A disturbing little exercise in reverse engineering:
May 3- In 1802, Washington, D.C. is incorporated.
In 1901, a fire destroys much of Jacksonville, Florida. Unhindered by FEMA, the
city is quickly rebuilt. In 1916, captured leaders of Irish Easter Risings are
executed by the British. In 1921, West Virginia imposes the first union state
sales tax. In 1946, the International Military Tribunal for the Far East begins
trials of Japanese officials for offenses such as authorizing the waterboarding
and other inhumane acts to which captured enemy combatants were subjected.
Ultimately seven are executed and 16 are given life sentences.

Have American Educators Decided To Throw Real
Teaching Under The Bus?
A disturbing little exercise in reverse engineering.
HERE'S A LITTLE THOUGHT EXPERIMENT: Suppose that
beginning slowly back in the 1970s
many in the bureaucratic American education establishment-- teachers and
administrators-- discovered that it's hard to teach actual academic
material such as reading skills, math, sciences, the arts, history,
civics, logic, and so forth to kids immersed in a popular culture in which academic
accomplishment is increasingly disrespected-- even scorned. Similarly
(these folks discovered), it's hard to teach
kids from increasingly-common single-parent households-- or intact-family
households in which both parents work full-time (thanks
to ignorance about the income tax)-- where they
are increasingly less likely to be read to, thoughtfully reasoned with, or shown by example the practices
and profits of disciplined academic work.
Suppose these education bureaucrats likewise figured out that it's
difficult to get students to cooperate in producing satisfactory gender
and racial representation (such as in S.T.E.M. disciplines or class
rankings) per the notions of political pressure groups when those
students are disinclined to do so for any number of reasons (among which
could be that the notions of the political pressure groups are wrong).
Suppose that instead of digging in to hoe those tough rows,
these bureaucrats figured out that the easier option is to teach (and
argue) that systemic racism, misogyny and other evils are built into
traditional academic curricula and the overall institutional
environment. The object (continues the teaching and the argument) is to thwart
the achievements of underperforming or uncooperative students on behalf
of the patriarchy's interests.
This selfish design of the patriarchy is such that academic
underperformance or the failure of politically-desired proportional
representation are entirely due to externalities. None of it (goes the
narrative) is the fault of the students--
or of the teachers, of course-- nor due to flaws in the unmet
politically-motivated expectations.
IF THESE SUPPOSITIONS ARE SOUND (or to whatever degree they
might be) wouldn't it be reasonable to expect a conclusion among those
so taught that the only real solutions to the problems of
underachievement and disparate outcomes are the nurturing of grievance,
criticism of the traditional culture, focus on the "group identity"
purportedly distinguishing those being victimized by the patriarchic and
racist hegemon, and a revolutionary (or retaliatory, or just generally--
and aggressively-- contrary) impulse? Indeed, what else could be the
conclusion of those taught from childhood that they are victims, as
described above?
And isn't that conclusion exactly what we are seeing
dramatically-expressed in the group-and-grievance-identity politics
being shamelessly encouraged and exploited by progressives? Isn't that
conclusion just what we're seeing as the energy for a "cancel" culture
which recognizes no wrong in simply shutting off voices alleged to be
defending the patriarchal or "white supremacist" hegemon?
Wouldn't the string of curricular simplifications that we
have seen steadily trotted out by the public education industry over the
last several decades (all the way to the current "requirements
to show math work is racist" insanity)-- and
the falling academic performance with which they have been
accompanied-- be consistent with these
suppositions?
These ARE all just suppositions, of course. I have no
evidence of email exchanges between guilty parties plotting (or just
acknowledging) what I suggest may have taken place (or be taking place).
But someone is responsible for the astonishing eruption of the
ideological pathologies described above among today's young Americans. I think there is some grist here for the mill.
Two important responses which are often misunderstood and
overlooked.
I HEARD FOR THE FIRST TIME RECENTLY FROM someone who
describes himself as a long-time student of
CtC (since 2006), but who
only pulled it all together and stepped onto the field in 2016 with his
first educated return, followed by more every subsequent year. All of
these timely returns yielded victories.
My correspondent's string of successes was good cause for
celebration. But the reason for his reach-out was that upon having
finally resolved to take action in 2016, he had also filed belated
returns for 2003 - 2015, in regard to which he had been, until then, a
non-filer.
Two things happened in response to the thirteen belated filings.
The good one was the prompt
ending of what had become a steady monthly ding in the new warrior's
military retirement on the proposition that he owed taxes for the
previously unfiled years. The other, annoying response, a few years later, was a
batch of "frivolous return penalties" (FRPs) for these late filings.
My correspondent's interest in writing me was in getting
some feedback on his handling of these FRPs (which had already taken the
matter through IRS appeals) and guidance going forward (which would be
into tax court). His victories which I mentioned above only appear in what he sent to me by way
of references in exchanges with the IRS. No scans were provided.
Because doing so will benefit others, I am going to respond
to my correspondent by way of the remainder of this article (other than as to a few detail
issues which will be communicated just between the two of us). There are
two matters to address.
REGARDING THE FRPs, I will take this opportunity to
re-emphasize something I have occasion to repeat more often than should
be necessary: In my view, it is never helpful nor wise to argue issues not raised by the assertion
being
disputed.
In FRP assertions, the asserted "frivolous position" on which
targeted filings by CtC-educated filers are purportedly based is almost
always expressly identified as "Argument 44". "Argument 44" or "ARG44"
will appear on the Form
8278 authorizing the penalty for each of those filings as the declared
basis for the purported supervisor approval by which the penalty
assertion is held to be valid (as seen in the examples
here and
here).
As
presented here in considerable detail, "Argument 44"-- on the
official (and only legally-valid) list of "positions" in regard to which
a FRP can be imposed-- is the argument that:
(44) A taxpayer’s income is not taxable if the taxpayer assigns or
attributes the income to a religious organization (a “corporation sole”
or ministerial trust) claimed to be tax-exempt under section 501(c)(3),
or similar arguments described as frivolous in Rev. Rul. 2004-27, 2004-1
C.B. 625.
If "argument 44" is the asserted qualifying "frivolous
position" on which a return is approved for penalty (and no penalty can
be valid without written supervisor approval), the position quoted above
must be apparent on the face of the return (or otherwise established as
the basis for the self-assessment calculated thereon). Lacking evidence
of that basis, a penalty approved on an allegation of "Argument 44" is
invalid. Full stop.
In light of the simple legal mechanics arising from the
foregoing statutory facts, two elements appear as the sole real issues
relevant to the FRP being asserted in such a case. One is the question
of whether evidence of reliance on that
"position" actually appears on, or can be construed from, what appears on
the return. As noted above, lacking that evidence, the penalty fails.
Thus, pointing to the lack of such evidence is relevant to the issue.
THE OTHER (and somewhat less obvious) element is that since no evidence of reliance
upon "Argument 44" appears on, or can be construed from, the return, it
is clear that the "approval" given to the penalty was entirely without
actual scrutiny of the return or meaningful consideration of the aptness
of the penalty, and the penalty assertion is invalid on those grounds,
as well.
In other words, a qualified "supervisor's" signature
may
appear on the Form 8278 "approving" the penalty (or purport to appear,
there often being an open question of whether a signature in the
'approver's' field is actually that of the direct supervisor of the
penalty's originator, as required by law). But where no evidence appears
of the asserted qualifying "position", the "approval" was
plainly just a blind rubber-stamp, examining, and thus approving,
nothing.
These two elements are directly and exclusively relevant to
the penalty assertion. Leaving aside matters like whether the purported
"supervisor" really is one, or timing issues, nothing else is relevant
Although it may be hard for some to grasp, an "ARG44" FRP
assertion isn't alleging that a filer's earnings are "income", or that
he works for the Department of Transportation, or anything else. All
that is being alleged is that the filer completed his return on the
basis that his "income is not taxable if [he] assigns or attributes [it]
to a religious organization (a “corporation sole” or ministerial trust)
claimed to be tax-exempt under section 501(c)(3)", or similar arguments.
Period.
Again, whether THAT "POSITION"-RELIANCE ALLEGATION is
proven is all that matters in contesting the validity of the asserted
penalty (with the added fact that lacking such proof, the penalty is
also invalid for the manifest lack of legitimate supervisory approval).
All must make their own calls as to how to chart their
courses, but in my view, the two elements above are the only things that
should be argued in a dispute over an "ARG44" penalty assertion. Nothing
else is relevant; nothing else will help; and
anything else will actually cause problems.
NOW LET'S MOVE ON TO THE OTHER matter to be addressed-- the
failure of my new correspondent (and so, so many others out there) to
share with me his victories, so that I can share them with everyone
else.
As was very much the case last year, so far in 2021 I have
heard from many people announcing victories in upholding and enforcing
the rule of law with
CtC-educated
filings-- but without the documentation being submitted for posting.
This failure to share is, to be frank, irresponsible, and it really
needs to be corrected.
Let me explain...
AS HARD AS IT MAY BE for those further down the path to
remember from when they began their own journey, new folks just becoming
aware of CtC's
liberating, state-restraining information experience the transformation
of their understanding incrementally. One of the very first and biggest
roadblocks on this "Pilgrim's Progress"-- well-cultivated and reinforced
by tax agencies and their beneficiaries who don't want
CtC's
information to spread-- is the suspicion that
CtC-educated
victories, learning of which may be what brought them to the foot of the
path to begin with, are just "slips through the cracks" of some kind.
These 'tenderfeet' often haven't taken in enough facts and
evidence to dismiss the "slip through the cracks" anxiety, which is fed
heartily in every Americans' subconscious from lifetime-conditioned
deference to "official" narratives and fear of the IRS. These folks can
easily let those deeply-conditioned cognitive blinders push entirely out
of mind
the more than 17-year history of CtC, and all the authority of which
its revelations are comprised--
get a snapshot here--
even if those things have yet entered their minds at all by that point.
To such nervous tenderfeet, it is what happened
yesterday that matters, and their ability to see ongoing
victories-- especially the first new examples posted for each new year--
can be the difference between them proceeding down the path (and
learning why all of their anxieties are groundless, no matter what
happens), or turning away and retreating into the comforting darkness of
the barn.
IT MAY ALSO BE HARD for those further down the path to keep
in mind the enormous importance to their own well-being of LOTS
of Americans staying on the path and becoming
CtC-educated.
I don't think I should have to explain this-- everyone reading these
words must understand how important to their own happiness it would be
if the HR director at the company for which they work was so educated,
for instance.
It's important for everyone's security, as well. There will
be no obnoxious "FRP" assaults once enough Americans know the truth
about the tax.
Because these things are true, everyone already down the
path should view it as a very high priority to instantly share every
victory for posting here (see
formatting and submission guidance here)-- and to do their own
posting of those victories as well. Everyone should strongly want to see
these victories-- accompanied by referral to
LHC to learn more--
posted like a blizzard, everywhere possible.
FOR THOSE LIKE MY CORRESPONDENT in the matter discussed
above, who is himself being victimized by an obnoxious assault made
possible by widespread ignorance of
CtC's
truths, sharing victories and spreading the word is especially
important. Having unfortunately let the best time to do so-- immediately
upon winning them-- slip away, my correspondent should view jumping into
gear and sharing those victories to be as much an appropriate response
to that harassment as the legal response.
Likewise, the arising of any "pushback" should be a prompt
to anyone so targeted to go into high gear spreading the word, even if
without personal victories. This may seem like a big ask, so to speak,
but read this carefully:
In the discussion above of the legal issues involved in the
FRP assault, every one of you has been given a clear-as-day,
three-to-five-paragraph proof that the IRS is forced to resort to
complete pretenses and frauds when trying to stand in the way of a
CtC-educated
filer, or to discourage
CtC-educated
filings. Do you see what power these pretenses give you to open the eyes
of other people?
The fact is, the truth wins the cognitive battle-- both
when properly honored, and just as much when improperly disputed, as
long as those standing with it recognize the implications and
evidentiary utility of such bad behaviors.
So, c'mon, people! Share those victories (and post them
everywhere yourselves, too)!
As usual, the bilge from the MSM and the government (but I
repeat myself...) is unfit for consumption.
THERE IS LITTLE MORE NAUSEATING than the push from all
co-opted quarters just recently for everyone to get the "vaccine" so we
can return to normal. The baldly-stated subtext is that the "lockdown"
restrictions ordered by various governors won't get lifted until
everyone has submitted to the injection, so let's get going, people!
More, going unsaid (often due to suppression) is the fact
that a huge portion of the American population is already immune due to
exposure to the virus over the past 16 months, and thus herd immunity is
already fully in place. This explains why those wishing to keep the
panic alive for their own reasons have been pretending "cases" and
fatalities from this year's seasonal flu are C19 events and making
ridiculous assertions for why flu is going unreported.
FURTHER, (AND THE MAIN POINT HERE), going unsaid (often due
to suppression) is the fact that the naturally-acquired immunity from
exposure offers full protection against the much-touted "variants"
bug-a-boo-- unlike the currently-flogged "vaccines". Let me explain the
difference.
Your natural immune system breaks an invading pathogen down
into hundreds of subcomponents, training your body to protect against
any and all of them. "Variants" of a virus involve small changes to the
overall organism, and do nothing to hinder naturally-acquired immunity
from exposure, which will continue to kill the "varied" virus through
recognition of the 99% that is unchanged (all as better explained by
Dr. Michael Yeadon here).
The same complete, flexible protection would be obtained
from a real vaccine, which would involve the injection of actual C19
virus (either weakened or dead)
The current "vaccines", on the other hand, even if taken
only as advertised (or
quietly admitted) by the manufacturers and boosters, is only the
introduction of a description of a single, very narrow physiological
feature of the virus. These faux vaccines prompt immune response
training for nothing but that one feature. Those relying on such
"vaccines" ARE potentially vulnerable to variants-- but, ironically,
should hope to encounter one and become infected, so as to acquire more
complete immunity going forward...
ALL TOLD, everything we are being told about "the pandemic"
by the MSM and their government principals is horsesh*t, and should be
rejected with a grimace when served up for your consumption. Those who
dig in to the crap should be derided and deprogrammed. Those who serve
it up should be denounced.

the first half or so of the video below on the insanity of the current

creative self in sending and "selling" these links. Do memes; make
gifs; respond to everything in the news that would be or have been
better had the state been small, or if Americans kept their money
for their own uses.
If you pay attention to the news and train yourself to

can make use in awakening other Americans to the virtues of having
the income tax correctly administered. Please, for my sake, for your
own sake, for the sake of your children and their future, make that
use.

Not Letting This "Crisis" Go To Waste...
...an important action item opportunity.
FRIENDS, THE SPORADIC BITS OF EASING of the despotic measures to
which most of the country has been subjected this year should not be
allowed to bleed off the head of steam you probably had been developing.
The offenses happened, and they're far from over. Stay hot.
And while you are all warmed up, and while others, if
they're smart, are just as hot, I'd like you to send an email (and
Facebook post, or whatever) with the following content to everyone you
can (with a request that they pass it along, in turn):
[Name], over the last several months you've
watched as over-fed state power has been used to literally destroy
classical Western civilization and impose a new despotic paradigm. No
dissent or debate permitted-- no permission or agreement sought.
YOU KNOW where this will end up if the arrogant
state power being used to make this happen isn't radically diminished in
size, influence, resources and popular support, and exposed as an
opportunistic exploiter of legal ignorance (an ignorance which it has
been nurturing in the average mind for decades).
Those things having not yet happened, you
should be quaking in your boots-- and you probably are.
Isn't it time-- and past time-- for you to
begin helping to make those desperately-needed defensive changes take
place? There is only one way these things can happen short of a
who-knows-what we'll-end-up-with explosion of violence. I'm going to
show it to you.
When you're done with that reading, you'll know
what to do next.
BTW, REMEMBER, ALSO, THAT EVERY AMERICAN has lately been given a stark lesson in the fact
that government officials at all levels will lie to you and violate the
law without batting an eye. They will do so any time it serves their agenda, and
you don't call them out for it.
If you know anyone who has been persisting in denial on the
truth about the income tax, you know such nonsense is usually be
grounded in some version or another of, "That can't be true..." or "They
would never do something like that...". Now's the time to put a pin in
that delusional bubble.

like that.

FOR ALL THE YEARS SINCE 2003 when
CtC was first published, the government has engaged in a
concerted effort to frighten people away from its truths. This
effort involves official government websites and press releases
touting an occasional court ruling that appears to be at odds
with some
CtC-revelation (but without details sufficient to expose the
real substance of the ruling)--
and sometimes even more mendacious behavior.

on YouTube regarding donations. I didn't know what to do about
it to begin with; I don't do what I do intending for anyone to
feel obligated in any way.

thoughtful personal resolution and encouragement to others is
just an invitation for consideration by those who may not be

Are You Having Trouble Spreading The
Word?
SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE
EXPECTED when you're trying to explain to someone that
everything they've been encouraged their whole lives to
believe about something as entrenched and significant as the
income tax is basically nonsense. So here's a way to help
cut through the resistance:
Ask your listener how he or she would react if
you were to show an announcement from the Commissioner of
Internal Revenue admitting that the tax doesn't apply to the
earnings of most Americans and is misapplied most of the
time because people don't understand how it works? Or how
about if you showed a ruling from the Supreme Court saying
the same?
Now you just have to explain that
you're going to show exactly those things-- but because
the state really doesn't want people to know this, these
things haven't been said quite as forthrightly as we would
all wish. It's going to take a bit more work to take these
admissions in than is sufficient for just reading a press
release. But it'll be worth the effort...
IF YOU'RE NOT SPREADING THIS LINK with every bit of
energy you can, to school libraries, homeschool
families and community groups, your neighbors, your
family members, your pastors and
co-congregationalists, journalists, lawyers, CPAs,
members of congress, tax-agency workers, Wikipedia,
Anonymous, WikiLeaks, the Tax Foundation, everyone
in the "tax honesty" movement, the 9/11 truth
movement, other activist movements and everyone
else,
you have only yourself to blame for your
troubles with the tax, and a whole lot else of which

All animals experience fear—human beings,
perhaps, most of all. Any animal incapable of fear would have been hard
pressed to survive, regardless of its size, speed, or other attributes.
Fear alerts us to dangers that threaten our well-being and sometimes our
very lives. Sensing fear, we respond by running away, by hiding, or by
preparing to ward off the danger.
To disregard fear is to place ourselves in
possibly mortal jeopardy. Even the man who acts heroically on the
battlefield, if he is honest, admits that he is scared. To tell people
not to be afraid is to give them advice that they cannot take. Our
evolved physiological makeup disposes us to fear all sorts of actual and
potential threats, even those that exist only in our imagination.
The people who have the effrontery to rule us,
who call themselves our government, understand this basic fact of human
nature. They exploit it, and they cultivate it. Whether they compose a
warfare state or a welfare state, they depend on it to secure popular
submission, compliance with official dictates, and, on some occasions,
affirmative cooperation with the state’s enterprises and adventures.
Without popular fear, no government could endure more than twenty-four
hours. David Hume taught that all government rests on public opinion,
but that opinion, I maintain, is not the bedrock of government. Public
opinion itself rests on something deeper: fear.
Hume recognizes that the opinions that support
government receive their force from “other principles,” among which he
includes fear, but he judges these other principles to be “the
secondary, not the original principles of government” ([1777] 1987, 34).
He writes: “No man would have any reason to fear the fury of a tyrant,
if he had no authority over any but from fear” (ibid., emphasis in
original). We may grant Hume’s statement yet maintain that the
government’s authority over the great mass of its subjects rests
fundamentally on fear. Every ideology that endows government with
legitimacy requires and is infused by some kind(s) of fear. This fear
need not be fear of the government itself and indeed may be fear of the
danger from which the tyrant purports to protect the people.
DESPITE BEING a few years old, this piece by Higgs is very
pointedly relevant to current events. Indeed, the piece is timeless, or will be
for as long as we have states unrestrained by the sort of widespread,
institutionalized jealous regard for individual liberties intended by America's
Founders and Framers.
I particularly appreciate Higgs' workaday presentation on
the crass realities of political calculation. Everyone needs to
internalize that perspective-- it's a nice antidote to the efforts of
the political class and its beneficiaries to tart up state impositions
as benevolent, necessary and done for your own good (or on behalf of
causes you, if moral and wise, should support).
ALL TOLD, HIGGS' PIECE points any sensible person straight
to the principles and purposes articulated in
this short,
concise explanation of the Founders' solution to an overgrown state.
Read it and share it, please. It is the key to liberation from those
practicing the politics of fear. (And click on the image below for a

keep them paying the tariff for the benefit of Northern interests in
his first inaugural address on March 4, 1861, paid at least lip

complete morons who granted authority to the state to take whatever it

killing at least two, a bomb is thrown at police trying to break up a subsequent
labor rally in Haymarket Square in Chicago, Illinois. 8 are killed and 60 are
wounded; the police open fire on the crowd again, resulting in an unknown number
of casualties. In 1932, Al Capone begins serving an eleven-year sentence for
tax evasion. In 1970, National Guardsmen shoot into a crowd of unarmed students
protesting the Vietnam War at Kent State University, killing four and wounding
nine.

premiers in Vienna. In 1915, the British ship Lusitania is sunk by a German
U-boat with Americans on board. The fact that the ship, which was purportedly a
passenger and non-military cargo ship, was actually carrying a large load of
munitions from the U.S. to Britain was kept from the civilians encouraged to
take passage by U.S. and British officials, despite specific warnings from the
German government that the ship would be viewed as a military target. The

Hendrickson is also a widely-read essayist on
matters of politics, public policy and law; many of these works
are collected in his second book, ‘Upholding

soccer coach. He is a long-time political activist as well, and
has served as co-chair and platform convention delegate of
Michigan’s largest county Libertarian Party organization; as a
consultant to the National Right to Work Foundation and Citizens
for a Sound Economy; as a member of the Heartland Institute; and
as a member of the International Society for Individual
Liberty. He is a frequent radio-show guest on stations across
the country.
Hendrickson's business career has included nearly a
decade-and-a-half at the leading edge of the renewable-energy
industry, both as Director of Purchasing and Materials
Management and member of the R&D board at Starpak Energy
Systems, the mid-west's then-largest solar heating and
energy-recovery-and re-utilization company; and as founder and
president of AFJ Inc., a high-efficiency lighting design,
manufacture and installation firm.
Beginning in the mid-1990s and continuing for the
twelve years before his present full-time focus on the
restoration of the rule of law in America, Hendrickson directed
purchasing activities for the $84 million-a-year
multi-family-housing division of the Farmington Hills, Michigan
branch of Edward Rose and Sons, with responsibility for 18,000+
apartments, direct supervision of 35 technicians and agents, and
incidental authority over several hundred divisional workers.
He also ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On rather the other end of the spectrum, amidst
these more mundane pursuits Hendrickson co-founded and was the
primary creative force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan,
with his wife and two children. He is currently working on his
next book.
