If Any Discrimination Is To Be
Illegal, Ideological Discrimination Surely Qualifies
...and it's time conservative Americans stop putting up
with it.
I SAW
A NEWS REPORT the other day about
a journalist who was ejected from a restaurant in
Florida for being "too conservative" in his
conversation with a companion. This abusive incident
was only the most recent in what has become a fairly
routine occurrence during the ascendancy of the Left
over the last few years on the back of several
stolen elections, its alliance with the deep state,
and its complete capture of the MSM.
Such marginalizing cannot be allowed to
continue. Those who engage in it and those who
celebrate and encourage it must be punished and
shown to be the filthy illiberal barbarians that
they are.
Two years ago, in the earlier days of
this two-minute-hate-like practice-- when it was yet
more tentative and likelier to meet with more
equivocal treatment by media, that is, more
vulnerable to challenge-- I posted an analysis of
the issue, showing that
ideological discrimination is covered under the
"religion" element of the federal Civil Rights Acts
and corresponding state acts. That earlier article
focuses more on social media deplatforming than
otherwise, but the principles apply in every variety
of the offense.
Here is the beginning of that article:
Ideological
Discrimination Is ILLEGAL
No one can be fired or denied a
service or otherwise punished for his
beliefs, or be subject to any such extortive
pressure to change or suppress those
beliefs. Victims of this kind of offensive
behavior by the "woke" should queue up with
lawsuits, asap.
THERE IS A CALCULATED EFFORT
UNDERWAY to suppress election fraud evidence
until sufficient new-paradigm-momentum has
gathered to render it harmless to the
Biden/Harris/Establishment Democrat agenda.
Similar efforts are being directed at C19
challengers and indeed, at anyone expressing
general disagreement with any part of the
agenda or its pretenses and pretexts--
especially those doing so by way of showing
abiding support for Donald Trump.
The effort has involved
vigorous censorship and sinister threats
directed at opposition voices.
These
attacks are certain to escalate as
characterization of challengers to the
preferred narrative as seditionists,
insurrectionists and "domestic terrorists"
is increasingly rolled-out, but so far the
assaults are mostly by way of partisan
non-governmental actors imposing
denials-of-service of various kinds, with
some attacks extending all the way to
firings from jobs and cancellations of
contracts.
Some of the private suppression
and intimidation efforts are doubtless
motivated by fears of those responsible that
should they fail to act against an accused
target of a two-minute hate, they will be
targeted in turn for the same treatment (or
even by the sort of "Lord of the Flies" mob
violence we were all very carefully and
deliberately shown during last summer's
"peaceful protests"). Some may actually be
motivated by the perpetrator's genuine
personal investment in the "woke" nonsense.
Either way, all these
private-actor suppression and intimidation
efforts are committed in the belief that
those responsible are immune from legal
consequences, because it is only the
government that is legally-constrained
against such ideologically-driven
suppressive acts. However, this belief is
incorrect.
The Civil Rights Act of 1964
makes such ideology-based suppressions and
other denials of service illegal.
BEFORE WE LOOK AT THE DETAILS,
let's remember that the CRA of 1964 is a
real enactment, 57 years ago, by an
overwhelmingly white majority of Americans
for the benefit of minority populations now
pretended to be threatened by those
who doubt the validity of the Biden/Harris
election and lack enthusiasm for their
agenda. "Jim Crow" has been dead for
generations now, and the only "threat"
offered by non-Biden/Harris enthusiasts to
minorities is what some see as an
insufficient solicitude toward the
wish-lists of race-hustlers and
public-schooled socialists. Nonetheless,
those non-Biden/Harris voters are being
provocatively labeled "white supremacists".
The
storyline is that the Biden/Harris ticket
and their Democrat party are the manifest
(and only) champions of minorities (they've
said so loudly, after all, and they are VERY
solicitous toward the wish-lists of
race-hustlers and socialists). Therefore,
any who oppose their coming to power
(whether illegally seized or not)-- and the
pandering to race-hustlers and socialists on
which their campaign rested-- must
be anti-minority, and hence, white
supremacists.
Hard to argue with THAT...
BUT HERE'S A HAPPY IRONY-- the
minority-benefit CRA stands as a concrete
rebuke to
the "systemic racism" hustle under which
the de-platforming and other
denial-of-service offenses are being
committed against challengers to the
validity of the Biden/Harris election
(and/or the virtues of their programs). But
the same act offers the mostly non-minority
victims of these assaults their remedy.
The fact is, by its plain
terms, the Civil Rights Act of 1964
prohibits discrimination against anyone for
his or her beliefs. Follow along, now, and
you'll see what I mean.
Here is a relevant provision of
the CRA, for example (as codified in Title
42 of the USC):
All persons shall be entitled
to the full and equal enjoyment of the
goods, services, facilities, privileges,
advantages, and accommodations of any place
of public accommodation, as defined in this
section, without discrimination or
segregation on the ground of race, color,
religion, or national origin.
42 USC § 2000a
Although the express words of
the "public accommodations" provision in the
CRA, particularly, confine themselves to
physical facilities offering only certain
services (i.e., hotels, lunchrooms,
theaters...), over the years, federal courts
have found elasticity in the application of
the law based on legislative intent.
Further, state versions of the
same provisions are more expressly
expansive. Here, for instance, is Michigan's
broader language in its Elliot-Larsen Civil
Rights Act of 1976:
(a) “Place of public
accommodation” means a business, or an
educational, refreshment, entertainment,
recreation, health, or transportation
facility, or institution of any kind,
whether licensed or not, whose goods,
services, facilities, privileges,
advantages, or accommodations are extended,
offered, sold, or otherwise made available
to the public.
MCL § 37.2301
Other provisions of the state
and federal laws prohibit discrimination in
all governmental and government-related or
facilitated accommodations, and in hiring
and firing practices, both public and
private.
As a practical matter, then,
short of a final judicial determination to
the contrary in any particular provision of
services or workplace, discrimination by any
business in employment practices or in
providing services to interested customers
is prohibited across the board. That
prohibition includes discrimination on the
basis of religion.
NOW, LET'S TALK ABOUT
"RELIGION" a bit, and sharpen up what I
suspect might be a fuzzy notion some folks
might have on that subject
Do you think "religion" is just
a matter of things like what church you
attend, or how you picture God, with no
practical, day-to-day,
interact-with-the-world aspect? Not hardly.
religion ...
In construing the protections under the
Establishment Clause and the Free Exercise
Clause, courts have interpreted the term
religion quite broadly to include a
wide variety of theistic and nontheistic
beliefs.
Black's Law Dictionary, 7th
Ed.
Another, more precise and more
illuminating word for "religion" as meant in
federal law is "conscience". "Conscience",
in turn, encompasses "opinion" and "belief",
as well as "motivation".
Protection from discrimination
based on religion-- which is to say,
protection of your freedom of conscience--
doesn't just secure your right to call
yourself a Baptist or talk about the Bible.
It secures your right to think, say, teach
and argue what you believe to be true, as to
practical matters as well as spiritual, and
even when what you think, say, teach and
argue are things other people may well
dispute or think are dangerously wrong.
Most particularly to the
instant issue, your freedom to assert bad
faith, evil motives and deeds and deliberate
mendacity to others is protected.
There is considerable case-law
now on the books in the federal courts--
including the US Supreme Court-- developing
freedom of expression as a fundamental
component of religious freedom (and broadly,
well-beyond simple matters of theology, as
indicated in the definition quoted from
Black's, above). For the best-known recent
example, see Masterpiece Cakeshop, Ltd.
v. Colorado Civil Rights Commission,
584 U.S. ___ (2018).
These rulings establish
expressions as among the acts against which
prohibitions of discrimination on the basis
of religion are directed under the CRA and
related state laws. The most memorable
judicial statement going to this point (and
one well-worth remembering at this time of
vicious snarling in Washington and elsewhere
about prescribing what is "true" and can be
said-- and what is "false" and cannot) is as
recounted and reiterated by the Supreme
Court in 2013:
"[W]e cannot improve upon
what Justice Jackson wrote for the Court 70
years ago: "If there is any fixed star in
our constitutional constellation, it is that
no official, high or petty, can prescribe
what shall be orthodox in politics,
nationalism, religion, or other matters of
opinion or force citizens to confess by word
or act their faith therein."

SADLY, I HAVE NEVER SEEN ANY INDICATION
that any victim of ideological discrimination ever
took up this remedy and pursued the matter through
the courts. Unsurprisingly, the offenses continue,
while seldom getting the adverse attention they
deserve, and never the definitive chastisement and
deterrence that would attend a nice big civil suit
award to the target of the abuse.
I have a feeling that part of the issue
might be a conservative reluctance to make use of a
law perceived by some as troublingly in conflict
with a view of "freedom of association" under which
any business owner has the right to discriminate at
will, and for any reason. Suing over being
discriminated against by a business owner in the
provision of services or accommodations would seem
hypocritical to one holding that view.
I can be sympathetic to anyone's
concern about hypocrisy (even while not necessarily
sharing the views by which that concern arises in
any particular instance). At the same time, however,
I am nothing but impatient with a conservative
tendency to play nice with his or her adversaries,
especially those who are actively abusive.
FURTHER, IT MUST BE UNDERSTOOD that the
anti-discrimination laws merely provide for the
bringing of suits in the face of perceived offenses,
not the leveling of criminal charges and the
involvement of the law enforcement establishment. In
bringing a lawsuit over being chased from a
restaurant for one's private speech therein, a
victim would simply be creating an opportunity for
the courts to establish that to whatever extent the
civil rights laws extend protections from
discrimination on some grounds, they also do so on
the grounds of ideology.
In such a contest, the other side would
be free to argue on behalf of nullifying
discrimination prohibitions on the basis of freedom
of association principles (although that path has
already been trodden), and even if not defended
against in that way, the outcome of the action would
no more compromise the freedom of association
argument than has many times been done in the past.
In other words, no wounding of a
principle would attend the suit. Hence, no sense of
hypocrisy or shame should attend the bringing of it.
More pointedly, since the abuser to be
sued in a case of the type at hand would doubtless
be among those who embrace anti-discrimination
policies without the least regard to the view of
freedom of association held by some conservatives--
and, in fact, would likely despise and condemn that
view-- there is a certain ironical aptness to suing
that person for his or her discriminatory behavior
without restraint on behalf of that view.

With cascading revelations unraveling
the C-19
hobgoblin-- including the mounting death rate
from the fake "vaccines" and especially Project
Veritas' capture last week of dramatic admissions by
a Pfizer Director of Research-- it's time the
grown-ups go on offense.
SERIOUSLY. Anyone wearing a mask at
this point should be subjected to scorn and
derision, excepting only the very elderly and
visibly frail. The wearing of a mask by anyone else
is not only an obnoxious display of mindlessness and
cult-capture, but it is an irresponsible enablement
of narrative-management efforts to perpetuate a
massively harmful
hobgoblin
episode and to thereby escape accountability.
Think about it. If everyone still
persisting with chin diapers were to be successfully
shamed (or awakened) into abandoning the ridiculous
and harmful practice, the narrative managers still
pushing "vaccines" and striving to keep alive for
future deployment the germ of "public-health
emergency" justifications for
lawless usurpations of power (and to keep their
criminal asses out of prison) would find themselves
increasingly exposed.
While a noticeable minority of the
American public still appears taken by the Kool-Aid,
these folks have some political cover. When that
minority shrinks further, that cover does, too and
the persistence of the shielding narrative is
increasingly untenable.
SIMILARLY, EVERY INCIDENCE of a plexiglass
barrier still in place at a checkout counter or
elsewhere, where never one had been before the
"pandemic", should be loudly condemned at every
opportunity. Likewise the "social distance" floor
decals that are still found in many stores.
This had better become the years of
truth militant, or it really will become just year
three of the "new normal"-- a year in which the
pernicious effort to destroy Western Civilization--
and the American Constitutional republic in
particular-- of which the C-19 assault has been a
very major part cements itself more thoroughly still
into the landscape.
Get impatient and unforgiving in
demanding the erasure from the public space of all
of these nauseating hat-tips to a
grotesque crime and its despicable perpetrators.

Not Letting This "Crisis" Go To Waste...
...an important action item opportunity.
FRIENDS, THE SPORADIC BITS OF EASING of the despotic measures to
which most of the country has been subjected under
the fraudulent mantle of
COVID-19 mitigation should not be
allowed to bleed off the head of steam you probably had been developing.
The offenses happened, and they're far from over. Stay hot.
And while you are all warmed up, and while others, if
they're smart, are just as hot, I'd like you to send an email (and
Facebook post, or whatever) with the following content to everyone you
can (with a request that they pass it along, in turn):
[Name], since March of 2020 you've
watched as over-fed state power has been used to literally destroy
classical Western civilization and impose a new despotic paradigm. No
dissent or debate permitted-- no permission or agreement sought.
YOU KNOW where this will end up if the arrogant
state power being used to make this happen isn't radically diminished in
size, influence, resources and popular support, and exposed as an
opportunistic exploiter of legal ignorance (an ignorance which it has
been nurturing in the average mind for decades).
Those things having not yet happened, you
should be quaking in your boots-- and you probably are.
Isn't it time-- and past time-- for you to
begin helping to make those desperately-needed defensive changes take
place? There is only one way these things can happen short of a
who-knows-what we'll-end-up-with explosion of violence. I'm going to
show it to you.
When you're done with that reading, you'll know
what to do next.
BTW, REMEMBER, ALSO, THAT EVERY AMERICAN has lately been given a stark lesson in the fact
that government officials at all levels will lie to you and violate the
law without batting an eye. They will do so any time it serves their agenda, and
you don't call them out for it.
If you know anyone who has been persisting in denial on the
truth about the income tax, you know such nonsense is usually be
grounded in some version or another of, "That can't be true..." or "They
would never do something like that...". Now's the time to put a pin in
that delusional bubble.

FOR ALL THE YEARS SINCE 2003 when
CtC was first published, the government has engaged in a
concerted effort to frighten people away from its truths. This
effort involves official government websites and press releases
touting an occasional court ruling that appears to be at odds
with some
CtC-revelation (but without details sufficient to expose the
real substance of the ruling)--
and sometimes even more mendacious behavior.

it to begin with; I don't do what I do intending for anyone to
feel obligated in any way.

thoughtful personal resolution and encouragement to others is
just an invitation for consideration by those who may not be

Are You Having Trouble Spreading The
Word?
SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE
EXPECTED when you're trying to explain to someone that
everything they've been encouraged their whole lives to
believe about something as entrenched and significant as the
income tax is basically nonsense. So here's a way to help
cut through the resistance:
Ask your listener how he or she would react if
you were to show an announcement from the Commissioner of
Internal Revenue admitting that the tax doesn't apply to the
earnings of most Americans and is misapplied most of the
time because people don't understand how it works? Or how
about if you showed a ruling from the Supreme Court saying
the same?
Now you just have to explain that
you're going to show exactly those things-- but because
the state really doesn't want people to know this, these
things haven't been said quite as forthrightly as we would
all wish. It's going to take a bit more work to take these
admissions in than is sufficient for just reading a press
release. But it'll be worth the effort...
IF YOU'RE NOT SPREADING THIS LINK with every bit of

families and community groups, your neighbors, your
family members, your pastors and
co-congregationalists, journalists, lawyers, CPAs,
members of congress, tax-agency workers, Wikipedia,

to fight all-out war with Russia, regionally or
globally.

Until it decided to confront Moscow with an
existential military threat in Ukraine,
Washington confined the use of American military
power to conflicts that Americans could afford
to lose, wars with weak opponents in the developing
world from Saigon to Baghdad that did not present an
existential threat to U.S. forces or American
territory. This time—a proxy war with Russia—is
different.
Contrary to early Beltway
hopes and expectations, Russia neither collapsed
internally nor capitulated to the collective West’s
demands for regime change in Moscow.
Washington underestimated Russia’s societal
cohesion, its latent military potential, and its
relative immunity to
Western economic sanctions.
As a result, Washington’s proxy war against Russia
is failing. U.S. Defense Secretary
Lloyd Austin was unusually candid about the
situation in Ukraine when he told the allies in
Germany at Ramstein Air Base on January 20, “We have
a window of opportunity here, between now and the
spring,” admitting, “That’s not a long time.”
Alexei Arestovich, President Zelensky’s recently
fired advisor and unofficial “Spinmeister,” was more
direct. He expressed his own doubts that Ukraine can
win its war with Russia and he now questions whether
Ukraine will even survive the war.
Ukrainian losses—at
least 150,000 dead including 35,000 missing in
action and presumed dead—have fatally weakened
Ukrainian forces resulting in
a fragile Ukrainian defensive posture that will
likely shatter under the crushing weight of
attacking Russian forces in the next few weeks.
Ukraine’s materiel losses are equally severe.
These include thousands of
tanks and armored infantry fighting vehicles,
artillery systems, air defense platforms, and
weapons of all calibers. These totals include the
equivalent of
seven years of Javelin missile production. In a
setting where Russian artillery systems can fire
nearly 60,000 rounds of all types—rockets, missiles,
drones, and hard-shell ammunition—a day, Ukrainian
forces are hard-pressed to answer these Russian
salvos with 6,000 rounds daily.
New platform and ammunition packages for Ukraine
may enrich the Washington community, but they cannot
change these conditions.
Predictably, Washington’s frustration with the
collective West’s failure to stem the tide of
Ukrainian defeat is growing. In fact, the
frustration is rapidly giving way to desperation.
Michael Rubin, a former Bush appointee and avid
supporter of America’s permanent conflicts in the
Middle East and Afghanistan,
vented his frustration in a
1945
article asserting that, “if the world allows
Russia to
remain a unitary state, and if it allows
Putinism to survive Putin, then, Ukraine should
be allowed to maintain its own nuclear deterrence,
whether it joins NATO or not.” On its face, the
suggestion is reckless, but the statement does
accurately reflect the anxiety in Washington circles
that Ukrainian defeat is inevitable.

intended to remind everyone that sociopaths--
a category
over-represented in the ranks of officialdom-- will do anything,
given adequate incentive. We're seeing that lesson on display in real
time, with very real consequences, in Ukraine over the last 9 years.
We're also seeing a real-time, real
consequence example of how sowing the wind reaps the
whirlwind.
Back at the beginning of those 9 years,
in 2014, arrogant and
reckless actors in Washington, DC encouraged and
assisted in the overthrow of the elected government
of Ukraine. To some degree this was likely a
service rendered to a Ukrainian oligarch who had
paid for it
through a massive payment to Bill and Hillary
Clinton. To some degree it was likely an effort
to secure control of a place in which considerable
evidence suggests the US has long operated, directly
or through proxies, biolabs engaged in illegal
weapons research-- a proposition vigorously denied
and disparaged by the same shills and hacks in the
MSM and the state apparatus itself who have insisted
that no US-funded gain-of-function research was
going on in Wuhan; Iraq had weapons of mass
destruction; Russia must have sabotaged its own
Nordstream pipelines; and so on.
As well, to some degree that Ukrainian
coup which threw out a Russia-friendly president was
likely a gift to a military-industrial complex, some
players in which have a relentless antipathy toward
Russia (and all players in which are never averse to
another market for weapons and the beak-dipping that
attends such markets). Further, of course, it was
useful in establishing new opportunities for Hunter
Biden & Co. to peddle influence for lots of money,
with the subsequent relentlessly-provoked
intervention by Russia
on behalf of its
majority-population ethnic-Russian cousins in
Eastern Ukraine and Crimea and core security
interests offering a nice way for all the evidence
of that corruption to end up irretrievably buried in
rubble.
In short, there have been plenty of
incentives for the increasingly bad behavior of US
officials, few of whom have failed to stoop to the
challenge.
As Col. McGregor points out, all that
tossing seeds of future consequences into the wind
has brought down a dire whirlwind indeed, onto
Ukraine especially. But there is more to be said.
ALTHOUGH UKRAINE has borne the brunt of
the reckless policies serving venal US operatives'
personal interests, that distribution of the
whirlwind has been changing over recent months as
the relentless logic of selfishness, recklessness
and deception, coupled with dangerously-enabling
power, plays out. Here is a nice depiction of that

THIS VIDEO PROJECTS THE PROGRESS of a nuclear exchange between Russia and
the United States. It's frightening, as it should
be, as well as sobering and instructive. My only
criticisms are, first of all, that it fails to
account for the imbalance that will now be present
in any such exchange due to
the new Russian
hypersonic weapons.
Secondly, the video fails to account
for China's contribution to the exchange against the
US, which is a virtual certainty. China knows that
if Russia goes, and the US survives, it goes soon
after. So, that will not be allowed to happen.
I don't think it is possible to
overstate our peril as manifestly lunatic
operators-- both Democrats and Republicans-- remain
equipped with the resources enabling their
compulsive and to their minds self-interest-serving
exacerbation of the criminal disaster in Ukraine for
which they are entirely responsible.
That said, I also don't think it is
possible to overstate how similarly insane is the
continued provision of those enabling resources to
those lunatic operators, and the continued failure
of those who know better-- that is, you, in the CtC-educated
community-- to CLAMOR as relentlessly, forcefully
and single-mindedly as possible the spread of the
knowledge by light of which nearly every other
American WILL stop providing those resources, even
if only as an expression of personal pecuniary
self-interest.
Let's remember, individual Americans
CAN stand up and pull the plug. Individual Americans CAN defund the state
that has become much more a danger to our liberties
than their champion, and now even a danger to our
lives.

Hendrickson is also a widely-read essayist on

Hendrickson's business career has included nearly a

Beginning in the mid-1990s and continuing for the
twelve years before his present full-time focus on the
restoration of the rule of law in America, Hendrickson directed
purchasing activities for the $84 million-a-year
multi-family-housing division of the Farmington Hills, Michigan
branch of Edward Rose and Sons, with responsibility for 18,000+
apartments, direct supervision of 35 technicians and agents, and
incidental authority over several hundred divisional workers.
He also ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On rather the other end of the spectrum, amidst
these more mundane pursuits Hendrickson co-founded and was the
primary creative force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan,
with his wife and two children. He is currently working on his
next book.
