A Few Words On The Constitution...

...in the hope of countering long-running government efforts to sow confusion about the instrument.

THE LAST THING THAT ANY AMERICAN PUNDIT should ever have to explain is what a Constitution is all about-- and especially any American federal or union state Constitution. However, the last several generations of parents have let themselves be fooled or distracted into putting their precious children into the hands of state indoctrination centers (known as "public schools").

As a consequence of that unfortunate negligence, the country is now overrun with people who are empowered with the franchise and yet deeply miseducated about the nature of our governmental structure. Here, then, are a few words meant to help remedy that problem.

FIRST PRINCIPLES: The People govern.

This principle is realized NOT by the People choosing from amongst themselves who will govern. Rather, self-government is realized by the People's foundational determination of what they will require and permit to be done by the governing structure they are about to establish.

In this primal process, the People enact the laws by which those whom they will later choose from among themselves to administer the powers they mean to delegate will be governed. All acts of those delegates must harmoniously conform to every element of these fundamental laws, and no power can be exercised by the delegates unless authorized by these fundamental laws.

The delegates, then, comprise a subordinate legislature which will make the specific and detailed rules by which the duties and responsibilities imposed by the Constitution are to be carried out. There will also be an executive department by which those rules will be put into effect; and a judicial office which will adjudicate disputes arising in connection with the foregoing activities.

PROPER CONSTITUTIONS TYPICALLY CONSIST OF five basic elements:

• The mechanical structure of the government-- bi-cameral or unicameral legislature; type of executive officers; how office-holders are chosen, etc..

• The duties and responsibilities of the government, both broadly and in many cases, very finely drawn. Here the limits of the government's authority are established. As noted above, a Constitutional government can do nothing not within the scope of a prescribed duty or responsibility, and can do nothing which violates a prescribed duty or responsibility. Perceived conflicts must default to inaction, because the government cannot do what it is not Constitutionally-authorized to do, and it cannot be authorized to violate any part of the Constitution, even if it appears (or is argued) that one duty compels the violation or compromise of another.

• The things the government is allowed to do in carrying out its duties and responsibilities.

• The things the government is prohibited from doing, even under the pretext of carrying out its duties and responsibilities.

• A mechanism by which the People can amend the Constitution, with or without the cooperation of the governing structure it creates.

OUR AMERICAN CONSTITUIONS tend to be very proper and effective instruments.

Look, for instance, at the United States Constitution. All five of the elements described above are carefully constructed. The instrument diffuses the power it delegates over three theoretically jealous and competing branches and, much more importantly, leaves the fundamental power of the purse primarily in the hands of the entirety of the People, in their individual capacities.

That the government created by the Constitution is confined in its powers and authorities and subordinate to the fundamental law is spelled out explicitly in the necessary and proper clause of Article I, Sec. 8, the "in pursuance thereof" language of Article VI, and the Ninth and Tenth Amendments. It is implicitly expressed by the enumeration of powers and the inclusion of the various express prescriptions and proscriptions throughout the instrument.

Our Founders and Framers were close students of history and knew well that, "[t]he natural progress of things is for liberty to yield and government [that is, despotism] to gain ground", as Jefferson put it, if great care was not taken to provide against such a course of events. They took that care.

THERE IS ONE DICEY LINK in the chain the Founders and Framers forged to bind down the government they created, though. It is the one thing they could not control: The wisdom and character of their descendants and heirs down through the centuries.

Complaints and criticisms have been made over the years by folks who don't understand that singular problem, and who seem to think that the Constitution has an enforcement army hidden someplace within the parchment upon which it is written. Lysander Spooner's famous but foolish complaint that either the Constitution is responsible for the injustices and corruption in America or has proven incapable of preventing them is a good example, and one often dredged up today.

But there is no such robotic or supernatural army, of course. Realization of the Constitution's purposes is 100% and inescapably reliant on those descendants and heirs of its designers, who must remain educated, alert and resolute against the dangers anticipated by the Constitutional design.

UNFORTUNATELY, SEVERAL RECENT GENERATIONS of the Founders' descendants and heirs have proven unequal to their responsibility for the preservation of self-government. These folks, for one reason or another, have fallen asleep at the wheel.

Hence, over the last 85 years inadequately supervised actors in the subordinate federal government (with the support of an especially-corrupt judiciary) have managed to create pretenses of laws violating nearly every liberty-protecting, state-restraining element in the U.S. Constitution. (Think, military aggressions without declarations of war by Congress; innumerable First Amendment violations; the "drug war"; and the offenses discussed here, here, here and here for a few examples. Here's another: Though I haven't read the opinion in full yet, it appears that the Supreme Court just blew a raspberry to the "double jeopardy" clause in the Fifth Amendment...)

They have even managed to erect and exploit a long-running scheme to subvert the strict Constitutional limits on the federal power to tax, albeit solely by craft.

BUT HERE'S THE THING about Constitutions: They are durable artifacts.

Being written and preserved, a Constitution's prescriptions and proscriptions only change by amendment. However distant from those prescriptions and proscriptions the subordinate governing structure created by a Constitution may stray, and however long it may be left free to exercise powers not authorized, that straying and exercising never becomes authorized, valid or entitled to respect.

Consequently, any generation, upon awakening to the slippage and the danger, can rein in the rogue subordinate government. They can do so with the full authority of the fundamental law, and in the certain knowledge that any act of that government in violation thereof is null and void and has no authority whatever, even if done with the connivance or approval of every official within that government-- legislative, executive or judicial.

SUMMING IT ALL UP: Proper Constitutions are marvelous things. Creating organized structures by which to shield individuals from the hazards of an inherently predatory world, and yet superseding and regulating the legislatures, executives and judicial officers they authorize, Constitutions are the only real, enduring and effective engines capable of preserving the authority and the liberties of self-governing sovereigns.

But they have no armies of enforcers within them.

That enforcement thing is our job.

I Just Can't Stop Sharing Victories!

Call me a junkie for American heroism!

I'VE BEEN POSTING A LOT OF VICTORIES LATELY, and each time I do I fully intend to give it a rest for awhile. But I just love celebrating heroes.

So, while I'll cool down the volume a bit this week, I am going to share a couple of nice two-fers (concurrent state and fed victories), each pair of which welcome a new warrior to the community, and one of which reflects a little misread of the law that remains very widespread in America, and merits a bit of comment.

Robert Foti

ROBERT ALSO SHARES VICTORIES FOR 2018 with both the feds and his home state-- in Robert's case, California. Here is Robert's complete federal refund:

Here is the filing that produced this complete refund, and in which a little misunderstanding of the law is reflected but which plays out in an interesting way. You'll notice that rather than list his Social security benefits on the line 5a of his 1040, Robert reports them by way of a Form 4852.

Robert's handing of the benefits in this way reflects his perception of the benefits as "retirement account" payouts"-- and in fact, Robert explains his treatment of the payments by pointing out that the Social Security extractions were from his non-taxable earnings in the first place, invoking the formula articulated here.

Now, the error is that Social security benefits are not, in fact, "retirement account" payouts, or anything like that. They are simply welfare payments, with no legal connection between the surtaxes taken under the FICA provisions and access to the benefits. The connection between the two is purely whimsical, and a sufficiently mercurial Congress could sever it at any time.

The interesting thing about this mistake is that it goes entirely unremarked by the government, despite Robert's filing having gone through the typical heavy gauntlet of careful and suspicious vetting marched through by every CtC filing before conversion to a check and then on to a mailbox. Why?

Maybe I'm just cynical, but I've seen the IRS catch even the most insignificant mistake imaginable. This one, I suspect, was let go for two reasons, acting in combination:

• First, because even if properly reported on the 1040 no tax would have resulted and the refund would have been the same.

• Secondly, and much more importantly, because the "ignorance tax" schemers continue to get a great deal of benefit from widespread misunderstanding of Social security.

Correcting Robert's mistake would have done nothing for the Treasury's bottom line. Letting it go, and thus perhaps helping perpetuate the myth which underlies that mistake absolutely does, in its contribution to the the clutter keeping a lot of folks from learning the truth about the tax.

ANYWAY... here is Robert's California victory:

Not much money recaptured, but a whole lot of power and dignity changed hands here, and by way of this filing.

A brief commentary on the ongoing effort by co-opted nutcases in Washington to provoke war on Iran.

I SAW A HEADLINE IN A RECENT EDITION of the Washington Post: 'How Trump may get manipulated into war with Iran'. Truly an expression of blindness to reality.

Donald Trump is not going to get "manipulated" into war with Iran. Israel wants the US to make war on Iran, and therefore Donald Trump wants the US to make war on Iran.

Any other conclusion requires a disregard of everything Trump has done in office in connection with the Middle East. It would also reflect a childish buy-in to soothing rhetoric even in the face of a long record of contradictory actions.

The simple fact is, Trump is perfectly willing to say whatever he thinks the marks want to hear while doing whatever suits his own purposes. And endless experience has shown that Bibi's purposes are Donald's purposes.

ISRAEL WANTS IRAN DESTROYED (or at least, rendered into chaos) because Iran supports Hezbollah. Hezbollah is the sole roadblock to Israel's long-standing plan to seize southern Lebanon's water resources (and other assets). See the backstory and documentation here.

It is beyond the scope of my purposes in this article to consider how much of the totality of events in the Middle East from (and including) 9/11 forward have been planned or contrived toward the end goal of eliminating Iran (and Syria, to a lesser degree) as an effective support for Hezbollah and its thwarting of Israeli ambition upon Lebanon. But this is certainly possible.

It can be readily observed that one end result of all those events has been the steady implantation of US military bases in a convenient encirclement of Iran, as helpfully illustrated in this waggish but very pointed meme:

AGAIN, THOUGH, I'm not here to make a case for the motives behind what has gone before. My focus here is on the point that in light of Donald Trump's actions in regard to:

• the US Embassy relocation,

• the annexation of the Golan Heights,

• the pass given to any and all Israeli settlement activity,

• the cut-off of all support for the Palestinians in Gaza and the blind eye turned to the routine murders of the prisoners there by the Israeli military,

• the appointment of a rabid Israeli partisan as US ambassador to Israel,

• the persistent violation of 22 U.S.C. §§ 2799aa and 2799aa-1,

• the withdrawal from the nuclear agreement with Iran,

• the brutal sanctions imposed on Iran,

• the endless provocations meant to prod Iran into a reaction that can be fraudulently characterized as "Iranian aggression",

• the appointment of people like Mike Pompeo and John Bolton,

...and many other concrete demonstrations of reality as opposed to mere rhetoric, to imply that Trump DOESN'T want war with Iran-- especially when it has long-since been made clear that Israel practically pants for Iran's destruction, regardless of its reasons-- is risible.

DON'T LET THE SELF-PROCLAIMED "master deal-maker" (read: "master salesman") sell you a dose of eyewash and earfluff.

Only kids come to conclusions based on the talkin'.

Grown-ups judge by the walkin'.

Regarding Trolleries

(Deceitful efforts to discourage Americans from learning the truth about the "income tax")

FFOR ALL THE YEARS SINCE 2003 when CtC was first published, the government has engaged in a concerted effort to frighten people away from its truths. This effort involves official government websites and press releases touting an occasional court ruling that appears to be at odds with some CtC-revelation (but without details sufficient to expose the real substance of the ruling)-- and sometimes even more mendacious behavior.

Media Evasion Of CtC Must End, Now

Time, unfortunately, is on the side of the well-funded disinformation specialists class

 

Illuminating Anniversaries of this week: June 28- In 1914, Archduke Ferdinand of Austria is assassinated, sparking World War I.   In 1919, the Treaty of Versailles is signed, ending that war and imposing draconian sanctions on Germany, the effect of which was the rise of Adolph Hitler little more than a decade later.  In 1922, the Irish Civil War begins.  In 1967, Israel annexes East Jerusalem.  In 1992, the Constitution of Estonia is adopted.  In 1996, the Constitution of Ukraine is adopted.  In 2000, Elian Gonzalez is returned to captivity in Cuba.  In 2004, the U.S. declares its puppet government of Iraq to be sovereign in that country (up to a point...).

 

Are You Having Trouble Spreading The Word??

SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance:

Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same?

Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort...

Ask the man and his two young daughters who saw their wife and mother shot to death and were themselves wounded in a car fired upon by U.S. Marines in Fallujah on July 22, 2005, what they think of Julian Assange. Ask the parents of Huda Haleem, an 18-year-old girl, and Raghad Muhamad Haleem, a 5-year-old boy, shot dead by U.S. soldiers on June 2, 2006, in Iraq’s Diyala province what they think of Julian Assange. Ask the parents of the 15-year-old boy choked with a wire and then shot to death by U.S. Marines in Ramadi on Aug. 10, 2006, what they think of Julian Assange. Ask the relatives of Ahmed Salam Mohammad, who was shot dead on Nov. 27, 2006, when U.S. troops attacked a wedding party near Mosul, an attack that also left four wounded, what they think of Julian Assange. Ask the families of the over one dozen people shot to death with .50-caliber machine guns by bantering U.S. Apache helicopter crews in east Baghdad in July 2007—the crew members can be heard laughing at the “dead bastards” and saying “light ’em up” and “keep shooting, keep shooting”—a massacre that included two journalists for Reuters—Namir Noor-Eldeen and Saeed Chmagh—what they think of Julian Assange. Ask the then 10-year-old Sajad Mutashar and his 5-year-old sister, Doaha, both wounded, whose 43-year-old father, Saleh, was shot to death from the air as he attempted to assist one of the wounded men in the Baghdad street what they think of Julian Assange. There is nothing like the boot of the oppressor on your neck to give you moral clarity. None of these war crimes, and hundreds more reported to the U.S. military but never investigated, would have been made public without Julian, Chelsea Manning and WikiLeaks. What it discusses and warns of is as grim and serious as an assassin's bullet, and we are the ones with the red dot painted on our chests. The only problem with the article is its failure to offer a remedy to the outrageous assault it rightly denounces, and the danger it rightly trumpets. But I'll fill in that blank: Attacks on truth-tellers will stop when successful gate-keeping of facts no longer promises control of vast pools of wealth extracted from American men and women. This will happen when those men and women have stopped sending those vast pools of wealth to the state. Thus, as with so many other matters of the swamp, the only solution is the CtC solution, which is to say, the Founders' solution. In short, We the People (you and me) have to do as the Founders meant for us to do, and stop fueling bad behavior by people in power. We must make ourselves once again strong-- at their expense-- just as they have made themselves strong at our expense over the last 80 years! Illuminating Anniversaries of this week: June 29- In 1767, the British Parliament passes the "Townshend Acts", imposing taxes on many common items imported into the American colonies, shifting the payment of public officials from local communities to the British government (out of the new tax revenue), and reaffirming the use of "writs of assistance"-- general warrants used by tax agents to conduct "fishing expedition" searches without probable cause.  These measures prompted extreme reactions and resistance by the colonists, and contributed significantly to the development of revolutionary sentiment.  In 1956, the U.S. Interstate Highway System is born.  In 2006, the United States Supreme Court rules in Hamdan v. Rumsfeld that the Bush administration's plans to try Guantanamo Bay prisoners in military tribunal Star-Chamber proceedings violates both U.S. and international law.

About The Author

Pete Hendrickson is possibly the most effective lawyer in history, even while never having set foot in a law school, nor ever being a card-carrying member of "the bar". He is the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes); further, since 2003 students of his legal analyses and arguments in ‘Cracking the Code- The Fascinating Truth About Taxation In America’’ (CtC), and its sequel, 'Was Grandpa Really a Moron?' have been routinely retaining and recovering billions of dollars which otherwise-- wrongly, but as a matter of course-- would have gone to federal or state government treasuries. This despite concerted efforts by government to suppress his work, and in some cases vigorously oppose the claims by his students.

Hendrickson is also a widely-read essayist on matters of politics, public policy and law; many of these works are collected in his second book, ‘Upholding the Law And Other Observations’. He is a member of Mensa; an award-winning artist; and has paid his dues as a youth soccer coach. He is a long-time political activist as well, and has served as co-chair and platform convention delegate of Michigan’s largest county Libertarian Party organization; as a consultant to the National Right to Work Foundation and Citizens for a Sound Economy; as a member of the Heartland Institute; and as a member of the International Society for Individual Liberty. He is a frequent radio-show guest on stations across the country.

Hendrickson's business career has included nearly a decade-and-a-half at the leading edge of the renewable-energy industry, both as Director of Purchasing and Materials Management and member of the R&D board at Starpak Energy Systems, the mid-west's then-largest solar heating and energy-recovery-and re-utilization company; and as founder and president of AFJ Inc., a high-efficiency lighting design, manufacture and installation firm.

Beginning in the mid-1990s and continuing for the twelve years before his present full-time focus on the restoration of the rule of law in America, Hendrickson directed purchasing activities for the $84 million-a-year multi-family-housing division of the Farmington Hills, Michigan branch of Edward Rose and Sons, with responsibility for 18,000+ apartments, direct supervision of 35 technicians and agents, and incidental authority over several hundred divisional workers. He also ran the division's 10 cable television earth-station and distribution systems in four states, and designed and administered the company's website.

On rather the other end of the spectrum, amidst these more mundane pursuits Hendrickson co-founded and was the primary creative force behind a small board- and card-game company that enjoyed a modest success for several years.

Hendrickson makes his home in southeast Michigan, with his wife and two children. He is currently working on his next book.
