A Prescription Against
Today's Dangerous "DEI" Infection
...and brief commentaries on a number
of other current topics, including events in the
Middle East, the government's duty to protect speech
rights even from "private" infringement, Section 3
of the 14th Amendment, and more.
SOME PEOPLE ARE particularly
disciplined, hard-working, studious, ethical,
prudent, quick of reflex, sober, composed
under pressure, equipped with well-trained memories
and competent-to-high-function IQs, and so forth.
Some people are less notably so, or even lacking
entirely in one or more of these respects.
It need hardly be asked which type any
given person would prefer in the cockpit of the aircraft in which
they were flying at 35,000 feet and 500 mph,
handling the scalpel during their surgeries, or
adjudicating their legal claims (or defenses).
Everyone would choose the former; no one would
choose the latter.
At one time, and up until not really
that long ago, American society was structured to
serve that preference of literally every citizen and
ensure that it was the demonstrated possession of
virtues such as those listed above, insofar as they
related to the responsibility involved, that
determined who ended up flying the plane, performing
the surgery, and adjudicating the disputes,
fine-tuned, in many cases, to the specific role
involved. Not any more, or at least, not as much
anymore, and less and less so every day.
Now, a leading element in the
determination of who is tasked with what
responsibility is race, gender or ethnicity (and
even sexual orientation, and soon, perhaps, degree
of obesity?).
Why? The affirmative action hiring or
advancement plague known as "Diversity, Equity and
Inclusion" (DEI).
THE IDEA BEHIND DEI is a confused
hodge-podge of assertions, such as that the
distinctions between types of people drawn above do
not exist (or are insignificant or irrelevant) and
any person can handle any responsibility with equal
success; that somehow mere membership in (or
representation of) particular ethnic or racial or
cultural groups is (or brings) a virtue to the
performance of a given responsibility in-and-of
itself (or offsets deficits in that regard); and
that a lack of representation of some particular
ethnic, racial or cultural group in any given
workforce or profession is solely an expression of
bigotry, rather than the practical outcome of blind
competence-based selection (usually put as
"merit-based", in an unfortunate wording lacking in
helpful nuance and prone to misapprehension).
It goes without saying that all of
these notions on behalf of DEI are nonsense on
stilts. Of course the distinctions exist-- not due
to race or ethnicity, certainly, but among and
within all groups. By that same token, mere
membership in any given group offers no special
benefit or virtue in the performance of (or ability
to perform) a given responsibility.
The lack (or weakness) of
representation of any particular group in any
particular area could be attributed to
bigotry, theoretically, since threshold
qualifications can be assumed to appear in any and
all groups. But since a rejection of qualified
candidates for positions based on bigotry would put
the rejector at a competitive disadvantage, such
bigotry would not survive the rigors of the
marketplace for very long. Thus, the much more
credible explanation is that just as attributes
vary, so, too, do interests, inclinations and
cultural expectations, some or all of which might
steer those of certain groups toward particular
vocations.
IT ALSO GOES WITHOUT SAYING that a DEI
hiring or advancement policy produces results at the
expense of traditional competence considerations.
The DEI policy is to deliberately add or advance
candidates because they meet desired racial, ethnic
or gender (etc.) goals. When one has decided that
the staff must include more black women, for
example, one might end up picking the most qualified
black women applying, but will look at no white
women (or black or white men), thereby artificially
narrowing-- and limiting the potential competence
within-- the applicant pool.
It may be that in such a case one might
still end up with the best possible candidates, but
there is no way to have or instill confidence in
that proposition (which is manifestly unlikely). The
recent Claudine Gay implosion demonstrated the
reality of this.
Gay was chosen (it seems clear)
because she was a black woman with which the Harvard
board wanted to virtue-signal. Considerations
such as the legitimacy of her academic and overall
professional credentials were given little or no
weight (and certainly no careful vetting).
The
selection of Kamala Harris offers another example.
Joe Biden's team wanted a black woman as his running
mate, and thus, candidates of other characteristics,
some of whom were certainly much more qualified for
this position of significant responsibility (as
would be admitted by anyone who has seen Harris in
action) weren't even considered.
More broadly, physical performance
standards have been dramatically lowered in
industries in which gender diversity is sought
(think the military, firefighters, police, and so
forth), and the construction of DEI Potemkin
villages in education has led to academic standards
dropping like rocks far beyond just the Ivy league--
indeed, to the point that grades have been
eliminated in many school systems, and segregated
classrooms have reappeared. The list of areas in
which this erosion of quality is taking place goes
on and on.
All told, DEI policies, which have been
being indulged under that label since the Obama
administration, at least, and for some time before
that more informally (or under the old label of
"affirmative action"), are diminishing the quality
of life for Americans on a broad scale, including
outright endangerment. (Matt Walsh does a nice job explaining one such
area of endangerment in a recent episode
that can be seen here).
Even where the dangers and other
downsides of this misbegotten policy are less
susceptible to articulation, we are all subject to
the disquieting sense that many people with whom we
deal in various capacities, or by whose judgment or
competence we are affected, are in their positions
not by being the best available for the
responsibilities, but like Gay or Harris, merely
because they checked some DEI boxes while NOT being
the best for the job, or perhaps not qualified at
all.
This latter downside might be worst for
those in the groups DEI singles out for special
treatment. Such group members, even if NOT picked on
a DEI basis, will never be confident that they were
chosen due to their own legitimate merits. Further,
they will understand that whatever the truth of
their competence or reason for selection, they will
always be suspect in the eyes of everyone else.
SO, DEI is a plague, universally
harmful in one way or another, and ultimately
threatening the structure of our civilization
itself, in that at bottom DEI is an attempt to sever
the relationship between individual effort,
discipline, sobriety and deferred gratification on
the one hand, and reward and responsibility on the
other. Though each instance of its application seems
modest in its ill-effects and generous in its
sentiments, as a whole DEI threatens our western
culture and tradition with a death of a thousand
cuts.
Happily, there is a
prescription by which this infection can be treated...
As with so many other maladies
afflicting America, DEI is in very large part the
product of the Leviathan state. The feds (and state
governments) dole out a huge amount of money into
the private sector, broadly influencing behavior in
that sector, and he who pays the piper calls the
tune. DEI is very much one of the state's favorite
songs

its deployment by way of grant and contract
specifications, and how it influences private actors
and other influencers.
The treatment for this malady, then, in
large part, is to deny government the money with
which it makes these behavior-dependent grants and
contracts, and shut down its ability to influence
(read: control) private behavior in service to
ideological fads or crass political agenda.
The means of administering this
treatment is, of course, spreading
the truth about the income tax, by which more
and more Americans will become equipped to stop
financing-- that is, to stop supporting and
nourishing-- the infected state.
You can spread the truth, each of you,
all by yourself-- just as you can, yourself, without
approval or permission or help from anyone, end your
own financing of the state's harmful behaviors.
Please do both, and encourage everyone
you know to do both, as well.
P.S. IT IS MY HOPE that enterprising
and public-minded law firms will soon develop
arguments for tort liability on the part of any
organization whose products, services or actions
impact the health safety and well-being of others
which fails to ensure the most rigorous
competence-based selection and employment standards.
Should, for instance, an airline indulging in DEI
practices in pilot selection/deployment experience a tragic
outcome, that airline should be held fully liable
for the reckless endangerment of those harmed, at
the very least.
The prior construction of legal tools
toward that end might give pause to those tempted
toward such practices, pre-empting the tragedies to
the benefit of us all.
A Few Additional Observations
In Brief
EVERYONE SHOULD STOP USING THE
EXPRESSION "October 7 attack by Hamas" in discourse
on the matter of the war going on in Palestine. The
more accurate and more propaganda-free formulation
would be: "October 7 retaliatory strike by Hamas".
IT IS INTERESTING, in light of the way
Israel is now bad-mouthing South Africa in every way
possible, that back when it was an apartheid state
under the Afrikaner Nationalist Party, Israel was
South Africa's good friend-- even sharing its stolen
nuclear-weapons technology with the Boer government
(as discussed and documented in
this
article)...

IT'S VERY TIRESOME to hear the "Iran-backed" nonsense
from talking heads in government and media pretending
that attacks by Syrians and Iraqis on Americans
stationed in each of those countries, and by Houthis
on shipping in the Red Sea, respectively,
are Iranian proxy attacks. Why on earth
would attacks on American invasion and occupation
forces in Syria and Iraq-- in both cases strongly
opposed and despised by the people of each country--
or by Houthis on Western-benefiting Red Sea shipping,
need to be inspired or directed by Iran? Syrians and
Iraqis and Houthis-- millions of whom, in the
aggregate, have been killed or displaced by the US
or its allies over the last twenty years or so-- have plenty of reasons of their own to want
to attack these American troops or assets, and kill them or
drive them out or make the West think twice about its support
of Israeli crimes against Palestinians.
Plainly the "Iran-backed" phrase is
just a propagandistic tool used in an effort to
build support for an eventual attack on Iran (or to
support the pretense that a just or sincere cause
exists for such an attack, when it commences). The
phrase should be rebutted and denounced by everyone
every time it is deployed.

THE ARGUMENT CAN BE MADE that not only
are American governments prohibited from abridging
or otherwise violating anyone's rights, but they are
also charged with the duty to ensure that no one's
rights (at least their expressly-recognized rights)
are abridged or otherwise violated by anyone else.
Remember, it is "to secure these Rights [that]
Governments are instituted among Men", and that to
"secure the Blessings of Liberty to ourselves and
our Posterity" that We, the People "do ordain and
establish ... the United States of America".
I think that at a minimum, in light of
these fundamental principles and mandates and the
specifics of the First Amendment to the US
Constitution (and all corresponding provisions of
state Constitutions), there can be no government
sanctioned structure under which social media
platforms can "moderate" (read: censor) speech
while
indemnified from liability (under Section 230 of the
Communications Decency Act). More properly,
government should be held to the duty of actively
punishing any such censorship. (See more about this
in the article
here.)

THE EXPRESS SPECIFICATION in Sec. 3 of
the 14th Amendment of some elected (as opposed to
appointed) offices (Senators and Representatives) as
subject to its "insurrection" disability provision
invokes an ancient and well-settled legal doctrine
by which others not specified are excluded from the
provision-- that is, relevantly, the presidency:
"Inclusio unius est exclusio
alterius. The inclusion of one is the exclusion of
another. The certain designation of one person is an
absolute exclusion of all others. ... This doctrine
decrees that where law expressly describes [a]
particular situation to which it shall apply, an
irrefutable inference must be drawn that what is
omitted or excluded was intended to be omitted or
excluded."
The inclusion of electors of presidents and vice
presidents in the expressly-specified list of
affected parties-- but not presidents or vice presidents
themselves-- underscored the deliberateness of this
exclusion.
It is not for me to say why
this exclusion was intended, though perhaps it
concerns the fact that a relatively small pocket of
rebellion could by itself throw sand in the gears of
the state by electing members of congress, and even
individuals could accomplish this on their own by
finagling appointments to office, while the
presidency requires the endorsement of the majority
(or at least a plurality) of the nation as a whole
to be placed into a position of trust and honor. It
is reasonable to imagine that those enacting the
14th Amendment may have reasoned that the will of
the majority (or a plurality) of the entire nation
should not be thwarted.
Regardless, absent some scholarship
investigating and finding clarification in the
amendment's ratification debates, the words of the
amendment itself must be taken as definitive, and in
those words, presidents are excluded from the
disability provision.
Further, of course, the
characterization of the events of January 6, 2021 as
an "insurrection" is ludicrous, even without
consideration of the considerable and growing
evidence that what Trump-supporter violence occurred that
day was reactive and instigated by both Capitol police officers
and state agents-provocateur infiltrated
throughout the crowd, with the latter perhaps having
actually committed most of what appeared to be
protestor violence (such as the breaking of windows
and such). Let's remember, the Trump folks were
there merely to support and encourage members of
Congress who intended to present evidence of
election-rigging and other improprieties in the 2020
election-- of which there is a great deal: see
here,
here
and
here, for instance-- to the body as a whole
prior to any certification of outcomes. The fact is
that the Trump supporters were gathered at the
Capitol that day to thwart an actual
insurrection-in-progress being carried out by
corrupt elements of the Democrat party, the MSM and
the Deep State.
Orchestration of the Capitol gathering
into a riot appears to have been a planned step in
that election-rigging insurrection, providing a
means by which future dissent from the "Democrat
victory" narrative could be demonized and
marginalized.
Further still, serious questions must
be entertained on the matter of the overall
legitimacy of the 14th Amendment. After all,
11 states-- well over a quarter of the total at the
time-- were only said to have ratified it after their disinclined
actual governments were replaced at
bayonet-point with Northern-selected puppets or
outright foreign carpet-baggers, making those
ratifications-- and the declared adoption of the
amendment overall-- a sham and plainly illegitimate
(and three Northern states rescinded ratification
shortly after first voting to ratify, making the
total number of rejecting states high enough to
prevent legitimate ratification even today).
Every regular reader of this page knows
that I am no fan of Donald Trump. But preventing him
from appearing on any ballot on the pretext of
Section 3 of the 14th Amendment would be criminal.

ANYONE TEMPTED TO TOLERANCE of
widespread obesity might take note of the emergence
of "Diabetic" sections in the health-product aisles
at drugstores and general stores. The fact is,
obesity is a hugely-harmful epidemic raging through
the Western world-- albeit one arising from
voluntary, reversible behavior by its victims, and
hence,
in no way a "public health" issue, even within
the abusively-stretched modern application of that
vague, power-serving expression.
I think the "body-positivity" madness
is fading a bit of late, but every upright American
should be as purposefully and un-self-consciously
intolerant of obesity as any given circumstances
allow, out of sympathy for those ensnared by the
lifestyle choices and denial by which they bring this
scourge upon themselves. Obesity should be viewed in
much the same way as is debilitating drug abuse--
with monolithic societal disapproval and vigorous
encouragement toward self-discipline.

Not Letting This "Crisis" Go To Waste...
...an important action item opportunity.
FRIENDS, THE SPORADIC EASINGS of the despotic measures to
which most of the country has been subjected under
since the onset of the
COVID-19 hobgoblin narrative should not be
allowed to bleed off the head of steam you probably had been developing.
The offenses happened, and they're far from over. Stay hot.
And while you are all warmed up, and while others, if
they're smart, are just as hot, I'd like you to send an email (and
Facebook post, or whatever) with the following content to everyone you
can (with a request that they pass it along, in turn):
[Name], since March of 2020 you've
watched as over-fed state power has been used to literally destroy
classical Western civilization and impose a new despotic paradigm. No
dissent or debate permitted-- no permission or agreement sought.
YOU KNOW where this will end up if the arrogant
state power being used to make this happen isn't radically diminished in
size, influence, resources and popular support, and exposed as an
opportunistic exploiter of legal ignorance (an ignorance which it has
been nurturing in the average mind for decades).
Those things having not yet happened, you
should be quaking in your boots-- and you probably are.
Isn't it time-- and past time-- for you to
begin helping to make those desperately-needed defensive changes take
place? There is only one way these things can happen short of a
who-knows-what we'll-end-up-with explosion of violence. I'm going to
show it to you.
When you're done with that reading, you'll know
what to do next.
BTW, REMEMBER, ALSO, THAT EVERY AMERICAN has lately been given a stark lesson in the fact
that government officials at all levels will lie to you and violate the
law without batting an eye. They will do so any time it serves their agenda, and
you don't call them out for it.
If you know anyone who has been persisting in denial on the
truth about the income tax, you know such nonsense is usually be
grounded in some version or another of, "That can't be true..." or "They
would never do something like that...". Now's the time to put a pin in
that delusional bubble.

certainly WOULD do something
like that.

outreach efforts.

FOR ALL THE YEARS SINCE 2003 when
CtC was first published, the government has engaged in a
concerted effort to frighten people away from its truths. This
effort involves official government websites and press releases
touting an occasional court ruling that appears to be at odds
with some
CtC-revelation (but without details sufficient to expose the
real substance of the ruling)--
and sometimes even more mendacious behavior.
Are the presentations and
resources offered on this site and in my other work of any value to you?
Tim Kendrick has posted
a video
on YouTube regarding donations. I didn't know what to do about
it to begin with; I don't do what I do intending for anyone to
feel obligated in any way.
But of course, no one IS obligated. I will continue
to make my work freely-available here, and in my books for only
the cost of a cheap paperback.
Thus, even though I post it here below, Tim's very
thoughtful personal resolution and encouragement to others is
just an invitation for consideration by those who may not be
conscious of the fact that I can't do what I do without support.

act let it be solely because it seems right.
All-in-all, just be the sort of person for others
that you would go to yourself for trustworthy leadership.

Are You Having Trouble Spreading The
Word?
SKEPTICISM (SOMETIMES INVOKED BY FEAR) IS TO BE
EXPECTED when you're trying to explain to someone that
everything they've been encouraged their whole lives to
believe about something as entrenched and significant as the
income tax is basically nonsense. So here's a way to help
cut through the resistance:
Ask your listener how he or she would react if
you were to show an announcement from the Commissioner of
Internal Revenue admitting that the tax doesn't apply to the
earnings of most Americans and is misapplied most of the
time because people don't understand how it works? Or how
about if you showed a ruling from the Supreme Court saying
the same?
Now you just have to explain that
you're going to show exactly those things-- but because
the state really doesn't want people to know this, these
things haven't been said quite as forthrightly as we would
all wish. It's going to take a bit more work to take these
admissions in than is sufficient for just reading a press
release. But it'll be worth the effort...
IF YOU'RE NOT SPREADING THIS LINK with every bit of
energy you can, to school libraries, homeschool
families and community groups, your neighbors, your
family members, your pastors and
co-congregationalists, journalists, lawyers, CPAs,
members of congress, tax-agency workers, Wikipedia,
Anonymous, WikiLeaks, the Tax Foundation, everyone
in the "tax honesty" movement, the 9/11 truth
movement, other activist movements and everyone
else,
you have only yourself to blame for your
troubles with the tax, and a whole lot else of which
you might complain. It's on you.

explaining what will be seen at the link-- cryptic
is bad; excited is good-- and then send this WMI
(weapon of mass instruction) far and wide.

Yemen Strikes: Biden Knows
Only Congress Can Declare War
It’s time for Biden to take his own
advice. The president has not been authorized to
escalate our Middle East entanglements.

Yesterday, the U.S. Navy
conducted massive strikes on Iranian-backed Houthi
rebels in retaliation for attacks made on shipping
lanes. While defending sea and trade routes are
indeed an American interest, President Biden’s
bombing of Yemen carries severe risk of escalation
spiral and another devastating forever war in the
Middle East.
Before I’m labeled as a
pacifist or appeaser, let me clarify. The U.S. Navy
was primarily created to defend seaborne trade
routes against pirates and rival powers. But Biden’s
choice to launch air strikes is a declaration of war
without congressional approval. Since the time of
the Washington Administration, the Constitution has
been clear: Only Congress has the power to declare
war. President Biden must come to us to authorize
these strikes—as he must do for ALL acts of war.
President Washington knew this when he
wrote to William Moultrie that “[t]he
Constitution vests the power of declaring War with
Congress, therefore no offensive expedition of
importance can be undertaken until after they shall
have deliberated upon the subject, and authorised
such a measure.”
In short, Congress remains
supreme for war powers. President Biden must come
before Congress and ask us to authorize these
strikes and specify an end game, time, and scope of
operations. He must detail the risks of escalation
and provide an alternative plan, if things worsen.
Consider the facts. America
carries a disproportionate burden of securing sea
routes, and the rest of the world reaps the
benefits. This arrangement is unsustainable and
unfair. Yes, the Houthi attacks raised the price of
shipping for all countries, but mainly for China,
India, and Europe. Other countries need to equally
share the cost of securing these trade routes. It’s
absurd that Washington elites have forced it upon
the American people to police the world’s waterways.
The Biden administration
has failed to explain why the U.S. is on the hook
for spending American taxpayer dollars to guard sea
routes far away from our shores instead of
prioritizing and protecting American shipping
companies and trade, as President Thomas Jefferson
ordered. Especially at a time when we have an
ongoing invasion at our southern border and face $34
trillion dollars in debt. Other countries need to
chip in for their security.
Second, the Biden
administration is radio silent on this war’s
endgame. The White House is officially arguing that
we are “restoring deterrence,” while also warning
that this might lead to further Houthi attacks! That
is contradictory. What is the point of deterrence if
it incites further attacks?
The Constitution gives
Congress various options to empower the executive
branch, including authorizing letters of marque,
punitive raids, and war. But Congress remains the
sole authority to grant those to the President. As
long as there is no immediate threat to the country,
the President does not have the power to use the
military as a private army or to deploy it to
wherever he wants—whether he wants to gain support
during campaign season or use “diversionary wars” to
hide from his own corruption. The Houthi attacks are
not existential or urgent enough to bypass Congress.
FAIRLY WELL SAID by Luna-- I just wish she had left out the
irrelevant stuff about who's paying for what. Unconstitutional is
unconstitutional, regardless of any and all other possible
considerations. And personally, I'm sick of all such oath of office
violations.
Indeed, I view blatant unconstitutional
acts by officeholders as the equivalent of treason,
since they certainly must be seen as giving "aid and
comfort" to the enemies of the United States...
Regardless, unconstitutional acts
should be curtailed, and sadly, such a
responsibility cannot be confidently left to
Congress or the courts, both of whom have proven
endlessly unreliable. Rather, resort must be made to
the real sovereigns in America-- the people-- using
the tools provided thereto by the Founders and the
Framers.
The simplest and most peaceable of
those tools is the power provided to each individual
American to restrict, within the law, the resources
he or she provides to the errant state with which it
would otherwise carry out its crimes. Happily, doing so is
relatively easy, requiring nothing more than a
little education and a little courage, all of which
is explained
here.
Read that material, and then become an
agent of change. Urge everyone you know to do so, as
well.
Seriously, people. It's time to stop
whistling past the graveyard and to start curing the
cancer, instead.

Hendrickson is also a widely-read essayist on

restoration of the rule of law in America, Hendrickson directed
purchasing activities for the $84 million-a-year
multi-family-housing division of the Farmington Hills, Michigan
branch of Edward Rose and Sons, with responsibility for 18,000+
apartments, direct supervision of 35 technicians and agents, and
incidental authority over several hundred divisional workers.
He also ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On rather the other end of the spectrum, amidst
these more mundane pursuits Hendrickson co-founded and was the
primary creative force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan,
with his wife and two children. He is currently working on his
next book.
