Debunking The '1870s Income Tax Repeal' Myth

'Cause one dab of poo on a plate spoils the whole meal...

I WAS SKIMMING THROUGH a History of the Tax Court the other day. My initial expectations for the very scholarly-appearing, 953-page work were for a good, informative and entertaining read.

After all, the curb appeal was high. I learned from the forward that the study was commissioned (and paid for with your tax dollars) in the 1970s by C. Moxley Featherston, Chief Judge of the Tax Court, and authored by Albany Law School professor Harold Dubroff (with the assistance of several Tax Court judges and a number of the professor's former students). The writing spanned three long years, being completed in 1977.

But the face cred doesn't stop there!

Dubroff's work was then updated over another three years of labor between 2010 and 2013 for a revised Second Edition (at the cost of another tax-funded grant) by Washington and Lee University School of Law Professor Brant Hellwig. It appeared clear that this was work of some serious pros, unstinting in their efforts.

And I was impressed when I began the read. Until page 14, that is.

That's when I encountered the inexcusable declaration (complete with a supposedly-supporting statutory citation, no less!) that "[t]he income tax of the Civil War period was repealed effective 1872":

Unbelievable!

WELL, "UNBELIEVABLE" IS NOT REALLY the right word. This bit of dog-poo on the plate, by which everything in these 953 pages is suddenly made unreliable, and any expressions it might make regarding the nature of the tax are shown to be the product of people who don't know enough to be able to understand the subject at all, is actually very believable. At least, it is unsurprising.

This poo is the same sort of stinky as the little footnote you find in most every copy of the US Constitution published over the last 8 decades at article 1, section 9, Cl. 4. The footnote reads, "See the Sixteenth Amendment", as though the Sixteenth Amendment changed that clause, despite the US Supreme Court, Congress and Executive branch specialists all saying it didn't in every way possible over all the years since the Sixteenth Amendment was first alleged to have done that by Frank Brushaber in 1916.

Whoever is behind these little germs of disinformation badly wants everyone to imagine that the 1862 income tax was repealed; the fresh and new 1894 income tax was ruled unconstitutional by the Supreme Court in Pollock v. Farmer's Loan & Trust in 1895; the Sixteenth Amendment then authorized the tax the Pollock court had invalidated; and the 1913 income tax act was a launching of this new, previously invalid but now Constitutional unapportioned direct tax.

It's a fine, shiny chain of events, but it can't survive if any of its premises are invalid. And all of them are.

As will be seen documented below, the "repeal" thing is bogus. The Pollock court only ruled the 1894 revival of the 1862 tax unconstitutional "so far as it falls on the income of real estate [that is, rent] and of personal property [meaning dividends proceeding from personally-owned stock]".

The Sixteenth Amendment only:

"...prohibited the previous complete and plenary power of income taxation possessed by Congress from the beginning from being taken out of the category of indirect taxation to which it inherently belonged, and being placed in the category of direct taxation subject to apportionment by a consideration of the sources from which the income was derived -- that is, by testing the tax not by what it was, a tax on income, but by a mistaken theory deduced from the origin or source of the income taxed.”

Stanton v. Baltic Mining Co., 240 U.S. 103 (1916)

...and the 1913 income tax was just a resumption of the same, never-repealed tax first imposed in 1862. It has the same objects and characteristics the income tax has always had, the limited nature of which had allowed it to be repeatedly upheld as fully Constitutional without need for apportionment until the brief interruption of the mistaken Pollock decision, which the Sixteenth Amendment, as explained by the Stanton court, had simply overruled. SO, LET'S GET TO THE DEBUNK of Dubroff and Hellwig's "repeal" falsehood. You'll find it here.

I've mentioned the truth about this false "factoid" many times (including in CtC, of course), but had never bothered to document it until now (other than by including the relevant authorities on the CtC Companion CD). Now that is HAS been documented, please read it for yourself so as to own the information, and then please share this article around so that the evil effects of Dubroff and Hellwig's disinformation might be undone wherever possible. Take that latter note seriously, recognizing that there are likely a LOT of evil effects to be undone. Think (with a groan) about the fact that both of these guys were (or maybe still are) professors at prestigious law schools.

Think about the fact that each of these guys probably put hundreds of "tax attorneys" into the field. All of them will be operating on the basis of a misunderstanding of the true nature of the tax, thanks to Dubroff and Hellwig (and doubtless thanks to many other sloppy, incompetent or ill-intentioned "researchers" and writers whose nonsense they will have been fed, as well).

Keep this disinformation dynamic in mind whenever dealing with anyone claiming expertise in matters relating to the tax (whether "professional" or amateur), and courteously point it out to anyone else you know who is dealing with such folks. Unless and until those "experts" are vetted they should be presumed to be ignorant to the point of being a danger to themselves and others.

At least the vetting process is easy, though. Anyone who DOES know the income tax will show it by their unswerving embrace of everything taught in CtC, and their disdain for anything not taught in CtC.

ONE FINAL AND RATHER AMUSED OBSERVATION: The presence of Dubroff and Hellwig's bit of repeal-bs serves to explain the otherwise curious notes found in the preface to each edition, each of which I read without much interest until finding the spoiler on page 14.

In the first of these notes, found in Chief Tax Court Judge C. Moxley Featherston's Preface to the First Edition, Featherston (and his colleague, Judge Howard A. Dawson, Jr.) say, "Although members of the Court reviewed Professor Dubroff’s manuscript from time to time, the content of the study is solely the responsibility of Professor Dubroff and should not be taken to reflect the views of the Court or any of its Judges."

This cautious disclaimer is then repeated in the 2014 Preface to the Second Edition by then Chief Judge Michael B. Thornton and his colleague Judge John O. Colvin, who say the same about Hellwig's revision: "The content of the revised text is solely the responsibility of Professor Hellwig and should not be taken to reflect the views of the Court or any of its Judges."

I'm guessing these guys had actually read the nasty big thing and knew about the poo.

(And then, of course, they let the thing be published, anyway...)

Calling Things By Their True Names

RECENT EVENTS, BOTH DOMESTIC AND INTERNATIONAL, have served as reminders of the importance of calling things by their true and proper names. The practice of doing otherwise is that of dissemblers-- that is, people who mean to conceal, confuse, and exploit.

Domestically, we have the little fabricated kerfuffle over Donald Trump's recent tweet-upchucks as a great example. Adversaries of Trump claim that his tweets are directed at Ilhan Omar, Alexandria Ocasio-Cortez, Rashida Tlaib and Ayanna Pressley (although none of these people are mentioned by Trump).

This claim as to Trump's targets then sets the stage for an accusation of "racism" (because his alleged targets are all "people of color"). But that accusation is false.

"Racism" is a disdain or dislike of a person or persons purely because of some immutable physical characteristics which have nothing to do with how that person or persons behave. As such, it is mindless, heinous, and indefensible and thus a wonderful weapon, if the charge is appropriate and can be made to stick.

Here, it is not appropriate. The charge of "racism" here is a venal effort to conceal, confuse and exploit, because "racism" is manifestly not on display from Trump in the tweets involved in this matter.

INSTEAD, WHAT TRUMP IS REALLY DISPLAYING in his criticized tweets:

So interesting to see “Progressive” Democrat Congresswomen, who originally came from countries whose governments are a complete and total catastrophe, the worst, most corrupt and inept anywhere in the world (if they even have a functioning government at all), now loudly......

....and viciously telling the people of the United States, the greatest and most powerful Nation on earth, how our government is to be run. Why don’t they go back and help fix the totally broken and crime infested places from which they came. Then come back and show us how....

....it is done. These places need your help badly, you can’t leave fast enough. I’m sure that Nancy Pelosi would be very happy to quickly work out free travel arrangements!

...is "culturalism".

Trump's disdain and dislike is not "racist". It is plainly prompted by, and directed at, the relative barbarism of the socialist culture on behalf of which his unnamed targets advocate.

This fact, obvious when stated (and never not obvious to any fair-minded analysis of his words), is simply made capable of deliberate and self-serving misconstruction by Trump's typical sloppiness of expression and apparent ignorance of the fact that the socialist nests from whence came those of whom he speaks are not exclusive to foreign parts and are, in fact, resident in rich supply here in America.

It needs to be observed, in all fairness, that Trump himself could be guilty of the same sort of dissembling as the "racism"-slingers. He could be trying to suggest that socialism is only embraced and practiced by "others", and so tar his ideological opponents with the "otherness" brush...

But whatever Trump's intentions, it is the "racist"-slingers who have deliberately deployed a misnomer. And they have done so for the standard purpose of this sort of dissembling-- to corruptly divert the debate from a subject which is bad for them and set the stage for denunciation and exclusion from the public square of anyone who critiques their socialist policies in the future as, "racists, just like Trump!"

ANOTHER EXAMPLE OF MISNOMER ABUSE in the news lately is the deployment of the expression, "sanctions", most notably in regard to Iran. The US is incapable of imposing "sanctions" on Iran.

Properly used, "sanctions" (in the "punishment" sense of the term) would mean actions intended to enforce some legal obligation. But Iran is under no legal obligation to the United States. Nor is it under any to the European Union or the UK, which recently seized a cargo of Iranian oil.

Even the UN sanctions upon Iran for various alleged offenses which had been authorized by the UN Security Council in resolutions over the years were all terminated under the terms of the most recent such resolution (Resolution 2231) as a consequence of Iran's compliance with the Joint Comprehensive Plan of Action. That compliance has been certified by the International Atomic Energy Agency repeatedly since 2015.

Further, "sanctions" is just as much a misnomer in regard to UN resolutions, which actually impose no "legal obligations". Absent its own consent, Iran is no more subordinate to the governance of the United Nations than are the United States or Israel, for instance, both of which routinely ignore UN resolutions.

And even without regard to those facts about Iran itself, none of the other nations against which the United States is presuming to level "secondary sanctions" for interacting with Iran are under any such legal obligations.

SO, "SANCTIONS" IS A MISNOMER, intended to imply to the unknowing and the naive that Iran-- particularly back in May of last year--  had broken some law or some contract by which it is thus made righteously subject to the US military and economic assault which began in November, 2018, while Iran remained fully compliant with UN Resolution 2231. Every journalist and commentator using the expression is party to this propagandistic mendacity.

The truth is, Iran is simply the victim of an aggressive US (and now, EU-- or more specifically, UK) blockade.

A BLOCKADE IS, OF COURSE, an act of war. Consequently, the US has been in a posture of aggressive war upon Iran since at least November of 2018-- albeit as a poltroon, there having been no formal declaration of belligerence. The UK has now joined in, seizing an Iranian oil tanker in the Mediterranean.

All-in-all, the situation in regard to Iranian-US relations is an ugly one. But even without ascribing responsibility for any part of it to either side, it should not be made uglier still by the deliberate deployment of false names for the propagandistic benefit of one of those sides.

"I confidently trust that the American people will prove themselves...too wise not to detect the false pride or the dangerous ambitions or the selfish schemes which so often hide themselves under that deceptive cry of mock patriotism: 'Our country, right or wrong!' They will not fail to recognize that our dignity, our free institutions and the peace and welfare of this and coming generations of Americans will be secure only as we cling to the watchword of true patriotism: 'Our country--when right to be kept right; when wrong to be put right.'"

BOTH THE "RACISM" CHARGE leveled at Trump and the equally propagandistic misnomer of "sanctions" in regard to US aggression against Iran are classic examples of consent-engineering techniques through the corrupt manipulation of words. Each should serve as red-flag reminders that the People must remain in charge of their language.

Let's remember-- the law is a written thing, here in the Home of the Brave and the Land of the Free. Here, more than anywhere else, it is critically-important that words retain their meaning. That can only be ensured if we refuse to tolerate deviation, even when encouraged to do so by partisan political pressures.

Something Is Missing From The Immigration Debate

...or so it seems to me...

WHILE WE'RE ON THE SUBJECT of "things in the news" (as in the "True Names" article above), I have another complaint to air. This one concerns the "immigration" and border control debate.

I was listening to a radio news summary the other day in which, among other things, the immigration issue was discussed in some fashion or another. I found myself struck by a thought: Why don't we ever hear in these debates about immigration any straight-up discussion of WHY anyone would want more immigrants in America?

I mean, aren't we already pretty overstuffed? 330 million (or more) already here is PLENTY + TOO MANY. But I don't ever hear this point raised.

THOSE ON THE "PRO-IMMIGRANT" SIDE talk about the barbaric manner in which immigration is interdicted, and sometimes about the barbarous conditions in the countries from which some of these immigrants come. But neither of these justify stuffing more people into our already overcrowded cities (or losing more of our steadily-vanishing countryside to immigrant domiciles).

Americans in the aggregate have already embraced the discipline of restrained reproduction-- even to the point of a slightly diminishing population. As a rule, those on the immigrant-apologist side of the political spectrum celebrate that trend in a big way.

But oddly, the same folks who tend toward celebration of ZPG generally nonetheless rally in favor of blowing America's hard-won gains in that respect by letting in more people. Why aren't they being asked to explain this?

I REALIZE THAT THE DEMOCRATIC PARTY machine wants more immigrants, cynically figuring that on the whole, they are more likely to vote for the handout party-- especially if the gates are most widely opened to the impoverished, refugee-kind of immigrant. But this doesn't explain why grassroots Democrats would want this.

In fact, I would think grassroots Democrats-- all lathered about "climate change" and other alleged anthropogenic pathologies as they so often are-- would, rather than welcoming more energy consumers and trash and pollution generators to the USA, be instructing their representatives in Congress to shut the door here, while getting going on massive efforts to export zero population growth attitudes and education into the Third-World countries from which the immigrants are coming.

Or, if corrupt local political conditions in those Third-World countries are the rationale for emigration, rather than overcrowding and the poverty and danger overcrowding creates, these grassroots Democrats should be advocating aggressive but principled liberation and self-government campaigns, as discussed here, in a piece which is a bit dated (by 20 years or so) but still suitable for many situations, I think.

ANYWAY, I'M JUST SPITBALLIN' here. But I would very much like to see commentators and politicians on the "anti" side of the "open borders" debate begin posing the challenge to those of the "pro" side to plainly state their reasons for wanting (or being willing to accept) a rise in America's population.

I think that challenge would serve to clarify the issue dramatically and very usefully (and depending on the response, I have now put on the table a couple of ready-to-go solutions, right?).

FFOR ALL THE YEARS SINCE 2003 when CtC was first published, the government has engaged in a concerted effort to frighten people away from its truths. This effort involves official government websites and press releases touting an occasional court ruling that appears to be at odds with some CtC-revelation (but without details sufficient to expose the real substance of the ruling)-- and sometimes even more mendacious behavior.

Illuminating Anniversaries of this week: July 26- In 1788, New York becomes the 11th of the several states to authorize the existence of the federal government by ratification of the United States Constitution.  In 1947, President Harry Truman signs the National Security Act, creating the Department of Defense, the CIA, the Joint Chiefs of Staff and the National Security Council.

 

Are You Having Trouble Spreading The Word??

SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance:

Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same?

Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort...

Other Voices (followed by an important afterword)   The Death of Privacy: Government Fearmongers to Read Your Mail by Philip Giraldi It is discouraging to note just how the United States has been taking on the attributes of a police state since 9/11. Stories of police raids on people’s homes gone wrong are frequently in the news. In one recent incident, a heavily armed SWAT team was sent to a St. Louis county home. The armed officers entered the building without knocking, shot the family dog and forced the family members to kneel on the floor where they were able to watch their pet struggle and then die. The policemen then informed the family that they were there over failure to pay the gas bill. Animal rights groups report that the shooting of pets by police has become routine in many jurisdictions because the officers claim that they feel threatened. Indeed, any encounter with any police at any level has now become dangerous. Once upon a time it was possible to argue with an officer over the justification for a traffic ticket, but that is no longer the case. You have to sit with your hands clearly visible on the steering wheel while answering “Yes sir!” to anything the cop says. There have been numerous incidents where the uncooperative driver is ordered to get out of the car and winds up being tasered or shot. Courts consistently side with police officers and with the government when individual rights are violated while the Constitution of the United States itself has even been publicly described by the president as “archaic” and “a bad thing for the country.” The National Security Agency (NSA) routinely and illegally collects emails and phone calls made by citizens who have done nothing wrong and the government even denies to Americans the right to travel to countries that it disapproves of, most recently Cuba. And traveling itself has become an unpleasant experience even before one sits down in the 17 inches of seat-space offered by major airlines, with the gropers of the Transportation Security Administration (TSA) acting as judge, jury and executioner for travelers who have become confused by the constantly changing rules about what they can do and carry with them. The TSA is now routinely “examining” the phones and laptops of travelers and even downloading the information on them, all without a warrant or probable cause. And the TSA even has a “little list” that identifies travelers who are uncooperative and flags them for special harassment. Continued... It offers a concise and coherent alarm regarding real, serious-as-a-heart-attack ongoing assaults on our liberties and the rule of law. Make no mistake, if the impending threats Giraldi describes are not thwarted, and offenses already in place not quickly reversed, it's over and the lights in America will have gone out. NOW, NORMALLY WHAT WOULD FOLLOW that sort of observation in this space would be a critique of Giraldi's article for offering no remedy to the threats he enunciates, when the broad spectrum Leviathan remedy of CtC does exist. And I will present that critique in a moment. This week, though, I want to first point out that the privacy threats of which Giraldi warns are not only facilitated by the "ignorance tax", but are also products of another area of legal ignorance, misconstruction and exploitation. In this specialized case, the ignorance, misconstruction and exploitation all concern the real nature of the  prescriptions and proscriptions imposed by the People on the state by way of the Fourth Amendment. The fact is, the historical record, Madison's own notes and predecessors of the Fourth Amendment in the Constitutions of Pennsylvania, Virginia and Massachusetts make clear that present-day jurisprudence regarding the Fourth is in complete and lawless defiance of its enactors intent. It is only this distortion of the Fourth Amendment that offers even a fig-leaf of cover for the privacy assaults of which Giraldi warns. SO, I STRONGLY URGE EVERYONE to read and study the fascinating truth about the Fourth Amendment presented here. Pass the link on as widely as you can, as well. To the best of my knowledge, none of the authorities or analysis you will see there has ever seen the light of day inside a modern American court room. Nor had it found its way into early case law to reappear as controlling precedent because during the first century or so of the Fourth's history the substance of this material was universally understood. No one makes arguments or rulings concerning the obvious or widely known. Unfortunately, that tendency to not ensconce the obvious or widely-known into precedent opens the door for incremental deviations away from that obvious truth in poorly argued or decided cases. Eventually, after years of such deviations piled one atop another, the once-obvious and widely-known truth is buried out of sight under a rancid pile of (usually) state-serving precedents amounting to a hundred-year judicial game of "telephone". We the People would be well-served by restoring the constraints of the Fourth Amendment, properly understood. So, please, spread that link around, with a persuasive introductory message designed to get it clicked on and taken in. OKAY, NOW TO THE USUAL CRITIQUE that is found in this space after a great article like Giraldi's:  his cogent warnings are unaccompanied by any solutions to the threats. Above, I have offered one very targeted solution, particular to the specific object of Giraldi's article, and with which everyone should run hard. Beyond that resuscitation of the Fourth Amendment, though, let's also remember and share like wildfire the OVERALL remedy to the OVERALL problem at hand, both of which are laid out in detail here. Illuminating Anniversaries of this week: July 28- In 1868, the Fourteenth Amendment to the United States Constitution was declared ratified, despite considerable irregularities in the process.  As this amendment is a source of much misunderstanding within the "tax honesty" community, I refer those interested in the subject to the discussion here.  In 1914, World War I begins.  In 1945, a B-25 bomber crashes into the 79th floor of the Empire State building.  The building does not collapse.  In 2010, an Airbus A321-231 jetliner crashed in the hills north of Islamabad, Pakistan, killing all onboard, and producing a wreckage site of the kind ALWAYS produced by an actual crash, as is seen in the photos at the beginning of this page.  In 2017, Pakistan's Prime Minister, Nawaz Sharif, then serving his third (non-consecutive) term, was found guilty of corruption by a unanimous Supreme Court and barred from office for life. This resulted from a 2016 document dump of millions of leaked internal files from a law firm handling Sharif's private business dealings by the Washington, DC-based imitator of WikiLeaks known as 'The International Consortium of  Investigative Journalists'.

About The Author

Pete Hendrickson is possibly the most effective lawyer in history, even while never having set foot in a law school, nor ever being a card-carrying member of "the bar". He is the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes); further, since 2003 students of his legal analyses and arguments in ‘Cracking the Code- The Fascinating Truth About Taxation In America’’ (CtC), and its sequel, 'Was Grandpa Really a Moron?' have been routinely retaining and recovering billions of dollars which otherwise-- wrongly, but as a matter of course-- would have gone to federal or state government treasuries. This despite concerted efforts by government to suppress his work, and in some cases vigorously oppose the claims by his students.

Hendrickson is also a widely-read essayist on matters of politics, public policy and law; many of these works are collected in his second book, ‘Upholding the Law And Other Observations’. He is a member of Mensa; an award-winning artist; and has paid his dues as a youth soccer coach. He is a long-time political activist as well, and has served as co-chair and platform convention delegate of Michigan’s largest county Libertarian Party organization; as a consultant to the National Right to Work Foundation and Citizens for a Sound Economy; as a member of the Heartland Institute; and as a member of the International Society for Individual Liberty. He is a frequent radio-show guest on stations across the country.

Hendrickson's business career has included nearly a decade-and-a-half at the leading edge of the renewable-energy industry, both as Director of Purchasing and Materials Management and member of the R&D board at Starpak Energy Systems, the mid-west's then-largest solar heating and energy-recovery-and re-utilization company; and as founder and president of AFJ Inc., a high-efficiency lighting design, manufacture and installation firm.

Beginning in the mid-1990s and continuing for the twelve years before his present full-time focus on the restoration of the rule of law in America, Hendrickson directed purchasing activities for the $84 million-a-year multi-family-housing division of the Farmington Hills, Michigan branch of Edward Rose and Sons, with responsibility for 18,000+ apartments, direct supervision of 35 technicians and agents, and incidental authority over several hundred divisional workers. He also ran the division's 10 cable television earth-station and distribution systems in four states, and designed and administered the company's website.

On rather the other end of the spectrum, amidst these more mundane pursuits Hendrickson co-founded and was the primary creative force behind a small board- and card-game company that enjoyed a modest success for several years.

Hendrickson makes his home in southeast Michigan, with his wife and two children. He is currently working on his next book.
