A Legislative Agenda For The
Protection Of Our Children And Our Culture
...from grotesque medical and judicial
malpractice, and from a dangerously arrogant
technocratic governmental apparatus.
I WAS SHOCKED AND DISMAYED the other
day... I saw a report that a three-judge panel of
the 8th federal Circuit Court of Appeals has upheld
a preliminary injunction against the enforcement of
Arkansas's 2021 ban on the mutilation of children
with the chemical and surgical destruction of
perfectly healthy body parts and functions under the
influence of so-called "trans health care" madness
issued by a federal district court judge in a suit
against the ban brought by the ACLU.
The ban was enacted with a super-majority of the
Arkansas legislature-- the gold-standard of the
people's expression of their sovereign will-- but is
thwarted (for the moment, and for so long as the
people of Arkansas are willing to let their sovereignty
hinge on approval by judges appointed for life by
those with their own political agenda and who reside
1500 miles away). The judicial reasoning for the
interference by these arrogant judges,
as reported by Jurist.org, is that the Arkansas
act,
"prohibits medical treatment that
conforms with 'the recognized standard of care for
adolescent gender dysphoria,' that such treatment
'is supported by medical evidence that has been
subject to rigorous study,' and that the purpose of
the Act is 'not to ban a treatment [but] to ban an
outcome that the State deems undesirable.'"
LET'S START BY OBSERVING THAT "ban[ning]
an outcome[s] that the State deems undesirable" is
the very point of a state's police power. Any judge
that doesn't understand this-- and the federalism
that leaves such matters solely in the hands of the
individual states-- should be removed from the
bench. It may be little known in this ill-educated
day and age, but the notion of federal veto power
over state legislation was proposed in the
Constitutional Convention in 1787 and was defeated.
The Fourteenth Amendment, often cited
as a justification for federal interference in state
sovereignty of the sort to which Arkansas is now
being subjected, merely obliges states to apply
their laws even-handedly, employ due process before
depriving anyone of life, liberty or property, and
(perhaps redundantly) respect the "privileges and
immunities" of citizens of the United States.
Nothing in these provisions can reasonably be
construed to thwart a state's authority to prohibit
the mutilation of children, as long as the
mutilation of ALL children is prohibited, not just
the mutilation of Asian children, for example, or
just the mutilation of left-handed children.
Almost amusingly, the once-respectable,
now clownish ACLU, recognizing the problem for
judicial interference outlined above, tries to spin
its way out by turning the inconvenient truth
sideways and applying a ridiculous tautology. The
Union argues that because the "treatments" involved
are related to "gender transition", the Arkansas law
targets only "transgender patients" (while risibly
suggesting that "transgender patients" are a
distinct and protected class of individuals), and
therefore:
"discriminates on the basis of sex
and transgender status by prohibiting certain
medical treatments only for transgender patients and
only when the care is 'related to gender
transition.'"
But the Arkansas law does no such
thing. As suggested above,
the Arkansas act prohibits the "treatments"
involved from being inflicted upon
anyone below the
age of 18:
(a) A physician or other healthcare
professional shall not provide gender transition
procedures to any individual under eighteen (18)
years of age.
(b) A physician, or other healthcare
professional shall not refer any individual under
eighteen (18) years of age to any healthcare
professional for gender transition procedures.
Pages and pages are devoted to defining
and explaining "gender transition procedures", so as
to leave no doubt as to what is prohibited, but "any
individual under eighteen (18) years of age" stands
on its own and means just what it says.
PAST THE FEDERALISM PROBLEM (which is
enough by itself to invalidate this judicial
interference in Arkansas's exercise of its People's
will) let's look at these prohibited "treatments"
which the court (and the ACLU) choose to describe as
"medical" (in an effort to stigmatize the Arkansas
act as though it equates to a prohibition of
chemotherapy for cancer patients).
Cutting off (or chemically destroying)
perfectly healthy and functional body parts, such as "top surgery"
where the healthy breasts of (in cases relevant to
this issue) adolescent girls are lopped off, or
"bottom surgery" in which existing, healthy primary
sex organs (penises and vaginas) are cut off
(usually followed by grotesque and inevitably futile
attempts to recreate in their place the organs of
the opposite sex) are not "medical treatments". Nor
is the chemical neutering of children by way of
puberty blockers and massive doses of opposite-sex
hormones.
Instead, these are evil acts inflicted,
for lots of money, upon
pathetic victims who are obviously not of sound
mind-- often due in part to the encouragement of
delusions, confusions, and deeply-harmful
self-loathing by the very parties profiting from the
procedures-- and who are, in any event, below the age
at which they are legally and mentally capable of
informed consent.
THEN THERE'S THE REFERENCE in the
interfering judge's ruling to "the recognized
standard of care for adolescent gender dysphoria".
This effort to elevate technocracy to sovereign
status is especially pernicious and obnoxious.
Some healthcare administration
bureaucrat's (or bureaucracy's) views of what is
appropriate care for what he or it imagines to be a
"medical condition"-- or those of some "professional
organization"-- in no way mandates the acceptance of
such views or practices by the people of Arkansas,
any more than the practice of abortion in
California-- or its enthusiastic employment or
endorsement by the "Abortion Providers of America"
(or whatever such folks might call themselves
collectively)-- can be labeled the "standard of
care" for unhappily-pregnant women and therefore
imposed in other places.
As much as the "progressive' mindset
would like to have it otherwise, in America neither
the People nor their state agents are subordinate to
the views of professional organizations, such as the
American Psychiatric Association or
WPATH. The People
and their state agents aren't even subordinate to
their own in-state medical communities (something
starkly illustrated by the widespread disregard--
and even suppression-- of the views of vast numbers
of their resident medical professionals concerning
COVID-19 by the governments of many states during
2020 and 2021).
"Standard of care" is entirely
irrelevant to any proper judicial consideration of
Arkansas's enactment.
Furthermore, the very term "care" is
being promiscuously abused in this ruling. After
all, rather than make any effort to explain to the
deluded child seeking "care" that he or she is just
having a not-so-unusually-confusing transition to
adulthood which will all resolve itself in due
course, the "providers" turn straight to assuring
the victim that he or she is-- as though by dark
magic-- bizarrely trapped in the wrong body, and
that drastic sausage-factory chemical consumption
and slice and dice surgeries can actually make him
or her into a member of the opposite sex (or at
least something other than the natural sex to which
they have been steered into finding uncomfortable).
This behavior is hardly an
administration of "care". It is, instead, service to
trans-enthusiast agenda, an effort by the
"providers" to affirm their own prior bad choices by
producing another apologist for those choices, or a
simple satisfaction of a financial interest.
FINALLY, THERE IS THE PROBLEM in the
ruling by the courts with the very use of the term
"medical". There is no medical issue involved with
"gender dysphoria", even if it is accepted for
purposes of argument as a real distress (rather than
a corruptly and maliciously-- or at best,
recklessly-- instilled and nurtured anxiety,
delusion and fixation).
Under its own terms, "gender dysphoria"
is a mental disease. It's not, after all, the cause
(or product) of rashes, joint pain, lumps, organ
compromise or failure, or any other physical
dysfunction. It is, rather-- on its own terms--
all in the victim's head.
In short, "gender dysphoria" is not a
medical condition, calling for medical care. It is a
mental condition, calling for therapy, perhaps
psychological, or perhaps spiritual or philosophical,
designed to heal the deluded notion that the body
into which one is born is somehow not the right one.
Treating "gender dysphoria" as a
medical condition requiring medical intervention--
especially radical, irreversible chemical and
surgical intervention-- is as inappropriate as
treating protracted grief or anxiety with a
lobotomy. What's the saying? The operation was a
success, but the patient died...
With "trans-genderism", the operation
cannot succeed-- men can never become women, nor
women, men (and mentally-healthy members of either
sex have no interest in such transformation even if
it were possible). As shown by the insane and
corrupt judicial rulings by the federal district
court and now even a panel of a federal appellate
court in the ACLU's suit against Arkansas, trying to
pretend otherwise is killing respect for objective
truths and the most rudimentary medical and
scientific principles and observable facts, and
hence, the culture that nourishes and protects us
all.
I'M GOING TO CLOSE THIS SEGMENT with a
few words about the Arkansas law prohibiting the
"trans-gender" mutilations of kids. It's a good law,
but I have a few constructive comments that I think
might help other states when enacting their own
versions of the same.
My first comment is that while once it
gets to the statements of prohibition the act is
very nicely straightforward and simple, there is too
much explanation and apologia beforehand. No
legislature needs to justify prohibition of the
chemical or surgical destruction of healthy and
functional body parts of minor children, even
when others may be all enthused to do such heinous
things.
It is not, in other words, necessary to
expressly ban (and hence,
oblige oneself to define at great length) "gender
transition procedures". Indeed, just using such
labels is way too accommodating of the lunacy
being prohibited.
It should be enough to criminalize
the administration of function-destroying chemical or surgical procedures
to physically-healthy children, period, whether
for purported "gender dysphoria relief" or any other
purpose.
After all, for what other purpose are
such things done? It says a lot that none can be
named (except as will be tellingly seen in the "ONE
LAST THING" portion below).
Second, I recommend cold-eyed clarity
in any statement of purpose or "sense of the
legislature" serving as a preamble to the
legislation. For instance,
WHEREAS SO-CALLED "GENDER DYSPHORIA" is
an induced distress resulting from parental and/or
professional misconduct by which minor children
become afflicted with severe confusion and anxiety
over their natural and immutable biological sex...
...going on to criminalize
function-destroying chemical or surgical procedures
administered to
physically-healthy minor children in the pursuit of
"gender dysphoria" relief or for any reason
whatever; prohibit the use of state funds for
any such procedure, etc.; and impose criminal sanctions upon anyone found
to have encouraged "gender dysphoria" in any child
by any means or method-- including the use of
biologically inappropriate pronouns or names, even
at the request of the supposedly gender dysphoric
child.
The "trans" agenda, and the political
and social dynamic to which it gives rise, brings to
my mind nothing so much as William Golding's
horrifying cautionary tale, 'Lord of the Flies',
with some notes of Orwell, Huxley and Kafka blended
in. Our children and their children need to be
spared this insanity and its evil effects, and it
falls to us to strangle this serpent before it
becomes too big to handle.
ONE LAST THING: Arkansas attorney
general Leslie Rutledge has said that she will take
the rulings in the ACLU lawsuit to the full 8th
Circuit Court of Appeals, and good for her. I wish
her well in that endeavor.
I also recommend to her
the study of American law and jurisprudence
regarding female genital mutilation for some
authorities that will be helpful in formulating her arguments.
In 1996 the Federal Prohibition of
Female Genital Mutilation Act made it illegal to
perform FGM on minors for non-medical reasons, and
in 2013 the Transport for Female Genital Mutilation
Act prohibited transporting a minor out of the
country for the purpose of FGM. The first FGM
conviction in the US was in 2006, when Khalid Adem,
who had emigrated from Ethiopia, was sentenced to
ten years for aggravated battery and cruelty to
children after severing his two-year-old daughter's
clitoris with a pair of scissors. A federal judge
ruled in 2018 that the 1996 Act was
unconstitutional, arguing that FGM is a "local
criminal activity" that should be regulated by
states. Twenty-four states had legislation banning
FGM as of 2016, and in 2021 the STOP FGM Act of
2020 was signed into federal law.

I WANT TO TOUCH BRIEFLY on one other
item in the news and in the vein of legislative
action items on behalf of our American kids and our
American culture. Last week, Uvalde School District
Chief of Police Pete Arredondo was fired by the
school board. This was followed by a well-publicized
demonstration in which bereaved parents and others
expressed their grief and called for various legal
and political acts imagined to be silver bullets to
the evils of (often) fatherless-reared and (often)
prescription-drug addled and (often)
morally-relativist taught, spiritually-adrift and
suicidal young men.
The issue of silver bullets is one for
another time. Today I want to observe that not one
but three great crimes took place at Robb Elementary
School in Uvalde, Texas, on May 24th, 2022.
THE FIRST OF THE THREE CRIMES at Robb
Elementary was the
murder of 19 children and two adults in that school.
The second was the 77-minute stand-down by the small
army of heavily-armed police, metaphorically picking
their noses while that first crime slowly and
methodically took place just feet away from them and
the muzzles of their many weapons.
The third crime, and in my mind very
possibly the most heinous of all, was the
obstruction by police outside the school of parents
trying to rush into the building and protect their
children.
Of course, the deaths of the kids is
terrible. But their suffering was over relatively
quickly.
The suffering of those parents who were
forced to stand outside, listening to those
gunshots, and thwarted from their attempts to race
inside and swarm the killer, caution properly thrown
to the winds, will be forever, and twice as bad for
the helplessness imposed upon them as for the loss
of their child, which latter pain would be so much
the less had they been able to make that effort,
even unsuccessfully.
How cruel a thing to be visited upon
them, and all for the sake of a baseless and
unprincipled view that in such situations Americans
should and must just leave everything to the
authorities (which is another expression of a
technocratic mindset taking hold in this formerly
greater country)!
Might some have died in such an
attempt? Of course.
But what of it? We speak of grown-ups.
It's their call. Full stop.
Those out of diapers will remember the
cry, "Let's roll!" made famous not that long ago,
the understood impulse behind which-- however
apocryphal the story might be-- was refreshingly
held up throughout the country as the epitome of
American virtue in the face of peril and poor odds.
It's pretty disturbing to see that good and powerful
impulse now made the target of state suppression.
And after all, it can't be argued that
parents rushing in to Robb Elementary to destroy the
shooter and save their children would have disrupted
or hampered any virtuous unfolding "first responder"
remedy...
I HAVE SPOKEN of this crime before (and
in regard to many of the "silver bullet" measures
spoken of in the demonstration in Uvalde last week),
as
can be seen here-- read that whole
article, especially including the Second Amendment
material. It's worth your time.
Today, though, I want to go a bit
further than merely condemning the ugly behavior of the police
during that terrible shooting spree. Today I want to offer a
possible legislative solution that should prevent
such heinous crimes in the future (while at the same
time reminding Americans of the actual relationship
between citizens and the state).
Here is the proposed text of enactments
that can and should be made in every state and by
the United States, as well:
IT SHALL BE A FELONY for any person,
acting in either a public or private capacity, and
regardless of any office held, to obstruct or hinder
the rendering of aid by any other person to a third
party facing an active, immediate threat to life or limb.
Violators shall be deemed guilty of the crime of
violence corresponding to their obstruction or
hindrance (i.e., assault, assault and battery,
murder, etc.) or to the preventable harm suffered by
the endangered person whose aid is obstructed or
hindered, whichever is greater.
No behavior or action in any effort to
overcome the hindrance or obstruction criminalized
by this act shall be subject to punishment, but
nothing in this act shall be construed so as to
mitigate or diminish individual civil or criminal
responsibility for all acts taken by the one
rendering aid in the course of so doing.
ONE FINAL NOTE in the area of the
various current assaults on American law, political
principles and culture-- a gripe, really: Many
commentators-- even many of whom I am very fond and
for whom I have considerable respect-- have fallen
into a rhetorical habit I think is
counter-productive and wrong-headed, to whatever
degree it is consciously done.
I speak of references by such folks to
this news item or that as "terrifying" or
"fearsome", or the like. For instance, I have heard
it said many times that we should all be terrified
at the prospect of "87,000 new IRS agents, or at the
behavior of the FBI (and DoJ) over the last 18
months under the pretense of punishing so-called
"insurrectionists", or in other abusive,
plainly-political conduct such as
the
slow murder of Julian Assange or the recent
raid on Mar-a-Lago, or other facially-abusive and
law-defying acts.
NO, MY FRIENDS, "terrifying" is NOT the
right word. "Outrageous" is the better one.
No American should be fearful of
abusive behavior of government agencies (or of
Congress). Rather, every American should be
angry at abusive behavior of government
agencies or of Congress.
Think about it, and then check your
attitude. Help errant pundits do the same.
And learn from the Democrats who have
been doing everything possible to discourage
attention to the "irregularities" of the 2020
election by a sustained, vigorous Mau-Mauing of
every non-squish Republican against whom they can
contrive any sort of pretext: The best defense is a
strong offense, and that applies to security from
corruption in government just as much as it does to
anything else.

what can be done with a little creativity and a tiny
amount of money (see more on that

here). Needless to say, every motorist seeing
these "ads" will be compelled to reflect on exactly
what is at stake in the choices facing Americans in
November.
It would be nice if memorable, pointed,
aggression-free-but-unapologetic messages like these
saturated the landscape for the next 72 days...
MORE COMMENT-WORTHY GRAPHICAL MATERIAL:
The World Economic Forum-- you, know, those
enlightened and selfless Platonic Guardians of
humanity laboring tirelessly to diminish and
ultimately destroy the blessings of liberty
bequeathed by America's Founders to their
posterity-- posted a little chart back in 2018,
which just resurfaced a few days ago in
this article at LRC (the claims within which
must be left to the judgment of others-- I have
given them no study or even consideration).
It is meant to explain that
the pressure to suppress conventional farming
and the
not-merely-coincidental push to replace the normal
protein-production part of farming with (supposedly)
edible insects which they are putting on their
puppets and useful idiots in positions of trust and
honor throughout (primarily) the Western world is
all in a good-- even vital-- cause.
The notion is that replacing meat
consumption with insect consumption is necessary in
order to protect Planet Earth from the existential
threat of "climate change" (and/or the exhaustion of
vital resources).
Here is the chart:
Everything relevant to the background
story sketched out above is disturbing and worthy of
scorn, and of outrage, condemnation and pushback
insofar as the expropriation of farmland and other
property is concerned. But this chart merits a few
words of its own, as it embodies four fallacies I
fear are widely overlooked by today's ill- (or mis-)
educated population, and are heavily exploited by
the "climate change"
hobgoblin
floggers.
TAKEN ONE AT A TIME, in order of their
appearance:
The primary so-called "greenhouse gas"
is carbon dioxide. Insects breathe oxygen and emit
carbon dioxide. Thus, while this chart may be meant
to express something about how much methane the four
categories of creatures produce, and the relative
numbers might be correct in that regard (I'm not the
one to ask or opine), it is complete nonsense to say
that a kilogram of insects produces only 1,425th as
much "greenhouse gas" as a kilogram of cow.
As for "feed required", there might be
a ratio such as is suggested here between cows and
insects (although I strongly doubt it and I think
physics principles suggest otherwise), but the
bigger point is that the comparison is fallacious.
For one thing, we get a whole lot more value out of
a cow than merely protein. Nearly every part of a
cow has value, from the hide to the bones, and
that's without accounting for the ongoing production
of milk throughout the lives of many such animals.
Further, the issue of how much "feed"
is required is irrelevant. The chart is meant to
suggest that there is some inherent importance to
the supposedly-lower feed demands of a given bucket
of bugs than of a cow, but there is no such
importance outside the arising of a shortage of
cow-feed, which is an undemonstrated problem but
which we are intended to simply assume is plaguing
the Earth. And if such a shortage does
arise, the free market will adjust accordingly (and
perhaps we'll all eat more chicken for a while until
the situation improves...).
The chart goes on to speak of land
requirements per unit of protein produced. As in the
comments above regarding "feed", this is a
non-problem. Plainly, there is enough land to
sustain the number of cows being husbanded, and the
market has already sorted out the fact that at
present, at least, the devotion of that land to that
purpose is either its optimal use or at least one
not seriously challenged by any alternative with
significantly greater utility.
Finally the WEF gets to water, one of
the older environmental hobgoblin-flogger issues,
the power of which has always mystified me. Is it
not understood by everyone above 8 years old that
water cannot be "used up"? Every drop consumed by
every creature on the planet finds its way back into
circulation, and usually very quickly. This, in
addition to the fact that while I don't have the
figures with which to do the math, I think I can
safely say that every animal alive on the planet,
taken as a whole and not just by the volume of water
within them, and lumped into an aggregate mass,
wouldn't put a notable dent in the volume of water
on Planet Earth.
Indeed, though now I have to suspect I
may be stretching the point too far, I wonder if
every animal on the planet combined would even
displace the water in Lake Michigan alone...
OK, THERE'S REALLY NO GREAT IMPORTANCE
in anything I have said here. As you can tell, what
I'm mostly doing is airing a few pet peeves
regarding aspects of our modern American public
discourse.
But only mostly.
We DO need to shut down this, "We need
to all just eat bugs to stave off climate change"
nonsense, and the assault on liberty and the rule of
law being justified on that basis. You can choose
your own course, but I'm not switching.

Not Letting This "Crisis" Go To Waste...

FRIENDS, THE SPORADIC BITS OF EASING of the despotic measures to
which most of the country has been subjected under
the fraudulent mantle of
COVID-19 mitigation should not be
allowed to bleed off the head of steam you probably had been developing.
The offenses happened, and they're far from over. Stay hot.
And while you are all warmed up, and while others, if
they're smart, are just as hot, I'd like you to send an email (and
Facebook post, or whatever) with the following content to everyone you
can (with a request that they pass it along, in turn):
[Name], since March of 2020 you've
watched as over-fed state power has been used to literally destroy
classical Western civilization and impose a new despotic paradigm. No
dissent or debate permitted-- no permission or agreement sought.
YOU KNOW where this will end up if the arrogant
state power being used to make this happen isn't radically diminished in
size, influence, resources and popular support, and exposed as an
opportunistic exploiter of legal ignorance (an ignorance which it has
been nurturing in the average mind for decades).
Those things having not yet happened, you
should be quaking in your boots-- and you probably are.
Isn't it time-- and past time-- for you to
begin helping to make those desperately-needed defensive changes take
place? There is only one way these things can happen short of a
who-knows-what we'll-end-up-with explosion of violence. I'm going to
show it to you.
When you're done with that reading, you'll know
what to do next.
BTW, REMEMBER, ALSO, THAT EVERY AMERICAN has lately been given a stark lesson in the fact
that government officials at all levels will lie to you and violate the
law without batting an eye. They will do so any time it serves their agenda, and
you don't call them out for it.
If you know anyone who has been persisting in denial on the
truth about the income tax, you know such nonsense is usually be
grounded in some version or another of, "That can't be true..." or "They
would never do something like that...". Now's the time to put a pin in
that delusional bubble.

certainly WOULD do something
like that.

FOR ALL THE YEARS SINCE 2003 when
CtC was first published, the government has engaged in a
concerted effort to frighten people away from its truths. This
effort involves official government websites and press releases
touting an occasional court ruling that appears to be at odds
with some
CtC-revelation (but without details sufficient to expose the
real substance of the ruling)--
and sometimes even more mendacious behavior.

on YouTube regarding donations. I didn't know what to do about
it to begin with; I don't do what I do intending for anyone to
feel obligated in any way.
But of course, no one IS obligated. I will continue
to make my work freely-available here, and in my books for only
the cost of a cheap paperback.
Thus, even though I post it here below, Tim's very
thoughtful personal resolution and encouragement to others is
just an invitation for consideration by those who may not be
conscious of the fact that I can't do what I do without support.
No one is to feel any pressure from it; if it moves anyone to
act let it be solely because it seems right.
All-in-all, just be the sort of person for others
that you would go to yourself for trustworthy leadership.
Leadership is a challenge. But it's not
complicated, and you can do it.

Are You Having Trouble Spreading The
Word?
SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE
EXPECTED when you're trying to explain to someone that
everything they've been encouraged their whole lives to
believe about something as entrenched and significant as the
income tax is basically nonsense. So here's a way to help
cut through the resistance:
Ask your listener how he or she would react if
you were to show an announcement from the Commissioner of
Internal Revenue admitting that the tax doesn't apply to the
earnings of most Americans and is misapplied most of the
time because people don't understand how it works? Or how
about if you showed a ruling from the Supreme Court saying
the same?
Now you just have to explain that
you're going to show exactly those things-- but because
the state really doesn't want people to know this, these
things haven't been said quite as forthrightly as we would
all wish. It's going to take a bit more work to take these
admissions in than is sufficient for just reading a press
release. But it'll be worth the effort...
IF YOU'RE NOT SPREADING THIS LINK with every bit of
energy you can, to school libraries, homeschool
families and community groups, your neighbors, your
family members, your pastors and
co-congregationalists, journalists, lawyers, CPAs,
members of congress, tax-agency workers, Wikipedia,
Anonymous, WikiLeaks, the Tax Foundation, everyone
in the "tax honesty" movement, the 9/11 truth
movement, other activist movements and everyone
else,
you have only yourself to blame for your
troubles with the tax, and a whole lot else of which
you might complain. It's on you.
WRITE A NICE, FRIENDLY AND BRIEF introductory note
explaining what will be seen at the link-- cryptic
is bad; excited is good-- and then send this WMI
(weapon of mass instruction) far and wide.
Remember: Real Americans don't accommodate fog, lies and a sliding scale of
adherence to the rule of law. Real American men and women stand up for the
truth and the law, come what may, knowing that it is only by setting the bar
at the top and enforcing it, come what may, that liberties are secured.

Mike Pompeo and CIA Sued for Illegal
Surveillance of Assange's Visitors

Attorneys and journalists
whom the CIA spied on when they visited WikiLeaks
publisher Julian Assange in the Ecuadorian Embassy
in London have filed a lawsuit against the CIA, its
former director Mike Pompeo, UC Global and its
director, David Morales, in U.S. District Court.
Assange is in a London
prison fighting extradition to the United States. He
is charged with violating the Espionage Act for
exposing U.S. war crimes and faces 175 years
imprisonment. During the seven years he lived in the
Ecuadorian Embassy under a grant of asylum, Assange
was visited by more than 100 attorneys, journalists
and doctors. They included Assange’s criminal
defense attorneys in the United States,
international human rights lawyers, national
security journalists whose sources could be
jeopardized if exposed, and physicians and medical
professionals.
The CIA commissioned
Undercover Global (UC Global), a private Spanish
security company, to send images from Assange’s
visitors’ cellphones and laptops as well as video
streamed from their meetings to the CIA.
“Unbeknownst to anyone there, they actually put
recording devices and cameras in the rooms where Mr.
Assange was, which essentially live streamed what he
was doing and saying back to Washington,” attorney
Richard Roth, who filed the lawsuit, told me and my
co-host Michael Smith on Law and Disorder radio. “I
think that there was clearly a desire to bring down
Julian Assange any way possible.”
Defendant Morales announced
to his employees that UC Global would be operating
“in the big league” and on the “dark side” with the
CIA,
the complaint says. Former employees of UC
Global said the deal included selling information
gathered as a result of the illegal surveillance.
The four plaintiffs, all
U.S. citizens, allege that the defendants violated
their Fourth Amendment rights to be free from
unreasonable searches and seizures. They are
requesting compensatory and punitive damages, an
injunction to prevent the CIA from revealing their
private communications, and the purging of CIA files
of this information.
One of the plaintiffs is
Deborah Hrbek, a media attorney who visited Assange
several times in the embassy. Speaking at an
online news conference, Hrbek noted:
On arrival, there was a
strict protocol, for the protection of Julian, we
were told. Passports, mobile phones, cameras,
laptops, recording devices and other electronic
equipment were turned over to the security guards in
the lobby. We learned much later, through a criminal
investigation under the supervision of a court in
Spain, that while visitors like me were meeting with
Julian in the embassy conference room, the guards
next door were taking apart our phones, removing and
photographing SIM cards and, we believe, downloading
data from our electronic equipment.
Attorney Margaret Ratner
Kunstler, another plaintiff, is a member of
Assange’s legal team. She said at the news
conference, “As a criminal attorney, I don’t think
there is anything worse than your opposition
listening in on what your plans are, what you intend
to do, on your conversations. It is treated by the
United States courts as a terrible thing … The
result has very often been a dismissal of the
indictment.”
Journalists John Goetz and
Charles Glass are the other two plaintiffs; they
interviewed Assange while he was in the embassy.
In addition to the Fourth
Amendment, the defendants violated the
attorney-client privilege and the physician-patient
privilege, according to Roth.
This lawsuit came nearly a
year after the release of a Yahoo News
report documenting the CIA’s plans to kidnap and
assassinate Assange when he was in the embassy.
Pompeo was furious at
the 2017 WikiLeaks revelation of the CIA’s “Vault 7”
program, which enabled the CIA to tap into
people’s cell phones and smart TVs, turning them
into listening devices. The CIA called the exposé
“the largest data loss in CIA history.” Pompeo
labeled WikiLeaks a “non-state hostile intelligence
service.” Senior CIA and administration officials
ordered “sketches” and “options” to assassinate
Assange. Donald Trump personally “asked whether the
CIA could assassinate Assange and provide him
‘options’ for how to do so,” according to the
report.
In 2019, the Trump
administration filed an indictment against Assange
for WikiLeaks’ 2010 publication of evidence of U.S.
war crimes in Iraq, Afghanistan and Guantánamo,
which were provided to them by whistleblower Chelsea
Manning. They include the 2007 “Collateral Murder”
video, which shows a U.S. Army Apache helicopter
gunship target and fire on unarmed civilians in
Baghdad. At least 18 civilians were killed,
including two Reuters journalists and a man who came
to rescue the wounded. Two children were injured. An
Army tank then drove over one of the bodies,
severing it in two. That video contains evidence of
three separate war crimes prohibited by the
Geneva Conventions and the U.S. Army Field Manual.
The Obama administration,
which indicted more whistleblowers than all its
predecessors combined, refused to indict Assange
because WikiLeaks did what The New York Times does.
No journalist or media outlet has ever been
prosecuted under the Espionage Act for publishing
truthful information. The First Amendment protects
the right of journalists to publish material that
was illegally obtained from a third person if it’s a
matter of public concern. The U.S. government has
never prosecuted a journalist or media outlet for
publishing classified information, an essential tool
of journalism.
Nevertheless, the Biden
administration is vigorously pursuing the
extradition and prosecution of Assange.

AS REGULAR READERS ON THESE PAGE KNOW, I take the assault
on Julian Assange-- and by extension, the assault on all of us being
carried out by silencing this most significant journalist of the modern
era and tormenting him as a warning to others who might dare to expose
the US deep state's crimes-- very seriously. For this reason alone I
would post Marjorie Cohn's report on the lawsuit against those accused
of illegal surveillance of Assange and his visitors in the Ecuadorian
embassy, in the hope that doing so would help keep Assange in the public
eye where he belongs, and from which his tormentors wish him removed.
But the story also has important
elements worth sharing on their own merits. For one,
the bringing of the suit serves to remind everyone
of a fact deep state actors of all varieties very
much wish to be misunderstood: the provisions and
prohibitions of the US Constitution apply for the
benefit of all persons with whom the US or its
agents interact, and wherever such interactions
occur. The fact that Julian Assange is not a US
citizen is immaterial. The US must nonetheless abide
by, for instance, the Fourth Amendment's
restrictions in any attention it pays to him.
Likewise, the fact the the US attention
was paid to Assange while he was in the UK is
immaterial to the constraints imposed by the Fourth
Amendment, as is the fact that the attention was
paid by foreign state actors on behalf of the US,
and not US operatives directly.
At the same time, this story also
reminds everyone of the farcical and contemptuous
attitude toward the Fourth Amendment of the US deep
state (and its co-opted courts), in that the
surveillance of Assange WAS carried out in defiance
of Fourth Amendment requirements, and yet everything
that was learned thereby which can be pretended to
have been developed in other ways-- even though the
discovery of those "other ways" relied on getting
the illegally-obtained information in the first
place-- will be admitted by the particularly puppet
court in northern Virginia in which Assange will be
"tried" if his extradition takes place (as
expected). The mere fact that illegal surveillance
was conducted should cause the charges against
Assange to be dismissed-- how else to meaningfully
deter such illegal acts in the future? But they will
not be.
ANOTHER VIRTUE TO THIS REPORT BY COHN
is in that it reminds everyone of how thoroughly
Mike Pompeo is a swamp-dwelling member of the deep
state, or at least how much he makes common-cause
with those creatures. Lest anyone misunderstand,
Assange's great offense, for which he has been
punished over the course of a full decade now, was
his revelations of US (and British) deep state
crimes. Anyone hostile to Assange is manifestly
friendly to those criminal deep state actors, since
anyone hostile to those deep state actors celebrates
Assange for his courageous revelations and calls for
more of the same.
It must be said as well that two of the
most egregiously bad and stigmatizing acts of Donald
Trump were his permission to Pompeo to indict
Assange and bribe Ecuador president Lenin Moreno
into revoking Assange's asylum, allowing his seizure
from the Ecuadorian embassy in London, and his
failure to pardon Assange (and Edward Snowden,
another man honored by all right-thinking people for
his exposure of US deep state crimes, but forced
into exile for having done so) in his last days in
office. I'm not sure I account Trump's bad acts here
as malicious, rather than simply the product of a
certain irresponsible disengagement to which he is
prone, but these bad acts need to kept up front in
the public eye, the political landscape being what
it is at the moment.
One simple act by each individual
American will do the trick, and it needs no approval
or agreement from any institutional authority. That one
simple thing will function as a catalyst, compelling
the beneficial reorganization of our whole societal
and political structure as a natural and inevitable
process.

the Law And Other Observations�. He is a member of Mensa;
an
award-winning artist; and has paid his dues as a youth
soccer coach. He is a long-time political activist as well, and
has served as co-chair and platform convention delegate of
Michigan�s largest county Libertarian Party organization; as a
consultant to the National Right to Work Foundation and Citizens
for a Sound Economy; as a member of the Heartland Institute; and
as a member of the International Society for Individual
Liberty. He is a frequent radio-show guest on stations across
the country.
Hendrickson's business career has included nearly a
decade-and-a-half at the leading edge of the renewable-energy
industry, both as Director of Purchasing and Materials
Management and member of the R&D board at Starpak Energy
Systems, the mid-west's then-largest solar heating and
energy-recovery-and re-utilization company; and as founder and
president of AFJ Inc., a high-efficiency lighting design,
manufacture and installation firm.
Beginning in the mid-1990s and continuing for the
twelve years before his present full-time focus on the
restoration of the rule of law in America, Hendrickson directed
purchasing activities for the $84 million-a-year
multi-family-housing division of the Farmington Hills, Michigan
branch of Edward Rose and Sons, with responsibility for 18,000+
apartments, direct supervision of 35 technicians and agents, and
incidental authority over several hundred divisional workers.
He also ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On rather the other end of the spectrum, amidst
these more mundane pursuits Hendrickson co-founded and was the
primary creative force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan,
with his wife and two children. He is currently working on his
next book.
