Some Further Comments On The Recent 'Kestin' Ruling
As correct as the ruling was regarding "frivolous return penalties" asserted against non-filings, it was still an exercise in judicial corruption even on that one issue, attempting to protect criminals and a criminal conspiracy.

ABOUT A MONTH AGO I posted an article on the Tax Court collapse of a long-standing crime committed by the IRS against a number of educated filers. I'm speaking ofthe assertion of "frivolous return penalties" against mere reference copies of educated filings included with correspondences sent to the agency.

This penalty-on-what-isn't-even-a-filed-return is a particularly transparent offense. Its invalidity is obvious, even independent of the impropriety of "frivolous return penalties" in regard to CtC-educated filings generally (itself an impropriety so transparent that the IRS has posted a fake "frivolous position list" on its website in order to fool its own employees into deploying that harassment).

There simply is no legal authority for asserting the penalty against something which is NOT a filing, but merely a reference copy of a return.

Indeed, such a penalty assertion is not just without legal authority but is positively illegal. It is a violation of several federal criminal statutes, such as 18 U.S.C. §§ 872, 876(d), 1341, and 1512(b) and 26 U.S.C. § 7214(a)(2), at least.

This penalty assertion would be illegal even if the copied return was not CtC-educated, and instead actually WAS based on frivolous nonsense (such as any of the varieties debunked in the handy collection here).
