Closing 2023 With A Nice Christmas Present For The CtC Community

I'm delighted to share a couple of recent wins over the obnoxious IRS "partial refund" (victory in progress, or v-i-p) ploy, which should warm the cockles of every righteous heart this holiday season.

SO, THE LAST FEW MONTHS HAVE BEEN BLESSED WITH not only a lot of victories but also two important crack-in-the-ice wins over the lame and indefensible "partial refund" ploy resorted to all too often over the last few years by an IRS struggling to preserve its scheme in the face of CtC-educated Americans. As we settle in for a nice Christmas break in this otherwise pretty tough year, let's enjoy those special wins and a selection of the others.

Ben Pezzano

BEN FILED NOT ONLY an educated return and claim concerning 2022 withholding totaling $7,884.03 early this year (albeit with a little confusion over the proper way to rebut an erroneous K-1). He also provided a very clear cover letter explaining his filing. (See both here.)

Nonetheless, the first response by the IRS was to try its ridiculous and corrupt pretense of acknowledging that Ben had had no tax-relevant "income" and owed no tax, but was somehow entitled to keep what had been withheld from him as Social Security and Medicare taxes (by pretending that those amounts had not been withheld, or don't qualify as "federal income taxes", and falsely reporting the amount shown on line 25(d) of Ben's 1040 to be only $2,493 (just as discussed more fully here in regard to the same corrupt treatment visited upon Lance Cole):

Immediately upon receiving the partial refund pretense, Ben, drawing on the vast legal resources I have presented in my books and on LHC over the last 20 years, fired off this cogent and concise reply, spelling out the relevant law and facts in detail, and demanding proper treatment by the tax agency. The IRS responded with a bizarre, disconnected letter about an amended return, seen here. Again, Ben fired off a straightforward and sensible reply pointing out the relevant facts and making clear that he was a grown-up American fully committed to standing his ground and enforcing the law.

After these exchanges helped the IRS see the light, the agency finally threw in the towel and got right with the law, returning all of Ben's money, with interest:

Brett & Tori Lackey

BRETT & TORI'S partial refund for 2022 from the feds was posted in the July 17 Newsletter, with a claimed $27,188.64 yielding just a $7,435.36 refund to begin with, on the same absurd pretense as that used against Ben Pezzano. But like Ben, Brett & Tori weren't having any of it.

After getting that first deposit, Brett & Tori fired off a letter spelling out the relevant facts and law. The IRS responded, but breaking the pattern a bit, this response was not just previously typical stonewalling, stalling, or gibberish. Instead, the agency tried to snake out of this problem with yet another partial refund of $10,776.59 more of what is owed to our virtuous warrior couple, followed by a notice purporting to explain the new deposit:

Brett & Tori, making progress but still short of made whole, again wrote an admirably patient reply, again explaining the facts and the law.

This time the IRS response since then has been a stall letter, followed a month later by a complete bit of nonsense pretending that Brett & Tori had tried to claim a refund of "Excess Social security Railroad Retirement tax" withheld (a subject discussed here, and in no way relevant to Brett & Tori's filing.

So, Brett & Tori aren't quite done with this silly little tussle, but the IRS is losing ground-- and dignity-- rapidly.

Julie Ann Marien

JULIE ANN SHARES TWO nice victories today. Let's start with her recovery of everything withheld from her and given over to the feds during 2020, secured, with interest, by way of an amended return:

Julie Ann follows up with a victory-in-progress from the feds for 2022, in the form of an admission of no tax-relevant "income" received, and no taxes owed, despite which the IRS is still trying to suggest that Julie Ann is not entitled to a complete refund:

This corrupt ploy is in response to this filing, which was first met with a little bit of pothole-style resistance (showing, among other things, that the tax agency had looked closely at Julie Ann's return before issuing that admission and partial refund, above), to which Julie Ann had patiently replied with this.

In October, Julie Ann wrote again, specifically addressing the CP12 admissions and fabrications/omissions/mendacities, to which she is still awaiting a response. But those admissions have been made, and as seen above, the v-i-p ploy is crumbling.

We will expect further good news, but in the meantime,

Deborah Smith

DEBORAH IS ANOTHER educated filer unwisely targeted by the IRS for the v-i-p treatment. Here is Deborah's filing for 2022, plainly showing and supporting a complete refund claim of $11,704.00. The desperate, mendacious (but critical and self-defeating admission-laden) IRS response? Behold:

SO, THIS IS THE LAST NEWSLETTER of the year, and I'm going to take this opportunity to say something a little bit stern, which I've said many times before, but not lately: If this community of good people really wants to smooth its own path forward, and see an end to the hoops through which many are made to jump on the way to lawful treatment by tax agencies, it needs to get loud and visible.

Do you all realize that NOT ONE pundit or influencer of any real heft has EVER learned about (or at least spoken about) my work and revelations regarding the income tax, and/or all the massive support for that work and those revelations steadily piling up over the last 20 years?

Many such voices talk about nonsense like the "flat tax", or the latest tax-related court case in the news (see the next article in this newsletter for more on that), but none have a word to say about the thoroughly-proven real-deal on the subject.

When that silence ends, THIS COMMUNITY will be the beneficiary, because when that silence ends, the "ignorance tax" scheme collapses entirely. You all can make this happen, each one on your own, or doing outreach in groups.

No post anywhere in social media, no column, no speech in which the income tax appears as a subject, either central or peripheral, should pass without dozens, hundreds or thousands of comments, replies, etc. politely explaining that the speaker is wrong, and directing that speaker (and everyone reading the comments, replies, etc) to LHC and the liberating truth.

C'mon, people. Make this happen!

Their great victories join those of the tens of thousands of other awakened and activated Americans represented here, and constitute more critical steps toward the restoration of the Founders republic and the true rule of law. A Few Final Thoughts (For This Year) On Current Events

Mostly on the tragedy unfolding in the Middle East, but also some comments on Moore v. United States, which has caught the attention of a lot of folks in the community, mostly due to hype about the case by outsiders who misunderstand the true nature of the income tax.

TO THOSE WHO ENTHUSE about (or quietly cheer for) war in the Middle East, or the continued barbaric genocidal behavior of Israel against the remnants of the Palestinian people, due to notions about the 'Revelations' chapter in the Bible, I have this to say: Even if your notions about the validity of that chapter and your interpretation of its meaning are correct, what will happen, and when, is God's call, not yours, and nothing you can do is either capable of, or necessary to, making it happen.

On the other hand, and very relevantly, Jesus, whose teachings are a repudiation of the primitive, exclusionary barbarism that pervades the Old Testamnet, instructed us all as to what IS within our power, and what IS proper for our attention and efforts, when he said, "Blessed are the peacemakers, for they will be called the Sons of God"; "Blessed are the poor in spirit [humble], for theirs is the Kingdom of Heaven"; and "Blessed are the merciful, for they will be shown mercy".

Think hard about all this as Christmas approaches.

I CONTINUE TO HEAR MYSTIFICATION from many pundits on the question of why Joe Biden & Co. are so persistent in seeking more American treasure to pour down the rat hole of Ukraine. But I think the answer might be simple.

As I have pointed out before, Biden's Ukraine obsession might well be as simple as his need to destroy a crime scene-- both his personal crimes and/or those of the corrupt state which had been doing illegal bioweapon research at various spots throughout Ukraine. (See the whole backstory on the Ukraine war here.)

Let's never forget that while the sane (or ethical) mind recoils at the idea of causing deaths (or burning vast sums of money) on behalf of purely personal benefits, the corrupt mind does not, and especially when the lives or wealth being burned away belongs to other people.

IS IT POSSIBLE THAT rather than otherwise incomprehensibly supporting Israeli war crimes because of religious piety (an unlikely thing to control the behavior of at least some of the people in question) or political considerations (an unlikely thing because the majority of the American electorate does not favor such support, and donor money is less and less a significant factor in American politics where an appearance on Tucker Carlson's or Joe Rogan's podcast will reach more voters and more effectively than $100,000,000 spent on ads), the denizens of Washington are instead literally afraid of Israel?

Like, afraid of being murdered by an Israeli assassin? Or of Israel setting off a nuke they've concealed someplace in the DC 30 years ago, in the execution of its blackly evil, utterly grotesque "Samson Option"? Understand, this "option is not solely a deterrent aimed at a belligerent, as is commonly misunderstood.

Rather, the "Samson Option" is also a coercion doctrine, meant to threaten even non-belligerents into supporting Israel, or at minimum to not stand against it, at peril of losing an urban population or two-- atrocities which would be committed, many in Israel (and some elsewhere) likely believe, with divine approval. As Martin van Creveld, professor of military history at Hebrew University in Jerusalem, has said in regard to the question of whether the world would permit the ethnic cleansing of Palestinians from Palestine:

'That depends on who does it and how quickly it happens. We possess several hundred atomic warheads and rockets and can launch them at targets in all directions, perhaps even at Rome. Most European capitals are targets for our air force. Let me quote General Moshe Dayan: "Israel must be like a mad dog, too dangerous to bother." I consider it all hopeless at this point. We shall have to try to prevent things from coming to that, if at all possible. Our armed forces, however, are not the thirtieth strongest in the world, but rather the second or third. We have the capability to take the world down with us. And I can assure you that that will happen before Israel goes under.'

Or perhaps the DC swamp creatures are simply afraid of being outed as criminals or degenerates by Israel, which has been hoovering up all electronic communication in the US since at least 2011 (see this article, within which will be found the documentation of that fact)?

FINALLY, THERE IS A BIT OF A BUZZ in the community over a widely-publicized case recently heard by the US Supreme Court, Moore v. US. I've been asked to comment about the case by several folks (with those requests being the first I had heard of the case), and have offered a few thoughts in response, which I will share here for the benefit of anyone else interested:

Having glanced over what was sent for me to look at on the matter, I don't think I see much of an argument for the Plaintiffs. They admit to having received profits, which they disposed of by buying more stock or otherwise increasing the value of their investment in an Indian-based business (which of those two it is is not clear to me, but in either case they have increased their assets). Thus, the Plaintiffs had, and actually realized, both profits and gains. Their argument seems to be only that having not taken these profits and gains in the form of folding money, they aren't cognizable (yet-- more on that in a moment) by the taxman.

However, while the Plaintiffs may not have realized these profits and gains in the form of dollars, it is a long-settled matter that the only way in which dollars are really relevant to the tax is insofar as gains from taxable activities are measured for tax purposes by their value as EXPRESSED in dollars. That is, however taxable-activity gains are realized, whether as services, stock, sheep or gold, those gains are accounted for tax purposes by what they could fetch if traded for dollars.

AS I SAID, THOUGH, this is just an observation at first glance, and only first glance at this news blurb write-up, to boot. Maybe there is more in the details that might explain why the court would take the case, unless it's just a matter of wanting to put to rest a mistaken notion that could prompt lots of confusion and/or hassle for the IRS.

I haven't seen anything about how the case has gone in the lower courts, other than what is implied by the Plaintiffs having had to seek a hearing by the Supreme Court.

HOWEVER, AND VERY IMPORTANTLY, all the foregoing merely addresses the case in the context it creates. Although Yahoo News (and presumably other outlets) says, "The legal question in the case involves how to define income for tax purposes," there is actually no indication that these Plaintiffs address the foundational issue of whether the profits made could be taxable at all (that is, could be "income" at all, for purposes of the income tax), whether, or however, realized or not...

Having not raised a challenge to their economic activity (or its products) being taxable in the first place, the Plaintiffs have conceded that point (or kept it from the court's consideration). HAD they raised that fundamental challenge, the court would almost certainly not have taken the case, regardless of the significance of any other argument made.

All in all, based on what I can glean from the news report presented, this case is a nothing-burger, and merits no great attention.

Not Letting This "Crisis" Go To Waste...

...an important action item opportunity.

FRIENDS, THE SPORADIC EASINGS of the despotic measures to which most of the country has been subjected under since the onset of the COVID-19 hobgoblin narrative should not be allowed to bleed off the head of steam you probably had been developing. The offenses happened, and they're far from over. Stay hot.

And while you are all warmed up, and while others, if they're smart, are just as hot, I'd like you to send an email (and Facebook post, or whatever) with the following content to everyone you can (with a request that they pass it along, in turn):

[Name], since March of 2020 you've watched as over-fed state power has been used to literally destroy classical Western civilization and impose a new despotic paradigm. No dissent or debate permitted-- no permission or agreement sought.

YOU KNOW where this will end up if the arrogant state power being used to make this happen isn't radically diminished in size, influence, resources and popular support, and exposed as an opportunistic exploiter of legal ignorance (an ignorance which it has been nurturing in the average mind for decades).

Those things having not yet happened, you should be quaking in your boots-- and you probably are.

Isn't it time-- and past time-- for you to begin helping to make those desperately-needed defensive changes take place? There is only one way these things can happen short of a who-knows-what we'll-end-up-with explosion of violence. I'm going to show it to you.

Regarding Trolleries

(Deceitful efforts to discourage Americans from learning the truth about the "income tax")

FOR ALL THE YEARS SINCE 2003 when CtC was first published, the government has engaged in a concerted effort to frighten people away from its truths. This effort involves official government websites and press releases touting an occasional court ruling that appears to be at odds with some CtC-revelation (but without details sufficient to expose the real substance of the ruling)-- and sometimes even more mendacious behavior.

Tim Kendrick has posted a video on YouTube regarding donations. I didn't know what to do about it to begin with; I don't do what I do intending for anyone to feel obligated in any way.

Are You Having Trouble Spreading The Word?

SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance:

Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same?

Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort...

How Haley's Hawks Brought Carnage To Ukraine

The Ukraine war could have been brought to a close much earlier, at a much smaller cost in lives and treasure, but for Western hawkism.

Once considered a fringe notion, this is fast becoming the bitter conventional wisdom in Washington, London—and Kiev. David Arahamiya, the leader of President Volodymyr Zelensky’s party, told a Ukrainian outlet that Russia had offered to end hostilities in spring 2022, provided Ukraine stayed out of NATO and maintained neutrality.

Arahamiya should know. He headed the Ukrainian delegation to the two rounds of peace talks held that spring in Turkey. The Russians “really hoped almost to the last that they would put the squeeze on us to sign such an agreement so that we would take neutrality,” he recalled. “It was the biggest thing for them.” He added: “They were ready to end the war if we took—as Finland once did—neutrality and made commitments that we would not join NATO. This was the key point.”

Team Zelensky was, understandably, mistrustful of Moscow’s intentions. And the prospect of amending the Ukrainian constitution to remove the reference to the country’s NATO aspirations—enshrined there at George W. Bush’s behest—was no doubt daunting. Still, whatever hopes there were of a negotiated settlement were dashed on April 9, when Boris Johnson, then the British prime minister, visited Ukraine, urging war. BoJo, according to Arahamiya, told the Ukrainians that they “shouldn't sign anything with them at all—and let’s just fight.”

Yeah, let’s just fight.

The result: many more months of combat, thousands more dead, the destruction of Ukraine’s physical landscape and infrastructure, the country’s utter depopulation, and the high likelihood that the Zelensky government will have to settle for worse peace terms than those that were on the table in 2022. This is what the “responsible people” in the corridors of Western power have wrought.

As Jacobin writer Branko Marcetic notes in a recent essay, restrainers on the left and the right were branded Kremlin stooges and irresponsible fools for warning that this is where escalation would lead: “Restrainers indicated that while Kiev is certainly justified in defending itself and trying to reclaim territory seized by Russia, the potential costs to Ukraine of a prolonged war would be much worse than the costs of losing territory.” He adds:

Through it all, proponents of peace and restraint and many military experts stressed that an outright Ukrainian victory was highly unlikely, given the imbalance of military power between the two states and Russia’s stark advantages in a war of attrition. The country and its people, they warned, could very well wind up bearing all of these enormous costs, only to be forced into some kind of ceasefire or peace deal anyway, and on more unfavorable terms than they would have gotten earlier. The danger was always that, with the American public and politicians weary of funding escalation, Kiev would be forced to negotiate without the leverage of US military backing.

In fact, I'll go further and say that even just as a electoral-success consideration, the best position that could be taken by any candidate for the presidency (or for any legislative office) is flat-out, total opposition to any war-mongering on any pretext short of military attack on American soil. The polls, when any pollsters bring themselves to ask the question fairly (which is rare, indeed) show that a solid majority of Americans are thoroughly sick of the US mucking about in other country's backyards for any reason, whether it be in support of a "partner" or "ally" or "client" or because we don't like what some other country is doing, or whatever.

The candidates that vow to pull the plug on the US proxy war against Russia, the US participation in Israel's ethic cleansing of Palestinians, and the endless saber-rattling over Taiwan, and to bring home US soldiers from foreign trip-wire or intimidation bases around the world, are the ones who will get my vote, and many millions of others.

As shown by recent reactions to what is being done by Israel (with US aid), a gratifying number of Americans-- most notably, a substantial majority of those between 18 and 34-- have come to realize US foreign adventures are merely exercises in pouring treasure down rat holes, propping up vile regimes that can't stand on their own, and immorally making widows and orphans while generating hatred and blowback risk for the rest of us. These folks have come to realize that as practiced since the Korean "police action" US foreign policy has done nothing good, and great deal that is bad-- and more often than not has been a product and a source of corruption.

At the same time, every American knows we have plenty of problems that need money and attention here at home, including the restoration of American economic and productive competitiveness by the restoration of the liberty and the rule of law that raised us to the top of the heap in the past, and allowed the production of all that wealth which the denizens of the DC swamp have been spending on counter-productive and outright destructive foreign adventurism for lo, these past seven decades.

SO, VOTING FOR THE PEACEMAKERS and the humble US foreign policy falsely promised by Bush the Second is the order of the day. But that's not all that can and should be done to shrink and bind back down the Leviathan state being made use of by the swamp for its evil deeds.

The other thing is for each American to stand up and start saying "NO!" to the long-standing misadministration of the income tax by which that Leviathan state and all its evil deeds are financed. Happily, doing so is relatively easy, requiring nothing more than a little education and a little courage, all of which is explained here.

Read that material, and then become an agent of change. Urge everyone you know to do so, as well.

Seriously, people. It's time to stop whistling past the graveyard and to start curing the cancer, instead.
