So, Just In Time For "Tax Day", 2023...

...an early educated filer has shared the community's first victories with filings for 2022.

NICK MEMMELAAR WASTED NO TIME submitting his first educated filings after receiving an erroneous W-2 from the company for which he worked during 2022. The respectful responses were just as prompt. On March 23, and then again on April 4, Nick received his complete refunds of everything claimed from both Michigan and the feds:

It must be said that Nick did things a bit differently than most for these debut educated filings. He chose to rebut the mischaracterization of his earnings as statutorily-defined "wages" only once he had submitted his withdrawal of authorization to withhold to the payer (in mid-November), which coincided with his completion of the 40 quarters of contributions to the FICA scheme necessary to qualify for Social Security benefits (see the several Q & As on this topic here, and especially the material at the links found therein).

Here is Nick's Michigan filing, and here is his federal filing. Each reflect Nick's decision, as is explained in considerable relevant detail in the cover letters accompanying the returns.

Here is the W-2 created by Nick's payer, which will make clear that his refunds, though relatively small, and despite Nick reporting a big chunk of "wages" on his 4852s (per his calculations as discussed), are indeed the product of educated filings and reflect the agreement of plainly well-informed tax agencies that Nick's earnings do not qualify as "wages" unless he chooses to so designate them-- either deliberately or, as is true for the vast majority, in silent acquiescence fueled by ignorance cultivated by revenue-hungry and thoroughly unscrupulous governments.

HATS OFF TO NICK, whose great victories join those of the tens of thousands of other awakened and activated Americans represented here, and constitute more critical steps toward the restoration of the Founders republic and the true rule of law. Their great activism and outreach drive everything forward.

A Few SOTFPWTWGB Thoughts

...that is, sitting-on-the-front-porch-watching-the-world-go-by thoughts, on the Ukraine war fraud, the unconstitutionality of the EPA, the LGBTetc. "genocide" trope, and more.

CONGRESS HAS THE SOLE AUTHORITY in the federal government to initiate military action by the United States (other than highly limited presidential latitude to repel active or imminent hostile attack for a brief period of time-- something not applicable to any US military action undertaken in quite a long time, notably including the current action against Russia). This is widely understood in at least an academic way.

The manifest implication of that widely understood fact-- that most of the military actions undertaken without a Congressional declaration of war over the last eight decades or so have been illegal, notably including the current action against Russia (the degree of which illegal action has just been much more widely exposed by the brave whistleblower, Jack Teixeira)-- is seldom acknowledged.*

WHAT I IMAGINE IS MUCH LESS WIDELY UNDERSTOOD is that the current illegal, undeclared war being prosecuted by the United States against Russia was begun solely by the United States. Nine years ago the US organized and carried out a coup overthrowing the legitimately-elected government of Ukraine. This was followed by a civil war between the majority of Ukrainians supporting the legitimate, overthrown government (the bulk of whom live in the eastern part of the country) and the US-backed minority which had engaged in the coup (and which is comprised in significant part by neo-Nazis).

At the beginning of this internal conflict Crimea, which had seceded from Ukraine repeatedly since the breakup of the USSR in 1991, voted overwhelmingly to be annexed by Russia. The other loyalist regions sued for similar annexation, but the Putin government, exercising astonishing restraint and being a bit naive, declined those requests, putting misplaced faith in a negotiated resolution to the civil conflict under the terms of the Minsk accords (I and II) which the US and the western Ukraine coup-plotters steadily violated to a greater and greater degree until Russia had no choice but to invade in order to forestall an imminent genocide in the Donbas. ALSO LESS WIDELY UNDERSTOOD is that the illegal war the US is prosecuting in Ukraine is against the largest and most technologically accomplished nuclear force on the planet. Russia has more nukes and bigger nukes and more diversified nukes that the US, and has submarine and hypersonic delivery technology well beyond that of the US and which cannot be intercepted by US countermeasures. If pushed to any definitive sense of existential peril by US encroachments, military or political, and whether directly or through the neo-Nazi Ukrainian proxy, Russia can be expected to take us out with it. Why not, after all?

China, which knows perfectly well that it is next on the hit list if the US succeeds in its aggression against Russia, will add its own throw weight to the obliteration of America. Why not, after all?

Here is an idea of what that will mean:

The day before one tiny nuclear bomb (since then, nukes literally thousands of times more powerful are made) was dropped on Nagasaki, what you see above had been a thriving city of 240,000.

Where outlying buildings remained erect in Hiroshima and Nagasaki, the "shadows" of incinerated inhabitants were burned into walls and sidewalks.

Americans need to stop sleepwalking and relying on someone else to arrest this madness being committed against us all by a political and military and industrial elite blinded by pomp and profits or in the sociopathic steer-into-the-iceberg grip of nihilism and narcissism. We need to defund (and thus, shrink back into its britches) the Leviathan state by the grossly swollen size of which the lunacy is enabled. See the solution here, and pass it around like your life depends on it.

*This illegality remains true even in the face of pretenses like the "Authorization of the Use of Military Force".

After all, Congress is not Constitutionally-authorized to delegate its war-making power to the executive, and no nations upon which war is being declared are named in the AUMFs, and yet the executive has treated them as license to bomb, invade and occupy other sovereign nations-- in other words, as license to prosecute undeclared wars at its discretion.

I WONDER HOW MANY PEOPLE reflect on the fact that if they have kids in public schools, they are welfare recipients?

THE BIDEN CABAL has just proposed new vehicle emissions standards seemingly calculated to eviscerate internal combustion engine production and sales within a few years. At this juncture, it is worth taking note of the fact that there is no Constitutional authorization for anything done by the Environmental Protection Agency.

In anticipation of the reflexive rejoinder by some, I will point out that where the expression "general welfare" appears in the Constitution, it is simply deployed as an explanation for the extraordinary and controversial inclusion of a power to tax in what was actually just a new version of the Articles of Confederation, which power had been entirely denied to the United States in the earlier version.

Here is how that expression appears:

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

This clause, the first in Article I, sec. 8, is often mischaracterized as the "General Welfare" clause (as here, by the US Congress, no less, which actually puts that label in its webpage text as though it appears thus in the Constitution itself, which it does not). In fact, the clause is plainly the "Power to tax" clause. This is unmistakably and indisputably shown by the location of the semi-colons with which the Framers divide and distinguish clauses throughout the entire section.

Here, we have a semi-colon after the grant of a power to tax, and then again after a subsequent limitation of that tax power. The "general welfare" phrase is in no way so distinguished as a delegated power, but instead is clearly in the same category of mere flourish and justification as are the phrases "pay the debts" and "provide for the common Defence" with which it appears.

The silliness of treating clause 1 of section 8 as the "general welfare" clause is shown in the fact that we never hear anyone label this portion of Article I, section 8 as the "Pay the Debts" clause, or the "Provide for the Common Defence" clause... At most, "general welfare" has a specific significance only as a reference to the good meant to be accomplished by Congressional implementation of the powers subsequently given in the section in which it appears.

As James Madison wrote in his 'Report of 1800':

“Money cannot be applied to the General Welfare, otherwise than by an application of it to some PARTICULAR measure conducive to the General Welfare. Whenever, therefore, money has been raised by the general Authority, and is to be applied to a particular measure, a question arises whether the particular measure be within the enumerated authorities vested in Congress. If it be, the money requisite for it may be applied to it; if it be not, no such application can be made.”

Thomas Jefferson put it this way (in a letter to Albert Gallatin in 1817):

“Our tenet ever was … that Congress has not unlimited powers to provide for the general welfare, but were restrained to those specifically enumerated; and that, as it was never meant they should raise money for purposes which the enumeration did not place under their action; consequently, that the specification of powers is a limitation of the purposes for which they may raise money.”

Even ardent statist and centralized, unrestrained-power enthusiast Alexander Hamilton admitted that the first clause of Article I, Section 8 shouldn't be, and can't plausibly be, read as a grant of any kind of general authority for legislation regarding whatever Congress might think is good, wise, or necessary for the general welfare, writing in Federalist #83:

“This specification of particulars [the 18 enumerated powers of Article I, Section 8] evidently excludes all pretension to a general legislative authority, because an affirmative grant of special powers would be absurd as well as useless if a general authority was intended.”

So, no. There is no "general welfare" clause or other manner by which by which the federal government is authorized to dictate what kind of lightbulbs, stove, toilet or showerhead you use, or how your car engine operates, or anything else of the sort. The Biden administration overreach on emissions is as good a reason as any to finally wake up to this fact.

Let's be done with the distracting, expensive and absurd practice of stationing a ASL signer at the elbow of every public official holding a press conference and rely on the deaf to use the closed caption function on their TVs and other devices, which are probably already on by default at all times anyway.

I AM SICK OF THE EXPRESSION "gender-affirming care" The behavior so labeled is actually delusion-nurturing abuse, and should be plainly referred-to as such.

After all, even taken with respect for the manner in which the misleading and improper phrase is used, it simply refers to "care" by which the imaginings of the one being "cared for" are endorsed or given a corresponding superficial costume (i.e., you think you are a woman; we will "affirm" this by making you look like one). Since the notion of a man that he is a woman (or of a woman that she is a man) is plainly delusional, and encouraging or enabling delusions is plainly abusive, so-called "gender-affirming care" is really delusion-nurturing abuse, full stop.

ON THE "TRANS" SUBJECT, I have a possible decryption of the often-heard plaint of the LGBTQRSYADAYADA community that opposition to their efforts to sexualize and acclimate children to queerness is "genocidal". Perhaps what is behind this apparently inapt language is the fact that sexualizing and queer-acclimating children is actually the way that community reproduces, and thus ensures its continuity.

After all, no one is "born queer". Like the pod people in 'Invasion of the Body Snatchers', the queer community must subvert normal healthy children in order to produce another generation of their kind (and, perhaps, secure the political power and related security which comes from what might end up being expanded numbers).

Obviously, I'm just speculating here. Perhaps there is some other explanation for the "genocide" language.

Maybe it is merely political rhetoric meant to evoke sympathy from poorly-informed members of the larger community who could be misled into imagining that the queer community is actually being targeted for deadly violence due to their peculiar choices and behaviors. Maybe it is just another example of the degeneration of language encouraged by the left by which any failure to embrace is deemed somehow an act of violent rejection comprising a sort of "spiritual genocide".

I don't know. But I think my speculation makes sense, though it might be difficult to imagine anyone within the queer community really thinking it through this way directly. After all, that community has marinated itself for years in idiotic notions like the existence of a "queer gene", and that kids are born knowing that they are in the wrong body.

Nonetheless, even with those blinders firmly in place, I think that at some core level, those impelled to conduct drag shows in front of little children, sexualize kindergartners and encourage them to question their "gender assignments", and do everything else possible to promote their lifestyle to little kids understand. They know, at some core level, that all this impelled grooming behavior is along the lines of a species-preserving imperative.

INDICTING A FORMER PRESIDENT is NOT a "crossing of the Rubicon". Trump is not, after all, indicted over a policy or act performed in the course of carrying out the duties of his office. That would be an indictment meriting treatment as remarkable and in which Trump being a former president would be relevant in that regard.

What IS a crossing of the Rubicon, and worthy of remarking as such, is the indictment of the front-running candidate-competitor of the current president, of whom the indicting DA is a political ally, and over so bizarrely and indefensibly contrived a collection of charges.

My quibble, therefore, is not with those getting exercised over the indictment of Trump by Alvin Bragg. It is just with the labeling that many of those folks use. Such things matter, and I wish everyone in the pro-Trump crowd would start getting this right.

WHILE WE'RE ON THE SUBJECT OF DONALD TRUMP, let me close with this: Much has been made recently of China successfully brokering a peace agreement between Iran and Saudi Arabia. Doesn't it seem like only yesterday that Donald Trump and Co. murdered the most beloved public figure in Iran in order to stop such an agreement being made? And on sovereign foreign soil, no less, with additional collateral fatalities...

There's some useful perspective to be learned from these facts by those capable of learning. Unfortunately, that class of learning-capable people seldom seems to include those in charge of US foreign policy.

Not Letting This "Crisis" Go To Waste...

...an important action item opportunity.

FRIENDS, THE SPORADIC BITS OF EASING of the despotic measures to which most of the country has been subjected under the fraudulent mantle of COVID-19 mitigation should not be allowed to bleed off the head of steam you probably had been developing. The offenses happened, and they're far from over. Stay hot.

And while you are all warmed up, and while others, if they're smart, are just as hot, I'd like you to send an email (and Facebook post, or whatever) with the following content to everyone you can (with a request that they pass it along, in turn):

[Name], since March of 2020 you've watched as over-fed state power has been used to literally destroy classical Western civilization and impose a new despotic paradigm. No dissent or debate permitted-- no permission or agreement sought.

YOU KNOW where this will end up if the arrogant state power being used to make this happen isn't radically diminished in size, influence, resources and popular support, and exposed as an opportunistic exploiter of legal ignorance (an ignorance which it has been nurturing in the average mind for decades).

Those things having not yet happened, you should be quaking in your boots-- and you probably are.

Isn't it time-- and past time-- for you to begin helping to make those desperately-needed defensive changes take place? There is only one way these things can happen short of a who-knows-what we'll-end-up-with explosion of violence. I'm going to show it to you.

Are You Having Trouble Spreading The Word?

SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance:

Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same?

Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort...

When will we ever be rid of the scourge of Donald J. Trump?

Just when his star was finally fading and the prospect of an alternative GOP candidate for the 2024 presidential race was gaining steam (i.e. Gov. Ron DeSantis) the lunatic who George Soros put in the Manhattan DA’s office comes up with this absolute joke of an indictment.

The “34 counts” consist of three misdemeanors, where the statute of limitations has already expired. These putative offenses are then each cut and pasted 11 times to match the monthly reimbursement checks to Michael Cohen for the hush payments he made to the Donald’s lady friends with respect to dalliances two decades earlier.

These three repetitive “books and records” violations include Cohen’s invoice for reimbursement (X11), its entry into the Trump Organization’s general ledger (X12) and the latter’s receipt of a check from the Donald to cover the payments (X11).

In turn, this no-count minutia is transformed into a felony aimed to bring down a former president for the first time in American history and the leading GOP candidate for 2024 by pure legal legerdemain. That is, the boosting of these stale misdemeanors into felonies owing to an alleged bad intent to hide something actually jail-worthy. And in this case, repeated 34 times for good measure.

…..with intent to defraud and intent to commit another crime and aid and conceal the commission thereof.

What the additional crime was, the indictment does not say. Bragg just assured that we would find out by the time of the trial, which is not likely to occur until after the GOP presidential primaries are over!

Of course, the unnamed crime is not hard to guess. It is failure to report these perfectly legal hush money payments as campaign expenditures. That is, offenses like the $113,000 civil fine Hillary paid when the ample money her campaign supplied to Christopher Steele to concoct the RussiaGate dossier was falsely reported as an expense for “legal services”.

As far as we can tell, Alvin Bragg may well be as stupid as his indictment. But that doesn’t excuse the whole of the Democratic Party and a good part of official Washington and the mainstream media for tolerating this hideous stunt. Bragg should have been shutdown long ago by a thundering chorus from Washington saying,

“….campaign promise or not, don’t you dare tamper with the very viability of democratic governance in this manner”.

Indeed, the whole escapade is so far off the wall as to make you want to don your tinfoil hat. That is to say, is the Donald secretly paying Bragg to undertake this madness?!

After all, if things go according to plan and a trial doesn’t happen until June 2024 at the earliest, it will literally be worth billions of campaign advertising in the run-up to the GOP convention. Indeed, given the backdrop of soaring crime in the Big Apple on Bragg’s watch, the sheer triviality, hypocrisy and persecutorial bad faith of the DA’s case will surely hand Trump the nomination by acclaim.

So to repeat: How is it that the Dems, media and Washington establishment, including the RINO poseur who passes for the GOP’s Senate leader (i.e. Mitch McConnell), have not called foul?

Unfortunately, the explanation lies in the nether reaches of human behavior. The fact is, the Donald is so toxic, such an unhinged narcissistic braggart, and so endlessly bombastic, insulting and thuggish that the other kids in the political sandbox simply refuse to play nicely with him; and, in fact, never stop looking for ways to kick-him off the playground entirely. In that sense, this is just one more iteration of the impeachment charade.

Of course, it is not considered kosher or seemly to go after a political opponent hammer-and-tong because you think he/she/they have an obnoxious personality or even a condemnable character. And that’s especially the case when you stretch the boundaries of the constitution and basic political decorum to the limit in order to do so.

So the establishment has concocted an alleged substantive case to camouflage the sheer hate that lies at the center of the prosecution. To wit, it is alleged that the Donald is a dangerous dog-whistling racist and a stooge of Vladimir Putin who endangers America’s very national security.

In effect, these bogus policy arguments have become thoroughly entwined in the personality-driven Trump Derangement Syndrome (TDS), and that’s where the true evil of this entire anti-Trump campaign lies.

That is to say, what needs to be addressed in Washington is—

• The hideous yet unnecessary proxy war with Russia that threatens to escalate to a nuclear confrontation;

• The $900 billion runaway defense budget that is enabling Deep State apparatchiks to supersede the rule of constitutional democracy by literally buying their way to control with taxpayer money;

• A level of overall fiscal incontinence that puts to shame the big spenders of times of yore including LBJ and FDR; and

• A rogue central bank that has enabled the above and has impregnated the US economy with bubbles, booby-traps and distortions that threaten to end capitalist prosperity as we have known it.

Yet none of these pressing matters are being even remotely addressed because Washington is submerged in TDS-incubated rancor. In the case of foreign policy, it can’t even see straight.

Afterword

DAVID STOCKMAN-- a truly reliable source of clear-headed observations on the political and fiscal landscape in the United States-- offers a fine take on the Trump indictment and the political contortions fueling that despicable assault. The one thing he gets wrong here is to suggest that a tin-foil hat might be appropriate while considering all that is involved in the bogus indictment and its predictable effect on the Republican nomination next year, as though Bragg and the Democrat machine of which he is a part are blindly aiding DJT's prospects.

This is the often-made mistake of failing to recognize that the Democrats and RINOs and their allies in the deep state (the Uniparty) rarely do anything randomly or carelessly. Stockman is right that Bragg's indictment and the timing of related events will enhance Trump's chances for the nomination, but not by mischance. This will happen because they WANT Trump nominated by the Republican party.

Seeing Trump nominated is the only way the Uniparty can avoid having to face the far more formidable candidate and far more dangerous-to-their-status-quo-if-elected Ron DeSantis in the general election in 2024.

Understand, Joe Biden will NOT be the Democrat nominee in 2024. If he were, even Donald Trump-- and even Trump with his actual record in office hanging around his neck like an albatross-- could win. But the Democrat nominee will be someone without Joe Biden's own ugly baggage in tow-- someone more Hollywood-ready, like Gavin Newsom, for instance. As noxious as Newsom also is, he is also a slick and accomplished political hack, who will have a ton of money and the best script-writers in the business behind him. The demonized and record-tarred Donald Trump would never beat him.

But the very bright, articulate, charismatic, photogenic and proven-record, walk-the-walk Ron DeSantis would handily mop the floor with Newsom, or any other opponent, and then begin the dismantling of the corrupt and dangerous crony-capitalist house of cards which has been teetering over all our heads for the last few decades, along with the ongoing leftist assault on Western Civilization. The Uniparty very much knows this.

DeSantis/Paul? Gabbard? Massie? in 2024!

MEANTIME, THE REST OF US CAN get that dismantling underway ourselves, and ease what will be a big lift for anyone, including Ron DeSantis.

One simple act by each individual American will do the trick, and it needs no approval or agreement from any institutional authority. That one simple thing will function as a catalyst, compelling the beneficial reorganization of our whole societal and political structure as a natural and inevitable process.
