striking McCormick Harvesting Machine Company workers-- killing at least two, a
bomb is thrown at police trying to break up a subsequent labor rally in
Haymarket Square in Chicago, Illinois. 8 are killed and 60 are wounded; the
police open fire on the crowd again, resulting in an unknown number of
casualties. In 1932, Al Capone begins serving an eleven-year sentence for tax
evasion. In 1970, National Guardsmen shoot into a crowd of unarmed students
protesting the Vietnam War at Kent State University, killing four and wounding
nine.

The Jim Jones Syndrome
...or, why and how the Constitution is not a suicide pact.
I LED OFF THE LAST NEWSLETTER with
a drill-down on the legal
reasons for the invalidity of so-called "emergency" powers claimed
by every autocrat from Donald Trump on down to even less-qualified
political pip-squeaks like Gavin Newsom of California and Gretchen
Whitmer of Michigan. Today I'm going to take a look at why free and
sovereign people set things up that way.
As noted in the earlier article, the simple fact that a
state is created by a sovereign people through the mechanism of a
Constitution in which certain powers are expressly delegated imposes the
prohibition on "emergency" powers. This is true due to the very nature
of such a Constitutional structure.
But the prohibition of "emergency" powers is not just a
fortuitous happenstance. Very explicit and positive interests are
protected by that particular aspect of Constitutional establishment.
BEYOND THE FACT THAT WHAT IS neither articulated nor
anticipated cannot be delegated at all, one big reason we, the people
never delegated
"emergency-do-whatever-you-think-you-must" powers to our governments is
simple self-interest. We wanted to protect ourselves from being forcibly afflicted with the consequences of bad
decisions.
As sensible people, our Founders and Framers knew full well
that "emergency" decisions are made either in panic, despair or hubris by incompetent or deluded
leaders
(the "Jim Jones" syndrome) or through political career-security
calculations which naturally default to hyper-(and often paralytic)-caution (the "FDA approval
process" effect) and/or produce the unwanted accretion of power in state
offices.
Our Founders and Framers designed things so that wiser or
more cool-headed (or even just foolhardy but nonetheless free and
sovereign) individuals could never be lawfully compelled to drink the
Kool-Aid or suffer harms from bad policy like livestock in a barn after
the farmer drops a lit cigarette from shock-frozen fingers.
ALTHOUGH THE EXPRESSION HAS BEEN ABUSED by shameless
statists to argue precisely the opposite point, and to justify exactly
the sort of destructions of liberty and the rule of law it is actually
designed to protect, the Constitution is not a suicide pact.
That is, our Constitutions neither provide for, nor allow, the state to
subject everyone in America to the disastrous consequences of frothy
madness, even should every "official" and the majority of the citizenry
succumb.
In short, no authority is granted to those officials to
compel sober-minded or courageous (or even foolhardy) Americans to join
their panicky neighbors in stampeding over any cliffs.

OF COURSE, DESPITE THE FOUNDERS' care in forestalling legal
compulsion of Kool-Aid consumption, it falls to each of us to keep our
heads and say no when the noxious stuff is offered-- or, more likely,
thrust upon us. Those doing such thrusting are seldom inclined (or even
cognitively equipped) to recognize or acknowledge the limits on their
authoritah.
This is why our prescient Founders and Framers gifted us
with another aspect of our Constitutional structure which should be
taught to every American child and shown proper respect by regular
exercise. I speak, of course, of
the strict
limits on the taxing power which are meant to ensure that American
governments stay small, humble and incapable of significant despotism,
no matter the stampede mentality that panic-mongering might fan to life
among the populace in certain circumstances.
Those limits are also meant to ensure that no individual
American can be compelled to participate in, and become a helpless
victim of, economically-ruinous fits of madness even just afflicting the
state alone. The primacy of the individual is the principle upon which
America is founded.
SO, TEACH YOUR CHILDREN WELL, turn down the Kool-Aid, and
be proper inhabitants of the "land of the free and the home of the
brave". The liberty and livelihood you protect will be your own.

DOESN'T WHAT'S GOING ON RIGHT NOW in many places across
America perfectly exemplify the wisdom in the cautionary observation
that, "A state
big enough to give you everything you want is big enough to take
everything away from you"?

THE "NORMAL" INTO WHICH AMERICA should settle going forward
is the one that has been typical during times of seasonal flu. That is
to say, straight back to January 1, 2020 in every respect, legally and
culturally, with one exception-- a dramatic downsizing of government,
federal and state, in order to ensure that the American people are never
again at the mercy of panic- or opportunism-prone political hacks with
enough influence to carry others along with them over the cliff.

TESTING FOR C19 INFECTION CAN ONLY SERVE one valid purpose:
keeping tabs on the case fatality rate (CFR). It has no virtue for any
purpose of "wisely staging" the pace and manner in which Americans
reclaim their liberties from the patchwork quilt of despotisms by which
the country has been smothered during the last two months.
The odds are that WAY more Americans are infected with the
virus than has been shown so far, as I anticipated long ago
here, and testing would
reveal that. But the appropriate take-away from that revelation is that
C19-- already known to
have a CFR at the no-big-deal level of a mild seasonal flu-- is even
LESS significant than has already been shown, NOT that more or continued
panic reactions (such as "immunity passports", "contact tracing" or any
other liberty-compromising measures) are warranted.

THERE HAVE BEEN MANY CONSPIRACY THEORIES floating about
lately concerning the appearance of C19. One I haven't heard yet but
would encourage-- not because I believe it likely, but purely due to the
instructive perspective it promotes-- is that the C19 panic has been an
attempt by competitors to gain an advantage vis-a-vis America's
liberty-nourished economic primacy.
That is, the generation of C19 hysteria is an attempt to
see a foreign economy benefit competitively by continuing on relatively
unhampered while we are tricked into shutting ours down for some period,
and then restarting it only with freedom (and thus,
effectiveness)-reducing interferences in place going forward. That'd be
pretty nefarious and pretty brilliant, wouldn't it?
I think we should throw this one out there for the jingoist
trying to pick fights over the whole affair to get all frothy over.
Maybe they'll then help ensure that as Americans wake up from this
madness we smugly embrace even more freedom-- just to thwart the evil
plots of those foreign devils, whoever they may be!
Share these all, everywhere you can. Be your most
creative self in sending and "selling" these links. Do memes; make
gifs; respond to everything in the news that would be or have been
better had the state been small, or if Americans kept their money
for their own uses.
If you pay attention to the news and train yourself to
apply these perspectives, you will see a dozen things of which you
can make use in awakening other Americans to the virtues of having
the income tax correctly administered. Please, for my sake, for your
own sake, for the sake of your children and their future, make that
use.

...and the window for action is only briefly open...
PEOPLE, MANY OF THE RECENT POSTS I have made here contain
the remedy to the ongoing destruction of the rule of law we are
suffering right now (not to mention the ongoing destruction of our
liberties and our prosperity). That remedy lies in the data proving
that C19 is of no more dire significance than the common seasonal flu.
The problem is that these facts that are NOT
being shared with the American public by the MSM or by any official.
This is
because these facts knock the pins out from under the agenda-driven pretense that
C19 is a unique threat in response to which "everything
must change" (meaning, your liberties must be compromised and the state
must have much more power going forward).
Those deception-favoring interests understand that when enough Americans have seen these
facts about the perfectly normal virulence of C19 (and more, learn of
our unusual ability to actually cure this one, rather than helplessly
suffer losses at its hands, as we have always done with every seasonal
iteration of influenza), some of them, at least, will wake up to the fact the
"cost-benefit" analysis of the virtues of "lockdowns" and all the rest
has always been: HUGE cost; no meaningful benefit.
The tolerance of those folks for each additional day of
ruinous oppression will drop fast, and their susceptibility to the
argument that it was the oppressive measures that saved their lives, and
that therefore those oppressive measures must become the "new normal",
will also evaporate. Only these changes in perception amongst enough of
our fellows will spare us that "new normal".
THUS, YOU MUST SHARE THESE FACTS!! They will not get into
circulation any other way.
Understand, I post these things here in order
to make them available for YOU to vigorously disseminate them. I can
only reach you, a tiny number of Americans. I have no
way of reaching those YOU are able to reach.

learning the truth about the "income tax")
FOR ALL THE YEARS SINCE 2003 when
CtC was first published, the government has engaged in a
concerted effort to frighten people away from its truths. This
effort involves official government websites and press releases
touting an occasional court ruling that appears to be at odds
with some
CtC-revelation (but without details sufficient to expose the
real substance of the ruling)--
and sometimes even more mendacious behavior.

on YouTube regarding donations. I didn't know what to do about
it to begin with; I don't do what I do intending for anyone to
feel obligated in any way.
But of course, no one IS obligated. I will continue
to make my work freely-available here, and in my books for only
the cost of a cheap paperback.
Thus, even though I post it here below, Tim's very
thoughtful personal resolution and encouragement to others is
just an invitation for consideration by those who may not be
conscious of the fact that I can't do what I do without support.
No one is to feel any pressure from it; if it moves anyone to
act let it be solely because it seems right.
Will German Courts Now Seek The Extradition Of
Gina Haspel?
Invoking a concept called "universal jurisdiction", Germany
is trying Syrian officials for alleged torture of prisoners. Why stop
there?
ACCORDING TO A DOCTRINE embraced in Europe a number of
years ago, "crimes against humanity" are subject to the jurisdiction of
any court, even one foreign to the geographical locus of the alleged
events or the citizenship of the alleged perpetrators. Under the
auspices of this doctrine,
a court in Germany is putting on trial two Syrians arrested in Germany
last year who are accused of being in positions of responsibility in
a Syrian detention center in which torture was conducted.
I offer a qualified "Hooray!" Torture is a heinous crime,
and those who can be proven to have conducted it, and those who can be
proven to have authorized or encouraged it should be punished severely--
severely enough to scare everyone in the future away from ever even
thinking of committing this despicable offense.
I qualify my "Hooray!" only in regard to the "universal
jurisdiction" doctrine, which, if confined exclusively to crimes like
torture, the initiation of wars of aggression (whether by military or
economic means), assassinations and other forms of terrorism, and
fomenting the overthrow of democratically-elected government is likely a
blessing for the world, but which bears the risk of being subverted into
a political tool and/or a weapon of aggression if extended to any other
alleged offenses.
SO FAR, SO GOOD, though, with Germany driving straight down
the lane in this latest application of the otherwise rarely-invoked
doctrine. If the defendants are guilty, justice will have been served by
the trial.
I can't help but wonder, though, whether the initiation of
this case is going to have a big impact in Washington. I may suffer for
having not examined the US-German extradition treaty before tapping out
this article, but assuming it to be of the normal variety and therefore
providing for the arrest and extradition of defendants accused of what
would be crimes in both places, it occurs to me that Gina Haspel, for
one, should be suffering a bit of anxiety at the moment.
It would seem to me that Germany, if sincere in the
motivations behind its current prosecution of the two Syrians, might
soon be forwarding extradition papers to Washington for the surrender of
Gina Haspel.
One can only hope that the thugs involved are similarly
brought to justice by the German courts, or those of any other nation
embracing the doctrine of universal jurisdiction over crimes against
humanity. The world desperately needs some serious cleansing of the
mounting list of evil practices committed by arrogant actors in states
whose people seem incapable of punishing or deterring bad behavior by
homegrown villains.
And when justice has been so served in a few cases without
the sky or the stock market falling, perhaps we will realize that we can
and should be taking care of our own housecleaning chores.

themselves...too wise not to detect the false pride or the dangerous
ambitions or the selfish schemes which so often hide themselves under
that deceptive cry of mock patriotism: 'Our country, right or wrong!'
They will not fail to recognize that our dignity, our free institutions
and the peace and welfare of this and coming generations of Americans
will be secure only as we cling to the watchword of true patriotism:
'Our country--when right to be kept right; when wrong to be put right.'"
SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE
EXPECTED when you're trying to explain to someone that
everything they've been encouraged their whole lives to
believe about something as entrenched and significant as the
income tax is basically nonsense. So here's a way to help
cut through the resistance:
Ask your listener how he or she would react if
you were to show an announcement from the Commissioner of
Internal Revenue admitting that the tax doesn't apply to the
earnings of most Americans and is misapplied most of the
time because people don't understand how it works? Or how
about if you showed a ruling from the Supreme Court saying
the same?
Now you just have to explain that
you're going to show exactly those things-- but because
the state really doesn't want people to know this, these
things haven't been said quite as forthrightly as we would
all wish. It's going to take a bit more work to take these
admissions in than is sufficient for just reading a press
release. But it'll be worth the effort...
IF YOU'RE NOT SPREADING THIS LINK with every bit of
energy you can, to school libraries, homeschool
families and community groups, your neighbors, your
family members, your pastors and
co-congregationalists, journalists, lawyers, CPAs,
members of congress, tax-agency workers, Wikipedia,
Anonymous, WikiLeaks, the Tax Foundation, everyone
in the "tax honesty" movement, the 9/11 truth
movement, other activist movements and everyone
else,
you have only yourself to blame for your
troubles with the tax, and a whole lot else of which
you might complain. It's on you.

explaining what will be seen at the link-- cryptic
is bad; excited is good-- and then send this WMI
(weapon of mass instruction) far and wide.
Remember: Real Americans don't accommodate fog, lies and a sliding scale of
adherence to the rule of law. Real American men and women stand up for the
truth and the law, come what may, knowing that it is only by setting the bar
at the top and enforcing it, come what may, that liberties are secured.

The American economy has been shut down by foolish
government orders, and the insights of Mises and Rothbard tell us that complete
collapse is only a matter of time. In an earlier column, I warned that the Deep
State might seek to start a war with China to divert attention from our domestic
mess. As I warned last month, “Because the epidemic started in China and spread
from there, hostility toward Chinese people living in the US has gone up.
Chinese-owned stores have been threatened, and gun sales to Chinese who fear
attacks have soared. Chinese restaurants have few takeout customers.
“The President’s talk about the ‘Chinese virus’
fans the flame of ill-feelings, and some fear that the government may
provoke a war with China in order to distract attention from a tanking
US economy. US government propaganda has spread false claims about
predatory Chinese trade practices to get the American people ready for
hostile action toward China.”
Unfortunately, things have gotten much worse
since last month. America continues its policies of naval confrontation
in the South China Sea; there are threats to sue China for damage caused
by the coronavirus; and President Trump has threatened to pursue payment
on long-defunct Chinese bonds in order to bankrupt the Chinese economy.
Our disastrous trade war with China continues.
But today I want to focus on something even
more sinister. There is good reason to believe that the coronavirus
epidemic is part of an American biological warfare campaign against
China and Iran. The brilliant physicist Ron Unz, who has time and time
again been proved right by events, makes this case in a
scintillating analysis.
Unz notes that “Shortly before the coronavirus
outbreak in Wuhan, that city had hosted 300 visiting American military
officers, who came to participate in the
2019 Military World Games, an absolutely remarkable coincidence of
timing. As I
pointed out at the time, how would Americans react if 300 Chinese
military officers had paid an extended visit to Chicago, and soon
afterward a mysterious and deadly epidemic had suddenly broken out in
that city?. . .
“Scientific investigation of the coronavirus
had already pointed to its origins in a bat virus, leading to widespread
media speculation that bats sold as food in the Wuhan open markets had
been the original disease vector. Meanwhile, the orchestrated waves of
anti-China accusations had emphasized Chinese laboratory research on
that same viral source. But we soon published a
lengthy article by investigative journalist Whitney Webb providing
copious evidence of America’s own enormous biowarfare research efforts,
which had similarly focused for years on bat viruses.”
LEW ROCKWELL AND RON UNZ have mirrored my own concerns (as somewhat
less directly stated in my March 26
call for a reward to discover the culpable party for the release of this
virus if indeed it began as a bioweapon). Although I haven't yet read Unz's
article, I imagine he adds to his picture not only the curious circumstances at
Fort Detrick, beginning last August, to which I provide a link in my article,
but also the notable coincidence of the Gates Foundation/WHO "Event 201" in
October (which I discuss a bit in
my afterword here), among other things...
All-in-all, there's a good deal of at least circumstantial
evidence of United States culpability by which any rational and alert
observer might be intrigued or even made suspicious. I'd rather no such
culpability exists, but again, any rational and alert observer has noted
that the state steadily metastasizing in the District of Columbia since
at least the time of the Spanish-American war has during the past 30
years become a relentless and utterly-unscrupulous engine of world-wide
death and destruction.
United States callousness toward people of other countries
is even more heinous, involving the unprovoked invasion of multiple
foreign countries, the production of widows, orphans and refugees on
an industrial scale, and even assassinations-- both of foreign officials
and American citizens. There is, sadly, no good reason to doubt that those
with their claws on the levers of power in Washington would stick for a
moment at inflicting a lives-and-economy destroying virus on the world
if it was believed that they would in any way fare better in the end for
having done so.
STILL, AND ALL THAT SAID, I will stand with
my own presentation on the
matter. I am uncertain as to what did happen but very interested in
having the truth come out so that proper deterrence against future
crimes of the same sort can be effected.
Every suspected actor is innocent until proven guilty. But
an effort must be made to find and prove guilt-- if any-- with all
possible deliberation and vigor.
Indeed, I think the practical utility and aptness of such
an effort is a no-brainer, and I find the mere
fact that the United States has NOT announced a reward in the terms I
propose suspicious by itself. This is especially so in light of the
steady efforts by denizens of DC to suggest Chinese culpability for the
pandemic, even if only in terms of negligence of one kind or another.
OF COURSE, even if culpability for the current affliction
upon the world-- which could be viewed as either the virus or the
hysterical panic in response to it-- cannot be laid at the feet of the
swamp-creatures in Washington, all those other evil behaviors of the
past and present which make such culpability feasible are, by
themselves, sufficient to make rational Americans want to drain that
swamp.
Every American should be sick at heart with the knowledge
that he or she has unwittingly paid for the production and deployment of
innumerable instruments of death against other people around the world.
Every American should be sick with anxiety at the knowledge that he or
she has been financing the development and roll-out of the means of
oppression here at home (especially in light of the current
demonstration of the ease with which those means can and will be taken
up by state operatives given any pretext for doing so).
Every American should be stern in his or her resolution to
become a champion on behalf of the rule of law and cease being a
mindless piggy-bank for the state.
DOES IT NOT OCCUR to people that it is their yielding-up
of resources that make possible the 24/7 surveillance to which they are
subjected, in defiance of the Fourth Amendment? Does it not occur to
people that it is their yielding-up of resources that put teeth in the
threats of harm at the hands of the state should they keep their
businesses open during the current
hobgoblin "crisis" and
keep their livelihoods and dignity intact?
Do people not realize that it is THEIR permissiveness at
the state's extraction of their wealth that allows Leviathan to exist,
in all its terrible and voracious appetites?
Sadly, people DON'T realize these things. At least, most
people don't realize the "yielding-up" and "permissiveness" parts of the
equations.
If they did-- if more Americans knew that as a matter of
law, those resources and that wealth are yielded-up entirely by their
choice, and that they have every right and power under the law to snap
shut the purse and let Leviathan shrink back down from 8,000 lb.
do-what-I-want gorilla to Constitutionally-intended "public-servant"
size-- I think we would see a change in the world for the better.
Needless to say, YOU can be an agent of that change.
EVEN AS ARDENT A STATIST as Abraham
Lincoln, in announcing his willingness to burn the Southern states to the ground in order to
keep them paying the tariff for the benefit of Northern interests in
his first inaugural address on March 4, 1861, paid at least lip
service to the Founders design of leaving control over the fuel
available to feed the fires Washington wants to light in the hands
of the individual citizenry when he said, "Doing this I deem to
be only a simple duty on my part; and I shall perform it, unless my
rightful masters, the American people, shall withhold the requisite
means..."

Illuminating Anniversaries of this week:
May 7- In 1429, Joan of Arc wins her first major military
victory, ending the Siege of Orleans. In 1824, Beethoven's Ninth Symphony
premiers in Vienna. In 1915, the British ship Lusitania is sunk by a German
U-boat with Americans on board. The fact that the ship, which was purportedly a
passenger and non-military cargo ship, was actually carrying a large load of
munitions from the U.S. to Britain was kept from the civilians encouraged to
take passage by U.S. and British officials, despite specific warnings from the
German government that the ship would be viewed as a military target. The
expected sinking and loss of American lives were then used to encourage popular
and Congressional support for American entry into World War I. In 1992,
Michigan gets around to ratifying what then becomes the 27th Amendment to the
United States Constitution (barring mid-term Congressional pay raises)-- 203
years after it was first submitted to the several states for approval. In 1998,
Mercedes-Benz buys Chrysler for $40 billion. In 2017, after 7 years of
grossly-unjust imprisonment, United States war-crime whistleblower Chelsea
Manning was released from federal prison on a qualified commutation of the
remaining 28 years of her sentence by outgoing President Barak Obama 5 months
before.
If you're not talking this one up everywhere and

Illuminating Anniversaries of this week:
May 10- In 1768, John Wilkes is
imprisoned for writing an article critical of King George III. The arrest
prompts a riot by his supporters. In 1775, the Second Continental Congress
convenes in Philadelphia. In 1801, the Barbary Pirates of Tripoli declare war
on the United States of America after newly-inaugurated President Thomas
Jefferson decided to stop paying them the tribute they had been receiving from
previous administrations. In 1869, the Lincoln administration's
transcontinental railroad is completed when the Central Pacific and Union
Pacific railroad lines meet in Promontory Summit, Utah. The Union Pacific
organization had built west from Council Bluffs, Iowa (a spot which was, at the
time of selection, 150 miles from the nearest existing rail line, but which
offered Lincoln personal political and financial benefits); Central had built
east from Sacramento. Both rail lines were heavily subsidized with land grants
and were made subject to permanent significant federal control, as were a number
of other smaller lines contracted to construct feeders from major terminal
cities along the way. In 1994, Nelson Mandela is inaugurated as president of
South Africa after spending 27 years in prison for "crimes against the state",
which included a campaign of sabotage against military and civilian government
targets, and the making of plans for a guerilla war against the government. In
2012, terrorists supported by the United States detonated two suicide car bombs
outside government buildings in Damascus, Syria, killing 55 and injuring 400.
Some voices challenge that assignment of responsibility, claiming that the Assad
regime carried out the bombings itself as a false-flag operation designed to
justify the regime's past and future actions. But everyone knows THAT kind of
thing never happens, right?

Hendrickson is also a widely-read essayist on

has served as co-chair and platform convention delegate of
Michigan’s largest county Libertarian Party organization; as a

Liberty. He is a frequent radio-show guest on stations across

Hendrickson's business career has included nearly a
decade-and-a-half at the leading edge of the renewable-energy
industry, both as Director of Purchasing and Materials
Management and member of the R&D board at Starpak Energy
Systems, the mid-west's then-largest solar heating and
energy-recovery-and re-utilization company; and as founder and
president of AFJ Inc., a high-efficiency lighting design,
manufacture and installation firm.
Beginning in the mid-1990s and continuing for the
twelve years before his present full-time focus on the
restoration of the rule of law in America, Hendrickson directed
purchasing activities for the $84 million-a-year
multi-family-housing division of the Farmington Hills, Michigan
branch of Edward Rose and Sons, with responsibility for 18,000+
apartments, direct supervision of 35 technicians and agents, and
incidental authority over several hundred divisional workers.
He also ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On rather the other end of the spectrum, amidst
these more mundane pursuits Hendrickson co-founded and was the
primary creative force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan,
with his wife and two children. He is currently working on his
next book.
