This Year, Nobody Has To Vote For The Lesser Of
Two Evils
No more holding your nose and pulling the lever just to
keep the worse threat out of office.
HOW MANY TIMES have you cast a ballot for an unpleasing
political candidate simply to keep an even more unpleasing candidate
from the office? If you're a typical American voter and no longer wet
behind the ears, you've done it many times.
Over the last 80 years, that "lesser of two evils" choice
has become a commonplace where it never really had been before.
This is because over that 80 years audacious
hobgoblin-floggers have
skillfully exploited fears they have excited in the public mind and
ignorance they have nurtured about the limited scope of the income tax to attach
more and more power to the office they hold-- power which will be wielded
by each of their successors.
As a consequence, over that 80 years each politician
winning high office has become more and more capable of doing great harm to you
and your children. In the case of federal office-holders, the threat
extends to even non-Americans and their children, and to
the world overall.
In light of these threats, prudence has compelled American
voters to hold their noses and vote for folks their grandparents would
have hooted off the stage, if not committed them for psychiatric
evaluation-- because the other sociopath seeking the office is even
hairier and scarier.
Many, many such voters would rather cast ballots for
actually-pleasing third-party candidates. But those folks face the
prospect that by withholding a vote for the lesser evil major-party
candidate they will ensure that the greater evil from the other major
party takes power-- a prospect too grim to face considering the modern
scope of the power involved.
In the last presidential election a very large percentage
of the votes cast for either Donald Trump or Hillary Clinton were not
votes FOR the candidate chosen. They were votes AGAINST the opposition
candidate. And such has been the pattern for decades now.
This is no way for good Americans to make such choices. But
it has seemed necessary-- until now.
THIS YEAR,
THE CtC REMEDY offers all Americans the chance of liberation from
the 'Hobson's choice' of defensively backing an evil candidate-- a
candidate of greater or lesser evil, but evil nonetheless. All it takes
is a vigorous campaign by those in the know to spread awareness of the
truth about the income tax revealed in
CtC.
Widespread awareness of the truth about the tax will prompt
Americans to cease furnishing evil office-holders with the fuel by which
government power is fed. At that point, as in the past, even a real
monster taking office will be able to do little harm.
Picture a "swamp" confined to $1 trillion or so in total
annual income tax revenues-- "normal" income taxes and income "surtaxes"
(FICA taxes)-- with that amount diminishing as federal sprawl recedes
and fewer people find themselves entangled with the shrinking state. A
"swamp" with little or no ability to finance excess spending with debt,
and little or no ability to puff itself up with inflation (at least,
little more than the extraction with which Americans have already
learned to live).
The only available options are revenue tariffs (which are
never well-received unless kept relatively low, and which,
serendipitously, steer consumers to home industry products in any event)
and apportioned direct taxes (which are constrained in their scope by
Constitutional design and are incapable of profligacy due to the high
political accountability which attends their passage).
Not much of a "swamp", at that point, and draining fast in
size and influence as Washington's tentacles wither away from their
current grants-and-bureaucratic army-enabled intrusions into a million
places they don't belong.
Knowing this, American voters will stop voting for the
"better" monster, and will vote instead for policies they really favor.
It then won't be but a single election cycle before even the major
parties will race back to their roots and start fielding desirable
candidates as well, in order to still have a chance at even just the
little bit of pie remaining on the table. After all, half a loaf (or a
tenth of a loaf) is better than none.
SO, KNOW ANY THIRD-PARTY ENTHUSIASTS? Be a good neighbor
and make sure THEY know about
the CtC Remedy.
They'll love you for it.
And pass this along to every third-party candidate you
know, especially. They can and should run with it!
Share this all vigorously. The liberation you will deliver
to those other folks
will liberate you from ugly and dangerous Hobson's choices as well.

An Important History Lesson For
Legal Scholars And Pundits Alike
...debunking the relentlessly persistent "income tax began in 1913 with the 16th Amendment"
myth.
JUST LAST WEEK ALONE I encountered several ill-informed
assertions-- by well-known pundits and even one historian-- that the
origin of today's income tax is to be found in 1913 and the Sixteenth
Amendment. This mythological infection has burrowed deeply into the
American body of received wisdom, despite being not only wrong but
unmistakably contradicted by the sources of information most routinely
relied upon for accuracy regarding this sort of issue.
The persistence of this myth is a testament to its
importance to the "ignorance tax" scheme, the beneficiaries of which--
the IRS and other tax agencies, the DOJ and its state counterparts, and
the "tax professional industry"-- are its most flagrant boosters. So,
though I've done so before more than once, I'm going to take that myth
apart, in the hope that this latest debunking will find its way onto the
screens of every one of its victims.
Happily, doing that "take-apart" only requires a look at a
couple of as-mainstream-as-you-can-get authorities. The only challenge
will be overcoming that quirky human tendency to read things
selectively-- subconsciously editing as we go to harmonize what we're
seeing with what we already believe true. I'll provide a little guidance
(and some "emphasis added") where needed to meet that challenge.
TO START WITH, we have to remember the Pollock
case. This was a lawsuit by an investor
objecting to the payment of income taxes by Farmer's Loan & Trust Co. (now Citibank) on its national-railroading-related profits prior to
distributing them as dividends. The suit led to an 1895 Supreme Court
ruling that when the income
tax was applied to what had previously been viewed without controversy
as excisable dividends or rent it was transformed into a direct tax
requiring apportionment.
The
reasoning adopted by the court
was that since the sources from which dividends and rent are derived-- stock
or real estate-- are both personal property, any tax on those two forms
of gains amounted to a property tax. A tax on the fruit was a tax on the
tree and a tax on the tree was a direct tax, went the argument (which served a lot of
very corrupt and very powerful Washington interests of the time)
notwithstanding other considerations which by which those gains would
qualify for the excise.
Accordingly, the court declared:
"The tax imposed by sections 27 to 37, inclusive, of the act of
1894, so far as it falls on the income of real estate, and
of personal property [dividends], being a direct tax,
within the meaning of the constitution, and therefore
unconstitutional and void, because not apportioned according to
representation, all those sections, constituting one entire scheme
of taxation, are necessarily invalid.”
Pollock v. Farmer's Loan & Trust Co., 157 U.S.
429 (1895)
The purpose of the Sixteenth Amendment was to
overrule the Pollock court and allow the very popular income tax to
resume operations as before the corrupt interruption.
In 1916, a unanimous Supreme Court issued its landmark
ruling in Brushaber v.
Union Pacific RR. Co. (240
U.S. 1, 1916) sorting out and settling the purpose, meaning and effect of the Sixteenth Amendment,
as summarized above.
Reporting on that ruling at the time, the Cornell Law Quarterly
put it this way:
"The Amendment, the
[Supreme] court said, judged by the purpose for which it was passed, does
not treat income taxes as direct taxes but simply removed the ground which
led to their being considered as such in the Pollock case, namely, the
source of the income. Therefore, they are again to be classified in the
class of indirect taxes to which they by nature belong."
Un-parsed by knowing eyes, the import of this language can
just be skipped over without disturbing the deeply-encouraged myth of
the 1913, Sixteenth Amendment origin of the income tax. But let's do
that parsing:
"The Amendment ... simply removed the ground which led to
[income taxes] being considered as [direct taxes] in the Pollock case
[in 1895]" with those same taxes being "again ... classified
in the class of indirect taxes to which they by nature belong".
Can there be any doubt that the Cornell legal experts are
speaking of a tax pre-dating 1913 and the Sixteenth Amendment by 18
years and proceeding-- unchanged but merely pulled back on the track by
the amendment after being bumped off by the errant Pollock
court ruling-- into today's post-Sixteenth Amendment present?
This cannot be honestly misunderstood. The income tax DID
NOT begin in 1913 or by virtue of the Sixteenth Amendment. Period.
But let's continue...
Within the same month as its Brushaber ruling
the same Supreme Court ruled on another "income" tax-related case in
Stanton v. Baltic Mining Co., 240 U.S. 103 (1916). In
Stanton, the court makes this unambiguous statement:
“[B]y the [Brushaber] ruling, it was settled
that the provisions of the Sixteenth Amendment conferred no new
power of taxation, but simply prohibited the previous complete and
plenary power of income taxation possessed by Congress from the
beginning from being taken out of the category of indirect taxation
to which it inherently belonged, and being placed in the category of
direct taxation subject to apportionment by a consideration of the
sources from which the income was derived -- that is, by testing the
tax not by what it was, a tax on income, but by a mistaken theory
deduced from the origin or source of the income taxed.”
The Supremes saying the same again, a couple of
years later:
"The Sixteenth Amendment,
although referred to in argument, has no real bearing and may be put out of
view. As pointed out in recent decisions,it does not extend the taxing
power to new or excepted subjects..."
61 years later, the American Law Division of the Library of
Congress puts it this way:
"The Supreme Court, in a
decision written by Chief Justice White, first noted that the Sixteenth
Amendment did not authorize any new type of tax…"
Legislative Attorney of the
American Law Division of the Library of Congress Howard M. Zaritsky in his
1979 Report No. 80-19A, entitled 'Some Constitutional Questions
Regarding the Federal Income Tax Laws'
Fast-forward 9 more years and the Supreme Court says it
again:
"[T]he sole purpose of
the Sixteenth Amendment was to remove the apportionment requirement for
whichever incomes were otherwise taxable. 45 Cong. Rec.
2245-2246 (1910); id. at 2539; see also Brushaber v. Union Pacific R.
Co., 240 U. S. 1, 240 U. S. 17-18
(1916)
(This one benefits from a little knowledgeable parsing
as well, or its import is capable of being missed. Inserting the
clarifying elements we have:"[T]he sole purpose of
the Sixteenth Amendment was to remove the apportionment requirement [imposed
by the Pollock court in 1985 upon]
whichever incomes were [then] otherwise taxable.")
WELL, IS THIS ALL CLEAR ENOUGH?
The income tax pre-dates 1913 and the Sixteenth Amendment.
Does this matter? Of course it does, and hugely.
What is
proven by the evidence of the pre-amendment origin of the tax is that
the tax of today-- the same tax as yesterday's-- can and does only fall on the same
limited class of objects which were uncontroversially taxed without apportionment prior to
the Pollock interruption. That means the tax still only falls
on objects suited to an
indirect excise (which, in turn, means objects suited to a "privilege
tax", as also declared by
the Supreme Court).
It is in hope of obscuring this straightforward and
"ignorance tax"-threatening cognitive light-bulb that the myth-mongers
work so hard to promote the nonsense about 1913 and the Sixteenth
Amendment being the origin of today's tax. Indeed, even if these
mendicants admit that an income tax was collected prior to 1913 (which
is, of course, easy to prove and hard to deny), they pretend that the
post-1913 tax is different in character from the pre-1913 tax, even in
the face of every relevant authority saying otherwise.
The "ignorance tax" folks grasp that obscuring the truth
about the origin of the tax is that important to their scheme. YOU need
to grasp how important exposing the truth about the origin of the tax is
to liberating everyone from the "ignorance tax" scheme.
SO, SLAP ANY PUNDIT or professional you meet who speaks of
a 1913 origin of the tax with
this fistful of facts!
Make sure that he or she leaves the encounter knowing the truth and
ruminating on its implications.
You'll be helping restore liberty and the rule of law in
America-- one mind at a time. But they'll do it wholesale once they've
thought it all through.

Regarding Trolleries
(Deceitful efforts to discourage Americans from
learning the truth about the "income tax")
FOR ALL THE YEARS SINCE 2003 when
CtC was first published, the government has engaged in a
concerted effort to frighten people away from its truths. This
effort involves official government websites and press releases
touting an occasional court ruling that appears to be at odds
with some
CtC-revelation (but without details sufficient to expose the
real substance of the ruling)--
and sometimes even more mendacious behavior.
Are the presentations and
resources offered on this site and in my other work of any value to you?
Tim Kendrick has posted
a video
on YouTube regarding donations. I didn't know what to do about
it to begin with; I don't do what I do intending for anyone to
feel obligated in any way.
But of course, no one IS obligated. I will continue
to make my work freely-available here, and in my books for only
the cost of a cheap paperback.
Thus, even though I post it here below, Tim's very
thoughtful personal resolution and encouragement to others is
just an invitation for consideration by those who may not be
conscious of the fact that I can't do what I do without support.

Are You Having Trouble Spreading The
Word??
SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE
EXPECTED when you're trying to explain to someone that
everything they've been encouraged their whole lives to
believe about something as entrenched and significant as the
income tax is basically nonsense. So here's a way to help
cut through the resistance:
Ask your listener how he or she would react if
you were to show an announcement from the Commissioner of
Internal Revenue admitting that the tax doesn't apply to the
earnings of most Americans and is misapplied most of the
time because people don't understand how it works? Or how
about if you showed a ruling from the Supreme Court saying
the same?
Now you just have to explain that
you're going to show exactly those things-- but because
the state really doesn't want people to know this, these
things haven't been said quite as forthrightly as we would
all wish. It's going to take a bit more work to take these
admissions in than is sufficient for just reading a press
release. But it'll be worth the effort...
IF YOU'RE NOT SPREADING THIS LINK with every bit of
energy you can, to school libraries, homeschool
families and community groups, your neighbors, your
family members, your pastors and
co-congregationalists, journalists, lawyers, CPAs,
members of congress, tax-agency workers, Wikipedia,
Anonymous, WikiLeaks, the Tax Foundation, everyone
in the "tax honesty" movement, the 9/11 truth
movement, other activist movements and everyone
else,
you have only yourself to blame for your
troubles with the tax, and a whole lot else of which

Following the U.S. assassination of Soleimani, the Trump
administration is leading American conduct abroad into a zone of
probably unprecedented lawlessness.

Of all the preposterous assertions made since the drone
assassination of Qassem Soleimani in Baghdad on Jan. 3, the prize for bottomless
ignorance must go to the bottomlessly ignorant Mike Pompeo.
Speaking after the influential Iranian general’s death,
our frightening secretary of state declaimed on CBS’s Face the Nation, “There
was sound and just and legal reason for the actions the President took, and the
world is safer as a result.” In appearances on five news programs on the same
Sunday morning, the evangelical paranoid who now runs American foreign policy
was a singer with a one-note tune. “It’s very clear the world’s a safer place
today,” Pompeo said on ABC’s Jan. 5 edition of This Week.
In our late-imperial phase, we seem to have reached
that moment when, whatever high officials say in matters of the empire’s foreign
policy, we must consider whether the opposite is in fact the case. So we have it
now.
We are not safer now that Soleimani, a revered
figure across much of the Middle East, has been murdered. The planet has
just become significantly more dangerous, especially but not only for
Americans, and this is so for one simple reason: The Trump
administration, Pompeo bearing the standard, has just tipped American
conduct abroad into a zone of probably unprecedented lawlessness,
Pompeo’s nonsensical claim to legality notwithstanding.
This is a very consequential line to cross.
Hardly does it hold that Washington’s foreign
policy cliques customarily keep international law uppermost in their
minds and that recent events are aberrations. Nothing suggests policy
planners even consider legalities except when it makes useful propaganda
to charge others with violating international statutes and conventions.
Neither can the Soleimani assassination be
understood in isolation: This was only the most reckless of numerous
policy decisions recently taken in the Middle East. Since late last
year, to consider merely the immediate past, the Trump administration
has acted ever more flagrantly in violation of all international legal
authorities and documents — the UN Charter, the International Criminal
Court, and the International Court of Justice in the Hague chief among
them.
PATRICK LAWRENCE IS SO GRIMLY CORRECT-- and not least in his
unveiled condemnation of Mike Pompeo. The United States Secretary of State is manifestly insane,
and this has never been more plainly on display than in the wake of the Soleimani murder.
In fact, in light of the transparency of Pompeo's recent
displays of war-lust soicopathy, his continuation
in office to this date is by itself sufficient to prove that Donald Trump has never actually
meant anything he ever said about wanting to get out of Middle East wars.
But the reasons are immaterial. What IS material is that
Pompeo and his boss are lathering the horses in their drive to ignite
Hell on Earth for some, if
not for all of us.
AMERICANS WHO ARE NOT INSANE need to step up, and
step up briskly. We'd be crazy ourselves to wait until more crimes are
committed, or worse, before pulling the plug on the Rock'em Sock'em
Robots of DC.
As P.J. O'Rourke pithily observed, "Giving money and power
to politicians is like giving whiskey and car keys to teenage boys."
Sane Americans need to take away the money and power from the crazies
behind the wheel. After all, we're in the back seat of that car...
Call it prudent pre-emption of an imminent threat... Even
the crazies will appreciate the reasoning, or at least the irony.
HERE'S WHAT NEEDS TO BE DONE: Help your neighbors
learn the truth--
about the law; about Leviathan; and about the liars. They'll resist and
resist and resist, as the propaganda in which they've been steeped all
their lives struggles to maintain its grip and keep them drinking the
Kool-Aid. But the truth will win in
the end, if you are persistent.
"I confidently trust that the American people will prove
themselves...too wise not to detect the false pride or the dangerous
ambitions or the selfish schemes which so often hide themselves under
that deceptive cry of mock patriotism: 'Our country, right or wrong!'
They will not fail to recognize that our dignity, our free institutions
and the peace and welfare of this and coming generations of Americans
will be secure only as we cling to the watchword of true patriotism:
'Our country--when right to be kept right; when wrong to be put right.'"
EVEN AS ARDENT A STATIST as Abraham
Lincoln, in announcing his willingness to burn the Southern states to the ground in order to
keep them paying the tariff for the benefit of Northern interests in
his first inaugural address on March 4, 1861, paid at least lip
service to the Founders design of leaving control over the fuel
available to feed the fires Washington wants to light in the hands
of the individual citizenry when he said, "Doing this I deem to
be only a simple duty on my part; and I shall perform it, unless my
rightful masters, the American people, shall withhold the requisite
means..."

Hendrickson is also a widely-read essayist on

soccer coach. He is a long-time political activist as well, and
has served as co-chair and platform convention delegate of
Michigan’s largest county Libertarian Party organization; as a
consultant to the National Right to Work Foundation and Citizens
for a Sound Economy; as a member of the Heartland Institute; and
as a member of the International Society for Individual
Liberty. He is a frequent radio-show guest on stations across
the country.
Hendrickson's business career has included nearly a
decade-and-a-half at the leading edge of the renewable-energy
industry, both as Director of Purchasing and Materials
Management and member of the R&D board at Starpak Energy
Systems, the mid-west's then-largest solar heating and
energy-recovery-and re-utilization company; and as founder and
president of AFJ Inc., a high-efficiency lighting design,
manufacture and installation firm.
Beginning in the mid-1990s and continuing for the
twelve years before his present full-time focus on the
restoration of the rule of law in America, Hendrickson directed
purchasing activities for the $84 million-a-year
multi-family-housing division of the Farmington Hills, Michigan
branch of Edward Rose and Sons, with responsibility for 18,000+
apartments, direct supervision of 35 technicians and agents, and
incidental authority over several hundred divisional workers.
He also ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On rather the other end of the spectrum, amidst
these more mundane pursuits Hendrickson co-founded and was the
primary creative force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan,
with his wife and two children. He is currently working on his
next book.
