Why Does The IRS Lie About The Arguments Made In CtC? This question, though not raised for the first time here, may be more significant than previously imagined... I HAVE OFTEN POINTED OUT the happy opportunities offered by the fraudulent allegation that CtC argues that only government workers are subject to the income tax. This is the allegation created and deployed by Robert Metcalfe and Nancy Edmunds in 2006 as part of the government's fall-back effort to discourage the spread of CtC's liberating revelations after the failure of its attempts to simply ban the book outright. The falseness of this assertion by Metcalfe and Edmunds is so transparent, and its creation and deployment so unmistakably corrupt, that anyone to whom the facts are competently-presented should at minimum be made to wonder why such lies would be told in official proceedings and by high officers of government. So, this absurd lie is a wonderful tool to use against the very purpose for which it was created and deployed. I even created a video rebutting this nonsense, as the final product of a project titled, 'Uki-Goshi'. The name is taken from a Judo maneuver which involves the use of the opponents own weight, strength and momentum against it, just as pointing out the falseness of Metcalfe and Edmunds' allegation about the arguments in CtC is meant to do. Making this good use of the false allegation remains a very virtuous and productive exercise. It is my serious hope that everyone does all that they can in this regard. BUT I NOW BEGIN TO SUSPECT that there is a good deal more to the false ascription of the silly only-government-workers argument than I had previously imagined. I had previously imagined the fraud being deployed primarily as a weapon against me and Doreen (both in the bogus "civil case" in which it first appeared and then years later in the criminal assaults on each of us). Beyond that I had imagined its further use by the government as merely a sand-in-the-eyes virus meant to give trolls and other deniers a pretext for disparagement where no real one exists (i.e., "It has been found by a judge that this "CtC" thing is based on the notion that only government workers are subject to the income tax! Obviously the book is nonsense and no one should bother reading it!"). Now, however, things I have recently seen suggest another dimension to the deployment and exploitation of the product of Metcalfe and Edmunds' corruption. I now suspect that this false argument ascription to
CtC has been made a
sort of "secret legal argument". MY RECENTLY-CONCEIVED SUSPICION could explain the manifestly non-"position" description given as "Argument 44" in the fake "frivolous positions" list. Since the description is obviously not a position, and even the most dense IRS agent couldn't mistake it for one, perhaps it is simply associated elsewhere with the fake argument ascription. Maybe somewhere in a file cabinet in the agency is something along
the lines of, "People who file forms described in Such a calculation would still be a hoax, of course, and one known to be so. Otherwise why would this "position" ascription never once be declared, thereby making it potentially vulnerable to rebuttal? Understand, the FRP assertions being spoken of here NEVER declare an actual offending "position" of the filer. Why be so monolithically cagey about that if not because some indefensible pretense is being relied-upon, as I suggest here? At the same time, keep in mind that however much any given behavior may be abhorrent and seem inexcusable, there is always going to be a pretext for it all, even if only for "CYA" purposes. What to do about this charade SO, WHAT'S TO DO? Well, first and foremost, vigorously debunk as widely as possible (that is, into the larger American community) the false ascription to CtC of the "only government workers are subject to the tax" nonsense. All effective filings, no matter how constructed and even if not using a single actual IRS form but only alternative instruments serving the same legal purposes and having the same legal effects (as discussed here, for instance), will be classed as CtC-educated filings and subjected to the same fake list hoax attack. The only answer, then, is to disable the attack pretense directly. (Serendipitously, the process of debunking this fake ascription offers great opportunities for waking up those to whom they are directed. Exposés of official corruption which are this easy to demonstrate very thoroughly capture the inherent American desire to know what's behind such villainy.) ON THE MORE "CASE-BY-CASE" FRONT, I think a lot more energy should be put into demands for an express articulation of an actual "frivolous position" allegedly underlying what is said on CtC-educated filings which have been subjected to FRP assertions, if those assertions actually get to the point of meaningful threats to seize anything. (This would be the point at which the opportunity for a "collections due process" hearings arises, which is when such demands are appropriate and relevant, in my opinion.) A mere description of the forms filed, which is all that is offered when "ARG44" is the "explanation" for the asserted penalty, should be accepted by no one. (Btw, this demand for meaningful articulation should be done in any case, whether on the basis of my suspicion outlined above or not. It has always been ridiculous that these penalties are proposed for allegedly "frivolous" returns and yet the proposing tax agency will never, ever identify what it is on those filings that is allegedly "frivolous", even while offering, as often as not, to rescind the penalty proposal if the unidentified "frivolous" element is removed.) IN THE END, I think this creative and committed CtC community as a whole will knock this bs for a loop and turn its foul energy in on itself, to the advantage of the good guys at the same time (as discussed here). Are You Having Trouble Spreading The Word?? SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance: Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same? Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort... *****

***** About The Author Pete Hendrickson is possibly the most effective lawyer in history, even while never having set foot in a law school, nor ever being a card-carrying member of "the bar". He is the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes); further, since 2003 students of his legal analyses and arguments in ‘Cracking the Code- The Fascinating Truth About Taxation In America’’ (CtC), and its sequel, 'Was Grandpa Really a Moron?' have been routinely retaining and recovering billions of dollars which otherwise-- wrongly, but as a matter of course-- would have gone to federal or state government treasuries.
