A Welcome Tartness From A Chief Judge Of The 5th
Circuit
...while reminding us that IRS "revenue rulings" are just
snow-jobs with zero authority.
PUTTING TOGETHER TOOLS LAST SUMMER for a refund
lawsuit against the IRS (in which he and his wife Denise just last week
defeated a corrupt government motion to dismiss), New Jersey
warrior
Vito Manente dug up a nice ruling by the Fifth Circuit Court of Appeals
concerning the legal authority of IRS "Revenue Rulings":
The government makes three main contentions in this case,
namely, (1) Revenue Ruling 59-371 controlled and required the plaintiff
to withhold taxes from the "per diem payments," (2) the determination of
the Commissioner that the payments were wages is presumed to be correct
and plaintiff failed to overcome it, and (3) a proper interpretation of
Sections 3401(a) and 3402(a) of the Code requires the payments to be
considered as wages. We will consider these arguments in the order
named.
1. Revenue Ruling 59-371 is not Controlling
The government argues
that Revenue Ruling 59-371, 1959-2 Cum.Bull. 236, has the force and
effect of law. We do not agree. A ruling is merely the opinion of a
lawyer in the agency and must be accepted as such. It may be helpful in
interpreting a statute, but it is not binding on the Secretary or the
courts. It does not have the effect of a regulation or a Treasury
Decision. Helvering v. New York Trust Co.,

455, 54 S. Ct. 806, 78 L. Ed. 1361 (1934); Biddle v.
Commissioner of Internal Revenue,
302 U.S.
573, 58 S. Ct. 379, 82 L. Ed. 431 (1938); Sims v. United States,
4 Cir. 1958, 252 F.2d 434, aff'd. 359 U.S.
108, 79 S. Ct. 641, 3 L. Ed. 2d 667 (1959); Bartels v.
Birmingham,
332 U.S.
126, 67 S. Ct. 1547, 91 L. Ed. 1947 (1947), and United States v.
Bennett, 5 Cir. 1951, 186 F.2d 407. In the case last cited, Chief
Judge Hutcheson stated that such a ruling had: * * * [N]o more binding
or legal force than the opinion of any other lawyer, * * *. [Id. at
410.]
Stubbs, Overbeck & Associates, Inc., v. United
States, 445 F.2d 1142 (5th Cir. 1971)
Just so. The only "legal" significance of an IRS
revenue ruling is in that the IRS can be bound to conform its own
arguments in court to its own "rulings", as held in
this case--
a fact that might furnish good opportunities for entertainment to any
diligent and thoughtful research spelunker....
OF COURSE, IT'S A SHAME that Vito's fine gold-mining was
necessary, but it was. The fact is, despite the common-sense character of the
Fifth Circuit's observation, the IRS routinely tries to mislead folks--
including judges, as in the case above-- into imagining that its
self-serving nonsense qualifies as actual "rulings" in any meaningful
sense of the word.
To pick a prominent example, look at the agency's
heavily-deployed propaganda package labeled 'The Truth About
Frivolous Tax Arguments', which is routinely sent as a front-line
defense of the "ignorance tax" scheme to folks just beginning to suspect
that all is not as the government would like them to believe in regard
to the income tax. This collection relies on the IRS's own self-serving
statements as "authority" for its contentions about various elements of
tax law fully 25 times.
Emphasizing the snow-job character of the exercise, these
"revenue ruling" contentions are usually followed by citations to court
cases meant to be taken as "support" for the validity of whatever is
being said. But these cited cases only say things varyingly similar
to the contentions made (or even just apparently similar, based
on the inadequate information of a custom-trimmed, out-of-context
excerpt), and in law, any difference is complete difference.
Those already alert to IRS mendacity will recognize this
even without further investigation, by virtue of the fact that the
supposedly-supporting judicial rulings are not simply quoted directly
for the contention the tax agency is advancing. Sadly, those not yet
alert will be taken in, as they are meant to be.
LET'S LOOK AT THE ONE EXAMPLE of the misrepresentations
described above, in which an effort is made to falsely assert that
"includes" as used in tax law has the effect of adding listed objects to
a retained common-meaning of the word being given a statutory definition:
No
CtC-educated person argues that the federal government can tax only
employees of the federal government, of course, so this "contention"
appears at the gate to be just a routine debunk of hoary "tax honesty"
nonsense, and of no interest to any educated filer. But as is often the
case in these IRS publications, several different elements are
intertwined in order to slip some "ignorance tax"-serving false in with
the true.
In this case the false appears at the end, just above the
"Rev. Rul." citation:
Thus, the word "includes" as used in the definition of
"employee" is a term of enlargement, not of limitation. It makes federal
employees and officials a part of the definition of "employee", which
generally includes private citizens.
This statement is completely false.
INDEED, WHAT IS MEANT TO BE SUGGESTED by the IRS's false
statement has been expressly debunked by the courts repeatedly
over the years. That's why the only "authority" cited for it is "Rev.
Rul. 2006-18, 2006-1" (and Cumulative Bulletin 743).
In fact, as shown in those actual judicial rulings on the
subject, federal employees and officials are not "a part of the
definition" of "employee". They ARE
the definition of "employee" in tax law.
This legal reality was helpfully highlighted in the Federal
Register of Tuesday, September 7, 1943, page 12267, with this entry
reflecting the enactment of § 2(a) of The Current Tax Payment Act
of 1943 (by which § 1621(c)-- now represented at 26 U.S.C. §
3401(c)-- was added to the IRC of 1939):
As said here in very plain English, the term "employee" at
1621(c) (now 3401(c)) includes every individual performing services
under the "legal relationship of employer and employee". The
specifically-included examples of the class so described are exclusively
government officers and employees.
OF COURSE, AS IS TYPICAL of these "revenue ruling"
misrepresentations, a couple of references to rulings by actual courts over the years
are provided after the "contention" reproduced above (see them
here). While
some of the
excerpts offer varyingly direct support for the
fact that federal employees aren't the only people subject to the income
tax (a no-brainer in any event) none offer support for the "revenue
ruling" assertion about the meaning of includes.
Even the one snippet of language that seems to come closest
to doing so-- the bit teased out of the much abused 1984 Latham
ruling-- does not,
when carefully read. In fact, the carefully nuanced language (and
the couple of outright lies) of these "supporting rulings" (or of
references thereto)-- along with the
manifest inability of the IRS to come up with even a single judicial
ruling actually saying what it means to be believed-- just emphasize the
mendacity of the revenue ruling contention about "includes".
(Further, of course, even if any of these lower court rulings DID say
what the IRS wants taken from its "revenue ruling" contention, they
would simply represent faults in those courts in light of the contrary
Supreme Court jurisprudence and plain language of the relevant law. But
none do.)
WELL, I'M GETTING ALL WOUND UP HERE, and I've got to watch
my blood pressure. So, as much fun as it is, I'll wrap up this little
slap-around of IRS bs.
I'm going to let Chief Judge Hutcheson close this one
for me with the very lemony complete statement he makes in
United States v. Bennett in 1951. The Stubbs
court had extracted the technical substance of that statement, but it is
the rest that contains the real heart of what Hutcheson is observing.
Scornfully summarizing the IRS argument being made in the
case, here is how Hutcheson puts it: "On the basis of these rulings of the Income Tax Unit of the
Bureau, made to order for the commissioner by his legal staff, and
having no more binding or legal force than the opinion of any other
lawyer, the collector claims..."
"[M]ade to order for the commissioner by his legal
staff..."
Yup. Well said, Judge Hutcheson. That captures the whole
sleazy little practice very nicely.
(It also puts one in mind of the Jay Bybee and John Yoo
"it's not torture, it's "enhanced interrogation"..." memos. Or, the
similarly convenient "definition-of-imminent threat" stuff cooked up to
pretend that the Soleimani murder was somehow legal. Or,... I could go
on and on.
Americans tolerate these pretenses of a rule of law at
their extreme peril. Each is a matter of an out-of-control executive
branch making it up for the convenience of its operators' personal
ambitions and to facilitate their fulfillment of the wish-lists of their
benefactor clients and cronies. Each is a frontal assault on the
liberty, security and prosperity of everyone else.
Happily, if we all really buckle down and beat the drums to
spread the word, the
CtC remedy-- even though only directly addressing the "revenue
ruling" version of these executive branch offenses-- will defuse what is
otherwise a ticking time bomb.)

BTW: In making his very concise observation about the
self-serving, authority-devoid character of "Revenue Rulings" quoted
above, Hutcheson cites to an earlier opinion in
Fleming v. A. H. Belo Corp., 5 Cir., 121 F.2d 207 (1941) in
which he holds forth at length on the subject. It is well-worth reading.
BTW, II: I can't let this one go without mentioning that
one of the cases cited as "support" for the "contention" entry in the
'Truth About Frivolous Tax Arguments' propaganda discussed
above is the one in which a federal district court allowed itself to be
coopted into falsely ascribing the "only federal employees are subject
to the tax" nonsense to
CtC.
This was done in order to create a pretext for government
disparagement of the book as based on faulty arguments-- because the
government can't find any actual faulty arguments in the book
at which to point...
I encourage everyone to become familiar with this episode.
It's very useful for helping anyone willing to read as little as
three
short pages-- with supporting documentation-- to that "alert" state
referenced above, which is so important in starting down the path toward
the liberating truth.
Share these all, everywhere you can. Be your most
creative self in sending and "selling" these links. Do memes; make
gifs; respond to everything in the news that would be or have been
better had the state been small, or if Americans kept their money
for their own uses.
If you pay attention to the news and train yourself to
apply these perspectives, you will see a dozen things of which you
can make use in awakening other Americans to the virtues of having
the income tax correctly administered. Please, for my sake, for your
own sake, for the sake of your children and their future, make that
use.

concerted effort to frighten people away from its truths. This
effort involves official government websites and press releases
touting an occasional court ruling that appears to be at odds
with some
CtC-revelation (but without details sufficient to expose the
real substance of the ruling)--
and sometimes even more mendacious behavior.

Are You Having Trouble Spreading The
Word??
SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE
EXPECTED when you're trying to explain to someone that
everything they've been encouraged their whole lives to
believe about something as entrenched and significant as the
income tax is basically nonsense. So here's a way to help
cut through the resistance:
Ask your listener how he or she would react if
you were to show an announcement from the Commissioner of
Internal Revenue admitting that the tax doesn't apply to the
earnings of most Americans and is misapplied most of the
time because people don't understand how it works? Or how
about if you showed a ruling from the Supreme Court saying
the same?
Now you just have to explain that
you're going to show exactly those things-- but because
the state really doesn't want people to know this, these
things haven't been said quite as forthrightly as we would
all wish. It's going to take a bit more work to take these
admissions in than is sufficient for just reading a press
release. But it'll be worth the effort...
IF YOU'RE NOT SPREADING THIS LINK with every bit of
energy you can, to school libraries, homeschool
families and community groups, your neighbors, your
family members, your pastors and
co-congregationalists, journalists, lawyers, CPAs,
members of congress, tax-agency workers, Wikipedia,
Anonymous, WikiLeaks, the Tax Foundation, everyone
in the "tax honesty" movement, the 9/11 truth
movement, other activist movements and everyone
else,
you have only yourself to blame for your
troubles with the tax, and a whole lot else of which
you might complain. It's on you.

Today's feminists can't abide that which makes women
inherently different from men.

Women across the West are under attack. Our enemy is
not the infamous “patriarchy,” allegedly scheming to undermine us at every turn.
Nor is it pregnancy, with its physical discomforts and emotional tribulations.
Even children are blameless here, no matter how much their arrival can shift
careers or thwart travel plans.
No, the culprit is progressive feminism, a movement
whose very existence depends on holding women in contempt. Modern-day feminism
has succeeded in a spectacular charade, masquerading as a great champion for
women while spewing antipathy for men and groaning over the burden of children.
But at its core, its real hatred is for womanhood itself.
According to the narrative that has dominated feminist
discourse since the 1960s, women are weak until we strike out every feminine
trait that distinguishes us from men.
This message has been repeated with increasing
volume for decades, echoing from the studios in Hollywood to the ivory
towers of higher education, chanted by the women in white at the 2019
State of the Union Address. Behind every iteration is a reminder that
women are always victims. Even as feminism promises women that we can
“have it all” and “be anything we want,” we are told we will remain
powerless until we cease to behave like women and instead become like
men. Traditionally feminine virtues of modesty and chastity are flagged
as signs of repression. We must subvert our natural ability to bring
forth new life if we want to achieve anything substantive in our lives.
Most of all, we must have the ability to destroy our own children or we
will never succeed.
During the recent Golden Globes, Michelle
Williams sparked controversy when she
credited her professional success to her ability to “employ a
woman’s right to choose.” She did not specify whether this meant she had
utilized contraception or ended an unborn child’s life, or both.
However, her point was clear: children are obstacles to achievement, and
women must be able to prevent their creation and dispose of them as
needed.
Applause greeted Williams’ passionate advocacy
for the war against motherhood and fertility that is euphemistically
called “reproductive rights.” The camera panned the room, showing
glittering starlets openly weeping at Williams’ bravery as she praised
the sundering of the sacred relationship between mother and child.
WOW! ISN'T THAT A WONDERFUL treatment of the subject?! Marcum's
core point-- that radical feminism's real argument is that women as women aren't
acceptable (aren't "good enough", that is)-- is exactly the
fingernails-on-the-chalkboard background to the advocacy.
And Marcum articulates
it so well, both as to how and why the radical feminism is an intellectual
fraud, and as to how and why real femininity-- comfortable and proud in its own
skin-- is an equal aspiration and achievement to the real masculinity to which
proper and thoughtful men aspire!
This subject has plenty of gravitas on its own steam.
Radical feminism has done great harm to Western culture in general and
especially to Western academic standards. And it is a founding pillar of
the disastrous "identity politics" plague that is fragmenting the lower
80% of the American demographic pyramid into a chaos easily ruled and
exploited from above.
THE ONLY THING I will try to add to Marcum's able
presentation and my own few words above is a reiteration of my
long-standing request that everyone read and share and at least take a
stab at discussing
these comments and prescriptions regarding the abortion conundrum.
Somehow that discussion has never taken place, and I think that's a real
shame.
I firmly believe that what I propose here is completely
correct from a standpoint of principles. I also believe it is completely
certain to change practices and perspectives regarding "unwanted
pregnancies".
Maybe I'm wrong. But that will not be known until the
discussion takes place.

Lincoln, in announcing his willingness to burn the Southern states to the ground in order to
keep them paying the tariff for the benefit of Northern interests in
his first inaugural address on March 4, 1861, paid at least lip
service to the Founders design of leaving control over the fuel
available to feed the fires Washington wants to light in the hands
of the individual citizenry when he said, "Doing this I deem to
be only a simple duty on my part; and I shall perform it, unless my
rightful masters, the American people, shall withhold the requisite
means..."

Hendrickson is also a widely-read essayist on
matters of politics, public policy and law; many of these works
are collected in his second book, ‘Upholding

award-winning artist; and has paid his dues as a youth
soccer coach. He is a long-time political activist as well, and
has served as co-chair and platform convention delegate of
Michigan’s largest county Libertarian Party organization; as a
consultant to the National Right to Work Foundation and Citizens
for a Sound Economy; as a member of the Heartland Institute; and
as a member of the International Society for Individual
Liberty. He is a frequent radio-show guest on stations across
the country.
Hendrickson's business career has included nearly a
decade-and-a-half at the leading edge of the renewable-energy
industry, both as Director of Purchasing and Materials
Management and member of the R&D board at Starpak Energy
Systems, the mid-west's then-largest solar heating and
energy-recovery-and re-utilization company; and as founder and
president of AFJ Inc., a high-efficiency lighting design,
manufacture and installation firm.
Beginning in the mid-1990s and continuing for the
twelve years before his present full-time focus on the
restoration of the rule of law in America, Hendrickson directed
purchasing activities for the $84 million-a-year
multi-family-housing division of the Farmington Hills, Michigan
branch of Edward Rose and Sons, with responsibility for 18,000+
apartments, direct supervision of 35 technicians and agents, and
incidental authority over several hundred divisional workers.
He also ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On rather the other end of the spectrum, amidst
these more mundane pursuits Hendrickson co-founded and was the
primary creative force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan,
with his wife and two children. He is currently working on his
next book.
