALL to re-visit and re-read the words posted here. Do what you are asked to do there.

Visit this page, too, and go full-bore at spreading the word directly.

It IS a transformational moment. It's a Restore the Republic moment. The principles of CtC are a necessary component of that restoration, and it is up to us to see to it that this is understood across America.

The bad guys are reeling and rocking. The good guys need to get rocking and rolling.

So, Did You Fear A President Clinton? Do You Fear A President Trump?

You ought to dread either one...

IF THERE HAS BEEN ONE POSITIVE CONSEQUENCE of this latest election cycle, it is that a whole lot of Americans have been awakened to the fact that power in the hands of public officials is dangerous! Whether one's choice of the lesser evil might be, Clinton or Trump, the other evil on offer has starkly painted into his mind the perils of modern state power falling into undeserving hands.

Generally, in past elections, opposition to the "other guy"-- the pick preferred by other folks but not you-- has hinged on policy issues. Though sometimes heatedly defended or assailed, and though often concerning important matters, the issues have generally been taken at one or another level of "academic" consideration.

This year "position" and "opposition" have been on a self-preservation level. Whether you're for Clinton or Trump, you view the choice as one on which your very survival might depend.

Being unable to tell today how it's going to turn out in December (when the actual election takes place), everyone has experienced a very cold feeling in the pit of the stomach from the thought that it might go the wrong way. That feeling of imminent dire peril is the gift of the remarkable 2016 presidential race.

This year, for the first time, a lot of Americans are really, truly learning that to facilitate the near-Satanic power of the unrestrained state is to hang a Sword of Damocles over their own heads, and those of their children.

As P.J. O'Rourke wittily and accurately said, "Giving money and power to politicians is like giving whiskey and car keys to teenage boys." I'll add what is clearly implied but what I suspect many folks hadn't really realized until this year-- you and your kids are strapped into the back seat of that car.

SO, LOTS OF FOLKS ARE REALLY GETTING THE MESSAGE FOR THE FIRST TIME that power in political hands is bad, stupid, dangerous. What we in the CtC community must do is help these folks-- our friends, family and acquaintances-- recognize the necessary solution to this now-understood grave threat: STOP GIVING THEM THE GAS!!!

We in the CtC community must seize the moment. We must make a big push right now to show those about whom we care that it is their right and their duty to learn and declare the truth on every tax-related instrument they sign.

At the same time, we must show those we love that learning and declaring the truth on every tax-related instrument-- and thereby cutting off the excessive fuel-supply to the state-- is their only real hope for safety. Otherwise there will always be a Leviathan plenty big enough to destroy them at best waiting in the wings for one dicey election to go the wrong way and bring the nightmare to life.

A NUMBER OF YEARS AGO a statist thug made the observation that a crisis should never be allowed to go to waste. In his case he meant that a crisis should be used to grow the state and fasten it ever-more firmly on the American people.

But that sword cuts both ways. This time, how about the good guys capitalize on the crisis and use it to shrink the state?

Let's not forget, the "Cracking the Code" community has always also been the "Restore the Republic" community. So, CtC2RtR (#CtC2RtR)! That has a nice ring to it, doesn't it?

The Biggest Snow-Job In World History: The Myth That 1913 America Adopted A Marxist Progressive Tax On "All That Comes In"

February 15- In 1898, the USS Maine explodes in Havana Harbor, Cuba, providing a pretext for the United States to declare war on Spain.  In 1933, an assassin bungles an attempt to shoot FDR during a speech in Miami, Florida, but does shoot and fatally wound the mayor of Chicago, who was in the car from which the president was speaking.  In 1946, ENIAC, the first general-purpose electronic computer, is unveiled.  In 1971, the first celebration of Washington's Birthday takes place on the third Monday of February, rather than the actual anniversary of February 22. Although Lincoln idolaters have sought to mischaracterize the new schedule as somehow making the occasion a combined celebration of Washington and Lincoln, the holiday is still officially dedicated exclusively to Washington's Birthday.  In 1989, the Soviet Union announces that all its troops have left Afghanistan.  In 2003, protests against the impending U.S. invasion and occupation of Iraq take place in 800 cities worldwide.  BBC News estimates the participation of between 6 and 10 million people in what proves to be the largest peace demonstration in history.  The Bush administration pays no attention...  In 2005, YouTube is launched.

 

PRO TIP: If I were the IRS and I wanted to discourage people from rebutting allegations that they had done things I can tax, and keep them from successfully reclaiming withheld or paid-in money, I would salt the "tax honesty" community with passionate-seeming "legal researchers" who would warn anyone whose ear they captured that filing a 1040 is a bad idea for one reason or another.

Regarding Trolleries

(Deceitful efforts to discourage Americans from learning the truth about the "income tax")

 

The plane that gets the most flak is the one that's right above the target.

FOR ALL THE YEARS SINCE 2003 when CtC was first published, the government has engaged in a concerted effort to frighten people away from its truths. This effort involves official government websites and press releases touting an occasional court ruling that appears to be at odds with some CtC-revelation (but without details sufficient to expose the real substance of the ruling)-- and sometimes even more mendacious behavior.

Tim Kendrick has posted a video on YouTube regarding donations. I didn't know what to do about it to begin with; I don't do what I do intending for anyone to feel obligated in any way.

But of course, no one IS obligated. I will continue to make my work freely-available here, and in my books for only the cost of a cheap paperback.

Thus, even though I post it here below, Tim's very thoughtful personal resolution and encouragement to others is just an invitation for consideration by those who may not be conscious of the fact that I can't do what I do without support. No one is to feel any pressure from it; if it moves anyone to act let it be solely because it seems right.

Why Does The Government Lie About 'Cracking the Code'?

Accompany your emails and posts with with a strong admonishment to watch the film through, and that doing so will show the viewer an individual-empowering, state-restraining truth about the income tax which the government has been trying to keep hidden from view for 75 years and which that person really needs to know.

Two Simple Questions For Every Silent "Alt-Media" Journalist

The silence of these folks is the liberation bottleneck. Maybe this'll help, if enough people ask...

HERE'S A SIMPLE QUESTION: The income tax is, and always has been, an excise tax on privilege. This is established beyond any controversy whatever by repeated Supreme Court rulings, the words of the related laws, and, since 2003, by hundreds of thousands of acknowledgements by federal and state tax agencies.

You, like most folks, have been fooled into inadvertently agreeing that your economic activities are exercises of privilege, thereby allowing the tax to be applied to your earnings. Why is this so hard for you to admit?

HERE'S ANOTHER SIMPLE QUESTION: You and everyone else being fooled into agreeing that your economic activities are privileged and thereby allowing them to be taxed is what enables the flow of wealth that finances all the bad things done by the state of which you complain in every column. Why is this so hard for you to admit?

I GUESS THESE ACTUALLY LEAD TO A THIRD SIMPLE QUESTION: If you really feel that all these things of which you complain are so bad, why are you not helping more Americans understand the true nature of the tax and the ill effects of it being misunderstood and misapplied?

PRO TIP: By the physics of the law, an indirect tax is necessarily a privilege tax. Here's why:

The distinction between a direct tax and an indirect tax is incidence. A direct tax arises by the direct imposition of the taxer, without any election of the taxed (other than that of authorizing the taxing power in the first place).

An indirect tax arises by the taxed choosing to to to to do something by which the taxer's claim is then created. The choice that is a valid object of an indirect tax can't be anything done as an exercise of an untaxable right. Nor can it be any activity of necessity. A tax on anything done by necessity would arise not by actual election of the taxed but simply because the tax had been imposed by the taxer. Such a tax, whatever it may be called, would be in actual substance a direct tax, even if one that arose only intermittently. Think of a tax on eating, for example, or working, or engaging in trade with others (all of which are things done by right as well as by necessity, but you get the point).

What is left as the valid object of an indirect tax is the exercise of privilege-- something done not by right, and therefore done by the permission of the taxer (who, due to being possessed of an ownership right in the thing being permitted, is entitled to claim of portion of the proceeds when the thing is profitably used).

"[Although the Legislature may declare as privileges and tax as such for State revenue purposes those pursuits and occupations that are not matters of common right], the Legislature has no power to declare as a privilege and tax for revenue purposes occupations that are of common right."

The 'Watching the Watchmen Amendment'

If you're not talking this one up everywhere and helping generate a buzz, you don't really want liberty and the rule of law...

 

PRO TIP: The argument that a concept explicitly given a statutory definition for purposes of this or that chapter or "title" has the same meaning as the common word the legislature has borrowed for its label-- which meaning plainly didn't suit the legislature's purposes, hence its replacement-- is a preposterous reading of the law.

“It is axiomatic that the statutory definition of the term excludes unstated meanings of that term.” 

Meese v. Keene, 481 U.S. 465 (1987);

“[W]e are not at liberty to put our gloss on the definition that Congress provided by looking to the generally accepted meaning of the defined term.”

Tenn. Prot. & Advocacy Inc. v. Wells, 371 F.3d 342 (6th Cir. 2004).

 

 

In light of the actual evidence, , those who doubt or deny the accuracy and correctness of CtC just because government officials make weaselly representations against it are like the 16th-century Europeans who were mystified by Copernicus getting all those astronomical predictions right even though the church had said he was wrong.

Are You Having Trouble Spreading The Word?

SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance:

Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same?

Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort...

 Trump's Fortress America is rooted in the Obama years

The Trump administration has the media and its political opponents (or do I repeat myself?) in a lather as the White House continues to fire executive orders in quick succession, demolishing the old order and enraging both liberals and their newfound neoconservative allies. Amid all the virtue-signaling hysterics, the most significant aspects of what is occurring are being overlooked – and it’s my job to point them out.

While the blue-state crowd is protesting President Trump’s order banning travel to the US by citizens of Iran, Iraq, Syria, Sudan, Libya, Yemen, and Somalia, what gets lost in all the shouting is that the legal and political basis of his order was laid down by President Barack Obama. These people don’t care to recall that, in 2013, Obama banned all refugees from Iraq for six months, and his action was hardly noticed: Trump is only proposing a ninety-day pause. What prompted Obama’s action, as ABC News reported at the time, was “the discovery in 2009 of two al Qaeda-Iraq terrorists living as refugees in Bowling Green, Kentucky — who later admitted in court that they’d attacked U.S. soldiers in Iraq.”

Two years later, Congress passed a law, the Visa Waiver Program Improvement and Terrorist Travel Prevention Act, that restricted travel visas for citizens of “states of concern,” i.e. Syria, Sudan, Iraq, Iran and “any other country or area of concern.” Obama promptly signed it. In early 2016, the Department of Homeland Security unilaterally extended these restrictions to Yemen, Libya, and Somalia. What this meant was that the visa waiver program did not apply to citizens of these countries: travelers had to apply for a visa at US embassies, a highly problematic matter (Syria, for one, has no such facility) and were very unlikely to be successful in their efforts. I don’t recall any protests at the time.

In short, the legal and political basis of Trump’s executive order – which is being denounced as an unprecedented attack on our allies (Iraq), civil liberties, and decency itself – was laid during the previous regime. Trump has simply dispensed with the fiction that these travelers are welcomed by our government, and issued an ostensibly temporary outright ban.

February 18- In 1841, the first filibuster begins in the United States Senate.  It will last until March 11.  In 1885, 'The Adventures of Huckleberry Finn' is published.  In 1930, Pluto is discovered.  In 1930, a cow named Elm Farm Ollie makes the first bovine flight in a fixed-wing aircraft.  In 1943, the members of the White Rose anti-Nazi movement are arrested in Germany.  In 1979, snow falls in the Southern Algerian portion of the Sahara Desert.  In 1991, the IRA explodes bombs in Paddington Station and Victoria Station in London.  In 2014, the US-instigated coup by neo-Nazi factions in Ukraine against the existing elected government, which was balking at following a US-charted foreign-policy course calling for distancing itself from Russia, began to boil into its final days.  Mysterious sniper fire indiscriminately killed both police officers defending the government and rioters whipped up by the plotters of the coup amidst steady, increasingly violent clashes between the two sides.  Scores are killed and hundreds wounded.

About The Author

 

Pete Hendrickson is possibly the most effective lawyer in history, even while never having set foot in a law school, nor ever being a card-carrying member of "the bar". He is the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes); further, since 2003 students of his legal analyses and arguments in ‘Cracking the Code- The Fascinating Truth About Taxation In America’’ (CtC), and its sequel, 'Was Grandpa Really a Moron?' have been routinely retaining and recovering billions of dollars which otherwise-- wrongly, but as a matter of course-- would have gone to federal or state government treasuries. This despite concerted efforts by government to suppress his work, and in some cases vigorously oppose the claims by his students.

 

Hendrickson is also a widely-read essayist on matters of politics, public policy and law; many of these works are collected in his second book, ‘Upholding the Law And Other Observations’.  He is a member of Mensa; an award-winning artist; and has paid his dues as a youth soccer coach.  He is a long-time political activist as well, and has served as co-chair and platform convention delegate of Michigan’s largest county Libertarian Party organization; as a consultant to the National Right to Work Foundation and Citizens for a Sound Economy; as a member of the Heartland Institute; and as a member of the International Society for Individual Liberty.  He is a frequent radio-show guest on stations across the country.

 

Hendrickson's business career has included nearly a decade-and-a-half at the leading edge of the renewable-energy industry, both as Director of Purchasing and Materials Management and member of the R&D board at Starpak Energy Systems, the mid-west's then-largest solar heating and energy-recovery-and re-utilization company; and as founder and president of AFJ Inc., a high-efficiency lighting design, manufacture and installation firm.

 

Beginning in the mid-1990s and continuing for the twelve years before his present full-time focus on the restoration of the rule of law in America, Hendrickson directed purchasing activities for the $84 million-a-year multi-family-housing division of the Farmington Hills, Michigan branch of Edward Rose and Sons, with responsibility for 18,000+ apartments, direct supervision of 35 technicians and agents, and incidental authority over several hundred divisional workers.  He also ran the division's 10 cable television earth-station and distribution systems in four states, and designed and administered the company's website.

 

On rather the other end of the spectrum, amidst these more mundane pursuits Hendrickson co-founded and was the primary creative force behind a small board- and card-game company that enjoyed a modest success for several years.

 

Hendrickson makes his home in southeast Michigan, with his wife and two children.  He is currently working on his next book.
