Even while knowing that their beliefs about the tax are derived entirely from the representations of those who profit from those beliefs (like tax bureaucrats and "tax professionals")?

October 14-  In 1066, Norman invader William the Conqueror wins the Battle of Hastings over the Saxons, gaining control of England.  In 1322, Robert the Bruce wins Scotland's independence from England.  In 1884, George Eastman patents paper-strip photographic film.  In 1926, Winnie-the-Pooh is published.  In 1943, prisoners at the Nazi death-camp at Sobibor rise up, killing guards and breaking out of the camp.  About half escape.  In 1947, Chuck Yeager breaks the sound barrier in level flight in a Bell X-1 jet.  In 1962, the Cuban Missile Crisis begins when a U-2 spy-plane spots Soviet missiles being installed in Cuba.  In 1968, the United States DoD announces that 24,000 Vietnam vets will be re-rotated back for second tours of duty.  In 1968, Jim Hines becomes the first man to run 100 meters in under 10 seconds.  In 1982, Ronald Reagan launches the federal assault on liberty and the Constitution known as the "War on Drugs".  In 2012, Felix Baumgartner performed a 24-mile skydive, reaching an estimated speed of 843.6 mph before deploying his parachute.

Every Which Way But Loose

A hardy warrior for the truth weathers years of corrupt IRS browbeating to emerge $121K+ victorious in the end.

HERE'S A STORY I AM ESPECIALLY DELIGHTED to report: Dane La Vigne, excellent son of excellent father Don, of whose inspiring testimonial video I am particularly fond, has secured a hard-fought victory after a long, utterly obnoxious effort by the IRS to capture from him a pile of money the agency eventually admitted he had never owed.

Dane's story joins the several dozen others I have been pleased to post over the years in my 'Every Which Way But Loose' (EWWBL) collection. All are episodes of special virtue in illustrating government agreement with all that is taught in CtC-- both as to the law and as to the proper and effective means of invoking and enforcing the law-- beyond the denial of all but the utterly brain-dead.

Like the other episodes in the EWWBL series, Dane's 2014 adventure documents intense IRS attention to his filing and all things with which it is concerned. This attention was for the explicit purpose of imposing a tax on Dane measured by his considerable receipts during that year from activities of the same sort conducted by millions of other Americans every year.

Because Dane, unlike most Americans, is CtC-educated, he knows the truth about the income tax along with all the intimate and critical details of tax law. In the face of Dane's knowledge and steadfastness, the IRS effort collapsed.

THAT TAX AGENCY COLLAPSE-- plainly done with eyes wide open-- shows once again, in glaringly sharp relief as in all the episodes in the EWWBL collection, that the government's sporadic pretenses of disagreement with, or resistance to, CtC and CtC-educated filings are just that: pretenses.

Whether they take the form of bogus "frivolous return penalties", falsifications and co-options of corrupt jurists, or in any other form, those pretenses are desperate frauds. Counting on voodoo-chant energy from every brain-dead (or self-interested) CtC-denier in both the "tax professions" and the so-called "tax honesty community", they are meant to spasm the CtC-slain vampire a few more yards downfield to can scam another $trillion or so out of the pockets of Americans before enough of them finally learn the truth and the zombie vampire turns to dust at last.

"If the taxpayers of this country ever discovered that we operate on 98% bluff, the entire system will collapse."

-Reported remark by an internal revenue service officer to Sen. Henry E. Bellmon (R. Okla.) on April 15, 1971.

It's not all bluff, of course-- there's a lot of trickery involved, too. But CtC teaches how the bluff and the trickery both work, and shows the reader the unique means by which the presumptions on which both depend can be nullified.

Aren't you glad you're CtC-educated? Don't you wish everyone was?

Anyway, let's get back to Dane...

DANE'S DELIGHTFUL VICTORY concerns his $230,000 or so in earnings during 2014. To begin with, the IRS initially admitted Dane's earnings were not "income" (in the sense of being income tax relevant). The agency had dutifully refunded the $1,000 deposit Dane had sent in with his application for a filing date extension in April of 2015 and then reclaimed on his return filed later that year. It was thus (and properly) agreed that Dane's earnings were not of the specialized variety received for the performance of taxable activities, and by which a resulting tax liability could be measured.

But in 2016, some bad apple at the IRS decided to pretend the agency had made a big mistake and try to herd Dane back into a copper-top pod. The campaign began with this:

...to which Dane responded with this, the following October.

Meantime, a "proposed change" notice was run up the flagpole:

It was hoped that Dane would be overawed by this "official" expression, abandon his own knowledge of the provisions and particulars of the relevant law, and salute the "proposal" like a good little soldier given orders from above.

Not Dane. This man IS a good soldier-- but not the little kind who worships at the altar of the state.

Dane is a good soldier of the Founders' republic. He is a big, grown-up, real American man whose salutes are reserved for the principles of liberty and the rule of law.

Dane stood his ground and stuck to what he himself had learned to be true, by his own study and verification and reliance on his God-given powers of reason. After three long years of increasingly strident harassment and repeated officious pronouncements, including, among much else back and forth, this:

...the IRS bluff, trickery and intimidation project collapsed a few weeks ago, ending with these two flat-out white-flag acknowledgements:

It was a long ordeal for Dane, but a capital victory in the end. Perseverance won this battle, as it does every battle with adversaries whose only weapons against solid, well-grounded and accurate knowledge of the law are fear and bluster.

Dane is still waiting for the other shoe to drop on the pretended "frivolous return penalty", giving him a chance to demand a hearing and start that nonsense on its way off-stage. Maybe that one will just ease off on its own steam, under the circumstances...

IN THE MEANTIME, GOTTA LOVE THIS HERO!! Dane La Vigne stands tall in the ranks of all the good American men and women who are doing the Founders' work by binding down an out-of-control state with the chains of the Constitution.

Dane's victory joins those of the tens of thousands of other awakened and activated Americans represented here. Each constitutes another critical step toward the restoration of the Founders republic and the true rule of law.

P.S. IT WILL BE NOTED that I have not posted most of Dane's responses to the notices shown in the article above. In fact, I haven't posted every notice and letter and what-have-you that Dane received over his three-year battle, either.

The reason for this is simple: I have observed over the years that my posting of such docs often has the perverse effect of leading some folks to forego actually studying and acquiring ownership of the knowledge on which proper responses and proper positions and arguments is grounded. Instead, some folks just mimic (virtually copying and pasting, in some cases) whatever they most recently see associated with a victory, imagining that whatever that is, it's what they should be doing themselves.

Such "free-riding" is a mistake, and I warn against it here and in every seminar.

The idea of such free-riding also reflects a misunderstanding of battles such as Dane's. Here is what SHOULD be understood:

Dane did not deploy a secret word, or special deep magic to get to his victory. Once Dane filed his accurate and proper CtC-educated tax return he had done all the "magic" involved here. The rest was just a matter of Dane standing his ground and making sensible and informed use of the resources to be found here, something he was able to do by diligently studying that material.

It is only those proper beginnings and sensible practices that should be learned and copied from Dane's victory by anyone else.

P.P.S. I WILL MAKE ONE EXCEPTION to my decision about Dane's responses discussed above by relating that while he did respond with an objection letter, Dane did not petition Tax Court in response to the CP3219A he received, the cover page of which is amongst the notices shown above. I mention this for two reasons-- neither of which is to be taken as approving or disapproving Dane's decision, or as assigning it any special significance in the outcome of Dane's situation.

The first of those reasons is to keep it from being erroneously assumed that Dane DID go to court as a part of the process toward his victory. Whether a good call or not a good call, he did not, and that should be clear.

The other reason for this exception is to give me a chance to share a few comments about the form "CP3219A" that Dane received, something new-ish to the CtC community, and about which I have therefore not written previously. What is notable about this form is that unlike a normal Notice of Deficiency, the "CP3219A" is generated by a largely automated process (as part of the IRS 'Automated Underreporter Program'), without even the pretense of any actual "examination" or "determination".

Because of these characteristics, the "CP3219A" appears on its face to be fundamentally arbitrary and capricious, declaredly reflecting nothing more than a self-serving tax agency preference for "information return" allegations by which the agency gets revenue over the testimony of a filer by which it does not. (This as opposed to the conventional 3219, in which the same self-serving subjective preferences operate, but do so concealed behind some deniability-generating window-dressing.)

PRO TIP: If I were the IRS and I wanted to discourage people from rebutting allegations that they had done things I can tax, and keep them from successfully reclaiming withheld or paid-in money, I would salt the "tax honesty" community with passionate-seeming "legal researchers" who would warn anyone whose ear they captured that filing a 1040 is a bad idea for one reason or another...

Regarding Trolleries

(Deceitful efforts to discourage Americans from learning the truth about the "income tax")

 

 

FOR ALL THE YEARS SINCE 2003 when CtC was first published, the government has engaged in a concerted effort to frighten people away from its truths. This effort involves official government websites and press releases touting an occasional court ruling that appears to be at odds with some CtC-revelation (but without details sufficient to expose the real substance of the ruling)-- and sometimes even more mendacious behavior.

Are You Having Trouble Spreading The Word??

SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance:

Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same?

Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort...

The Very Idea Of Economic Policy Is Itself Dangerous

In the last few years, the topic of trade and trade policy has returned to center stage in the United States, thanks to the protectionist policy and rhetoric of Donald Trump. The result has been a reopening of many debates and also an apparent shift in public opinion, toward stronger support for the free trade position. What this public argument has also done is to reveal some very basic assumptions about economics and public policy. 

These foundational assumptions are particularly widespread among professional economists but are also found among social and political commentators more generally. They reflect the way that economics as a discipline has developed over the last 30 to 40 years. The assumptions are about public policy in general, not just trade, and from the individualist or classical liberal standpoint are dangerous and misleading — in fact their becoming explicit because of the current debate over trade highlights the need to clarify language in these discussions and through that thought.

In the current argument about trade, Donald Trump’s protectionism and the trade war he has started with China have led to a strong reassertion of the free trade position. Most of this has taken the form of arguments that the United States should follow a free trade policy. 

Closer examination of these positions should leave one feeling very uneasy. The implication is that free trade is a policy of the government. In other words, the assumption is that free trade only exists or comes about as the result of an active government policy. Very often the explicit thesis is that free trade is something created by and dependent upon complex and elaborate intergovernmental trade agreements, such as NAFTA or the proposed Transatlantic Trade and Investment Partnership (TTIP) and Trans-Pacific Partnership (TPP). 

If you actually think about it, this is a bizarre position. Free trade simply means the absence of government action, leaving people free to exchange goods and services across national borders. To have free trade, governments do not have to do anything; they simply have to stop doing things, such as imposing duties and tariffs or imposing regulatory barriers. This shows we should become aware of the misleading language used in much public discussion and commentary, particularly in the business and financial press and in academic journals. 

So-called “free trade agreements,” such as the ones mentioned, are not about free trade properly understood. They are about managed and regulated trade. A trade policy centered around them is not about free trade; it is about extending the scope of regulations beyond national borders through a process of harmonization. To put it simply and bluntly, if you are an individualist liberal you do not want the government to have a “free trade policy”; you do not want it to have any kind of policy in that area. You want it to simply leave trade alone.

Afterword

DAVIES MAKES AN IMPORTANT and very to-the-root observation about the true nature of so-called "free trade" as the term is used in modern political debate. There's nothing free about it, and no one should be fooled by the label. And of course, Davies is right that what any sensible American wants is ACTUAL free trade-- historically known as laissez faire-- meaning "let be".

In fact, any sensible American wants the same stance by government in many areas beside just economics or trade.

BUT DAVIES MAKES ONE interesting mistake in his article (or perhaps it is a deliberate avoidance of what he might think some of his readers would find off-putting). I refer to the passage in which he is describing modern courtier economists as viewing themselves as "technocratic experts whose task and role is to advise the sovereign power as to the best and most efficient way of realizing its economic goals (such as greater prosperity, full employment, economic growth)."

With all due respect to Dr. Davies, this expression is hopelessly naive, and as such, sacrifices what could have and should have been a powerful point in his overall argument's favor. Here is the defect: The actual and singular economic goal of those who exercise "sovereign power" in America (as in most other state-afflicted societies) is to maximize revenue flowing into their hands. Period.

Realizing this self-interested goal of course requires catering to the perspectives of the masses, so as to avoid too much resistance (or possible revolution) and allowing such liberty and producer profitability so as to not kill the goose that lays the golden egg. But the policies pursued by those state operators are for their benefit and that of their clients and cronies, and at the expense of the interests of the rest of us to as great a degree as can be gotten away with.

Taken in that accurate light, the so-called "free trade" fictions against which Davies writes are all the more strongly seen as the evil and undesirable offenses that they are.

Laissez faire is, in fact, the watchword of every free and sovereign people, and under that regime Americans prospered for our first 110 years or so. We DO need it restored, and again, in much more than just economics.

But AS for economics, CtC has enabled individual Americans to secure a "let be" policy for themselves, and all by themselves. Use it.

In so doing, you will not only free yourself from destructive policies, but you will contribute to the liberation of society as a whole. There is nothing you can do that is more civically-responsible.

So stand tall invoking and enforcing your personal free trade policies. You'll be saving America, as all good citizens should do.

About The Author

Pete Hendrickson is possibly the most effective lawyer in history, even while never having set foot in a law school, nor ever being a card-carrying member of "the bar". He is the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes); further, since 2003 students of his legal analyses and arguments in ‘Cracking the Code- The Fascinating Truth About Taxation In America’’ (CtC), and its sequel, 'Was Grandpa Really a Moron?' have been routinely retaining and recovering billions of dollars which otherwise-- wrongly, but as a matter of course-- would have gone to federal or state government treasuries. This despite concerted efforts by government to suppress his work, and in some cases vigorously oppose the claims by his students.

Hendrickson is also a widely-read essayist on matters of politics, public policy and law; many of these works are collected in his second book, ‘Upholding the Law And Other Observations’. He is a member of Mensa; an award-winning artist; and has paid his dues as a youth soccer coach. He is a long-time political activist as well, and has served as co-chair and platform convention delegate of Michigan’s largest county Libertarian Party organization; as a consultant to the National Right to Work Foundation and Citizens for a Sound Economy; as a member of the Heartland Institute; and as a member of the International Society for Individual Liberty. He is a frequent radio-show guest on stations across the country.

Hendrickson's business career has included nearly a decade-and-a-half at the leading edge of the renewable-energy industry, both as Director of Purchasing and Materials Management and member of the R&D board at Starpak Energy Systems, the mid-west's then-largest solar heating and energy-recovery-and re-utilization company; and as founder and president of AFJ Inc., a high-efficiency lighting design, manufacture and installation firm.

Beginning in the mid-1990s and continuing for the twelve years before his present full-time focus on the restoration of the rule of law in America, Hendrickson directed purchasing activities for the $84 million-a-year multi-family-housing division of the Farmington Hills, Michigan branch of Edward Rose and Sons, with responsibility for 18,000+ apartments, direct supervision of 35 technicians and agents, and incidental authority over several hundred divisional workers. He also ran the division's 10 cable television earth-station and distribution systems in four states, and designed and administered the company's website.

On rather the other end of the spectrum, amidst these more mundane pursuits Hendrickson co-founded and was the primary creative force behind a small board- and card-game company that enjoyed a modest success for several years.

Hendrickson makes his home in southeast Michigan, with his wife and two children. He is currently working on his next book.
