Sometimes You've Just Got To Sue...

Doing so is a virtuous endeavor, but it can pit one against some decidedly NON-virtuous adversaries, including corrupt judges. Plus, a quick note on the border crisis.

A NUMBER OF GOOD CtC-EDUCATED FOLKS are currently engaged in suing over tardy refunds or the "frivolous return penalty" hoax (see lawsuit templates and background info for each here and here, respectively). These efforts are really important, and these warriors deserve accolades and encouragement from us all.

Such actions are often uphill battles. A virtuous American litigating (as plaintiff, petitioner or defendant) against a revenue-hungry and arrogant government is faced with not only an adverse lawyer representing the government but also an adverse-- or ignorant-- judge. Since, as has been well said, "It is hard to get a man to understand something when his salary depends on him not understanding it,"  these can be tough obstacles to overcome.

However, there is a tool that offers a lot of promise to the virtuous but outnumbered litigant-- the often overlooked Federal Rule of Evidence No. 201. Rule 201 empowers a litigant to require the court to notice (treat as established and indisputable, in its own deliberations and/or in instructing a jury), relevant facts, however inconvenient they may be to the government side.

Here is the text of the rule:

Rule 201. Judicial Notice of Adjudicative Facts

(a) Scope. This rule governs judicial notice of an adjudicative fact only, not a legislative fact*.

(b) Kinds of Facts That May Be Judicially Noticed. The court may judicially notice a fact that is not subject to reasonable dispute because it:

(1) is generally known within the trial court’s territorial jurisdiction; or

(2) can be accurately and readily determined from sources whose accuracy cannot reasonably be questioned.

(c) Taking Notice. The court:

(1) may take judicial notice on its own; or

(2) must take judicial notice if a party requests it and the court is supplied with the necessary information.

(d) Timing. The court may take judicial notice at any stage of the proceeding.

(e) Opportunity to Be Heard. On timely request, a party is entitled to be heard on the propriety of taking judicial notice and the nature of the fact to be noticed. If the court takes judicial notice before notifying a party, the party, on request, is still entitled to be heard.

(f) Instructing the Jury. In a civil case, the court must instruct the jury to accept the noticed fact as conclusive. In a criminal case, the court must instruct the jury that it may or may not accept the noticed fact as conclusive.

I'm not a lawyer, and I won't presume to explain the best way to deploy Rule 201. A little research or a quick consultation with a clerk of the court, paralegal or attorney is recommended. Still, it is a simple rule, and largely self-explanatory-- anyone up to writing a competent motion should be able to manage without help, I suspect...

I will presume to suggest a few facts likely relevant to most, if not all, tax-related trials (or other adjudicative proceedings, however labeled) involving the CtC-educated. These facts will not necessarily be known to the judge or a jury beforehand, and in any case, the government attorney-- if not the judge, as well-- would likely prefer that they remain out of sight and out of mind.

The income tax is an excise tax, and excise taxes are privilege taxes. (Attach this document, for example, as the "necessary information".)

Merely earning money without doing so by the conduct of an income-tax excisable activity is not an income taxable event under US income tax law.

A tax on common, unprivileged economic activities-- or the gains they produce-- is a capitation, as that term is used in the US Constitution, and capitations can only be laid under the provisions of the apportionment rules. (Attach this document, for example, as the "necessary information".)

The Sixteenth Amendment did NOT create a hybrid or apportionment-excepted, non-apportioned direct tax. (Attach this document, for example as the "necessary information.)

Information Returns (IRs) such as W-2s* can be wrong both as to amounts paid (or withheld) and as to their characterization of payments as being of the tax-relevant "wages" defined in tax law (or as being relevant to the tax in any other way, or under any label). (This one is self-evident, of course, but believe me, it needs to be stated and noticed, in these cases.)

*Cases involving 1099s or other non-W-2 IRs would need a notice of similar nature, but customized to that purpose.

The utility of making these points (as well as perhaps others based in CtC scholarship that might be additionally relevant in certain cases) part of the established evidence in the record need hardly be explained. After all, this evidence can then be cited both at the trial level (in closing arguments or motions to dismiss), as well as on appeal as grounds for reversal in the event of a stubbornly adverse trial outcome.

BTW, I REALIZE that at first glance, some of the facts in my sample list above may seem superficially to fall into what is taken as the "legislative fact" category, or otherwise seem to be intruding on a judge's role as the one who "says what the law is". But really, no (and it may be necessary to explain this in a "notice" motion or hearing).

Most of the facts in my list consist of nothing more than Supreme Court-specified-or-endorsed definitions of words/terms ("excise", "capitation" and "income") which appear in the laws upon which the judge will rely in doing his or her job. And these are words or terms the real, contextual meaning of which will often be completely unknown to the judge and/or government counsel (and almost certainly to any jury, in a contest so equipped).

The facts in my sample list which are not just definitions, such as that "merely earning money is not a privileged activity, and hence not taxable by an excise" and that "IRs can be wrong in each of two ways" are plain and simple common-sense observations. They should be known or obvious to anyone (as in, "The sun rises in the East" example sometimes used to explain the "generally known" part of Rule 201).

Unfortunately such facts are often not known or obvious, due to a generations-long effort by governments and their taxing agencies to sow confusion in Americans' minds (and because knowing them or finding them obvious requires knowing the accurate definition of certain words or terms, like "excise", "capitation" and "income"...). But illuminating them is also not an intrusion on a judge's legitimate authority to say what is the "law of the case".

IN THE END, the object of judicially noticing a judge is to ensure that important information otherwise likely to be omitted from consideration is given its due attention and weight. The same information can and should be presented in briefs, of course, which are another means by which a judge is instructed with relevant knowledge.

But judicial notice is more likely, it seems to me, to actually be read by the judge, and taken seriously.

In any event adding judicial notice to one's quiver is potentially very helpful "belt and suspenders" fortification, if you'll forgive my mixed metaphors. I recommend it to everyone's attention.

ONE QUICK NOTE on the "Border Crisis" now threatening to morph into a various serious destabilization as Texas (and other states) begin to take the illegal immigrant invasion seriously and to do what's necessary in the face of federal malfeasance:

The Biden administration is taking a lesson from the long-running Israeli tactic of defying inconvenient law (UN resolutions and international conventions on behavior in occupied territory) in regard to settler expansion in the West Bank over the last several decades. That lesson is that if you change the facts on the ground for as long as you can get away with it, you might succeed in changing the politics on the subject when push finally comes to shove.

Biden has been being allowed to pump huge numbers of illegals into and throughout America, with each one becoming an increasingly intractable problem to undo if and when the political will is mustered to consider that undoing. Eventually there is a threshold number beyond which any hope of remedy (i.e., mass deportation) becomes untenable.

THIS INVASION should have been stopped January 22nd, 2021. It desperately needs to be stopped now.

Kudos to Greg Abbott for finally (if belatedly) getting in gear on this (and to the now many states showing support for Abbott's initiative).

However, why are you continuing to needlessly finance the border patrol and other resources Biden and company are deploying against Abbott's actions? Why?!

Why are you not challenging everyone you know with this question?!

Not Letting This "Crisis" Go To Waste...

...an important action item opportunity.

FRIENDS, THE SPORADIC EASINGS of the despotic measures to which most of the country has been subjected under since the onset of the COVID-19 hobgoblin narrative should not be allowed to bleed off the head of steam you probably had been developing. The offenses happened, and they're far from over. Stay hot.

And while you are all warmed up, and while others, if they're smart, are just as hot, I'd like you to send an email (and Facebook post, or whatever) with the following content to everyone you can (with a request that they pass it along, in turn):

[Name], since March of 2020 you've watched as over-fed state power has been used to literally destroy classical Western civilization and impose a new despotic paradigm. No dissent or debate permitted-- no permission or agreement sought.

YOU KNOW where this will end up if the arrogant state power being used to make this happen isn't radically diminished in size, influence, resources and popular support, and exposed as an opportunistic exploiter of legal ignorance (an ignorance which it has been nurturing in the average mind for decades).

Those things having not yet happened, you should be quaking in your boots-- and you probably are.

Are You Having Trouble Spreading The Word?

SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE EXPECTED when you're trying to explain to someone that everything they've been encouraged their whole lives to believe about something as entrenched and significant as the income tax is basically nonsense. So here's a way to help cut through the resistance:

Ask your listener how he or she would react if you were to show an announcement from the Commissioner of Internal Revenue admitting that the tax doesn't apply to the earnings of most Americans and is misapplied most of the time because people don't understand how it works? Or how about if you showed a ruling from the Supreme Court saying the same?

Now you just have to explain that you're going to show exactly those things-- but because the state really doesn't want people to know this, these things haven't been said quite as forthrightly as we would all wish. It's going to take a bit more work to take these admissions in than is sufficient for just reading a press release. But it'll be worth the effort...

Tell me: is there a fairer grandmotherly face than this in all of Western Civ? Does it not seem to radiate eons of aggregate wisdom, maternal kindness, bountiful nurture, caring, and healing, and even a hint of fun in the nursery. . . the rectified essence of Teutonic beauty, fertility, vitality, and virtue. . . the loving smile of the life-giver caressing humanity like a spring zephyr wafting through the piney Schwarzwald on a June morning?

That is exactly why Ursula von der Leyen was (s)elected President of the European Commission, and why she was sent out to front the World Economic Forum (WEF) this week in her keynote speech to the assembled global grandees of Davos in the dead chill of January. It’s one thing when a cadaverous goblin such as Yuval Noah Harari tells you to eat bugs, and quite another thing when Oma Ursula tells you Keine Sorge, Kinder. Alles ist gut.

Ursula did offer us children-of-the-world one wee note of caution, though, as every good “grammy” might give to the global kindergarten: watch out for misinformation and disinformation on the internet! Like the evil imps of the Germanic Märchen, these wicked forces lurk and propagate on the internet — waiting to dash all of the WEF’s benevolent plans for our utopian future. That’s why, she explained, the European Commission has drawn up the Digital Services Act — because misinfo and disinfo can fluoresce into hate speech, the most dangerous thing in the world. It must be stomped out! Ground into the dirt under a boot heel!

Misinfo and disinfo about what, exactly? Ursula omitted to specify, but we can guess, can’t we? For instance, about how more and more every year the WEF seems to operate like a global racketeering operation, seeking the levers of control in all the naughtiest sovereign nations of the earth overpopulated with “useless eaters” who are remorselessly busy wrecking the climate to enjoy, say, in the case of the USA, their loathsome motor-sports, mega-churches, gun shows, hot-tubs, and Golden Corral All-You-Can-Eat buffets! The WEF, a racket? A cabal of haughty control freaks? What a hateful thing to say, after everything kindly onkel Schwabenklaus has done for mankind! It hurts our feelings to hear this!

Yet, why do scores of billionaires flock to the yearly Davos meet-up and coordinate their funding streams into countless NGOs and shadowy activist organizations aimed at manipulating the activities of governments around the world? I assure you it’s hardly for the fabulous hors d’oeuvre platters or the even more fabulous on-call hookers. (The nabobs of finance must be satisfied with the services of their personal chefs and masseuses.) Ursula says the WEF notables meet annually “because our democracies and our businesses have interests that align: creating prosperity, wealth and security for people, creating a stable environment to unlock innovation and investment, and creating equal opportunity and freedom.”

I have some disappointing news for you: grandmother Ursula is lying (alas, we live in time of epic disappointments). If the WEF wanted “stability” you would not see Alex (and papa George) Soros pouring money into every county DA election from Maine to California to make sure that looting, car-jacking, and mayhem go unpunished. . . or that men of military age from every failed state on the planet get flown across the oceans to NGO-supported waystations in Central America so that the cartels of Mexico can take over the final leg of their illegal entry into the USA. . . or ditto the boats ferrying Africans and Arabs across the Mediterranean to overwhelm the societies of Europe — including especially Grammy Ursula’s Germany.

The last thing the WEF she fronts for cares about is this airy-fairy freedom thing. Ditto equal opportunity. They want all the goodies for themselves and they want the rest of us to quit cluttering up their world. And they mean to get you out of here, for-real. The Covid-19 operation, so advantageous to their Great Reset plan, has resulted in billions of people subjected to very sketchy “vaccines.” The record indicates a shocking, abnormal, sustained rise, since 2021, when the “vaccines” were introduced, of all-causes deaths. That was just the overture of the Next Big Thing.

This week, the WEF and its subaltern org, the WHO, amped up warnings about the coming “Disease X.” This, they say, will be much worse than the namby-pamby Covid-19, which mostly led to people’s deaths by iatrogenic medical maltreatment with respirators, remdesivir, and opiates — and the relentless suppression of actual effective treatments. (All talk of ivermectin and hydroxychloroquine on the Internet was deemed “disinfo.”)

The solution.

I HOPE EVERYONE FOLLOWED the link above and finished Kunstler's article. It is in that last paragraph that the real money line will be found-- a very wise speculation that I suspect can be taken to the bank.

The overall message of this article is less unique, but just as important. The people of the Davos forum and Disease X ARE THE ENEMY.

They are not just self-indulgent, vice-ridden sybarites. They are ambitious sociopaths twisted by far too much wealth for people of such meager character. They are using that wealth to destabilize Western Civilization in order to overthrow its rule of law and the equal individual rights, protection and power which that rule is designed to secure-- even for those they view as useless eaters, so that it can be replaced by an alternative more to their liking.

It will be (or should be) noted that among that Davos/WEF crowd are not just the billionaire oligarchs themselves, but also the political operatives-- heads of state, presstitutes and others of that sort-- by the manipulation, cooption and corruption of whom these 1%ers are enacting their agenda. These lesser folk are necessary because for all the wealth and privilege of the oligarchs, they depend on puppet governments to make it all happen, and to keep the increasingly awakened rabble from showing up at their palaces and playgrounds armed with pitchforks, torches and rope.

A chief mechanism by which the control of co-opted and corrupted politicians and officials is successfully used against the People on behalf of the sociopaths is through the growth of the Leviathan state, which relentlessly erodes individual liberty. While most of us may not be able to do much about the Davos crowd's overall plans and program in many respects, we CAN and must each do our part to deny it a massive state apparatus to use against us. This is actually easy, using the tools provided for that purpose by the Founders and the Framers.

The simplest and most peaceable of those tools is the power provided to each individual American to restrict, within the law, the resources he or she provides to the co-opted state with which it would otherwise carry out its crimes. This requires nothing more than a little education and a little courage, as is explained here.

Read that material, and then become an agent of change. Urge everyone you know to do so, as well.

Seriously, people. It's time to stop whistling past the graveyard.
