Click here for more information *** The First Federal Victory Of 2019! A full-bore admission by Uncle Sam, even while attempting a lame and transparent dodge. VERMONT WARRIOR JAMES LAMBERT has shared what appears to be the first CtC-educated victory issued by the feds in 2019. This victory is over a filing for 2017, of course-- it is still too early for any filings concerning 2018 to have yet been processed, or likely even to have been filed. James' victory, dated January 7, 2019, features a 100% surrender to his filing in the key respects of $0 "income" received; $0 tax owed:
Obnoxiously, this 100% admission of no income/no tax owed is accompanied by a government attempt to keep a good chunk of what was withheld from James anyway, as shown here:
The actual total withheld from James and reported on line 7 of his return is 4,010.71. This is the accurate total of all federal withholdings reported on James' form 4852 (and something clearly known by the IRS, because the $1,348.67 shown on the IRS notice above is exactly what James had entered on one of the three federal tax withheld lines on his 4852). See James' filing here. The feds are proposing to keep $2,662.04 of James' money-- the total withheld under the provisions of Chapter 21 of 26 U.S.C.-- while having admitted that James did nothing for which he could owe such taxes. This admission is made both by the government's black-and-white statement shown above and by its agreement that everything withheld from James under the provisions of Chapter 24 of 26 U.S.C. are an "overpayment" which must be refunded. Remember, withholding under the Chapter 21 provisions is based on the same alleged taxable activities as withholding under the Chapter 24 provisions. So in admitting that no activities validating the latter took place, the feds admit that none validating the former have taken place, either. SO, THE FEDS ARE PROPOSING that James just take a chunk of what belongs to him (plus interest):
...while they keep the rest, and for no reason whatever. It appears to just be a matter of, "We've already got your money, and you should take this deal because we might just drag our feet coughing up the whole amount, and in the meantime you won't have any of it... Nyah, nyah, nah!" (See the whole admission/refund notice here.) This puts me in mind of the "civil asset forfeiture" game practiced in some cases, where police departments make offers to victims of their scheme to "buy back" their stolen property at a price calculated to be less than cost and trouble of going through the legal hassles of recovering it outright. ANYWAY, JAMES ISN'T HAVING any of it. This guy is the real deal, as made clear by his note to me when sharing these docs:

Some Thoughts About The INF Treaty Self-serving Deep State corruption endangers and impoverishes us all. HERE WAS THE KEY VIRTUE of the Intermediate Nuclear Forces treaty (INF): It served as an artificial buffer zone, allowing the USSR to keep US nuclear missiles at a 3,000 mile arm's length without actually having to occupy or control enough surrounding territory-- in Europe, especially-- in order to do so directly. That is, the US has natural buffers by way of two oceans, east and west, and compliant neighbors to the north and south. The USSR (and later, Russia) maintained the integrity of these buffers, having no beachheads closer than many thousands of miles from serious US targets. The USSR (and now Russia) had, and has, no such natural buffers to the west and south, nor much to the east, and in fact, has been repeatedly invaded from the west by countries now allied with, or puppets to, the US. Further, the US had (and has) established military bases throughout Europe (and, at the time, Turkey) in which unlimited firepower could be placed under US command and control. While permitted intermediate-range nuclear missiles, these near-Russian-abroad US weapons emplacements represented the threat of practically-zero-warning attacks on Russian targets, with Russia possessing no countervailing capacity. The only non-INF solution for achieving parity (and the stability and safety of the Mutual Assured Destruction (MAD) such parity provides) would be for Russia to push US emplacements back several thousand miles by occupying that much buffer territory in Europe. The INF (which was purely and very deliberately a bi-lateral treaty between the USSR and the US, excluding all Western European participants and security concerns) prevented the US from having such missiles (which, in practical terms, meant preventing missile emplacements within the treaty-designated range). This provided for Russian security from the unbalancing threat and restored the stability and safety of MAD. The alternative was the world at risk from a necessary hair-trigger Russian nuclear footing at all times, and/or Russian development of a corresponding encirclement of the US (which would have both nuclear powerhouses on a hair-trigger at all times). So, the INF treaty was good and important, restoring the critical parity between nuclear superpowers on which the continued survival of the world depends. BUT BY THE EARLY 21st Century, neo-con nutcases who had slithered into positions of power in the US had decided that parity and stability weren't good enough. They wanted US hegemony. They wanted to rule the world (or see it burn-- sometimes it's hard to tell). So, in 2002 the US unilaterally abrogated the 1972 Anti-Ballistic Missile treaty. This was the one that strictly limited measures intended to intercept and defeat incoming long-range ballistic missiles-- again for the purpose of maintaining the MAD-required parity on which world security from nuclear holocaust relies. The danger of anti-ballistic missile systems is that a side that has built them and is crazy-enough to rely on them will be willing to consider a first-strike (which is to say, willing to use nukes against another nuclear-armed people) based on the calculation that the ABM system will defeat the adversary's retaliatory strike. Denied such systems, neither side will ever use its nukes because to do so is suicidal, even if the first-strike is "successful". But the neo-cons then in power in the US DID (and DO) want to use their nukes. THWARTED BY THE INF from menacing Russia with first strike capability based on being on Russia's borders with nuclear-armed cruise missiles barely 200 miles from Moscow itself and possibly able to destroy retaliatory capacity before it ever left the siloes, the neo-con nutcases running the show by 2002 dumped the ABM treaty. They placed their hegemonic hopes on developing an anti-ballistic missile capability, deeming it just about as good (if you ignore the fact that destroying incoming nukes would salt the atmosphere and eventually everything else with radioactive debris). Slim Pickens was back in the saddle again! But then those evil Russkies screwed things up. They developed hyper-sonic warhead delivery vehicles incapable of being intercepted by any currently-conceivable technology. The US abandonment of the ABM treaty was suddenly a dead-end. SOME MIGHT HAVE BEEN PROMPTED to a wake-up moment by Russia's technological feat in developing these really quite remarkable solutions to the relentless US aggressions. Some might have shaken their heads, come to their senses and breathed a sigh of relief that they had never quite managed to have their crazy way. At the same time, some might also recognize that even these hyper-sonic, unstoppable weapons are based far from the US, providing plenty of time for a US retaliatory strike to be launched should the occasion arise. Thus, even these spooky-fast Russian missiles are not first-strike weapons. But not the neo-cons. Thwarted in their last workaround of the thwarting of their prior first-strike threat design but undaunted in their hegemonic lusts and fantasies, they now dump the INF treaty. The idea is to resume the close-quarters deployment strategy which the INF had prevented by virtue of the careful, grown-up labors of Ronald Reagan and Mikhail Gorbachev. The Russian response to that-- which again raises the idea, at least, of first strike capable of such rapid effect as to possibly prevent even lightning-quick Russian-based retaliatory weapons from ever leaving the siloes-- will likely be the deployment of their own missiles at locations ever-closer to the US, even possibly the encirclement of the US with ship-mounted hyper-sonic missiles. However, the details are irrelevant. What IS relevant is that this entire business-- an increasingly costly and very much increasingly perilous arms race-- is the responsibility of the neo-con swamp creatures infesting Washington (and their deep-pocketed and deep-appetite clients in the armaments industries, along with every government apparatchik whose power, prestige and perks are polished up a bit by the pretense of a foreign threat to national security). EACH AND EVERY ONE OF ALL THE REST OF US should be very, very bothered by what is going on here. Appalled and outraged, actually. Each and every one of the rest of us ought to be lining up in opposition to this madness. We ought to be lining up to shut off all supporting spigots, both of political resources and, especially, of financial resources. We have many sound reasons for doing so. Even if the mere survival of the world (meaning that of you and your kids, among everyone and everything else) isn't enough of a motivation to deny air to the war-mongers, we should do it for the morality of the issue. Understand-- and I know this will sound strange to modern, conditioned American ears-- hegemony, which means "dominion" or "rule", even when exercised by the United States, is immoral. This country betrays its founding principles in seeking hegemony over others, and especially in seeking global hegemony. As Thomas Jefferson, one of the key intellectual Fathers of the American revolution and of the America that was born thereof, observed: "[T]he mass of mankind has not been born with saddles on their backs, nor a favored few booted and spurred, ready to ride legitimately, by the grace of God." Even American pretenses of "exceptionalism" do not excuse us from the sin thus described, when we presume to make decisions for others, or to simply impose our will upon them by force. We ARE exceptional-- insofar as we are a people organized under, and respectful of, the principle of self-determination and consent of the governed. We are NOT exceptional, and rather are just the next tyrants to come down the pike, when we betray that principle by interfering in the choices made by others, even under the pretense that we somehow know or are properly able to decide that those choices are ill-made, or "involuntary". The myths told by wanna-be hegemons about everybody who doesn't bend to our bidding being the victims of dictators and autocrats and what have you, from whom they deserve to be freed by the ministrations of US military power are, for the most part, just that-- myths. Precious few regimes ever cling to power without a necessary level of support (or at least, deliberate complacency) from the governed. And even where a seemingly-credible case could be made for viewing any people as especially meriting our friendship and succor, or especially meriting our enmity, wisdom says we should still treat the matter as none of our business. Wisdom says we must recognize that even extreme cases of this kind are just dicey challenges to accuracy in appraisal, and fertile soil for perverse incentives. I dearly hope that we will soon see an end to the madness that has Washington in its grip and has led to decades of provocations of a Russia which, fairly considered, has been by comparison a model of turn-the-other-cheek restraint and forgiveness. If we do not, I deeply fear we will not see much of anything, soon.

Are You Having Trouble Spreading The Word?? SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance: Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same? Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort... *****

***** About The Author Pete Hendrickson is possibly the most effective lawyer in history, even while never having set foot in a law school, nor ever being a card-carrying member of "the bar". He is the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes); further, since 2003 students of his legal analyses and arguments in ‘Cracking the Code- The Fascinating Truth About Taxation In America’’ (CtC), and its sequel, 'Was Grandpa Really a Moron?' have been routinely retaining and recovering billions of dollars which otherwise-- wrongly, but as a matter of course-- would have gone to federal or state government treasuries. On rather the other end of the spectrum, amidst these more mundane pursuits Hendrickson co-founded and was the primary creative force behind a small board- and card-game company that enjoyed a modest success for several years. Hendrickson makes his home in southeast Michigan, with his wife and two children.
